Die Wissenschaftslehre von 1812 - die letzte, die Fichte vollstandig vorgetragen hat - wird der Forschung erstmals in zuverlassiger Form vorgelegt. In ihr deduziert Fichte vom hochsten bestimmten 'Blick' aus, dem des sittlichen Wollens als einem der hoheren 'Schemata' der Erscheinung des Absoluten, die weiteren Momente des Wissens. Die Rechtslehre von 1812 wird ausschliesslich nach der Handschrift wiedergegeben. Drei nicht exakt zu datierende Texte zeigen Fichtes Reaktion auf die Zeitereignisse (u.a. This is the last complete version of Fichte's lectures on the Wissenschaftslehre, and it is here published for the first time in a reliable edition. This version begins with the most determinate "point of view," that of ethical willing, understood as one of the higher "schemata" of the absolute's appearance, from which Fichte deduces the additional moments of knowing. The texts of the 1812 Doctrine of Right [Rechtslehre] and the 1812 Doctrine of Ethics [Sittenlehre] published here are based entirely on the lecture manuscripts and incorporate nothing from previously published texts based upon other sources. -- Three additional texts, none of which can be precisely dated, illustrate Fichte's reaction to events of the day, such as Napoleon's demand for reparations from Prussia. Here the philosopher engages in fundamental reflections concerning the economic realm (the valuation of agricultural wealth, monetary theory). The introductory lecture of the Summer Semester of 1812 documents Fichte's efforts, at the start of the semester, to attract and to introduce as many interested students as possible to the study of philosophy. Noncompete agreements are among the most commonly used methods to restrict employment. Upwards of 38% of American workers, many of which are low-wage workers, have signed noncompete agreements. These agreements effectively hold those workers hostage to their current employer. This project analyzes the use of noncompete clauses in employment contracts with low-wage workers. We show that noncompetes with low-wage workers are not enforceable in the U.S.; employers nevertheless continue to include noncompete clauses in employment contracts with low-wage workers. We survey (...) states’ attempts to regulate the use of (even unenforceable) noncompetes and argue that current legislation is ineffective at preventing employers from including noncompetes in low-wage worker contracts. We argue that employers’ use of (even unenforceable) noncompete agreements with low-wage workers is wrongfully exploitative of those workers, and we provide suggestions for how states can effectively regulate the use of noncompetes, and thus protect low-wage workers from exploitation, using Virginia’s recently passed noncompete bill as a model. One of the most controversial issues to emerge in recent studies of Fichte concerns the status of his normative ethics, i.e., his theory of what makes actions morally good or bad. Scholars are divided over Fichte’s view regarding the ‘final end’ of moral striving, since it appears this end can be either a specific goal permitting maximizing calculations (the consequentialist reading defended by Kosch 2015), or an indeterminate goal permitting only duty-based decisions (the deontological reading defended by Wood 2016). While I think each interpretive position contains an element of truth, my aim in this paper is to defend a third alternative, according to which Fichte’s normative ethics presents us with a unique form of social perfectionism. Fichte’s Jena Wissenschaftslehre is often thought to occupy a standpoint from which claims about what there really is, as opposed to claims about how we necessarily represent things to be, are metaphilosophically prohibited or methodologically precluded. This essay argues that for Fichte a transcendental account of the necessary conditions for knowing supports an accordant understanding of the basic nature of being. These are linked by a reconception of the nature of rationality, and thus of rational justification, that Fichte’s transcendental epistemology (...) secures and which his ontology draws on and develops. In particular, his account of the nature of rationality issues in a distinctive form of nonevidentialism, according to which we possess unimpeachable rational grounds, albeit not narrowly evidential ones, for assent to certain metaphysical claims. Allen W. Wood presents the first book-length systematic exposition in English of Fichte's most important ethical work, the System of Ethics. He places this work in the context of Fichte's life and career, of his philosophical system, and in relation to his philosophy of right or justice and politics. Wood discusses Fichte's defense of freedom of the will, his grounding of the moral principle, theory of moral conscience, transcendental deduction of intersubjectivity, and his conception of free rational communication and (...) the rational society. One of Fichte's most important ideas - that nature can place limits on our ability to govern ourselves, and that anyone who values autonomy is thereby committed to the value of basic research and of the development of autonomy-enhancing technologies - has received little attention in the interpretative literature on Fichte, and has little currency in contemporary ethics. This volume aims to address both deficits. Beginning from a reconstruction of Fichte's theory of rational agency, this volume examines his arguments (...) for the thesis that rational agency must have two constitutive ends: substantive and formal independence. It argues for a novel interpretation of Fichte's conception of substantive independence, and shows how Fichte's account of moral duties is derived from the end of substantive independence on that conception. It also argues for a new interpretation of Fichte's conception of formal independence, and explains why the usual understanding of this end as providing direct guidance for action must be mistaken. It encompasses a systematic reconstruction of Fichte's first-order claims in normative ethics and the philosophy of right. (shrink)

Fichte’s Ethical Thought follows a format familiar to those who have read Allen Wood’s books on the ethical thought of Immanuel Kant and G. W. F. Hegel: Wood integrates Johann Gottlieb Fichte’s work into topical chapters, each discussing an important component of Fichte’s ethical system. The text he focuses on, of course, is Fichte’s 1798 System of Ethics, but Fichte scholars will likely be pleased to find that Wood discusses a wide range of Fichte’s Jena-era writings. My aim in this chapter is to address what looks like a tension in Fichte’s derivation of ethical content for the moral law in his System of Ethics. In the first place, Fichte seeks to derive the content of our duties from our “natural drive [Naturtrieb],” which he defines in terms of our striving for enjoyment. But later in the book we find a second argument that derives the content of our duties from what Fichte calls the conditions of (...) our “I-hood [Ichheit],” namely, our embodiment, intelligence, and sociality. I argue that a careful rereading of Fichte’s notion of a natural drive is consistent with this second derivation. The key to this reading lies in Fichte’s effort to reframe the natural drive through the category of “reciprocal interaction [Wechselwirkung],” which allows us to view the natural drive as a “formative drive [Bildungstrieb]” that is both active and passive. For Fichte, the formative drive amounts to a striving for self-organization, and this striving, I argue, prefigures what becomes the ethical drive to engage in reciprocal interaction with other members of the rational community. Recent literature on J. G. Fichte's ethical philosophy has tended to focus on a handful of interpretive issues while simultaneously emphasizing his under-appreciated relevance to contemporary moral theory. In this regard, Kosch's book on Fichte's ethics is similar to other recent publications. In almost every other way, however, it is unique. It is often assumed that Fichte's aim in Part I of the System of Ethics is to provide a deduction of the moral law, the very thing that Kant – after years of unsuccessful attempts – deemed impossible. On this familiar reading, what Kant eventually viewed as an underivable 'fact' (Factum), the authority of the moral law, is what Fichte traces to its highest ground in what he calls the principle of the 'I'. However, scholars have largely overlooked a (...) passage in the System of Ethics where Fichte explicitly invokes Kant's doctrine of the fact of reason with approval, claiming that consciousness of the moral law grounds our belief in freedom (GA I/5:65). On the reading I defend, Fichte's invocation of the Factum is consistent with the structure of Part I when we distinguish (a) the feeling of moral compulsion from (b) the moral law itself. (shrink)

This article considers how the I furnishes a ground for the moral principle’s reality or applicability, or the synthetic unification of the higher and the lower powers of desire, through its originally determined nature. It argues that the nature of I-hood as an immediate unity of seeing and being, an absolute identity of the subjective and objective, is key to securing the moral principle’s applicability. On its basis, Fichte envisages an originally determined system of drives and feelings on the one (...) side, and of ends on the other, in and through which each of our dutiful actions in each given situation is determined. For Fichte, the question of the moral law’s application has more to do with demonstrating the moral law’s applicability as a principium executionis (or what is the same, the real, practical efficacy of reason) than with employing the law as a discursive criterion for deciding whether actions are dutiful or not. On the evening of August 30, 1895, Josiah Royce addressed the Philosophical Union of his alma mater, the University of California at Berkeley, taking as his topic “The Conception of God.” Also speaking that evening were Royce’s former professor, Joseph LeConte, and his former student, Samuel Mezes, but his severest critic at the podium was the organizer of the event, Royce’s friend and rival, George Holmes Howison. In this “battle of the giants,” as the newspaper descriptions characterized it,1 Howison criticized (...) Royce for an inadequate treatment of the individual, person-alist strictures that Royce took to heart. This article shows that Fichte’s ethics and theology in the Jena period are conceived in intimate connection with each other. It explores what Fichte’s theology, as it is promulgated in the “Divine Governance” essay of 1798, might tell us about his account of the ethical law’s material content, as it is expounded in the System of Ethics of the same year. It does so with the aim of defending the standard interpretation of Fichte as a staunch advocate of (...) deontology. From the theological vantage point, a plan for the realization of the final end is laid out in and through the moral world-order. The material of our duty is signified by the place we are assigned in and through the order. On account of our lack of insight into the “higher law” through which our place in the order is determined, no abstract, discursive criterion for what we ought to do here and now is forthcoming. While Fichte characterizes ethically right actions in terms of their tendency to produce the final end, he regards them as being so in an ideal, intelligible world rather than the real, empirical one. This paper examines Fichte's proof of evil in §16 of the System of Ethics. According to the majority of commentators, Fichte was mistaken to consider his proof Kantian in spirit (Piché 1999; Kosch 2006, 2011; Dews 2008; and Breazeale 2014). For rather than locate our propensity to evil in an act of free choice, Fichte locates it in a natural force of inertia. However, the distance between Kant and Fichte begins to close if we read his concept of inertia, (...) not as a material force, but as a tendency to resist the work of agency and autonomy. There are, I argue, both textual and conceptual reasons in support of a figurative interpretation. In the course of presenting these reasons, I also uncover an important insight guiding Fichte's analysis of evil in the System of Ethics: namely, his claim that we can never fully step back from ourselves in reflection. In the concluding sections of the paper, I argue that Fichte's insight may solve a particular skeptical threat facing recent Kantian accounts of normativity. (shrink)

I propose solutions to two longstanding interpretive questions about J.G. Fichte’s 1796–97 Foundations of Natural Right: 1. What does Fichte mean when he describes the theory of right as ‘independent’ of moral theory, and what motivates that independence thesis? 2. What does Fichte mean when he describes requirements of right and the principle of right as ‘hypothetical’ imperatives, and how is that characterization consistent with his claim to have derived the concept of right as a condition of possibility of self-consciousness? (...) Answers to both questions are motivated by an approach to the text that looks at it through the lens of Fichte’s 1798 System of Ethics, into which its results must fit if, as Fichte believes, the possibility of morally sanctioned interactions with others requires standing in some law-governed political relationship with them. I argue that Fichte (rather than Kant or Hegel or some amalgam of the two) was the primary historical model for the ethical standpoint described in Kierkegaard's Either/Or II. I then explain how looking at Kierkegaard's texts with Fichte in mind helps in interpreting the criticism of the ethical standpoint in works like The Sickness unto Death and Concluding Unscientific Postscript, as well as the significance of the discussion of secular ethics in Fear and Trembling. J.G. Fichte’s 1798 System of Ethics is seldom read, despite the fact that it remains, after more than two centuries, one of the most original and insightful efforts at a systematic normative ethical theory on Kantian foundations. Part of the reason for its obscurity lies in the perceived implausibility of Fichte’s account of practical deliberation and of the authority of individual conscience. The view typically attributed to Fichte is a conjunction of four claims: that moral deliberation consists entirely in (...) consultation of one’s conscience; that conscience is a faculty that gives immediate epistemic access to substantive moral truths; that conformity with the verdict of conscience is the sole criterion of the moral worth of actions; and that an individual’s conscientious decision is therefore morally incorrigible. This set of views is indeed implausible; but Fichte in fact held none of them. Hegel was the first to attribute them to him and, incredibly, Hegel’s has remained for 200 years the dominant interpretation, even among scholars of Fichte. In this paper I explain how Fichte actually thought about practical deliberation and the role of conscience, and diagnose the sources of appeal of the Hegelian interpretation. (shrink)
