This paper postulates that the proper function of tort law is to provide protection from, and redress of, non-consensual invasions of individual rights of person and property. It then proceeds to analyze and criticize, in that context, several theories of the law of unintentional torts including traditional English negligence law and the models of Posner, Fletcher and Epstein. That analysis proceeds in terms of the answers of each theory to a uniform set of questions which must be answered by any (...) theory of the law of unintentional harms. The paper concludes that none of the theories examined is rights-based or, indeed, consistent with the existence of individual rights of person and property.The paper goes on to elucidate a theory of liability which is rights-based. That theory turns out to be variant of traditional English negligence law in which reasonable foreseeability of harm to legally recognized rights or interests is the sole criterion of liability, the burden of precautions on the agent of the harm being explicitly excluded from consideration. Whether through concrete references to the meaning and working of money, or in attempting to give a fuller understanding of work or of the significance of market economics in our time, Steiner shows himself to be well versed in the subject. Gary Steiner argues that ethologists and philosophers in the analytic and continental traditions have largely failed to advance an adequate explanation of animal behavior. Critically engaging the positions of Marc Hauser, Daniel Dennett, Donald Davidson, John Searle, Martin Heidegger, and Hans-Georg Gadamer, among others, Steiner shows how the Western philosophical tradition has forced animals into human experiential categories in order to make sense of their cognitive abilities and moral status and how desperately we need a new approach to (...) animal rights. Steiner rejects the traditional assumption that a lack of formal rationality confers an inferior moral status on animals vis-à-vis human beings. Instead, he offers an associationist view of animal cognition in which animals grasp and adapt to their environments without employing concepts or intentionality. Instead, he advocates a "cosmic holism" that attributes a moral status to animals equivalent to that of people. In _Animals and the Limits of Postmodernism_, Gary Steiner illuminates postmodernism's inability to produce viable ethical and political principles. Ethics requires notions of self, agency, and value that are not available to postmodernists. Thus, much of what is published under the rubric of postmodernist theory lacks a proper basis for a systematic engagement with ethics. Steiner demonstrates this through a provocative critique of postmodernist approaches to the moral status of animals, set against the background of a broader indictment (...) of postmodernism's failure to establish clear principles for action. He revisits the ideas of Derrida, Foucault, Nietzsche, and Heidegger, together with recent work by their American interpreters, and shows that the basic terms of postmodern thought are incompatible with definitive claims about the moral status of animals--as well as humans. Steiner also identifies the failures of liberal humanist thought in regards to this same moral dilemma, and he encourages a rethinking of humanist ideas in a way that avoids the anthropocentric limitations of traditional humanist thought. I propose a systematic survey of the various attitudes proponents of enaction (or enactivism) entertained or are entertaining towards representationalism and towards the use of the concept “mental representation” in cognitive science. For the sake of clarity, a set of distinctions between different varieties of representationalism and anti-representationalism are presented. I also recapitulate and discuss some anti-representationalist trends and strategies one can find the enactive literature, before focusing on some possible limitations of eliminativist versions of enactive anti-representationalism. Rudolf Steiner's vision of art, as with all forms of human expression, is that it should reflect our human experience of the Divine. This was not intended to suggest vague, mystical fantasy. As one of the few true initiates of the twentieth century, he was able to experience the realms from which humanity and all nature descend into temporal and spatial existence. He was able to speak with confidence of the qualitative and dynamic worlds of soul and spirit, from (...) which all the phenomena we experience spring, including our individual existence. The means by which the living nature of these realms can be expressed is not through rationally expressed concepts--which point only to the material, quantitative perceptions from which they are derived--but through the various forms and languages of art. Through art, human beings express the qualitative experiences of life. But Steiner goes even further. In the more recent history of art, especially that of the West, artistic expression has become less a product of spiritual inspiration and more the expression of personal experience, which is identified with materialistic existence. Naturalistic and realistic representations of the physical world are devoid of spiritual expression. As humanity has descended into a materialized, spiritually void experience of life, art has followed that trend. Today, it is little more than expressions of subjective, sensory views of the world. Modern nonrepresentational art, on the other hand, is an instinctive backlash against that trend, but does not get beyond personal expression. Contemporary art remains sadly isolated from the source of its own being: the world of soul and spirit. Steiner, however, attempts to unite personal human experience with the spiritual source of art, so that artists are spiritually conscious of the realm from which inspired expression descends into human existence. Such artists are neither isolated from the spirit, nor do they act as automatic mediumistic channels, but as a conscious and cooperative instruments of spirit. Human consciousness must come to truly sense some experience of spirit before real progress in art can occur, and this is what Steiner tries to help artists achieve in the lectures and writings collected in this volume. In this chapter, I pursue two aims. Firstly, I propose an original survey and analysis of the way proponents of 4E cognition have until now defined the relations between normativity and cognitive science. A first distinction is made between making normativity an explanandum of 4E cognitive science, and turning normativity into a property or part of the explanantia of 4E cognitive science. Inside of the latter option, one must distinguish between methodological, ontological and semantic claims on the value of normativity (...) for studying and defining cognitive phenomena. The second aim of the paper consists in developing the further claim that normativity is an essential property of daily intentional concepts and of scientific concepts. I show how 4E cognition might further develop this latter claim in the context of recent debates about cognitive ontologies in neuroscience. (shrink)

In a recent review essay of a two volume anthology on left-libertarianism (edited by two of us), Barbara Fried has insightfully laid out most of the core issues that confront left-libertarianism. We are each left-libertarians, and we would like to take this opportunity to address some of the general issues that she raises. We shall focus, as Fried does much of the time, on the question of whether left-libertarianism is a well-defined and distinct alternative to existing forms of liberal egalitarianism. (...) In order to account for how organisms can apprehend the contents of the external representations they manipulate in cognizing, the endorsement of representationalism fosters a situation of what I call cognitive overdetermination. I argue that this situation is problematic for the inclusion of these external representations in cognitive processing, as the hypothesis of extended cognition would like to have it. Since that situation arises from a commitment to representationalism (even minimal), it only affects the viability of representationalist versions of extended (...) cognition. (shrink)
