How can we capture the intuitive distinction between lying and misleading? According to a traditional view, the difference boils down to whether the speaker is saying (as opposed to implying) something that they believe to be false. This view is subject to known objections; to overcome them, an alternative view has emerged. For the alternative view, what matters is whether the speaker can consistently deny that they are committed to knowing the relevant proposition. We point out serious flaws for this (...) alternative view, and sketch a simpler alternative that incorporates key insights of the traditional view. (shrink)

On a representationalist view, conceptual engineering is the practice of changing the extensions and intensions of the devices we use to speak and think. But if this view holds true, conceptual engineering has a bad rationale. Extensions and intensions are not the sorts of things that are better or worse as such. A representationalist account of conceptual engineering thus falls prey to the objection that the practice has a bad rationale. To account for the assumption that conceptual engineering is worthwhile, (...) we propose to view what is being engineered as inferential devices, as opposed to representational devices. The objective is not to establish that being or having an inferential role is all there is to meaning or conceptual content. Rather, our agenda is to recommend a shift of focus from the representational features of content to the inferential features of content for the purposes of doing and thinking about conceptual engineering. Inferentialism about conceptual engineering makes better sense of the practice than a representationalist approach: In addition to accounting for the rationality of engaging in conceptual engineering, inferentialism provides a sound interpretation of what is at stake in concrete examples of conceptual engineering. A philosopher argues that state-sponsored cyberattacks against central military or civilian targets are always acts of war. What is this philosopher doing? According to conceptual analysts, the philosopher is making a claim about our concept of war. According to philosophical realists, the philosopher is making a claim about war per se. In a quickly developing literature, a third option is being explored: the philosopher is engineering the concept of war. On this view, the philosopher is making a proposal about which (...) concept we should have – even if it deviates from the extant concept, and even if it does not capture ‘what war really is’. The activity or method of proposing such revisionary definitions, as well as the metaphilosophical reflection on it, has become known as conceptual engineering. (shrink)

At the general elections in Belgium, the voter bas the possibility to bring out a vote fora party or a vote for a candidate of the party. At the general elections of November 24, 1991, for the House of Representatives, the voters have voted for 48% by preference, whereas, for the Senate 41 % of them have done so. The evolution is stagnating. The use of preferential votes is varying from one electoral district to another: from 62% in the district (...) of Tongeren-Maaseik to 34% in Mechelen.There is also a difference from one political party to another. The highest percentage is obtained by the christian-democratic parties: 58%; the lowest by the last remaining communists: 27%.The preferential v'ótes individual candidates obtain differ widely. This is not only a result of their popularity, but also of their political position, rendering of services and media-attraction. Preferential voting is characteristic to politically conscious voters. The sociography of the Belgian post-war minister is characterized by an upper middle-class or middle-class origin, a French-speaking and male preponderance and a university-education. The most frequent professional occupations are lawyer, professor and executive.The political career which led to a ministerial post, went in the first place through the legislative body and in the second place through thepolitical parties. After their ministerial career 39 % of the ministers played a promine part in the parliament; 35 %, however, prosecuted an extra-parliamentary (...) and prestigious « after-function ».The Belgian ministerial career pattern bears some resemblances to the Dutch, German and French career pattern, but also many differences. The most outstanding difference is the importance of the bureaucratic component in the structure of the ministerial elite in those three countries, where in Belgium this is not very important. _Why originalism is a flawed, incoherent, and dangerously ideological method of constitutional interpretation__ “Chemerinsky... offers a concise, point-by-point refutation of the theory [of originalism]. He argues that it cannot deliver what it promises—and if it could, no one would want what it is selling.”—David Cole, _New York Review of Books__ Originalism, the view that the meaning of a constitutional provision is fixed when it is adopted, was once the fringe theory of a few extremely conservative legal scholars but is now (...) a well-accepted mode of constitutional interpretation. Three of the Supreme Court’s nine justices explicitly embrace the originalist approach, as do increasing numbers of judges in the lower courts. Noted legal scholar Erwin Chemerinsky gives a comprehensive analysis of the problems that make originalism unworkable as a method of constitutional interpretation. He argues that the framers themselves never intended constitutional interpretation to be inflexible and shows how it is often impossible to know what the “original intent” of any particular provision was. Perhaps worst of all, though its supporters tout it as a politically neutral and objective method, originalist interpretation tends to disappear when its results fail to conform to modern conservative ideology. Clinical ethics consultation service remains undeveloped in developing countries. It is recognised that its introduction poses challenges. Malaysia, a multicultural society with diverse religions, values and perceptions further complicate the introduction of formal clinical ethics consultation service. Clinicians attending a national congress workshop completed a Strengths–Weaknesses–Opportunities–Threats analysis. The aim was to gain insight into clinician’s expectations and promote initiatives leading to the introduction of clinical ethics consultation service. Clinicians agree that clinical ethics consultation service can improve quality of care, reduce (...) healthcare costs and advocate for patients and providers. The analysis highlighted constraints in sufficient critical mass of relevant expertise and restricted opportunities for training. The European Union is working towards harmonizing legislation across Europe, in order to improve cross-border interchange of legal information. This goal is supported for instance via standards such as the European Law Identifier and the European Case Law Identifier, which provide technical specifications for Web identifiers and suggestions for vocabularies to be used to describe metadata pertaining to legal documents in a machine readable format. Notably, these ECLI and ELI metadata standards adhere to the RDF data format which forms the (...) basis of Linked Data, and therefore have the potential to form a basis for a pan-European legal Knowledge Graph. Unfortunately, to date said specifications have only been partially adopted by EU member states. In this paper we describe a methodology to transform the existing legal information system used in Austria to such a legal knowledge graph covering different steps from modeling national specific aspects, to population, and finally the integration of legal data from other countries through linked data. We demonstrate the usefulness of this approach by exemplifying practical use cases from legal information search, which are not possible in an automated fashion so far. (shrink)

Conceptual Engineering (CE) is thought to be generally aimed at ameliorating deficient concepts. In this paper, we challenge this assumption: we argue that CE is frequently undertaken with the orthogonal aim of _conceptual adaptation_. We develop this thesis with reference to the interplay between technology and concepts. Emerging technologies can exert significant pressure on conceptual systems and spark ‘conceptual disruption’. For example, advances in Artificial Intelligence raise the question of whether AIs are agents or mere objects, which can be construed (...) as a CE question regarding the concepts AGENT and OBJECT. We distinguish between three types of conceptual disruption (conceptual gaps, conceptual overlaps, and conceptual misalignments) and argue that when CE occurs to address these disruptions, its primary aim is not to improve concepts, but to retain their functional quality, or to prevent them from degrading. This is the characteristic aim of CE when undertaken in philosophy of technology: to _preserve_ the functional role of a concept or conceptual scheme, rather than _improving_ how a concept fulfills its respective function.
