This project will track and explain the development of the Doctrine of Divine Immutability from early mythological and scriptural source material that seems to indicate that divine entities are changeable into metaphysical systems that demand a perfectly consistent deity. The Doctrine of Divine Immutability is a philosophical and theological postulate that has long been a staple of systematic metaphysics and theology, but its function in robust and fully formed systems is different than its function when it is first generated in (...) Ancient Greece and Judah. Methodologically mostly primary sources are studied and compared with interpretive help from relevant secondary sources. Once the generation and evolution of this doctrine is understood, a more holistic understanding of the relationship between religion and philosophy will be evident. Additionally a more robust understanding of Middle Platonism and 1st and 2nd century Christianity and their relationship to Roman Stoicism will be achieved. Of particular importance to contemporary scholarship this work will allow us to understand the doctrine in its context and will shield us from anachronistic readings of the arguments that are bound to cause fundamental errors in scholarship. In this paper, I aim to show that agency-based accounts of moral status are more plausible than many have previously thought. I do this by developing a novel account of moral status that takes agency, understood as the capacity for intentional action, to be the necessary and sufficient condition for the possession of moral status. This account also suggests that the capacities required for sentience entail the possession of agency, and the capacities required for agency, entail the possession of sentience. (...) Thus on this account sentient beings possess agency and agents possess sentience. If this is correct, it will show that an Agency Account of moral status can offer a plausible defence of the moral status of all sentient beings, something that previous Agency Accounts have not succeeded in doing. What is more, this account could establish that all sentient animals are not just moral status holders per se, but that they are owed pro tanto obligations regarding continued existence and liberty, similar in kind, though not always in strength, to those owed to humans. Critics of so-called ideal theory argue that prevailing liberal egalitarian principles were constructed under idealized assumptions and thus are ill suited to real-world circumstances where such assumptions do not apply. Specifically, they raise three related objections: ideal theory cannot help us understand current injustices in the actual, nonideal world, ideal principles are not sufficiently action-guiding, and ideal theory tends to reflect and perpetuate unjust group privilege. This chapter explores recent philosophical work on immigration in light of these criticisms. I argue (...) that prominent arguments on both sides of the open borders debate are subject to the standard criticisms of ideal theory and thus that a nonideal approach to migration justice is urgently needed. Wellman argues that legitimate states have a presumptive right to close their borders, excluding all prospective immigrants. He maintains that this right is not outweighed by egalitarian considerations because societies can fulfill their duties to outsiders by transferring aid instead of opening borders. I argue that societies cannot discharge their egalitarian duties by providing aid in at least two cases: when opening borders is the only way to fulfill these duties, and when transferring aid is inconsistent with egalitarian commitments. I (...) also consider additional, non-egalitarian moral considerations that may justify a duty to maintain open borders. This book is meant to be a primer, that is, an introduction, to probability logic, a subject that appears to be in its infancy. Probability logic is a subject envisioned by Hans Reichenbach and largely created by Adams. It treats conditionals as bearers of conditional probabilities and discusses an appropriate sense of validity for arguments such conditionals, as well as ordinary statements as premisses. This is a clear well-written text on the subject of probability logic, suitable for advanced undergraduates or (...) graduates, but also of interest to professional philosophers. There are well-thought-out exercises, and a number of advanced topics treated in appendices, while some are brought up in exercises and some are alluded to only in footnotes. By this means, it is hoped that the reader will at least be made aware of most of the important ramifications of the subject and its tie-ins with current research, and will have some indications concerning recent and relevant literature. Over the past decade, the increased involvement of local police in facilitating the deportation of undocumented migrants has played a central role in creating a record-breaking volume of deportations from the United States. In response to this so-called deportation crisis, nearly 600 localities have enacted sanctuary policies that limit their cooperation with federal authorities on immigration matters. This paper explores three moral justifications for sanctuary policies: the public safety, civil disobedience, and collective resistance arguments. Specifically, it addresses two questions: Which (...) justifications are available for which types of sanctuary policies? What must these justifications accomplish in order to be successful? I argue that although common public safety considerations can justify some sanctuary policies, others are best understood as a form of legitimate collective resistance. (shrink)

The prevalent views of animal liberty among animal advocates suggest that liberty is merely instrumentally valuable and invasive paternalism is justified. In contrast to this popular view, I argue that liberty is intrinsically good for animals. I suggest that animal well-being is best accommodated by an Objective List Theory and that liberty is an irreducible component of animal well-being. As such, I argue that it is good for animals to possess liberty even if possessing liberty does not contribute towards their (...) subjective well-being, and even in some cases where it has a negative effect upon their subjective well-being. To establish this view I argue that if animals are agents, as I assume they are, then like humans they must be able to determine the course of their own lives (to some extent). Further, having the opportunity to self-determine one’s life just is the very same thing as liberty, and having the opportunity to determine the course of one’s life is intrinsically good. Thus liberty has intrinsic value for humans and animals. So, in addition to the instrumental harms of having one’s liberty restricted, I claim that restricting animals’ liberty in principle harms them because it undermines their capacity for self-determination and fails to acknowledge their authority as agents to make their own choices. In it, I articulate a version of the principle and provide what appears to be a novel argument in favour of it. The argument relies on a thought experiment where, intuitively, an agent’s confidence in any particular outcome being true should decrease with the addition of outcomes to the relevant space of possible outcomes. Put simply: (...) the greater the number of outcomes, the weaker your confidence should be in any one of those outcomes. The argument holds that this intuition favours the principle of indifference. I point out that, in contrast, the intuition is also incompatible with a major alternative to the principle which prescribes imprecise credences: the so-called wide interval view. In the moral vacuum and world of shifting values following World War I, Aldous Huxley was both a sensitive reflector and an articulate catalyst. This work provides a highly illuminating analysis of Huxley's evolution from skeptic to mystic. During communication, the interpretation of utterances is sensitive to a listener's probabilistic prior beliefs. In this paper, we focus on the influence of prior beliefs on so‐called exhaustivity interpretations, whereby a sentence such as Mary came is understood to mean that only Mary came. Two theoretical origins for exhaustivity effects have been proposed in the previous literature. On the one hand are perspectives that view these inferences as the result of a purely pragmatic process (as in the classical Gricean view, (...) and more recent Bayesian approaches); on the other hand are proposals that treat them as the result of an encapsulated semantic mechanism (Chierchia, Fox & Spector 2012). We gain traction on adjudicating between these two approaches with new theoretical and experimental evidence, focusing on the behavior of different models for exhaustivity effects, all of which fit under the Rational Speech Act modeling framework (RSA, Frank & Goodman, 2012). Some (but not all!) of these models include an encapsulated semantic mechanism. Theoretically, we demonstrate that many RSA models predict not only exhaustivity, but also anti‐exhaustivity, whereby “Mary came” would convey that Mary and someone else came. We evaluate these models against data obtained in a new study which tested the effects of prior beliefs on both production and comprehension, improving on previous empirical work. We find that the models which have the best fit to human behavior include an encapsulated exhaustivity mechanism. We conclude that, on the one hand, in the division of labor between semantics and pragmatics, semantics plays a larger role than is often thought, but, on the other hand, the tradeoff between informativity and cost which characterizes all RSA models does play a central role for genuine pragmatic effects. Like many recent works in legal theory, especially those focusing on the apparently conflicting schools of legal positivism and natural law, Waluchow’s Inclusive Legal Positivism begins by admitting a degree of perplexity about the field; indeed, he suggests that the field has fallen into “chaos”. Disturbingly, those working within legal theory appear most uncertain about what the tasks of their field are. Legal philosophers often seem to suspect strongly that at least their colleagues in the field are confused about those (...) tasks. As a result, many recent books in legal theory are in large part exercises in legal metatheory, devoting many pages to attempts to define the purposes and goals of the field. Waluchow follows this trend and begins by expressing a desire to clarify the issues that separate those trying to give an account of the nature of law. His ultimate goal is to defend a version of legal positivism, inclusive legal positivism, that he thinks is at least implicit in H. L. A. Hart’s work. (shrink)

The ethics of immigration has emerged as a topic of considerable interest among political philosophers. The subject includes normative questions related to various dimensions of global migration, including territorial admissions, admission to citizenship, and the rights and duties of noncitizen residents. The central issue in these debates is whether liberal democratic states have a moral right to restrict immigration. On one side of the issue, philosophers argue that states have a moral right to exclude immigrants in most cases. On the (...) other, proponents insist that a commitment to fundamental liberal values, such as freedom and equality, requires states to maintain mostly open borders. This essay attempts to interpret John Rawls's concept of the state in his "Theory of Justice". His concept is not an analysis of the existing monopoly capitalist state. Such an analysis can be found in, for example, "The Fiscal Crisis of the State" by James O'Connor. Rawls's concept is, by contrast, not one of the actual state but of an idealized state. Ideals, though, touch reality at some point. At what point does Rawls's concept of the state touch reality? The (...) market is the key to a realistic interpretation of Rawls's concept of the state. His view of the market is even at the basis of his renowned principles of justice. The 'efficiency' and 'freedom' of the market are prized by Rawls and other liberal theorists. Income inequality and large capital concentration threaten these prized virtues of the market. Rawls requires a strongly interventionist state to counteract the dangers of monopoly. His idealized state intervenes, not to promote concentration in the manner of the monopoly capitalist state, but to promote greater equality. This equality is needed if the market is to display efficiency and freedom. It is through this intervention that the state promotes justice. Properly interpreted, the assurance problem on which Rawls bases the need for the state arises from market tendencies. The market enables initial advantages to be increased. This is ultimately why people with advantages support the market, whether the context is private ownership or bureaucratic control within so-called market socialism. The inequality resulting from increasing initial advantages interferes with efficiency and freedom. Rawls's state intervenes to preserve the market while restraining it. This can be seen as an attempt to preserve class society from itself. Consequently, Rawls's conception of justice is founded on classes. (shrink)

Two early drafts of the Essay have survived, one in the commonplace book Adversaria 1661, and the other in loose gatherings of leaves subsequently bound together into one volume by the Bodleian Library. Though both works were given titles by John Locke, they are now invariably known as Draft A and Draft B. Both manuscripts are in Locke's hand. Locke seems to have been doing further work on the Essay while in France. Draft C is very different from Drafts A (...) and B in one important respect. They are true drafts, written in Locke's own hand. The broad organization of Draft C is very similar to that of the published Essay, both (unlike Drafts A and B) being divided into books and chapters.
