Many political philosophers believe that we owe moral obligations to our political communities simply because we are asked. We are, for example to pay taxes, or serve in the army whenever we are demanded to do so by the competent authorities or agencies. Can such moral obligations be created by European Union institutions? This essay discusses the natural duty of justice to support just or nearly just political institutions as defended by John Rawls and Jeremy Waldron. It suggests that (...) European Union institutions can be seen to create similar obligations, only if we adopt a cosmopolitan theory of political legitimacy for both domestic and international institutions. A key distinction proposed is that between a duty of jurisdiction, owed by everyone to every legitimate state, and a duty of civility, owed by citizens to their own states. (shrink)

This volume contains the first publication in book form of an English translation of Thomas Aquinas's controversial disputed question De unione Verbi incarnati. This disputed question is a remarkable portal into the Angelic Doctor's theology of the hypostatic union, which is recognized as an area in which Aquinas forged some of his most original and penetrating articulations of the Christian faith. In the De unione Verbi incarnati Aquinas presents in five articles material that occupies more than eighteen questions in (...) the third part of the Summa theologiae. The attribution of an esse secundarium to Christ, in the fourth article of the De unione, has been the object of intense debate, for it seems to contradict the account of the Summa. In addition to Professor Nutt's English translation, the volume includes the critical Latin text published by Barbara Bartocci, Klaus Obenauer, and Walter Senner, as well as a substantial introduction. Professor Nutt's introduction carefully unfolds the historical background, technical concepts, sources, and speculative claims needed for understanding the breadth of the biblical and metaphysical contemplation represented in this work; it also includes a detailed exploration of the debate over the fourth article. Spinoza breaks with Descartes’ conception of the psychophysical union and deeply changes the ontological statute of men. He considers no longer that human beings in Nature are a dominion within a dominion and share with God the privilege of being substances. In Descartes, the union of an immaterial or non‐extended substance and a material or extended substance remains beyond understanding, since the problem of whether they are able to interact arises. By identifying the mind to the idea of (...) the body, the author of the Ethics provides guidance on how to conceptualize their relationship. The psychophysical parallelism fails to explain both identity and differences in Spinoza. It presupposes homologies and one‐to‐one correspondences between ideas and things, mind and body, and leads to conceptualizing the various modal expressions according to a linearly identical model. The psychophysical union in Spinoza sounds like a duet that puts an end to duality without reducing it to a mechanical identity. (shrink)

While unionization is usually evaluated as an aspect of freedom of association—the idea being that workers have the right to associate and form unions if they want and have an equal right not to do so if they don't, I argue that this is a mistake. Instead of merely allowing unions to form or not depending on the preferences of workers, I argue that unions are a basic and therefore necessary institution of a just society. After analyzing and criticizing the (...) schema developed by John Rawls for evaluating what constitutes a basic institution, I introduce a new principle that allows us to determine what should be considered a basic institution in the context of our existing social institutions and practices. I then apply this principle to unionization, and argue that while unions are subject to post-institutional regulation, just like firms are, their existence is demanded by pre-institutional principles of equality and liberty and therefore not optional. Not only are union shops consistent with our deepest moral principles, including our commitment to liberty, that commitment, when properly understood, actually requires that unionization be universal. ‘The Union of Cause and Effect in Aristotle : Physics III 3’, Oxford Studies in Ancient Philosophy, 32, pp. 205-232, May 2007.: I argue that Aristotle introduced a unique realist account of causation, which has not hitherto been appreciated in the history of philosophy: causal realism without a causal relation. In his account, cause and effect are unified by the ectopic actualization of the agent’s potentiality in the patient. His solution consists in the introduction of a property that belongs (...) to one subject but is realized in another subject on whose state this realization depends. Todos los Acuerdos de Libre Comercio (ALCs) concluidos recientemente por la Unión Europea (UE) incluyen capítulos sobre Comercio y Desarrollo Sostenible (CDS) donde se recogen compromisos mutuos en materia laboral y medioambiental. Las disposiciones sobre medio ambiente mencionan expresamente los acuerdos multilaterales que cada Parte se compromete a cumplir, como el Acuerdo de París sobre cambio climático. Sin embargo, la falta de un mecanismo de ejecución efectiva en caso de incumplimiento de las disposiciones sobre CDS merma la credibilidad de los (...) compromisos de sostenibilidad. El ALC de la UE con Nueva Zelanda representa un punto de inflexión en esta tendencia, ya que introduce un nuevo modelo de aplicación. Con respecto a los compromisos climáticos, en particular, el ACL incluye objetivos ambiciosos que, unido al nuevo enfoque de aplicación, podrían incorporarse a futuros ALCs de la UE, contribuyendo así de forma importante a la lucha global contra el cambio climático. This monograph deals with the interrelationship between chemistry and physics, and especially the role played by quantum chemistry as a theory in between these two disciplines. The author uses structuralist approach to explore the overlap between the two sciences, looking at their theoretical and ontological borrowings as well as their continuity. -/- The starting point of this book is that there is at least a form of unity between chemistry and physics, where the reduction relation is conceived as a special (...) case of this unity. However, matters are never concluded so simply within philosophy of chemistry, as significant problems exist around a number of core chemical ideas. Specifically, one cannot take the obvious success of quantum theories as outright support for a reductive relationship. Instead, in the context of a suitably adapted Nagelian framework for reduction, modern chemistry's relationship to physics is constitutive. The results provided by quantum chemistry, in particular, have significant consequences for chemical ontology. Context: Neurophenomenology is a relatively new field, with scope for novel and informative approaches to empirical questions about what structural parallels there are between neural activity and phenomenal experience. Problem: The overall aim is to present a method for examining possible correlations of neurodynamic and phenodynamic structures within the structurally-coupled work of Alexander Technique practitioners with their pupils. Method: This paper includes the development of an enkinaesthetic explanatory framework, an overview of the salient aspects of the Alexander Technique, and the (...) presentation of an elicitation interview technique as part of a neurophenomenological method. It will propose a way of testing the hypothesis that if, in the effective practice of Alexander Technique, there is a union between the nervous systems of teacher and pupil, it should be visible neurologically and affective phenomenologically, and thus it should be possible to investigate both its neural and phenomenal signatures. Results: The proposed means of testing the hypothesis is to use the elicitation interview technique alongside neural monitoring during the teaching of the Alexander Technique in four paired sets of subjects. Constructivist content: At the heart of this paper is the claim that all activity is co-activity. I make no assumption of an ontological primacy of mental or physical, or explanatory primacy of any methodology. Implications: This has important ramifications for somatic education and therapies, for establishing frameworks of co-engagement and care in health-care situations, and for understanding empathy. For twenty years, the European Union has qualified as a supranational actor more and more present on the educational scene. Through the European strategies - Lisbon 2010 and Europe 2020 - but also the open method of coordination, an essential mutation has been occurring at the level of Member States. In this article, I intend to analyse in which manner the European Union manages to become a genuine educational actor. Thematic analysis of forty semi-structured interviews conducted with European (...) and international officials demonstrate that the European leaders prepared the European “suitcase” for the first “flight” of 2010 and the second one in 2020. Mainly, this briefcase regroups benchmarks, core competencies, mobility programs and the European qualifications framework. If the European Union is able to “boast” with a national or international political visibility through educational proposals however, an unknown factor remains in this geopolitical equation. Many political and legal philosophers compare the EU to a federal union and believe its basic laws should be subject to the standards of constitutional law, and thus find it lacking or incomplete. This book proposes a rival theory: that the substance of EU law is not constitutional, but international, and provides a close examination of the treaties and the precedents of the European courts to explore this concept further. -/- Just like international law, EU law applies primarily to (...) the relations between member states, who have democratically chosen to adapt their constitutional arrangements in order to share legislative and executive powers with their partners. The legal architecture of the European Union is thus best understood under a theory of dualism and not pluralism. -/- According to this 'internationalist' view, EU law is part of the law of nations and its distinction from domestic law is a matter of substance, not form. This arrangement is supported by a cosmopolitan theory of international justice, which we may call progressive internationalism. The EU is a union of democratic peoples, freely organizing their interdependence on the basis of principles of equality and reciprocity. Its central principles are not the principles of a constitution, but cosmopolitan principles of accountability, liberty, and fairness. -/- Presenting an 'internationalist' reading, this book proposes that the EU is a creation of the law of nations, and argues for a dualist account of its legal architecture, with EU law and domestic law allocated different institutional roles. We find properties of topological spaces which are not shared by disjoint unions in the absence of some form of the Axiom of Choice.

We study statements about countable and well-ordered unions and their relation to each other and to countable and well-ordered forms of the axiom of choice. Using WO as an abbreviation for “well-orderable”, here are two typical results: The assertion that every WO family of countable sets has a WO union does not imply that every countable family of WO sets has a WO union; the axiom of choice for WO families of WO sets does not imply that the (...) countable union of countable sets is WO. We follow [8] in asking when a set of ordinals $X \subseteq \alpha$ is a countable union of sets in K, the core model. We show that, analogously to L, and X closed under the canonical Σ 1 Skolem function for K α can be so decomposed provided K is such that no ω-closed filters are put on its measure sequence, but not otherwise. This proviso holds if there is no inner model of a weak Erdős-type property.

This book examines the role of the EU in ensuring privacy and data protection on the internet. It describes and demonstrates the importance of privacy and data protection for our democracies and how the enjoyment of these rights is challenged by, particularly, big data and mass surveillance. The book takes the perspective of the EU mandate under Article 16 TFEU. It analyses the contributions of the specific actors and roles within the EU framework: the judiciary, the EU legislator, the independent (...) supervisory authorities, the cooperation mechanisms of these authorities, as well as the EU as actor in the external domain. Article 16 TFEU enables the Court of the Justice of the EU to play its role as constitutional court and to set high standards for fundamental rights protection. It obliges the European Parliament and the Council to lay down legislation that encompasses all processing of personal data. It confirms control by independent supervisory authorities as an essential element of data protection and it gives the EU a strong mandate to act in the global arena. The analysis shows that EU powers can be successfully used in a legitimate and effective manner and that this subject could be a success story for the EU, in times of widespread euroskepsis. It demonstrates that the Member States remain important players in ensuring privacy and data protection. In order to be a success story, the key stakeholders should be prepared to go the extra mile, so it is argued in the book. The book is based on academic research for which the author received a double doctorate at the University of Amsterdam and the Vrije Universiteit Brussels. It builds on a long inside experience within the European institutions, as well as within the community of data protection and data protection authorities. It is a must read in a time where the setting of EU privacy and data protection is changing dramatically, not only as a result of the rapidly evolving information society, but also because of important legal developments such as the entry into force of the General Data Protection Regulation. This book will appeal to all those who are in some way involved in making this regulation work. Trade unions in Australia have long played an important role in the enforcement of minimum employment standards. The legislative framework today continues to recognize this enforcement role, but in a way that is more individualistic and legalistic than in the past. At the same time that the law has evolved to emphasize the representation and servicing role of trade unions, the Australian union movement has sought to revitalize and grow through the adoption of an “organizing model” of unionism that (...) emphasizes workplace-level activism. This Article explores how these seemingly opposing trends have manifested themselves in the enforcement-related activities of five trade unions. Considerable diversity was found among the unions in relation to the extent to which and how the unions performed enforcement-related activities. However, all five unions spent significant time and resources on monitoring and enforcing employer compliance with minimum standards and saw this work as a core part of what they do. The case studies suggest, however, that the way in which this work is undertaken within unions and by whom has changed significantly in recent decades. While there was evidence that enforcement work was used tactically by unions in certain cases, this was largely on an ad hoc basis and there was little indication that the enforcement work was integrated into broader organizing objectives and strategies. Overall, the unions were ambivalent, if not skeptical, as to the capacity for enforcement work to grow unions through building workplace activism and collective strength. (shrink)

Union Citizenship as currently implemented in the European Union introduces a distinct concept of citizenship that necessitates an adequate normative approach. The objective of this paper is to assess EU Citizenship against the theoretical background of multilateral democracy. This approach is specifically suited for this task, as it does not rely on a nation-state paradigm or the presumption of a further transformation into a federation or union. We propose three criteria by which to assess multilevel citizenship: equal (...) individual rights, equal sovereignty of peoples and the balancing of individuals' and peoples' interests. We argue that the current practice of Union Citizenship does not fully meet the proposed standards, regarding equal rights within and equal access to, the political system. Based on our assessment, we propose reform options of access to national and supranational citizenship and argue for supranational participation rights and equal transnational rights to gradually re-establish full membership for individuals.
