How to measure performance in charitable organisations continues to excite interest among academics and practitioners. Despite the intellectual interest, little consensus has emerged as to what are the best measures of performance in charities. This is against the backdrop of an increased demand by donors and other stakeholders on charities to provide information on their performance. Building on prior studies, this paper examines the measures of performance in charities using a hybrid methodological approach which consists of 14 exploratory interviews and (...) a quantitative survey of 105 chief executive officers/board of trustees of large British charities. The results of factor analysis and internal reliability produced five broad measures of performance of charities: financial measures; client satisfaction; management effectiveness; stakeholder involvement; and benchmarking, indicating that the overall performance of charities is best measured by a set of factors that reflect the multiple and diverse stakeholders associated with charities. Further analysis using structural equation modelling corroborates the results that non-financial measures such as management effectiveness, stakeholder involvement and benchmarking are important to the performance of charities. In Memory of Ed PellegrinoEuthanasia in Belgium is not limited to terminally ill patients. It may be applied to patients with chronic degenerative diseases. Currently, people in Belgium wish to make it possible to euthanize incompetent patients who suffer from dementia. This article explains the Belgian law and then explores arguments for and against euthanasia of patients with dementia. It probes the dementia paradox by elucidating Dworkin’s distinction between critical and experiential interests, arguing that at the end-of-life this distinction is (...) not clearcut. It argues against euthanasia for patients with dementia, for respecting patients’ humanity and for providing them with more care, compassion, and good doctoring. (shrink)

Can animals, and especially cattle, be the subject ofmoral concern? Should we care about their well-being?Two competing ethical theories have addressed suchissues so far. A utilitarian theory which, inBentham's wake, extends moral consideration to everysentient being, and a theory of the rights orinterests of animals which follows Feinberg'sconceptions. This includes various positions rangingfrom the most radical (about animal liberation) tomore moderate ones (concerned with the well-being ofanimals). Notwithstanding their diversity, theseconceptions share some common flaws. First, as anextension of primarily anthropocentric (...) theories (aboututility or rights) they still participate in the flawsof the original setting. Second, extending them tonon-human beings raises the problem of the borderwhich is to be drawn between what can be included inthe purview of moral consideration and what is leftoutside. Third, such theories are not able to distinguishbetween an ethics of wildlife and an ethics ofdomestic life, which too often leads to preposterousstatements. We would like to argue (i) that we should distinguishbetween environmental ethics (concerned withpopulations, species, biotic communities) and animalethics (where animals are taken into consideration individually);(ii) that individualist animal ethics are not relevantfor animal rearing; (iii) that animal rearing is a hierarchicalrelationship which rules are to be found in the fiction of a domesticcontract.Hence, we would like to construct a new conception ofthe ethics of the relation between men and the cattlethey breed based on the idea of a domestic contract.Our main assumption is Mary Midgleys's anthropologicalassumption, according to which human communities,since the Neolithic age, have always included variousanimals, so that relations of sociability have alwaysexisted between human beings and animals within thedomestic community (a mixed community). In order tospecify the hierarchical and non-egalitarian, butinclusive reciprocal obligations and relations insidesuch a community, we will elaborate on the notion ofa ``domestic contract'', an implicitly assumedidea traced back to Lucretius and whichwe will follow up to the physiocrats and Adam Smith.We will show that such an idea relies upon theassumption of communication between cattle farmer andanimals, of shared experience and exchanges betweenthe two parties. We will then show how modern factory,or battery animal farming, can be seen as unilaterallybreaking this domestic contract, forsaking ourduties towards domestic animals. (shrink)

The aim of this essay is to reflect on the Millian, utilitarian argument from truth that is held as one of the most conspicuous answers to the question Why tolerate? This argument postulates that only in a free market of ideas may the truth be discovered. Even the most unpopular idea may contain some truth in it and may contribute to the advancement of knowledge. It further commands us to contest those opinions which are believed to be true vigorously and (...) earnestly to explore some further truth, and to acknowledge their false aspects. The results of free exchange of opinions will either confirm our idea, or bring some doubt to our attention, to cast accounts and maybe change our opinion, at least to some extent. After reflecting on some of the common arguments that are frequently mentioned in this connection, I discuss Mill's formulation of the Truth Principle as it came into expression in his writings. Here I reflect on his article "Law of Libel and Liberty of the Press" which did not receive adequate attention by scholars. I show that it is difficult to reconcile what Mill had to say in this article with what he later said in On Liberty. I further maintain that the Millian view of truth as superior to all other social values might endanger the very ground which the Truth Principle is intended to safeguard, i.e., tolerance. The holding of truth as the most important value might result in harming individuals, and in generating an atmosphere of intolerance. (shrink)

Flawed clinical practice guidelines may compromise patient care. Commercial conflicts of interest on panels that write treatment guidelines are particularly problematic, because panelists may have conflicting agendas that influence guideline recommendations. Historically, there has been no legal remedy for conflicts of interest on guidelines panels. However, in May 2008, the Attorney General of Connecticut concluded a ground-breaking antitrust investigation into the development of Lyme disease treatment guidelines by one of the largest medical societies in the United States, the Infectious Diseases (...) Society of America (IDSA). Although the investigation found significant flaws in the IDSA guidelines development process, the subsequent review of the guidelines mandated by the settlement was compromised by a lack of impartiality at various stages of the IDSA review process. This article will examine the interplay between the recent calls for guidelines reform, the ethical canons of medicine, and due process considerations under antitrust laws as they apply to the formulation of the IDSA Lyme disease treatment guidelines. The article will also discuss pitfalls in the implementation of the IDSA antitrust settlement that should be avoided in the future. (shrink)

Bertolt Brecht’s poem “A Worker’s Speech to a Doctor” is frequently cited as a means to raise awareness among health workers of the health effects of living and working conditions. Less cited is his Call to Arms trilogy of poems, which calls for class-based action to transform the capitalist economic system that sickens and kills so many. In this article, we show how “A Worker’s Speech to a Doctor,” with its plea for empathy for the ill, contrasts with the more (...) activist and often militant tone of the Call to Arms trilogy: “Call to a Sick Communist,” “The Sick Communist’s Answer to the Comrades,” and “Call to the Doctors and Nurses.” We also show that, while “A Worker’s Speech to a Doctor” has been applied in the training of health workers, its accusatorial tone towards health workers’ complicity in the system the poem is critiquing risks alienating such workers. In contrast, the Call to Arms trilogy seeks common ground, inviting these same workers into the broader political and social fight against injustice. While we contend that the description of the sick worker as a “Communist” risks estranging these health workers, our analysis of the Call to Arms poems nevertheless indicates that their use can contribute to moving health workers’ educational discourse beyond a laudable but fleeting elicitation of empathy for the ill towards a structural critique and deeper systemic understanding in order to prompt action by health workers to reform or even replace the capitalist economic system that sickens and kills so many. This chapter considers eternity, duration, time, and their interrelations, and aims to resolve a paradox in Spinoza's theory of the mind's eternity. Spinoza's metaphysics of time includes an endless series of virtuous regresses. Spinoza characterizes duratio as a “magnitude. Spinoza says that duratio is “conceived as being greater or lesser, and as composed of parts”. Spinoza addresses time and its relation to duratio in the Metaphysical Thoughts. Spinoza accepts Suarez's view that “duratio and existence are only rationally distinct”. Spinoza holds, (...) with some of the Scholastic philosophers, that extrinsic denominations are mind‐made. Spinoza also uses geometrical construction as a model for thinking about the relationship between eternity and time. The discourse on economic integration with authoritarian regimes has evolved as a key topic throughout the different disciplines of social sciences. Are sanctions and boycotts effective methods to incentivize human rights improvements? To analyze this question, we focus on the situation in China’s Xinjiang province from 2010 to 2019. In this paper, we discuss the relevance of human rights as an ethical norm within business ethics and international law. We evaluate the ongoing processes in Xinjiang from this perspective and scrutinize (...) the interests of major players in the region, including the Central Government of the People’s Republic of China, Xinjiang’s local government, and enterprises involved in the region. To find adequate answers to a changing reality heavily influenced by advances in technology, medical professionals have developed and adopted an array of terms that have brought new concepts into the profession. “Dignity,” “vegetative state,” “futility,” “double effect,” and “brain death” have become indispensable words in the medical setting. In the following discussion, the attention is on terminology. If we believe in phenomenology, the assumption is that we should closely reflect on the words we use in all spheres of life, (...) especially in those that concern life and death. This article calls for a sincere discussion about these terms and concepts. The thesis put forward is that the language in the medical setting serves primarily the physicians, at times at the expense of the patients’ best interests. This language and the concepts it describes have generated an unhealthy atmosphere for patients, which might lead to undesirable actions at the end of patients’ lives. (shrink)

The article deals with the Dawson College Massacre, focusing on the story of Kimveer Gill, a 25-year-old man from Laval, Montreal who wished to murder young students in Dawson College. It is argued that the international community should continue working together to devise rules for monitoring specific Internet sites, as human lives are at stake. Preemptive measures could prevent the translation of murderous thoughts into murderous actions. Designated monitoring mechanisms of certain websites that promote violence and seek legitimacy as well (...) as adherents to the actualization of murderous thoughts and hateful messages have a potential of preventing such unfortunate events. Our intention is to draw the attention of the multifaceted international community to the shared interest and need in developing monitoring schemes for certain websites, in order to prevent hideous crimes. The Dutch experience has influenced the debate on euthanasia and death with dignity around the globe, especially with regard to whether physician-assisted suicide and euthanasia should be legitimized or legalized. Review of the literature reveals complex and often contradictory views about the Dutch experience. Some claim that the Netherlands offers a model for the world to follow; others believe that the Netherlands represents danger, rather than promise, and that the Dutch experience is the definitive answer regarding why we should not (...) make active euthanasia and physician-assisted suicide part of our lives.Having investigated the Dutch experience for a number of years, in the summer of 1999 I went to the Netherlands to visit the major centers of medical ethics as well as some research hospitals, and to speak with leading figures in euthanasia policy and practice. This essay commences by providing some background information on the practice of euthanasia and on the legal framework, and then reports the main answers to my first question: Why the Netherlands? Senegal is among the few African countries that counts with an important agroecological movement. This movement is strongly backed up by a network of transnational partnerships and has recently matured into an advocacy coalition that promotes an agroecological transition at national scale. In this article, we investigate the role of transnational links on the empowerment potential of agroecology. Combining the multi-level perspective of socio-technical transitions and Bourdieu’s theory of practices, we conceptualize the agroecological network as a niche shaped by the (...) circulation of different types of capital. Using social network analysis, we investigate the existing flows of resources and knowledge, as well as membership and advocacy links to critically address within-niche empowerment processes. We show that transnational ties play a key role in building the niche protective space, showing a financial dependency of the agroecological niche on NGOs and international cooperation programmes based in Europe and North America. This configuration tends to favor the empowerment of NGOs instead of farmer unions, which only play a peripheral role in the network. However, the multiple innovations focus of agroecology may open up prospects for more gradual but potentially radical change. Based on our findings, we suggest to include more explicitly core-periphery dynamics in transition studies involving North–South relations, including circulation of capital, ideas and norms. In this article I analyze some of the troubling issues in Canadian media ethics, based on in-depth interviews with more than 50 experts on Canadian media. I begin by reflecting on the cultural considerations involved in the Canadian media's proximity to the United States. Subsequently, I discuss the problems of excessive ownership of the media by a few organizations, arguing that the right to exercise free expression does not include the right to own as many media organizations as money can (...) buy. In this context are considered the work of two Royal Commissions: the 1970 Davey Commission and the 1980 Kent Commission. Finally, I am concerned with excessive intrusion of individual privacy. When news becomes entertainment and private stories become public spectacle, individual lives can be mercilessly exposed to the glaring spotlight of unwanted publicity. In delineating the boundaries of intrusion, there is a need to distinguish between public figures and ordinary citizens, and between those who choose to live in the spotlight and ordinary citizens who stumble into the public eye. The German Act on Autonomous Driving constitutes the first national framework on level four autonomous vehicles and has received attention from policy makers, AI ethics scholars and legal experts in autonomous driving. Owing to Germany’s role as a global hub for car manufacturing, the following paper sheds light on the act’s position within the ethical discourse and how it reconfigures the balance between legislation and ethical frameworks. Specifically, in this paper, we highlight areas that need to be more worked out (...) in the future either through ethical conventions, corporate measures or legal measures and examine how the law can be incorporated into the existing discourse on the regulation of technologies. Based on this examination, we derive implications for future discourse and elaborate on companies’ responsibilities in developing autonomous driving technologies in an ethical sense. (shrink)

La présente étude entend tracer et analyser le déploiement de « la Vérité de l’Etre » afin de montrer en quoi celui-ci est indissociable, pour Heidegger, de ce qu’il appelle, dans un passage tardif des Cahiers Noirs, l’« auto-annihilation ( Selbstvernichtung ) » du judaïsme. Nous montrerons en quoi et pourquoi, chez Heidegger, l’« Histoire » de la « Vérité de l’Etre », en se déployant elle-même, produit aussi un antijudaïsme, indissociable d’un antisémitisme, sans précédent dans l’histoire de la philosophie (...) occidentale. En effet, le judaïsme, pour Heidegger, se voit brutalement exproprié de toute possibilité d’être, et, par conséquent, demeure résolument forclos de l’« Histoire » gréco-allemande de la « Vérité de l’Etre » pour ne séjourner que dans l’« inessentielle » machination et exploitation « indéterminée » du monde. Il nous appartiendra de souligner, depuis le « dispositif » heideggérien de la « Vérité de l’Etre » – un dispositif, contrairement à ce qu’en dit Heidegger, dès plus technique – en quoi le judaïsme se voit condamné à son « auto-annihilation ». C’est ainsi que l’antijudaïsme de Heidegger, inséparable d’un antisémitisme catégorique, est à comprendre depuis sa pensée philosophique elle-même. Ce qui exige de nous une relecture dès plus vigilante, dès plus intransigeante et un questionnement critique circonstancié de cette œuvre et du rapport qu’elle détermine entre l’« Histoire » de la « Vérité de l’Etre » et l’« auto-annihilation » du judaïsme. Ainsi, à aucun moment ne s’agira-t-il, pour nous, de rejeter purement et simplement la pensée philosophique de Heidegger. Car, c’est aussi par une relecture critique de cette même pensée, par une confrontation incessante envers ce qui s’y cache dans ses plis les plus obscurs et douteux, que peuvent aussi se révéler d’inédites possibilités de repenser notre tradition philosophique tout entière en l’ouvrant vers une tout autre histoire de la philosophie – tout autre que celle qui se sera consacrée et déterminée dans et par le « dispositif » heideggérien. John Stuart Mill's concept of ethics was closely related to his firm belief in freedom. He was strictly a believer in each person bringing the greatest degree of happiness or good to the greatest number. This would be an individual act and in no way a forced action. One is free to act without coercion as long as no harm is brought to another person. Consequences must be considered carefully before acting and the act chosen must be the best of (...) possible choices designed to bring about the most good. Mill is definitely a prime example of teleological ethics - an ethics of considering consequences, one which is notably different from Kant 's concept of following a priori maxims or principles, regardless of consequences. This discussion is about the neglected concepts of trust and social responsibility on the Internet. I will discuss and explain the concepts and their implications to people and society. I then address the issue of moral and social responsibilities of ISPs and web-hosting companies. I argue that ISPs and web-hosting companies should aspire to take responsibility for content and that they should respect and abide by their own terms of conduct.

Early in 2008 I published Hate in the Classroom: Free Expression, Holocaust Denial, and Liberal Education. A rejoinder was published, and this is my reply to the rejoinder. It is about education and the role of the teacher in the classroom. I argue that teachers should keep their hateful views to themselves and not pronounce them publicly if they wish to serve as educators. Students should not be subjected to teachers who are unable to appreciate difference and pluralism, who interpret (...) liberty as a tool for hate, who abhor violence, and who exemplify the opposite of humanistic education. One cannot be a hate monger and an educator. When one opts to be the former, one should stay out of the classroom. (shrink)

Review of the literature reveals complex and often contradictory views about this experience. Some claim the Netherlands offers a model for the world to follow; others believe the Netherlands represents danger rather than promise, that the Dutch experience is the definitive answer to why we should not make active euthanasia and (...) physician-assisted suicide part of our lives.Given these contradictory views, fieldwork is essential to develop a fully informed opinion. Having investigated the Dutch experience for a number of years, in the summer of 1999 I went to the Netherlands to visit the major centres of medical ethics as well as some research hospitals, and to speak with leading figures in euthanasia policy and practice. This essay reports some of the main findings of my interviews and provides detailed accounts of the way in which some of the Netherlands’ leading experts perceive the policy and practice of euthanasia in their country. These accounts are quite fascinating.The discussion begins with background information on the guidelines for euthanasia. Next, explanation about the research methodology is outlined and then I discuss the interviewees’ views about the guidelines for euthanasia. I conclude by indicating that the Dutch guidelines on the policy and practice of euthanasia do not provide ample mechanisms against abuse. Virtually every guideline has been breached or violated. This finding reiterates Hendin’s finding. I recommend that the Netherlands amend its policy and remedy its troubling practice. (shrink)

The article discusses the way people wish to die, analyzing the legal situation in countries that permit either euthanasia or physician-assisted suicide. While criticizing the Dutch, Belgian and Swiss models, I argue that the Oregon model is the one with apparently little abuse. Building on the experiences of Oregon, the Netherlands, Belgium, Switzerland, and the Northern Territory of Australia, the article ends with a set of guidelines to improve the conduct of PAS.

The lexical–semantic organization of the mental lexicon is bound to change across the lifespan. Nevertheless, the effects of lexical–semantic factors on word processing are usually based on studies enrolling young adult cohorts. The current study aims to investigate to what extent age‐specific semantic organization predicts performance in referential word production over the lifespan, from school‐age children to older adults. In Study 1, we conducted a free semantic association task with participants from six age‐groups (ranging from 10 to 80 years old) (...) to compute measures that capture age‐specific properties of the mental lexicon across the lifespan. These measures relate to lifespan changes in the Available Richness of the mental lexicon and in the lexical–semantic Network Prototypicality of concrete words. In Study 2, we used the collected data to predict performance in a picture‐naming task on a new group of participants within the same age‐groups as for Study 1. The results show that age‐specific semantic Available Richness and Network Prototypicality affect word production speed while the semantic variables collected only in young adults do not. A richer and more prototypical semantic network across subjects from a given age‐group is associated with faster word production speed. The current results indicate that age‐specific semantic organization is crucial to predict lexical–semantic behaviors across the lifespan. Similarly, these results also provide cues to the understanding of the lexical–semantic properties of the mental lexicon and to lexical selection in referential tasks. (shrink)
