This paper notes the apparent ineffectiveness of the critical response to competence-based education and training (CBET) and suggests that this results from a failure to correctly isolate CBET's unique, identifying features. It is argued that the prevailing tendency to identify CBET with ‘competence’ is fundamentally mistaken and that the competence approach is more properly characterised in terms of its philosophically naïve methodological strategy. It is suggested that this strategy is based upon untenable assumptions relating to the semantic status of statements (...) of outcome and the epistemological and ontological constructs to which such statements are intended to correspond. Current research findings on metaphor in language and thought may be interpreted as producing a paradox of metaphor; that is, most metaphor is not processed metaphorically by a cross-domain mapping involving some form of comparison. This paradox can be resolved by attending to one crucial aspect of metaphor in communication: the question whether metaphor is used as deliberately metaphorical or not. It is likely that most deliberate metaphor is processed metaphorically (by comparison), as opposed to most nondeliberate metaphor, which may (...) be assumed to be typically not processed metaphorically (that is, by categorization). This resolves the paradox of metaphor because it suggests that all “metaphor in communication” (all deliberate metaphor) is processed metaphorically. Detailed comments are offered on the notion of metaphor deliberateness and on the nature of a three-dimensional model of metaphor in discourse involving metaphor in language, thought, and communication. This article offers a new theory about how using lotteries to distribute scarce benefits satisfies beneficiaries' claims. In the first section of the article I criticize John Broome's view and on the basis of these criticisms set out four desiderata for a philosophically adequate account of claim satisfaction by lottery. In section II I propose and defend a new view called the dual structure view, so called because it posits that claimants have two types of claims in the relevant scarce (...) benefit distribution cases under discussion. This view meets all the desiderata set out in section I. Section III draws out the practical implications of my view for a variety of temporally extended cases, including the distribution of corneas to patients who have suffered corneal degeneration. It is sometimes said that there has been a ‘paradigm shift’ in the field of assessment over the last two or three decades: a new preoccupation with what learners can do, what they know or what they have achieved. It is suggested in this article that this change has precipitated a need to distinguish two conceptually and logically distinct methodological approaches to assessment that have hitherto gone unacknowledged. The upshot, it is argued, is that there appears to be a fundamental (...) confusion at the heart of current policy, a confusion occasioned by the demand to know what learners know and compounded by a failure to recognise what this properly entails for assessment methodology. Despite hundreds of definitions, no consensus exists on a definition of life or on the closely related and problematic definitions of the organism and death. These problems retard practical and theoretical development in, for example, exobiology, artificial life, biology and evolution. This paper suggests improving this situation by basing definitions on a theory of a generalized particle hierarchy. This theory uses the common denominator of the “operator” for a unified ranking of both particles and organisms, from elementary particles to animals (...) with brains. Accordingly, this ranking is called “the operator hierarchy”. This hierarchy allows life to be defined as: matter with the configuration of an operator, and that possesses a complexity equal to, or even higher than the cellular operator. Living is then synonymous with the dynamics of such operators and the word organism refers to a select group of operators that fit the definition of life. The minimum condition defining an organism is its existence as an operator, construction thus being more essential than metabolism, growth or reproduction. In the operator hierarchy, every organism is associated with a specific closure, for example, the nucleus in eukaryotes. This allows death to be defined as: the state in which an organism has lost its closure following irreversible deterioration of its organization. The generality of the operator hierarchy also offers a context to discuss “life as we do not know it”. The paper ends with testing the definition’s practical value with a range of examples. (shrink)

There is currently an unrecognised conflict between the utilitarian nature of the overall NHS and the basic deontology of the doctor-patient interaction. This conflict leads to mistrust and misunderstanding between managers and clinicians. This misunderstanding is bad for both doctors and managers, and also leads to waste of time and resources, and poorer services to patients. The utilitarian thinkers tend to value finite, short term, evidence based technical interventions, delivered according to specifications and contracts. They appear happy to break care (...) up into smaller pieces, which can then be commissioned from multiple providers. The deontological thinkers tend to think about care delivered through a long term continuous relationship, and regard that relationship as therapeutic and salutogenic in itself. To them breaking care up into smaller fragments is a denial of what caring is really about. Very rarely are either or both sides of this debate fully aware of where their powerfully felt and often well argued positions start from. In this paper we offer an appraisal of the strengths and weaknesses of both moral viewpoints as applied in the UK NHS context and we suggest a way in which they can be reconciled, provided neither is pushed too far or too hard against the other. We believe this reconciliation would be good for patients, doctors, managers and improve the service as a whole. (shrink)

Scientific breakthroughs rarely yield the potential to engage a foundational ethical question. Recent studies on direct reprogramming of human skin cells reported by the Yamanaka lab in Japan and the Thomson lab in Wisconsin suggest that scientists may have crossed both a scientific and an ethical threshold. The fascinating science of direct nuclear reprogramming highlights empirical data that may clarify the ontological status of cellular activity in the early stages of what could become a human fetus and justify ethical options (...) for research in this controversial field. The Catholic tradition moors its moral teachings in the constructive interplay between faith and reason, each of which opens itself to the other for insight and enlightenment. The analysis begins with the theoretical realm to discuss the theological foundations and (...) the meaning of Natural Law that guide the Ethical and Religious Directives for Catholic Health Care Services. This stance is then applied to several practical concerns that ethically engage issues surrounding the medicalization of death, including maternal-fetal conflicts, patients approaching the end of life, and after death dilemmas. The flexibility and range of Catholic morality can offer astute guidance not only to those who follow this tradition but also to those with different faith perspectives when they encounter the heart-wrenching dilemmas that medical technology presents around death and dying. This the first part of a study (in two parts) devoted to Piketty’s theses on the history of capitalism. A summary of Pikety’s analysis is first presented, concerning the dynamics of total wealth (measured as a ratio to national income) and its components, and the tendency of wealth and income inequalities within major capitalist countries. The amplitude of the fall of total wealth in the United-Kingdom and France during World War I is questioned. Piketty explains the profile of these variables (...) concerning wealth and wealth inequalities in reference to historical mechanisms in which the rate of growth of output, the rate of savings, and the return on wealth are considered. The relevance of these mechanisms is basically questioned. We interpret the third component of wealth, other domestic capital, as a form of the capital of enterprises and substitute an alternative, more performing, model to account for the profile of this variable. Pour Gérard Raulet, le problème politique le plus urgent qui se pose aux républiques contemporaines, est celui de l’intégration. Face à l’échec de l’institution scolaire pour assumer cette fonction, l’auteur propose une relecture de Kant afin d’approfondir sa réflexion sur la redéfinition de la citoyenneté contemporaine. Contrairement à l’analyse ultra-républicaine qu’il avait faite de cette pensée dans un récent ouvrage, l’auteur prend une position plus modérée et plus pragmatique qu’il nomme le républicanisme authentique. Cette posture idéologique l’amène à relire Kant (...) dans une perspective plus globale. Cette réflexion se termine sur une question politique névralgique : comment les républiques contemporaines peuvent-elle revoir leur politique d’intégration, afin de respecter davantage le droit à la différence, sans mettre en danger l’unité de la nation? Cet article constitue la réponse à une note critique publiée dans le n° 71 d’ Actuel Marx, dans laquelle Fabien Foureault discutait les travaux de G. Duménil et D. Lévy concernant l’actuelle transition entre le capitalisme et un nouveau mode de production, le managérialisme. Le premier argument est le fait que les hauts managers sont rétribués par la distribution de stock-options, considérés comme des revenus du capital par Foureault bien que ces options n’aient pas de rapport avec la détention antérieure (...) d’actions par les bénéficiaires. La forme de la rémunération l’emporte sur les pratiques qui la motivent. Foureault utilise, par ailleurs, les calculs réalisés au sein des Distributional National Accounts qui montrent que la part des revenus du capital au sein du revenu total du 1 % supérieur de la hiérarchie des revenus n’a pas décru. Ces nouvelles estimations sont, pour GD et DL, inutilisables hors des finalités comparatives pour lesquelles elles ont été conçues. Enfin, les auteurs considèrent que Foureault se méprend radicalement quant à la nature de leurs interprétations politiques. (shrink)

S'inspirant essentiellement de la situation institutionnelle de la Communauté française (...) de Belgique, les constats et les questions posées peuvent, mutatis mutandis, trouver un écho réflexif plus large.The article presents the passage, in the field of "arts and popular traditions" and/or of the "ethnological inheritance", of the concept of "popular culture" to the label of "oral and immaterial inheritance" or of "alive treasure". Approaching at the same time disciplinary and institutional dimensions, it invites to question these notional passages as well in their historical inscription as in their definitional complexity and ambiguity or in their scientific and political implications. Being inspired primarily by the institutional situation of the French Community of Belgium, the reports and the questions can, mutatis mutandis, find a reflexive echo broader. (shrink)

The article revisits two basic questions of political theory posed by Jon Elster. First, should the political process be defined as private or public, and second, should its purpose be understood instrumentally or intrinsically? Having posed these questions, Elster arrives at three views of politics: social choice , republican and discourse theory . I argue for a fourth view , and explain Elster's omission of this model by referring to his underlying paradigm of politics, that is, as will formation. The (...) main thesis in Elster's article is about whether the process of will formation should be relegated to the market mechanism or dealt with via deliberative forums. I reject this paradigm and argue instead for politics as jurisdiction. This notion of politics is concerned with the question of how both market and forum processes of will formation should be institutionalized. Defining politics as jurisdiction strongly improves the plausibility of the missing fourth model of democratic will formation, as a depiction of democratic will formation as private in its process and intrinsic in its purpose illustrates the importance of distinguishing between two levels of democracy: namely, the civil level of will formation and the political level of jurisdiction. Lévy reviennent sur les implications de leur analyse du capitalisme managérial pour l’étude du capitalisme historique, de ses structures de classes fondamentales, et de ses alliances de pouvoirs variables. La thèse du marxisme traditionnel identifiant les managers à une fraction de classe capitaliste s’en trouve critiquée, de même que les présupposés véhiculés par le concept (...) de « capitalisme d’État ». Invités à revenir plus précisément sur leur distinction entre modes de production et « ordres sociaux », comme configurations variables de hiérarchies de pouvoirs et d’alliances de classe, les auteurs clarifient les raisons pour lesquelles ils introduisent une nouvelle catégorie de mode de production managérial qui impose de repenser le mode de production capitaliste lui-même suivant une logique de « l’hybridité ». Celle-ci permet de complexifier les tendances du capitalisme historique sur la longue durée, d’approfondir l’analyse de classe du capitalisme managérial, et d’y spécifier différentiellement, par rapport au « compromis » d’après-guerre (caractérisé par une alliance entre managers et classes populaires sous la direction des premiers), le dernier ordre social en date caractérisé par une alliance « au sommet » entre managers et capitalistes (au détriment des classes populaires) : le néolibéralisme. The US economy is not in a permanent crisis since the 1970, although growth rates remain comparatively low and a threat of financial crisis exists, due to domestic factors and risks of contagion from the periphery. The share of military spending in GDP is low, and the US has the capability to finance new wars.
