Das Phänomen des Todes fordert wie kein anderes das philosophische Thaumazein heraus, das Sich-Wundern und das Stellen grundlegender Fragen. Deshalb ist er ein stets wiederkehrendes Thema der Philosophie. Es ist zugleich eines der Themen, dessen philosophische Behandlung im Zeitverlauf die radikalsten Wandlungen erfahren hat. Während viele der Aussagen über den Tod, die wir etwa in der Philosophie des Hellenismus finden, heute noch ebenso gültig sind wie vor mehr als 2000 Jahren, haben sich andere überlebt oder sind Gegenstand von Kontroversen geworden. Ursächlich dafür sind sowohl der medizinische und technische Fortschritt, der es erlaubt hat, den Tod weit über seine jahrtausendealten Grenzen hinaus zeitlich zu verschieben, als auch die zunehmend naturalistischen Sichtweisen von Leben und Tod. Der Band diskutiert primär aktuelle Fragen im Umkreis des Todes, wobei anthropologische, metaphysische und ethische Fragen gleichberechtigt angesprochen werden, u. a. Besonders in jüngster Zeit findet es Interesse bei älteren Menschen, die dem Tode nahe sind und über Zeitpunkt und Umstände ihres Todes ein gewisses Maß an Gestaltungsspielraum behalten wollen. Unter den Befürwortern dieses Verfahrens ist allerdings u. a. strittig, wieweit Sterbefasten als eine „passive“ Form von Suizid gelten kann. Auf dem Hintergrund der WHO-Definition des Suizids verteidigt der Beitrag eine affirmative Antwort und (...) diskutiert, wieweit sich daraus Konsequenzen für die ethische Beurteilung des Sterbefastens ergeben. „Negative Kausalität“ bezeichnet ein hochkontroverses metaphysisches Problem. Können negative Entitäten wie Abwesenheiten oder das Nicht-Eintreten bestimmter Ereignisse Ursachen oder Ursachenfaktoren sein? Diese Frage steht im Schnittpunkt einer Reihe disziplinübergreifender Grundfragen: der Frage nach dem Wesen von Kausalität, der Frage nach der Natur von Handlungen und Ereignissen und der Frage nach der Beziehung zwischen Kausalität und normativer - moralischer und rechtlicher - Verantwortlichkeit. Die vorliegende Studie entwickelt im ersten Schritt eine Konzeption von negativer Kausalität ausgehend vom Sonderfall der handlungsförmigen negativen Kausalität, (...) der Kausalität durch Unterlassen. In einem zweiten Schritt erkundet sie anhand des Ariadnefadens der Kausalität von Unterlassungen die terra incognita der Kausalität andersartiger „negativer Ereignisse“ wie Abwesenheiten und Nicht-Ereignissen. ZusammenfassungPatientenverfügungen für spätere Zustände schwerer kognitiver Beeinträchtigungen, wie sie für Spätphasen der Demenz typisch sind, stoßen auf weitergehende Vorbehalte als Patientenverfügungen für anderweitige Zustände eingeschränkter Einwilligungsfähigkeit. Einer der Gründe dafür scheinen die ethischen und psychologischen Konflikte im Gefolge von Patientenverfügungen zu sein, mit denen Patienten in gesunden Tagen für bestimmte Phasen der Erkrankung die Nichtbehandlung interkurrenter Erkrankungen oder die Unterlassung künstlicher Ernährung verfügt haben, während sich unter den in der Patientenverfügung gemeinten Bedingungen keine Anzeichen finden, dass sie unter ihrer Situation (...) leiden. Der Beitrag argumentiert für diese Situation für eine „gemischte“ ethische Strategie: Patientenverfügungen im rechtlichen Sinne sollten insbesondere dann, wenn sie im Rahmen eines Advance Care Planning erstellt sind, befolgt werden, um zu verhindern, dass den Vorausverfügenden das Vertrauen in die spätere Befolgung ihres Wunsches nach Abbruch oder Nichtaufnahme medizinischer Behandlungen genommen wird. Dagegen sollten darüber hinausgehende „Pflegeverfügungen“ ohne rechtlich verbindlichen Status nur in Fällen beachtet werden, in denen zwischen vorausverfügtem und „natürlichem“ Willen Konkordanz besteht. ZusammenfassungWährend die terminale Sedierung neueren niederländischen Erhebungen zufolge bereits in mehr als 5% aller Sterbefälle zur Leidensminderung am Lebensende angewandt wird, sind viele der durch dieses Verfahren aufgeworfenen begrifflichen und ethischen Fragen weiterhin offen. Kontrovers ist insbesondere die begriffliche Einordnung der Kombination von terminaler Sedierung und Behandlungsabbruch sowie die Frage nach den dafür einschlägigen ethischen Kriterien. Ausgehend von einer Analyse von drei Szenarien mit unterschiedlicher kausaler Rollenverteilung argumentiere ich dafür, den Standardfall der Kombination von terminaler Sedierung und Behandlungsabbruch unter die (...) Kategorie der „passiven Sterbehilfe“ zu subsumieren und für sie dieselben ethischen Kriterien wie für den Behandlungsabbruch allein gelten zu lassen. Eine tentative vergleichende Bewertung ergibt, dass die terminale Sedierung als ultima ratio der Leidensminderung am Lebensende gegenüber der Alternative des assistierten Suizids insgesamt als ethisch vorzugswürdig gelten sollte, ohne jedoch die Alternative des assistierten Suizids als in toto unzulässig erscheinen zu lassen. Since there is no really elaborated theory of the dialectic of nature, it is not only desirable but necessary to take a look at some of Hegel's original intuitions, which in many cases lost their distinctness in his later works, or fell victim to the exigencies of his system. Philosophy makes use not only of reasoning but also of intuition. In respect of the mass which offers persistent resistance to a notional solution, it is important to find a suitable image (...) for developing a first approximation to the understanding of the question. According to Hegel, the metaphors of circular and gyratory motion are well-suited for this. Here it is essential to clarify what we can gain by a structural interpretation of such ideas. I think that an attempt has to be made to bring out the contemporary relevance of the topic. Doing so is always a delicate matter, but it is a must if undertakings of the present kind are to be anything more than philological expositions of Hegel's philosophy, if they are to make a real contribution to reflection on the foundations of physics. I shall first give a brief review of the arguments put forward in the Encyclopedia; then I shall analyse Hegel's interpretation of circular and gyratory motion and discuss the possibility of bringing out the relevance of his ideas; finally, I shall draw certain conclusions in respect of the principles involved in comprehending the divisibility of matter, and in putting forward a philosophical interpretation of the theory of relativity. The well-known empiricist apories of the lawfulness of nature prevent an adequate philosophical interpretation of empirical science until this day. Clarification can only be expected through an immanent refutation of the empiricist point of view. My argument is that Hume’s claim, paradigmatic for modern empiricism, is not just inconsequent, but simply contradictory: Empiricism denies that a lawlike character of nature can be substantiated. But, as is shown, anyone who claimes experience to be the basis of knowledge (as the empiricist naturally (...) does), has, in fact, always already presupposed the lawfullness of nature, i.e. has assumed the ontology of a nature lawful in itself. If lawfulness is, more closely, understood as dependency on conditions, then the functional character of the laws of nature is involved with the consequence that verification is not to be taken as a mere repetition of measurements but as clarification of the conditional structure of the physical process. Furthermore the functionality of the laws of nature also includes a statement on their invariance (relative to certain transformations) and so their lawlikeness. This throws a new light on the problem of induction. Seen in this way it is hardly surprising that the notorious neglect of the functional aspect in empiricism has led to fundamental problems with the concept of the law of nature. (shrink)

From the intrinsic connection between universality and functionality, however, – that is my claim – the ontological consequence of a nature results, for which lawfulness is coupled to essentially functionally defined time sequences, thereby implying a potentiality dimension of nature, too. The center of this investigation is the hard problem of phenomenal perception. To be clear, hereby it is thought of higher animals; accordingly the problem of Human consciousness will explicitly not be treated. The so-called explanatory gap (Levine), i.e. missing a neural explanation of experiences, here is emergence-theoretically countered: It is argued that systems own properties and laws different from those of their components. Applied to the brain the phenomenal character of perception is explained as an emergence effect from the (...) systemic cooperation of perception, valuation and behavior, whereby also an interpretation is opened to Davidson’s anomal monism. As is further shown, feelings are to be understood as a necessary completion of perception when, as in the case of higher animals, the behavior is primarily controlled by phenomenal perception. With an overview of the most important scientific innovations in 17th century Europe as a background, the focus is on the field of astronomy and its distinction from astrology. The essays collected in this volume are situated within this development of the early modern period.

Adapting a terminology introduced by Brian Barry, I make a distinction between want-regarding and ideal-regarding principles and apply it to the norms and criteria put forward in environmental ethics. I argue that priority should be given to want-regarding principles over ideal-regarding ones because the former are universalizable while the latter are not, universalizable being understood in the sense of appealing to value premises for which universal assent can be secured. This sense is different both from R. M. Hare’s metaethical concept (...) of universalizability and J. L. Mackie’s “three stages of universalisation.”. (shrink)

David Hume is quoted in Binmore’s book Natural Justice more than any other author, past or present, and throughout with a markedly positive attitude. It is argued that this affinity is reflected in many characteristic features of Binmore’s approach to fairness and social justice and especially in the central role motivational issues are made to play in his theory. It is further argued that Binmore shares with Hume not only important strengths but also certain weaknesses, among them a tendency to (...) derive from the limited evidence of past history far-reaching statements on human nature and the conditions thereby imposed on social morality. ZusammenfassungDer schnelle Fortschritt der Biomedizin fördert fortwährend neue bioethische Problemstellungen zutage und erfordert Anpassungen überlieferter Normbestände an neue Gegebenheiten. Für viele neue Verfahren stellen sich jedoch Fragen nicht nur der moralischen Bewertung, sondern auch der begrifflichen Einordnung. Diese besagt dann häufig etwas über das Gewicht, das einerseits sachlichen, andererseits normativen Kontinuitäten und Diskontinuitäten beigelegt wird. Der Beitrag illustriert die in diesem Zusammenhang auftretenden Konflikte am Beispiel des Gene editing bei Nutzpflanzen, der mitochondrial replacement therapy, des aktiven Behandlungsabbruchs bei Schwerkranken und (...) dem freiwilligen Verzicht auf Nahrung und Flüssigkeit zur Lebensbeendigung (Sterbefasten). Besonderes Augenmerk gilt den Dilemmata, die sich ergeben, wenn sich diese Konflikte angesichts verhärteter normativer Fronten diskursiv nicht auflösen lassen. (shrink)
