El estudio acerca de la influencia de las pasiones en el voluntario libre ha sido recurrente en la tradición tomista. Sin embargo, las causas de los dos efectos psicológicos de la intentio volitiva mencionados por Tomás de Aquino, la redundantia y la distractio, pasaron desapercibidas, y podrían aclarar algunos comportamientos consecuencia de la dinámica de las pasiones del hombre. La acción de la intentio volitiva originada por los afectos, al alcanzar cierto grado de intensidad, puede llegar a sobrepasar el control (...) de la voluntad y la inteligencia. Además, otro punto original de esta temática es que, a la par que el influjo de “abajo hacia arriba” (pasiones hacia la voluntad) —algo ya mencionado por Aristóteles cuando habla de la intemperancia y por los medievales en el estudio de la voluntad—, también puede detectarse otro de “arriba hacia abajo” (influjos afectivos superiores que influyen en la inteligencia —conocimiento afectivo⎯ y ésta sobre la voluntad), de tal manera que cierto tipo de concentraciones psicológicas hacen que la persona deje de tener sensaciones somáticas hasta producirse en él evasiones temporales, trances inconscientes y efectos extremos similares. Finalmente, desde el punto de vista de la Historia de la Filosofía, este trabajo también muestra que ha habido un olvido en el estudio de esta faceta volitiva de la intentio, ya que se ha estudiado sobre todo su aspecto ético, pero sin relación con la intentio cognoscitiva (“intencionalidad”). En cualquier caso, las tesis sobre la intentio y sus efectos muestran cómo es preciso rebasar el estudio del ámbito natural-biológico para completarlo con el ámbito personal-cultural. (shrink)

Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Este artigo propõe a discussão da educação escolar tomando como ponto de partida a burocracia, a racionalidade e o conceito de desencantamento do mundo proposto por Max Weber. Por fim, discutimos os impactos para a subjetividade dos principais envolvidos no processo educacional – professor e aluno – para sinalizar possíveis movimentos que tornem mais dinâmica as relações humanas na educação institucionalizada.

Resumen: Este artículo tiene como objetivo ofrecer al lector un análisis de las figuras antropomorfas conocidas como dogū, que fueron elaboradas durante el período Jōmon de la prehistoria japonesa. Para ello, en primer lugar, será necesario esclarecer sus orígenes y evolución a partir del conocimiento arqueológico acumulado hasta la actualidad, que pondrá de relieve un proceso gradual de complejización tipológica, desde formas primarías hasta un intento de trascender la representación del cuerpo humano. Al mismo tiempo, también se deberá prestar atención (...) a su diversidad sincrónica, marcada por diferentes tipos con una mayor o menor presencia en el marco espacial del archipiélago. Esta labor permitirá no sólo delimitar las diferentes etapas protagonizadas por estas figuras, sino también esclarecer su posible significado y uso. In this paper, I aim to discuss New Political Economy as a label for the economic analysis of politics, in the English language. The term 'political economy' itself, although it has ceased to be the preferred term by which economists refer to their discipline, it is still being used by a variety of scholars, especially for interdisciplinary research with political science, international relations and other social sciences. Marxist- inspired social scientists also have a claim on the term 'political economy'. The (...) term gained relevance again with economists, in the 1950s, thanks to various critiques of orthodox economics, especially to the theory of economic policy and to economic planning. They ignored issues of political economy, such as the self- interest of politicians. The public choice movement revived these issues by applying rational choice theory to politics and preferred the label “public choice” to designate its movement. Scholars and traditions not affiliated with the public choice movement prefer the label '(new) political economy' to refer to their own economic analysis of politics. The search for a proper label is still ongoing, but they show how they can differentiate their objectives and affiliations. (shrink)

Lukács, crítica esta que se apóia na rejeição de um método que deixa de prestar contas ao ser e que, por isso, acaba lidando com a identidade entre conhecimento e ser como uma mera postulação abstrata.: This paper discusses István Mészáros critique of Hegel’s Logic. We point out how Marxism criticizes the presuppositionless thinkingand self-constituted circle of reasoning of the Science of logic. We thereby show the difference between the Hegelian and Marxist ways of conceiving the rooting of knowledge in the process of real life. We also discuss how Mészáros made a scathing critique of the hypostatization of dialectical method in Lukács work. This critique is based on the rejection of a method that fails to be accountable to the real world and therefore ends up treating the identity of knowledge and being as a mere abstract postulation. The objective of this article is to analyse cultural influences when French companies cooperate with Mexican companies (subsidiaries of the French, established in Mexico) in the field of automotive manufacturing. An OEM supplier and a final assembly plant were selected to perform the study. Interviews with the workers, supervisors and managers have been performed. Case studies were collected in order to analyse the problems and to illustrate technical as well as cultural solutions. The analysis showed that important differences and coincidences (...) in the manufacturing solutions could be explained from the cultural (French and Mexican) standpoint. The conclusions integrate some recommendations for French and Mexican companies that are in actual cooperation or that are planning to globalise in the corresponding countries. (shrink)

DIREITO À INFORMAÇÃO NAS RELAÇÕES DE CONSUMO DE PRODUTOS ALIMENTÍCIOS NO ATACADO E NO VAREJO: PARTICULARIDADES SOBRE COMPOSIÇÃO, CARACTERÍSTICAS, PREÇO E QUANTIDADE DO PRODUTO.

Presentism is the view that only present entities exist. Recently, several authors have asked the question whether presentism is able to account for cross-time relations, i.e., roughly, relations between entities existing at different times. In this paper I claim that this question is to be answered in the affirmative. To make this claim plausible, I consider four types of cross-time relation and show how each can be accommodated without difficulty within the metaphysical framework of presentism.

The search for mechanisms has been a common practice in scientific research. However, since the empiricist critique of causality, and especially during the second third of the twentieth century, other non-mechanistic perspectives—especially deductivism—gained predominance. But the sustained effort of authors such as Michael Scriven, Mario Bunge and especially Wesley Salmon contributed to restoring the respectability of causality and mechanisms in philosophy of science. Some members of the causal family, usually lumped under the name of “new mechanistic philosophy”, emphasize the description (...) of mechanisms, especially causal ones, as a central aspect of explanation and other research practices in several areas of science. This approach offers viable solutions to the various ontological and methodological objections that are opposed to the two traditional approaches. In this work the basic characteristics of three philosophies that highlight the description of mechanisms as a central element to explanation and their suitability for the science of ecology are discussed. Little is known about employee reactions in the form of un/ethical behavior to perceived acts of unfairness toward their peers perpetrated by the supervisor. Based on prior work suggesting that third parties also make fairness judgments and respond to the way employees are treated, this study first suggests that perceptions of interactional justice for peers (IJP) lead employees to two different responses to injustice at work: deviant workplace behaviors (DWBs) and organizational citizenship behaviors (OCBs). Second, based on prior literature pointing (...) to supervisors as among the most important sources of moral guidance at work, a mediating role is proposed for ethical leadership. The article suggests that supervisors who inflict acts of injustice on staff will be perceived as unethical leaders, and that these perceptions would explain why employees react to IJP in the form of deviance (DWBs) and citizenship (OCBs). Data were collected from 204 hotel employees. Results of structural equation modeling demonstrate that DWBs and OCBs are substantive reactions to IJP, whereas ethical leadership significantly mediates reactions in the form of DWBs and OCBs. Behavioral ethics and managerial implications are discussed. (shrink)

The society is in a constant transformation caused by changes in people´s mentality that, as time goes by, feel the necessity and will learn how to question, from the most simple things of life to the most complex ones, which were formerly imposed and accepted by all. With time, something that became an object of investigation is faith. Through reason, several questions are asked with the intention to solve the mysteries of faith. It is certainly true that such questions produce (...) evolution and maturing in the construction of the thinking process, however, to which point is this faith beneficial or has a tendency to lead to a skepticism? The subject of this work is faith and reason, aiming to explore where it is reconcilable that the two may walk together, without reason interfering negatively. As an objective, explore the benefits that reason brings to faith, and which are the negative impacts that it can produce, besides defining what is faith and reason, demonstrating how through time reason started to make part of the society. As a conclusion, we try to show that reason and faith are two realities that are not opposed to each other, but both must walk together in the search of the truth. The absolutization of the reason can lead to a skepticism that ignores basic elements of the faith. In counterpart, the speech of faith without the consideration of reason can produce fundamentalist religious practices. (shrink)

El propósito de este artículo es identificar convergencias y diferencias acerca de la relación fe-cultura en las reflexiones de tres teólogos latinoamericanos, quienes representan, de alguna manera, tres grandes líneas teológicas de los últimos cincuenta años. Los tres autores convergen en su interés por conocer e interpretar la cultura latinoamericana y su relación con el Evangelio. Pero divergen en una variedad de aspectos. Esto se puede apreciar por los conceptos, o categorías, utilizados: la idea de la liberación sociocultural como implicación (...) de la misma evangelización, la idea de una síntesis entre las culturas originarias y la evangelización ibérica, y la idea que valora la realidad multiétnica y pluricultural de nuestro subcontinente. Los tres autores estudiados muestran más diversidad que convergencia, e incluso, oposición entre sus planteamientos y opciones pastorales. The purpose of this article is to identify similarities and differences about the relationship between faith and culture in the reflections of three Latin American theologians who represent, somehow, three great theological lines cin-account recent years. The three authors converge in their interest to know and interpret Latin American culture and its relationship with the Gospel. But they diverge in a variety of ways. This can be seen by concepts, or categories, used the idea of cultural liberation as involvement in the same evangelization, the idea of a synthesis between the native cultures and the Iberian evangelization, and the idea that values the multiethnic and multicultural reality of our continent. Corporations perform actions that can inflict harm with different levels of intensity, from death to material loss, to both companies’ internal and external stakeholders. Research has analysed corporate harm using the notions of corporate social irresponsibility and corporate crime. Critical management studies have been subjecting management and organizational practices and knowledge to critical analysis, and corporate harm has been one of the main concerns of CMS. However, CMS has rarely been deployed to analyse CSIR and corporate crime. Thus, the aim (...) of this paper is to critically analyse the perspectives of CSIR and corporate crimes on corporate harm via CMS in general and postcolonial studies in particular. The paper contributes by arguing that research on CSIR and corporate crime could be perceived as producing research that does not challenge the essence of contemporary corporation profit-seeking activities that ultimately produces corporate harm. We argue that CSIR and corporate crime are ideologies that assist in disguising the contradiction between producing shareholder value and the social good that is at the heart of the modern corporation system and the current economic system. Furthermore, the postcolonial view of CSIR and corporate crime highlights how they are based on a Western-centric view of corporate harm that ignores the realities and perspectives of the Global South, especially in situations where corporate harm leads to death in the Global South. Peirce’s idea of an unlimited community has been usually analyzed from its role in science and the normative ideal of truth. However, it is essential to understand the role of the community of inquiry in light of the other normative sciences, aesthetics and ethics, since according to Peirce, any endeavor to know that is not guided by the esthetical ideal of admirable per se should not be considered as proper science, but as a power tool to benefit some elite. This (...) article aims to analyze Peirce’s idea of community of inquiry in light of sentimentalism and the normative sciences in order to evidence that such community is not elitist, but open, insofar as it is also lured by the summum bonum and the admirable per se. Finally, we provide a more organic reading of Peirce’s work, opening the way to consider possible consequences of this position from an ethical and political perspective. (shrink)

This paper consists in the presentation of the first version of the Greek/Portuguese translation of Sextus Empiricus’ _Outlines of Pyrrhonism _1.220-235, passage where Sextus traces a comparison between the Pyrrhonism and the Academic philosophy.

It has been argued (for example, by Nelson Goodman and John Hyman) that ‘depicts’ and similar terms such as ‘is a picture of’ and ‘represents’ are semantically ambiguous: sometimes they are two-place predicates expressing a relation, and sometimes they are not. This article takes issue with this claim and develops an alternative theory according to which the ambiguity in question is pragmatic rather than semantic.

In this paper I argue that recent attempts at explaining aesthetic ineffability have been unsuccessful. Either they misrepresent what aesthetic ineffability consists in, or they leave important aspects of it unexplained. I then show how a more satisfying account might be developed, once a distinction is made between two kinds of awareness. -/- .

Quelle est la tâche – plutôt que la contribution – de la philosophie à l’égard du langage? Dans cet article, il s’agit de revisiter la réponse de Paul Ricœur à cette question, à partir de son texte “Philosophie et langage.” Ricœur assigne à la philosophie la tâche de se réapproprier la triple médiation langagière: “chemin” du langage vers monde, “chemin” du langage vers le sujet et “chemin” du langage vers la communauté humaine. Partant de l’expérience concrète des sujets parlants, Ricœur (...) s’oppose à la clôture systémique présupposée par la conception structuraliste du langage, qui suspend la fonction de la référence dans la relation de signification. À partir d’une conception élargie de la référence – qui inclut la fonction poétique du langage –, le philosophe dégage de la notion de “monde du texte” la dimension ontologique constitutive du langage: dans sa fonction poétique, en effet, le langage révèle, selon lui, les possibilités multiples de notre mode d’existence. Nous montrons enfin que c’est à travers la notion d’attestation que Ricœur établit une connexion entre la réouverture de la triple médiation du langage et l’élaboration de cette nouvelle ontologie. El artículo procura mostrar las razones por las cuales no puede considerarse que la ética aristotélica sea determinista. De este modo, critica los argumentos de tres intérpretes que defienden el determinismo aristotélico: Alfredo Gómez-Muller, Theodor Gomperz y D.J. Furley, con el fi n de mostrar que la ética del Estagirita no está fundamentada en la necesidad sino en la convención, que el carácter no está totalmente determinado por naturaleza y que una vez éste se ha formado Aristóteles sí concibe la (...) posibilidad de cambio, si bien para ello se necesita mucho más que la mera intención. Con este análisis se pretende mostrar, entonces, más allá de la polémica particular con los intérpretes, que la ética aristotélica trata de explicar el mundo humano en su complejidad y riqueza y, por tanto, no puede considerarse determinista. Este artigo tem por objetivo geral investigar, numa perspectiva foucaultiana, as relações entre governo e subjetividade, através das artes de governar e a constituição do Estado moderno. Nessa tarefa, consideramos os cursos ministrados por Foucault, Segurança, Território, População e O nascimento da biopolítica, para tratar da presença do poder pastoral na constituição da governamentalidade. O objetivo específico é investigar outras possibilidades de organização social, associados a princípios democráticos, como solidariedade e autogestão em oposição aos efeitos gerados pelo neoliberalismo, com a (...) generalização dos valores mercadológicos nas condutas individuais e coletivas. Em nossa hipótese, consideramos a perspectiva anarquista como o contraponto vital na produção de outras formas de vida social e política, para além dos princípios exclusivamente econômicos. Neste ponto, apresentamos conceitos básicos dos valores anarquistas, como a ideia autogestão, apoio mútuo, a ideia de liberdade, encontrados em Bakunin, Kropotkin e Goldman, e a possibilidade de um pensamento sobre resistências e práticas no presente conforme as reflexões de Rago. Passamos também por uma crítica ao modelo de organização social e à própria ideia de democracia, a partir dos apontamentos de Graeber em Um projeto de democracia. Por fim, nosso esforço visa refletir sobre as possibilidades de um mundo outro, a partir de uma perspectiva que se apresenta radicalmente oposta às práticas políticas e sociais que encontramos hoje. Pretendemos, portanto, pensar no tempo presente e na possibilidade de novas formas de existência. (shrink)

En 1968 Raquel Carson comenzaba una revolución en el pensamiento, quizá una de las de mayor peso en la actualidad. En su libro "La primavera silenciosa" acusaba del deterioro ambiental al poder ilimitado del ser humano. La creencia surgida en la modernidad de que todo lo que el hombre decidía era en sí mismo lo mejor por haber sido fruto de una voluntad libérrima, daba primacía y legitimidad absoluta a su acción sobre la naturaleza. Surgieron con gran fuerza numerosos grupos (...) ecologistas que adoptaron un pensamiento que responde al nombre de "ecología profunda" o "Deep Ecology" descrito por primera vez por Arme Naess en un artículo publicado por la revista Inquiry y titulado "The Shallow and the Deep, Long Range Ecology Movement". Los principios que proponía este movimiento (Naess 1984) pueden ser resumidos en ocho grandes puntos: 1) la vida de los seres no humanos es un valor en sí: 2) la riqueza y la diversidad de estas formas de vida son también valores en sí; 3) los seres humanos no pueden intervenir de manera destructiva en la vida; 4) a este respecto, la intervención humana actual es eminentemente excesiva; 5) por consiguiente, las reglas de juego deben ser radicalmente modificadas; 6) esta modificación radical debe hacerse tanto a nivel de las estructuras económicas como de las estructuras ideológicas y culturales; 7) a nivel ideológico, el cambio principal consiste en apreciar más la calidad de la vida que el goce de los bienes materiales; 8) las personas que acepten estos principios tienen la obligación de contribuir, directa o indirectamente a la realización de los cambios fundamentales que aquellos implican. RESUMEN: Este trabajo considera la conceptualización y aplicación de la figura de los ajustes razonables en Qatar tras nueve años desde la ratificación de la Convención sobre los Derechos de las Personas con Discapacidad (CDPD). En él se trata de analizar la situación de igualdad y no discriminación de las personas con discapacidad utilizando como medida de impacto la figura de ajustes razonables. El artículo destaca las principales fallas y virtudes del Estado de Qatar respecto a esta figura y traza (...) un camino a fin de poder avanzar en la inclusión de las personas con discapacidad a la luz de la CDPD. ABSTRACT: This paper considers the conceptualization and application of reasonable acommodation in Qatar after nine years since the ratification of the Convention on the Rights of Persons with Disabilities (CRPD). It analyzes the situation of equality and non-discrimination of people with disabilities using the figure of reasonable adjustments as an impact measure. The article highlights the main failures and virtues of the State of Qatar regarding reasonable accommodation and draws a path to move forward in the inclusion of people with disabilities in the light of the CRPD. O novo livro sobre Jean-Jacques Rousseau, ao qual esta resenha se dedica, chama-se Rousseau et le spectacle, organizada por Christophe Martin (Universidade Paris-Ouest Nanterre La Défense), Jacques Berchtold (Universidade Paris-Sorbonne) e Yannick Séité (Universidade Paris VII-Diderot). O volume é fruto de um Colóquio internacional intitulado Rousseau et le spectacle, ocorrido entre 15 a 17 de março de 2012, na capital francesa, em ocasião das comemorações do tricentenário de nascimento de Rousseau.
