A fact ignored or underestimated by most of the specialist of the work and thought of Merleau-Ponty is the debt h is phenomenology of perception has to Ernst Cassirer’s own phenomenology. The articulation of an actual dialogue between the two thinkers is here anchored in Cassirer’s _concept of symbolic pregnance; which will have further development in Merleau’s Phenomenology of Perception, especially in the chapter he dedicated to the concept of expression. Pour rendre compte de la première démonstration d’existence d’une grandeur irrationnelle, les historiens des sciences et les commentateurs d’Aristote se réfèrent aux textes sur l’incommensurabilité de la diagonale qui se trouvent dans les Premiers Analytiques, les plus anciens sur la question. Les preuves usuelles proposées dérivent d’un même modèle qui se trouve à la fin du livre X des Éléments d’Euclide. Le problème est que ses conclusions, passant par la représentation des fractions comme rapport de deux entiers premiers entre eux, (...) i.e. la proposition VII.22 des Éléments, ne correspondent pas aux écrits aristotéli­ciens. Dans cet article, nous proposons une nouvelle démonstration, conforme aux textes des Analytiques, fondés sur des résultats très anciens de la théorie du pair et de l’impair. Ne passant pas par la proposition VII.22, ni par aucune autre propriété établie par l’absurde, cette irrationalité apparaît comme le premier résultat que l’on ne pouvait établir par une autre méthode. L’importance de ce résultat, révélant un nouveau domaine mathématique, celui des grandeurs irrationnelles, rend compte de la centralité que cette forme de raisonnement acquiert alors, d’abord en mathématique, puis dans tout type de discours rationnel. À partir des conséquences qui suivent de cette nouvelle démonstration, on peut interpréter très simplement la leçon sur les irrationnels du passage mathématique figurant dans le Théétète de Platon (147d-148b), ce que nous ferons dans un article à paraître dans un prochain numéro. Pour Merleau-Ponty et Nancy, le sujet et son monde co-naissent ensemble dans le mouvement paradoxal du sentir. Dans cette perspective, le sentir serait alors un point de départ privilégié afin de déconstruire les théories classiques de la subjectivité et pour construire une nouvelle compréhension décentrée du sujet. Même si ces deux philosophes divergent sur la question du sujet, il est possible de les rapprocher sur la question du sentir et en particulier à propos de l’expérience de l’écoute. De cette façon, (...) nous ferons ressortir un ton radical chez le premier Merleau-Ponty et un timbre (ou une tonalité) phénoménologique chez Nancy. Pour ce faire, nous démontrons que l’écoute révèle la subjectivité comme activité de « coexistence » (et non pas de « coïncidence »), comme « co-naissance » (et non pas connaissance), et comme « trajectoire » (et non pas présence statique). En d’autres termes, c’est par la voie de l’écoute qu’on retrouve une théorie radicale de la subjectivité déjà présente dans la Phénoménologie de la perception, ainsi qu’une tonalité phénoménologique chez Nancy. For Merleau-Ponty and for Nancy, the subject and his or her world are born together (co-naissent) in the paradoxical movement of sensing. From this perspective, sensing is thus a privileged point of departure for the deconstruction of classical theories of subjectivity and for the construction of a new notion of a decentered subjectivity. Even though it may appear that these two thinkers diverge precisely with regard to the definition of the subject to be theorized, by bringing them together on the topic of sensing (and “listening” in particular), we are able to bring out a radical tone in Merleau-Ponty’s early work as well as a phenomenological timbre in Nancy’s thought. In this paper I demonstrate that listening reveals how subjectivity is an activity of “co-existence” rather than “co-incidence,” of “co-birth” (co-naissance) rather than “knowledge” (connaissance), and is a trajectory rather than a static presence. In other words, by listening to listening we rediscover a radical theory of subjectivity already at work in Phenomenology of Perception and a phenomenological tonality in the work of Nancy. Per Merleau-Ponty e Nancy, il soggetto e il suo mondo co-nascono nel movimento paradossale del sentire. In questa prospettiva, il sentire sarebbe allora un punto di partenza privilegiato per decostruire le teorie classiche della soggettività e costruire una nuova comprensione decentrata del soggetto. Anche se i due filosofi divergono sulla questione del soggetto, è possibile avvicinarli circa la questione del sentire e in particolare a proposito dell’esperienza dell’ascolto. In questo modo, cercheremo di far emergere un tono radicale nel primo Merleau-Ponty e un timbro (o una tonalità) fenomenologica in Nancy. Per farlo, mostreremo come l’ascolto riveli la soggettività come attività di “coesistenza” (e non di “coincidenza”), come “co-nascenza” (e non conoscenza), e come “traiettoria” (e non presenza statica). In altri termini, è attraverso l’ascolto che ritroviamo una teoria radicale della soggettività già presente in Fenomenologia della percezione, così come una tonalità fenomenologica in Nancy. Ces acteurs de la renaissance spinoziste redigent, en quelque sorte, le chapitre conclusif de la derniere ceuvre de Spinoza (i.e. le Tratte politique reste inacheve) en definissant les nouvelles conditions de la democratic ä l'heure de la deterritorialisation generalisee marquee par l'abolition des frontieres nationales (economie mondiale, reseaux informatiques, etc.). Ce contexte offre l'occasion de repenser la politique en radicalisant les propos de Spinoza et en faisant jouer les notions de "puissance" et de "multitude" non seulement contre les concepts de "pouvoir" et de "peuple" qui en sont venus ä dominer le champ de la reflexion en philosophic politique, mais egalement contre les philosophies de l'histoire fondees sur la dialectique et la teleologie. Apres avoir decrit brievement quelques-uns des principaux enjeux de la politique spinoziste et avoir presente les nouveaux ennemis du spinozisme (neo-liberalisme et marxisme ideologique), nous ferons une genealogie de la refondation neo-spinozienne de Marx (Althusser, Deleuze, Negri) avant de repondre ä la question "Que faire?". II s'agira alors de determiner le role de l'Etat et de situer cette pensee politique par rapport ä l'utopie revolutionnaire. Ce parcours contribuera ä mieux definir les fondements et les implications de la democratic non-representative qui est au cceur des revendications de la renaissance spinoziste. (shrink)

Introductory essay, translation, updating and bibliography.

I was recently asked to report on editorial trends in the Hastings Center Report, past and future. What I reported is that HCR has been going in two seemingly contrasting directions. One has to do with moral decision‐making in clinical ethics—the core theme in bioethics for fifty years, but still developing. A second editorial trend is treatment of larger social and political issues that bear on health, such as public health interventions and access to health care. I could also have (...) noted a continuing stream of pieces on emerging technologies, from whole‐genome screening for newborns to artificial intelligence in clinical diagnoses to the so‐called de‐extinction of extinct animals and plants through various genetic and reproductive tricks. This January‐February 2019 issue of HCR reflects all these trends. (shrink)

The financial Crunch of 2008 was easily explained by both the left and right–too easily. Each insisted that events thoroughly confirmed its own long-held views and utterly refuted those of the opposed camp. This essay argues that there are indeed new lessons to be drawn from the Crunch, lessons that involve balancing the bounty of the Invisible Hand against perils of the Prisoner's Dilemma. Liberal moral imperatives are traced to variables of Personal Choice and External Cost that are typically in (...) tension with each other and thus generate needs for institutional reconstructions that change according to time and circumstance. Personal bankruptcy protection, limited liability corporations, and intellectual property are cited as examples. It is argued that the Crunch occurred because of failure adequately to balance these variables. Three paradoxes came to a head in 2008: Paradox of Efficient Markets; Paradox of Reduced Risk; Paradox of Hard-won Knowledge. The essay concludes with suggestions concerning specific lessons to be drawn from the Crunch and a corresponding list of lessons not to be drawn. (shrink)

O estudo em questão tem por objetivo analisar a Lei 9099/95, que instituiu os Juizados Especiais Cíveis na Justiça Estadual, no que diz respeito aos seus limites e potencialidades discutidos a partir da principiologia proposta pela citada Lei em um viés jurídico-filosófico. Observar-se-á para tanto a Teoria do Discurso enquanto arcabouço procedimental capaz de potencializar a observância na prática de uma justiça mais célere, simples, informal, econômica e baseada na oralidade. Para tanto aplicar-se-á a interpretação do pensamento de Jürgen Habermas (...) e de Robert Alexy em conjunto a autores tradicionais do Direito com o objetivo de se avaliar se o pensamento dogmático se encontra superado ou ainda se apresenta como um entrave para que os princípios, que a Lei atribui a condição de Critérios Orientadores dos Juizados Especial Cíveis, sejam observados na realidade fática. Il presente studio si pone in ideale continuità con l’opera di Marcello Gigante Nomos Basileus, analisi fondamentale della nascita e delle interrelazioni tra diritto naturale, diritto divino e diritto positivo nel mondo greco, prendendo le mosse proprio dal punto in cui questi aveva interrotto la sua indagine, ossia sulle concezioni platoniche del nomos e le sue connessioni con il divino, l’anima e l’educazione. In Platone sono rintracciate le premesse teoretiche della concezione, poi diffusa in età ellenistica, imperiale e tardo-antica, e (...) solitamente attribuita agli stoici, del sovrano come nomos empsychos legge incarnata, fonte del diritto positivo in quanto è legge esso stesso. In Platone esiste uno stretto rapporto tra diritto naturale, diritto divino e diritto positivo: che il nomos empsychos sia espressione della legge di natura risulta dal principio platonico secondo cui natura è per l’uomo l’anima e principalmente la dimensione intellegibile e divina che è in essa. It is a thankless task to have to reply to Professor Murray Krieger’s “Retrospective.” Qui s’excuse, s’accuse, and since I cannot ask my readers to embark on their own retrospective of my writings and test them for consistency, I have little chance of restoring my reputation in their eyes. Hence I would have been happier to leave Professor Krieger to his agonizing, if he did not present himself the “spokesman” for a significant body of theorists who appear to have acclaimed (...) my book on Art and Illusion without ever having read it. The followers of this school of criticism—of which Professor Krieger is a prominent member—had apparently convinced themselves that the book lent support to an aesthetics in which the notions of reality and of nature had no place. They thought that I had subverted the old idea of mimesis and that all that remained were different systems of conventional signs which were made to stand for an unknowable reality. True, professor Krieger admits that I never endorsed such an interpretation of my views, and he even concedes that there are passages in Art and Illusion which contradict such an out-and-out relativism, but he wants to convince his readers that these contradictions lead precisely to the ambiguities he now proposes to analyse.If he were right that the book encourages such a misreading, all I could do would be to express my regrets for having failed to make myself sufficiently clear. Luckily I can draw comfort from the fact that unlike these literary critics, the leading archaeologist of this country, Professor Stuart Piggott, had no difficulty at all in discerning my meaning and profiting from my arguments. In his Walter Neurath Memorial Lecture of 1978, entitled Antiquity Depicted: Aspects of Archaeological Illustration, the author did me the honour of taking a statement from my book as his starting point. It is the passage at the end of part I in which I recapitulate the content of the first two chapters:What matters to us is that the correct portrait, like the useful map, is an end product on a long road through schema and correction. It is not a faithful record of a visual experience but the faithful construction of a relational mode.Neither the subjectivity of vision nor the sway of conventions need lead us to deny that such a model can be constructed to any required degree of accuracy. What is decisive here is clearly the word “required.” The form of a representation cannot be divorced from its purpose and the requirements of the society in which the given visual language gains currency.1 1. According to the great discovery by e. noether in 1918 there exists an intrinsic connection between the mathematical symmetries of the laws of nature and the conservation laws. the two kinds of symmetries, namely the continuous and the discrete ones, are discussed. the physical background of these symmetries is illustrated. finally, we sketch some topical conservation problems in elementary particle physics.
