The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. The enormous increasing of connections between people and the noteworthy enlargement of domains and methods in sciences have augmented extraordinarily the cardinality of the set of meaningful human symbols. We know that complexity is always on the way to become complication, i.e. a non-tractable topic. For this reason scholars engage themselves more and more in attempting to tame plurality and chaos. In this book distinguished scientists, philosophers and historians of science reflect on the topic from a multidisciplinary point of view. (...) Is it possible to dominate complexity through reductionism? Are there other conceptual instruments useful to take account of complexity? What is complexity in biology, mathematics, physics and philosophy of mind? These are some of the questions which are faced in this volume. (shrink)

Marcel Proust’s In Search of Lost Time, raises an interesting philosophical issue, namely, how can one be in touch with past things if they no longer exist? It provides us with a way to address this issue by outlining an ontological view according to which past things still exist within a four-dimensional world. Although one cannot be in touch with past things by means of ordinary perception, one can do so by combining perception and memory. In this sense, In Search (...) of Lost Time helps us to reconcile a four-dimensionalist ontology according to which things have both spatial and temporal parts with a realist phenomenology according to which experience gives us access to things as they are. In so doing, Proust’s masterpiece allows us to shed some light on what it means for a subject of experience to exist in a four-dimensional world. (shrink)

This work presents a model-theoretic approach to the study of first-order theories of classes of BL-chains. Among other facts, we present several classes of BL-algebras, generating the whole variety of BL-algebras, whose first-order theory has quantifier elimination. Model-completeness and decision problems are also investigated. Then we investigate classes of BL-algebras having (or not having) the amalgamation property or the joint embedding property and we relate the above properties to the existence of ultrahomogeneous models.

In this article, we describe an ontology aimed at the representation of the relevant entities and relations in the philosophical world. We will guide the reader through our modeling choices, so to highlight the ontology’s practical purpose: to enable an annotation of philosophical resources which is capable of supporting pedagogical navigation mechanisms. The ontology covers all the aspects of philosophy, thus including characterizations of entities such as people, events, documents, and ideas. In particular, here we will present a detailed exposition (...) of the entities belonging to the idea branch of the ontology, for they have a crucial role in the world of philosophy. Moreover, as an example of the type of applications made possible by the ontology we will introduce PhiloSurfical, a prototype tool we created to navigate contextually a classic work in twentieth century philosophy, Wittgenstein’s Tractatus Logico-Philosophicus. We discuss the potential usage of such navigation mechanisms in educational and scholarly contexts, which aim to enhance the learning process through the serendipitous discovery of relevant resources. Notwithstanding fundamental methodological advancements, scientific information about disorders of consciousness (DOCs)—e.g. Vegetative State/Unresponsive Wakefulness Syndrome (VS/UWS) and Minimally Conscious State (MCS)—is incomplete. The possibility to discriminate between different levels of consciousness in DOC states entails treatment strategies and ethical concerns. Here we attempted to investigate Italian clinicians’ and basic scientists’ opinions regarding some issues emerging from the care and the research on patients with DOCs. From our survey emerged that Italian physicians working with patients with DOCs give a central role (...) to ethics. Current Italian regulation regarding basic research conducted in patients with DOCs apparently risks to be inadequate to support scientific advancement, and would deserve a different assessment compared to ordinary treatments. We think the results of our survey deserve attention from an international audience because they exemplify the difficulty to define a shared approach to the issues related to patients with DOCs and the necessity to better assess both the ordinary and experimental treatment of patients with DOCs at the ethical and legal level. Enrico Müller legt hier die erste philosophische Gesamtdarstellung zur Bedeutung der Griechen für Nietzsches Denken vor. Er zeigt, wie sich in Auseinandersetzung mit dem Griechentum Nietzsches eigene Philosophie entwickelte, und problematisiert deren Abgrenzungen von der Logosphilosophie der griechischen Klassik. Müller kommt dabei zu dem Schluss, dass auch Nietzsches Philosophie letztlich auf die Vorgaben der sokratisch-platonischen Dialektik angewiesen bleibt.

A rigorous ab initio derivation of the (square of) Dirac’s equation for a particle with spin is presented. The Lagrangian of the classical relativistic spherical top is modified so to render it invariant with respect conformal changes of the metric of the top configuration space. The conformal invariance is achieved by replacing the particle mass in the Lagrangian with the conformal Weyl scalar curvature. The Hamilton-Jacobi equation for the particle is found to be linearized, exactly and in closed form, by (...) an ansatz solution that can be straightforwardly interpreted as the “quantum wave function” of the 4-spinor solution of Dirac’s equation. All quantum features arise from the subtle interplay between the conformal curvature acting on the particle as a potential and the particle motion which affects the geometric “pre-potential” associated to the conformal curvature itself. The theory, carried out here by assuming a Minkowski metric, can be easily extended to arbitrary space-time Riemann metric, e.g. the one adopted in the context of General Relativity. This novel theoretical scenario appears to be of general application and is expected to open a promising perspective in the modern endeavor aimed at the unification of the natural forces with gravitation. In this paper I argue that Rawlsians have largely misunderstood the idea of an overlapping consensus of reasonable comprehensive doctrines, thereby failing to delineate in an appropriate way the place of comprehensive doctrines in political liberalism. My argument rests on two core claims. The first claim is that (i) political liberalism is committed to three theses about the overlapping consensus. The first thesis concerns the subject of the overlapping consensus; the second thesis concerns the function of the overlapping consensus; the (...) third thesis explains how the overlapping consensus can serve its function in accordance with political liberalism’s commitment to epistemic neutrality. The second claim on which my argument relies is empirical: (ii) Rawlsians typically deny at least one of the three theses to which political liberalism is committed. Based on (i) and (ii), I conclude that Rawlsians have hitherto provided unconvincing accounts of the place of comprehensive doctrines in political liberalism. (shrink)

In section 1 we argue that the adoption of a tenseless notion of truth entails a realistic view of propositions and provability. This view, in turn, opens the way to the intelligibility of theclassical meaning of the logical constants, and consequently is incompatible with the antirealism of orthodox intuitionism. In section 2 we show how what we call the potential intuitionistic meaning of the logical constants can be defined, on the one hand, by means of the notion of atemporal provability (...) and, on the other, by means of the operator K of epistemic logic. Intuitionistic logic, as reconstructed within this perspective, turns out to be a part of epistemic logic, so that it loses its traditional foundational role, antithetic to that of classical logic. In section 3 we uphold the view that certain consequences of the adoption of atemporal notion of truth, despite their apparent oddity, are quite acceptable from an antirealist point of view. Numenius is an author who straddles the line between Middle Platonism and Neoplatonism. In this contribution, I focus on the differences between the second and the third God, which emerge from analyses of the relevant fragments. Numenius emphasizes, on several occasions, how the second God (i.e., the demiurge) has a dual nature. In this paper, I investigate the role of the demiurge in Numenius and examine in what sense the second and third God are “one.” On the one hand, Numenius (...) seems to be stressing the unity of the second and third levels of reality, but on the other hand, he also appears to be differentiating them. The present analyses concentrate on fragments 19F, 24F, 29T and 30T (respectively 11, 16, 21, and 22 in des Places’ edition). My purpose is to demonstrate that, according to Numenius, the second and the third God are one because they both can be regarded as demiurgic. Thus, Numenius conceives a kind of “double demiurgy,” which preserves the distinction between the second and the third God, who are distinguished from an ontological point of view, but who, at the same time, share a demiurgic function. The second God is then the paradigm, whereas the third God is immanent in matter as a ruling principle of the cosmos, which is similar to the World Soul, as he operates on matter in order to make it rationally ordered. Conceiving of fictional characters as types allows us to reconcile intuitions of sameness and difference about characters such as Batman that appear in different fictional worlds. Sameness occurs at the type level while difference occurs at the token level. Yet, the claim that fictional characters are types raises three main issues. Firstly, types seem to be eternal forms whereas fictional characters seem to be the outcome of a process of creation. Secondly, the tokens of a type are concrete particulars in (...) the actual world whereas the alleged tokens of a fictional character are concrete particulars in a fictional world. Thirdly, many fictional characters, unlike Batman, only appear in one work of fiction, and therefore one can wonder whether it does make sense to treat them as types. The main aim of this paper is to address these issues in order to defend a creationist account of fictional characters as types. (shrink)

The paper is devoted to an examination of the epistemic account of the notion of deductive inference recently provided by D. Prawitz, and based on the notion of ground. This is part of the general scenario constituted by the “Proof-theoretic semantics”, presented since the ’70s of the last century as an alternative to the standard model-theoretic explication of the notion of logical consequence.Our argument pivots on the so-called “Curry–Howard Correspondence”, which exploited the idea of considering proofs as proper mathematical objects (...) in a remarkable way. A sort of rational reconstruction of this idea is outlined, tracing it back to Hilbert and Husserl’s investigations. (shrink)

In the first part of this paper, published in issue 1 of Augustinianum 63 (2023), 9-45, we examined the question of whether Irenaeus of Lyons depended on the Exposition of Logia about the Lord of Papias of Hierapolis. In this second and final part we focus on the way Irenaeus used information which, since the first decades of the second century, had been attributed to presbyters of Asia and then in particular on the way he identifies the succession of presbyters (...) with that of bishops (primarily in Rome). He links the latter with Christian origins but also profoundly alters the function traditionally attributed to the presbyters themselves, within a system he devised in order to respond to urgent problems, in a context quite different from the era in which the traditions to which he appeals were born. Enrico Berti has had a profound influence on the birth and development of Italian studies in ancient philosophy. His sizable work has shaped a great part of Italian studies on Aristotle and other ancient philosophers. This paper develops Richard Wollheim’s claim that the proper appreciation of a picture involves not only enjoying a seeing-in experience but also abiding by a standard of correctness. While scholars have so far focused on what fixes the standard, thereby discussing the alternative between intentions and causal mechanisms, the paper focuses on what the standard does, that is, establishing which kinds, individuals, features and standpoints are relevant to the understanding of pictures. It is argued that, while standards concerning kinds, individuals (...) and features can be relevant also to ordinary perception, standards concerning standpoints are specific to pictorial experience. Drawing on all this, the paper proposes an ontology of depiction according to which a picture is constituted by both its visual appearance and its standard of correctness. (shrink)

De nombreuses recherches ont mis en évidence le fait que les épicuriens n’étaient pas complètement hostiles à la poésie en général mais qu’ils refusaient probablement les compositions ou procédures poétiques qui ne conduisent pas à la fin naturelle du plaisir « catastématique », c’est-à-dire le bonheur. Dans cet article, nous nous demanderons donc si les épicuriens ont inventé une poésie cathartique de type positif ou s’ils ont simplement rejeté toutes les formes de catharsis poétique en les décrivant comme des expériences (...) négatives. Nous constaterons dans ce travail de recherche, divisé en trois parties, que la première hypothèse est plus probable que la seconde. Dans un premier temps, nous démontrerons que les épicuriens ont effectivement reconnu l’existence d’une catharsis positive, transmise par la raison et l’enseignement de la philosophie, ayant la capacité de faire disparaître les émotions négatives qui entravent l’accès au bonheur (l’amour, la peur du divin, le désir excessif, etc.). L’idée développée, dans un second temps, établit qu’Épicure et ses disciples pourraient s’être opposés à la catharsis tragique décrite dans la Poétique d’Aristote, parce qu’elle implique de passer par des passions négatives telles que la pitié et la terreur. Cette expérience esthétique entrerait alors en contradiction avec l’idéal épicurien du plaisir comme absence de trouble et d’inquiétude psychique. Enfin, dans un troisième temps, nous exposerons l’idée selon laquelle les épicuriens pourraient avoir accepté une seule forme de catharsis poétique : celle facilitant le processus de purification effectué par la raison et l’enseignement de la philosophie. Un exemple possible de cette pratique est le poème De rerum natura de Lucrèce dans lequel la poésie n’est pas considérée comme cathartique en soi, mais si et seulement si elle assiste la philosophie épicurienne dans sa conquête du bonheur. Regardless of whether one agrees or disagrees with Stacie Friend’s claim that fiction is a genre, her notion of genre can be fruitfully applied to a paradigmatic genre such as science fiction. This article deploys Friend’s notion of genre in order to improve the influential characterization of science fiction proposed by Darko Suvin and to defend it from a criticism recently raised by Simon Evnine. According to Suvin, a work of science fiction must concern “a fictional ‘novum’ validated by cognitive (...) logic.” While Suvin conceives of his characterization as a necessary and sufficient condition for membership in the genre, I propose to cast the notions of “fictional novum” and “cognitive validation” as standard features of the genre, which works of science fiction should have but might lack. I argue that this amended version of Suvin’s characterization can better account for two basic properties of science fiction as a genre, namely its historicity and its relevance to appreciation. Lastly, I show that the amended version can shed some light on the affinity between works of science fiction and philosophical thought experiments. (shrink)

The stated aim of cryptocurrencies is to free the monetary system from the need to trust financial intermediaries, by relying on incentive design and technology. Many descriptive studies, however, have questioned cryptocurrencies’ delivery on the promise of trustlessness. This paper promotes a normative analysis of trust in cryptocurrencies by discussing (i) whether trust is in principle eliminable, and (ii) whether trustlessness is in itself a desirable goal. These issues are closely related, we argue, to the further issue of what kind (...) of institutions cryptocurrencies represent. We discuss the cognitive functions played by cryptocurrencies through the lens of the “extended mind” hypothesis in the philosophy of mind and hence conceive of cryptocurrencies as mind-extending institutions. As the models of institutional mind extension differ in the fiduciary bond they assume exists between individuals and institutional resources, we compare the reliance-based model of “scaffolding institutions” with the trust-based model of “cognitive institutions,” showing that the ineliminability and desirability of trust lead to seeing cryptocurrencies as instances of the latter. In the end, our discussion suggests that trust is a necessary component of cryptocurrencies’ cognitive functions and its promotion helps to perform such cognitive functions more effectively and sustainably. Nelson Goodman notoriously distinguished between autographic works, whose instances should be identified by taking history of production into account, and allographic works, whose instances can be identified independently of history of production. Scholars such as Jerrold Levinson, Flint Schier, and Gregory Currie have criticized Goodman’s autographic/allographic distinction arguing that all works are such that their instances should be identified by taking history of production into account. I will address this objection by exploiting David Davies’ distinction between e-instances and p-instances of (...) a work, thereby restating the autographic/allographic distinction. Then, I will show that this way of restating this distinction leads us to effective accounts of relevant related phenomena such as forgery, plagiarism, and digital technologies. Finally, I will show the theoretical advantages of my account of the autographic/allographic distinction in comparison with an alternative account recently proposed by Jason D’Cruz and P.D. Magnus. This paper considers two issues raised by the claim that fictional characters are abstract artifacts. First, given that artifacts normally have functions, what is the function of a fictional character? Second, given that, in experiencing works of fictions, we usually treat fictional characters as concrete individuals, how can such a phenomenology fit with an ontology according to which fictional characters are abstract artifacts? I will indirectly address the second issue by directly addressing the first one. For this purpose, I will (...) rely on the notion of a mental file. I will argue that the function of fictional characters is the generation of mental files of a special kind. I will show that our experience of fictional characters as concrete individuals depends on the kind of mental files that are generated by fictional characters as abstract artifacts. I will conclude that an appreciator of a work of fiction can open two files about a certain fictional character; one about the character as an individual in the fictional world, and the other about the character as an abstract artifact in the actual world. In this sense, our relation to a fictional character is characterized by a duality of files or ‘twofileness’. (shrink)

Nel presente contributo è nostra intenzione sondare un binomio che appare fondamentale in funzione dialogica interculturale e interreligiosa, ossia la relazione tra logos e mythos, principalmente in vista dell’incontro tra cristianesimo e tradizione induista. È nostra convinzione che le forme complementari di «teo-logia» e «teo-mythia» possa essere esplorato con frutto, tanto in funzione specifica dell’incontro con la tradizione induista, quanto per una più ampia e profonda inculturazione del vangelo.
