Die erst im Juli 1980 gefundene, bis dahin gänzlich unbekannte Kolleghandschrift von Krause aus dem Wintersemester 1798/99 erweitert den Wissensstand um die Entwicklung der Philosophie Fichtes zwischen den Jahren 1795 und 1800 in einem erheblichen Maße und markiert eine Zäsur: Fichte scheidet die Philosophie nicht mehr in Theorie und Praxis, sondern faßt sie als eine, als Philosophie überhaupt.

Im "System der Sittenlehre" fand Fichtes praktische Philosophie im direkten Anschluß an die Wissenschaftslehre von 1794 ihre vollendete Gestalt. Fichtes theoretischer Ansatz bietet den bis heute einzigen methodisch konsistenten Versuch einer Letztbegründung des Sollens als Beweis der sittlichen Freiheit des Einzelnen.

This article provides an original reappraisal of the notion of Minnemystik in the work of the 13th-century Flemish beguine Hadewijch of Antwerp, with specific reference to its Trinitarian and Christological orientations. After an introduction to the nature and origins of Hadewijch’s work, relating to the discovery of four extant manuscripts in Belgium in 1838, followed by an elucidation of the experience-driven epistemology of the Victorians Richard of St Victor and Hugo of St Victor as her key early scholastic influences, Hadewijch’s (...) Minnemystik is distinguished from Wesenmystik, as encountered in the mystical work of her French contemporary and beguine counterpart, Marguerite Porete. From this discursive basis, Hadewijch’s Minnemystik is reassessed and represented as pertinently Trinitarian and Christological in orientation, and therefore as a theological presentation from the 13th century. Like biological species, languages change over time. As noted by Darwin, there are many parallels between language evolution and biological evolution. Insights into these parallels have also undergone change in the past 150 years. Just like genes, words change over time, and language evolution can be likened to genome evolution accordingly, but what kind of evolution? There are fundamental differences between eukaryotic and prokaryotic evolution. In the former, natural variation entails the gradual accumulation of minor mutations in alleles. In the (...) latter, lateral gene transfer is an integral mechanism of natural variation. The study of language evolution using biological methods has attracted much interest of late, most approaches focusing on language tree construction. These approaches may underestimate the important role that borrowing plays in language evolution. Si l’on connaît aujourd’hui le dialogue fructueux que Paul Ricœur a noué avec les penseurs structuralistes, on ignore largement son positionnement face à la mouvance poststructuraliste. Faut-il opposer la philosophie de Ricœur au poststructuralisme à la française ou au contraire doit-on montrer qu’elle en est une variante singulière? C’est la seconde option qui est ici défendue. Certes, le poststructuralisme ne doit pas être considéré comme une école de pensée mais comme une reconstruction qui relève de l’histoire de la philosophie. Dans (...) la mesure où les horizons de dépassement du structuralisme ont été posés de manière chaque fois particulière, il est préférable de parler de poststructuralismes au pluriel. C’est la raison pour laquelle J. Michel propose des confrontations dyadiques entre Ricœur et certains de ses contemporains que l’on regroupe habituellement dans cette mouvance. (shrink)

This article is part of a research project, Conversations after God. The focus of this article is to reflect on the theory and methodology of practical theology in a post-metaphysical context. It will be suggested that practical theology can redefine itself as public theology, but specifically as Christology by engaging the public texts within their contexts, but from a Christ-science hermeneutical approach. The proposed approach is a hermeneutical approach where the Christ-Ereignis guides the inner- and inter-textual reading of texts within (...) contexts. This Christ-Ereignis cannot be translated into a science or even a definable philosophy and therefore the logos is crossed out. Christology, as public theology is done from the margins of the dominant discourses and therefore it could be seen as a Christology from the margins of the market to create spaces of kingdom life: life in fullness. Foucault’s sodomite’: Damian’s Liber gomorrhianus (1049) reopened. Taking Michel Foucault’s famous statement about the difference between the ‘Medieval sodomite’ and the heteronormative ‘19th century homosexual’ as its cue, this article surveys the discursive source of that statement in the work of Peter Damian (1007–1072) with regard to his obscure, yet consequential text, Liber gomorrhianus (presented in 1049 to Pope Leo IX, preceding the Council of Reims). Drawing on the recent research by Ranft and because Damian is such an understated figure (...) in the corpus of Medieval philosophy, an overview of Damian’s life and work is presented, especially in terms of Damian’s 11th century reforming labour ethics. Only then the article proceeds to reopen Damian’s text, indicating that the ‘Medieval sodomite’ is far removed from an elementary precursor to the modern scientia sexualis homosexual, but is indeed presented by Damian as a complex and gender-inclusive licentious person, within the context of the disintegration of sexual morality (especially within the domains of celibacy and confession) in the middle to late 11th century church and monasteries. Cross-referencing the own translation of the Latin text with the translation of Payer, the article disseminates and critiques the key concepts in Damian’s argument for the summarily deposition of lapsi [fallen priests] and the expulsion of promiscuous monks (and nuns) from the orders, especially with regard to Damian’s concepts of contra-natural and irrational fornication. Pope Leo’s deeply pastoral and insightful answer to Damian ( Ad splendidum nitentis ) is presented in the last part of the article, including his sanctioning of Damian’s complex concept of sodomy, which on that ground, became the conceptual source for the council of Reims (1049), and subsequent Medieval councils dealing with the ‘problem of sodomy’ in the church and monasteries. The canons of those councils were indeed the source of Foucault’s analysis of Medieval sexuality – yet the more fundamental source was Damian’s obscure text. (shrink)

A seminal figure in the philosophy of history, culture, and language, Johann Gottfried Herder also produced some of the most important and original works in the history of aesthetic theory. A student of Kant, he spent much of his life striving to reconcile the opposing poles of Enlightenment thought represented by his early mentors. His ideas influenced Hegel, Schleiermacher, Nietzsche, Dilthey, J. S. Mill, and Goethe. This book presents most of Herder's important writings on aesthetics, including the main sections (...) of one of his major untranslated works, Kritische Wälder. These notes, essays, and treatises, the majority of which appear here in English for the first time, show this idiosyncratic thinker both deeply rooted in the controversies of his day and pointing the way to future developments in aesthetics. Chosen to reflect the extent and diversity of Herder's concerns, the texts cover such topics as the psychology and physiology of aesthetic perception, the classification of the arts, taste, Shakespeare, the classical tradition, and the relationship between art and morality. Few thinkers have reflected so sensitively and productively on the cultural, historical, anthropological, ethical, and theological dimensions of art and the creative process. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

The objective of this article is to present an overview, based on the most recent specialist research, of Neoplatonist developments in the Cologne tradition of the later Middle Ages, with specific reference to a unique Proclian commentary presented by the German Albertist Dominican, Berthold of Moosburg (ca. 1300–1361). Situating Berthold in the post-Eckhart Dominican crisis of the 1340s and 1350s, his rehabilitating initiative of presenting this extensive (nine-volume) commentary on the Neoplatonist Proclus Lycaeus’ (412–485) Elements of Theology in his Expositio (...) super Elementationem theologicam Procli, the only of its kind from the Middle Ages, is contextualised with reference to Berthold’s discursive indebtedness to his Dominican predecessors, Albert the Great (ca. 1200–1280), Ulrich of Strasbourg (ca. 1220–1277) and Dietrich of Freiberg (ca.1250 – ca.1310), as well as two Dutch-Cologne successors, the Albertist Heymeric of Camp (1395–1460) and the Carthusian Thomist Denys de Leeuwis (1402–1471). Berthold’s unique contribution to the philosophical discourse of the Middle Ages is indicated therein that the Expositio provided a synthesis of the late Medieval version of Neoplatonism and contemporaneous German–Dominican theories. By contextualising the work of his Cologne predecessors and successors in the broad idea-historical landscape of antiquity and Neoplatonism, the article argues that Berthold succeeded in linking the Neoplatonic legacy with Cologne Albertism and provided an impetus for the overall consolidating ability of the Cologne tradition. By juxtaposing Berthold and his Expositio with the more conventional legacies of Ulrich, Dietrich, Heymeric and Denys, this exceptional Latin-Western intellectual tradition from Cologne is expanded and enriched with regard to its notable Neoplatonic contributions to philosophy in the later Middle Ages. The article examines how Gadamer reads, interprets and critiques Dilthey inTruth and Method. The author proposes to reconstruct this reading, placing it the contemporary hermeneutic debate, according to three transversal views : first relative to Dilthey’s position in the history of hermeneutics ; second relative to the criticism of methodological hermeneutics ; and third relative to the diltheyen contribution to a philosophy of life. The main thesis is that Gadamer’s relation to Dilthey is not univocal, even if Dilthey is quite (...) central to appreciate the scope ofTruth and Method. There is a problem of Diltheyenne inspiration that animates the project of this work — through a questioning on the foundation of the sciences of the spirit — but Gadamer gives a response of Heideggerian inspiration. The process of applying the law tends to oscillate between two modes: the subsumption under “clear” rules on the one hand and the interpretative concretisation of vague and abstract blanket clauses on the other. Legal arguments therefore refer both to the semantic content of rules and to legal self-evidence. Consequently the application of law can effectively be influenced not only through new legislation, but also through the introduction of new inter-preters bringing with them a different set of preconceptions, and thus (...) differing interpretations of the law. The traditional balance between these two models of control is endangered in mul-ticultural societies since these societies are characterised by conflicting concepts of justice. An automated application of law, aspired to by many legal scholars, could dispense legal practice from such conflicting prejudices. The price for that gain, however, would likely be a loss of the rule of law in the general understanding. (shrink)

Johann Christoph Gottsched is considered to be one of the greatest scholars of the Early German Enlightenment. As a professor for poetics in Leipzig, he worked towards a reformation of the German language and a renaissance in German drama. His extensive correspondence and social contacts made him a ‚European event‘ and his papers are being presented here in a standard edition: 25 volumes, approx. 6,000 letters to and from Gottsched, predominantly in German, are being published with a critical apparatus (...) and an academic commentary. This edition is being published in co-operation with the Saxonian Academy of Sciences and edited by members of the academy. The edition is scheduled to be published over 25 years and offers an ideal addition to the multi-volume edition of Gottsched's works, already published by de Gruyter. (shrink)

English summary: In 1775, Tetens had already attempted to consolidate metaphysics - even before such contemporaries as Lambert and Kant. By drawing on empiristic as well as rationalistic traditions, he developed the idea of a philosophical Grundwissenschaft (universal foundational science) and explains the necessity, goals and form of this. This volume is not only useful for those doing research on Tetens; it is also a key to late Enlightenment philosophy in Germany in the 18th century. This new edition, with a (...) text-critical apparatus and explanations of the subjects provides a revised text. It contains contemporary recensions, a comprehensive Tetens bibliography as well as material on his life and work, among which is a list of Tetens' lectures along with compendia of these.
