This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

So far, animals in fables have almost exclusively been studied as symbolic representatives of human behaviour. New perspectives are opened up by Human-Animal Studies which focus on the animals themselves and human-animal relationships. Inspired by this approach, this article examines five fables of Graeco-Roman antiquity which are connected by the motif of the vicious dog. On the basis of philological interpretation it is shown to what extent and with which intention the dogs are anthropomorphised and at the same time represented (...) as real animals. Interestingly, the human protagonists usually don´t blame the dogs and draw a clear borderline between animals and humans. It seems that successful communication is possible only within the same species. (shrink)

While the philosopher Rosi Braidotti sees her own, new materialist work as opposed to the analysis of biopolitics from Heidegger to Agamben, the present contribution establishes a dialogue between these two lineages. Starting with Aristotle’s distinction between zōē and bíos politikos, it puts the analyses of biopolitics in immunitarian modernity in conversation with new materialism conceptualizations of affirmative difference and relationality. Replacing the negative logic of identity/alterity, life/death, dualism or dialectics and desire-as-lack of the Western philosophical and psychoanalytic traditions with (...) human and more-than-human post-individualistic subjectivity as part of a rhizomatic web, NM proposes a groundbreaking shift to post-anthropocentrism. The biopolitical fear of viral contamination cedes to viral contamination as the generative vanishing of borderlines between self and other. In this vital geocentrism marking a new kind of politics, the sym-poetic life force of zōē generates complex allegiances between heterogeneous entities in a shared world. (shrink)

Medical practice is ideally based on robust, relevant research. However, the lack of disease-modifying treatments for Alzheimer’s disease has motivated “innovative practice” to improve patients’ well-being despite insufficient evidence for the regular use of such interventions in health systems treating millions of patients. Innovative or new non-validated practice poses at least three distinct ethical questions: first, about the responsible application of new non-validated practice to individual patients ; second, about the way in which data from new non-validated practice are communicated (...) via the scientific and lay press ; and third, about the prospect of making new non-validated interventions widely available before more definitive testing. We argue that the authors of metabolic enhancement protocols for Alzheimer’s disease have overstated the evidence in favor of these interventions within the scientific and lay press, failing to communicate weaknesses in their data and uncertainty about their conclusions. Such unmeasured language may create false hope, cause financial harm, undermine informed consent, and frustrate the production of generalizable knowledge necessary to face the societal problems posed by this devastating disease. We therefore offer more stringent guidelines for responsible innovation in the treatment of Alzheimer’s disease. (shrink)

Previous conversation analytic studies of institutional interaction included analyses of empathy in interaction. These studies revealed that professionals may use empathy displays not only to validate the client’s worry, but also to perform actions oriented to other institutional goals and tasks such as closing off a troubles-telling sequence. In this article, we present an analysis of empathically designed responses in Dutch telephone counseling. The data consist of 36 calls from the Alcohol and Drugs Info Line. In some of the calls, (...) clients’ troubles-telling includes ‘emotion discourse’, that is, descriptions of their feelings/emotions. Counselors may respond to these descriptions using conventional empathy displays like ‘I can imagine that’ and ‘I understand that’ in a range of verbal and prosodic variations. The analysis reveals that these responses open up advice sequences that vary in the extent to which they treat the client’s articulated feelings as valid. Most are affiliating, treating the client’s feelings as the basis for advice, while some are less affiliative, putting the client’s feelings into perspective or implicitly questioning their legitimacy. Hence, empathically designed responses are pivots to advice-giving. (shrink)

Dabei zeigt sich, daß die Voraussetzung der Intentionalität in der aristotelischen Sachproblematik der Wahrnehmung liegt (De an. 424 al7), die Brentano mit dem scholastischen Begriff obiective interpretiert, einem Terminus, den Brentano von der Neuscholastik, aber auch von Descartes und dem spätmittelalterlichen Konzeptualismus her kannte. Es ist nun entscheidend, daß in dieser Terminologie nur ein sehr eingeschränkter Aspekt (...) der scholastischen Intentionalität thematisch ist, der in seiner internen Problematik den Ansatzpunkt für alle späteren Reinterpretationen abgibt. Aims : The Modified Reasons for Smoking Scale (MRSS) is a widely accepted scale that measures psychological functions of smoking. The scale has been translated in Dutch and has been validated, in order to be used in clinical smoking cessation practice in the Dutch-speaking part of Belgium. This study examined the factorial structure, reliability and validity of the scale in a sample of smokers, who are characterized by a high level of dependence and an explicit motivation to stop smoking. Method (...) : The participants were 383 smokers, who volunteered at the stop-smoking clinic of a Belgian university hospital, and completed the translated scale. They were administered the translated MRSS, the Fagerstrom Test for Nicotine Dependence (FTND). Through a clinical interview, smoking behaviour and smoking history was assessed (daily smoking consumption, years smoking, number of quit attempts, weeks stopped, alcohol and coffee consumption, CO level). Exploratory factor analysis was performed. Internal consistency was studied in order to examine the reliability. The concurrent validity was assessed by means of manova, anova and correlation analysis. Results : Factor analysis identified four factors, named stimulation, pleasure of smoking, social smoking and automatism of smoking. Cronbach's alpha ranged from 0.65 (automatism) to 0.72 (stimulation). manova indicated the influence of the variables age, sex, daily consumption and the FTND (the latter two variables showed a dose-dependent association with each subscale). Regression analysis revealed a relationship with dependence indicators, namely: the daily consumption, the number and duration of previous quit attempts, FTND, CO level and daily coffee intake. Conclusions : The Dutch translation of the MRSS identified four factors and revealed acceptable validity and reliability. The adapted version of the translated scale as a component of the psychological assessment procedure in a smoking cessation treatment in Dutch-speaking areas should be implemented. (shrink)

Borders of the Member States of the European Union and the Schengen area, and more specifically the new procedures applied to protect the European Union’s external borders. Background: The development of the COVID-19 pandemic has prompted the implementation of many procedures to safeguard against further increases in illness. Unfortunately, this has drastically reduced residents’ contact with their families, which has increased feelings of loneliness and isolation. This is particularly difficult in long-term care facilities, where the risk of developing depression is higher than in the general population.Objectives: The aim of the study was to assess the risk of depression among the residents of long-term care institutions in Poland (...) during the COVID-19 pandemic and to determine the relationship between the risk of depression and the occurrence of cognitive impairment in the study group.Methods: The study included 273 residents from long-term care institutions in Poland. The risk of depression was determined based on an originally designed questionnaire. The cognitive state of the subjects was assessed using the screening test Mini-Mental State Examination. Both the depression risk assessment and the MMSE test were conducted twice: in March and December 2020.Results: In March, severe dementia was present in 28.2% of the residents and normal MMSE scores were observed in 16.1% of the subjects; in December, the prevalence of severe dementia increased to 31.1% and that of normal scores decreased to 10.3%. In March, no participant was found to be at high risk of depression and moderate risk was observed in 14.3% of the subjects; in December, 2.6% of the residents had a high risk score and 45.4% had a moderate risk score. Statistical analysis revealed that higher MMSE scores correspond with a higher risk of depression.Conclusion: A higher risk of depression was observed with the development of the pandemic. Residents with cognitive impairment were characterised by a lower risk of depression compared to individuals with normal MMSE scores. During the study, progression of cognitive impairment was observed in the residents. (shrink)

The contemporary sociology of morality is a form of descriptive ethics that shrinks away from any sort of prescriptive ethics. Building on the moral philosophies of John Dewey, and also of Alasdair MacIntyre and Paul Ricoeur, and in dialogue with recent work by Stefan Bargheer, this article proposes a more ambitious program of critical social ethics that connects concerns with character and the common good but tempers them with attention to alienation and oppression.
