The practice of paying prisoners to for their participation in research has long been debated, and the controversy is reflected in the differing policies in the U.S. prison systems. Empirical study of financial payments to inmates who enroll in research has focused on whether this practice is coercive. In this study, we examined whether monetary incentives have the potential to be unduly influential among fifty HIV‐positive prisoners. The majority of prisoners surveyed believed that inmates should receive some compensation for their (...) involvement in research and disagreed with statements suggesting that the offer of payment constitutes undue influence. However, a sense of potentially being susceptible to undue influence was significantly higher among participants who had spent a longer time in prison and had less education. Overall, our findings suggest that most prisoners feel that they would be able to make a decision about research enrollment that is not solely based on an offer of monetary payment. (shrink)

Several scholars have recognized the limitations of theories of moral reasoning in explaining moral behavior. They have argued that moral behavior may also be influenced by moral identity, or how central morality is to one’s sense of self. This idea has been supported by findings that people who exemplify moral behavior tend to place more importance on moral traits when defining their self-concepts (Colby & Damon, 1995). This paper takes the next step of examining individual variation in a construct highly (...) associated with immoral behavior — psychopathy. In Study 1, we test the hypothesis that individuals with a greater degree of psychopathic traits have a weaker moral identity. Within a large online sample, we found that individuals who scored higher on a measure of psychopathic traits were less likely to base their self-concepts on moral traits. In Study 2, we test whether this reduced sense of moral identity can be attributed to differences in moral judgment, which is another factor that could influence immoral behavior. Our results indicated that the reduced sense of moral identity among more psychopathic individuals was independent of variation in moral judgment. These results suggest that individuals with psychopathic traits may display immoral behavior partially because they do not construe their personal identities in moral terms. (shrink)

White matter tracts are known to be susceptible to injury following concussion. The objective of this study was to determine whether contact play in sport could alter white matter metabolite levels in female varsity athletes independent of changes induced by long-term exercise. Metabolite levels were measured by single voxel proton magnetic resonance spectroscopy in the prefrontal white matter at the beginning and end of season in contact and non-contact varsity athletes. Sedentary women were scanned once, at a time equivalent to (...) the Off-Season time point. Metabolite levels in non-contact athletes did not change over a season of play, or differ from age matched sedentary women except that non-contact athletes had a slightly lower myo-inositol level. The contact athletes had lower levels of myo-inositol and glutamate, and higher levels of glutamine compared to both sedentary women and non-contact athletes. Lower levels of myo-inositol in non-contact athletes compared to sedentary women indicates long-term exercise may alter glial cell profiles in these athletes. The metabolite differences observed between contact and non-contact athletes suggest that non-contact athletes should not be used as controls in studies of concussion in high-impact sports because repetitive impacts from physical contact can alter white matter metabolite level profiles. It is imperative to use athletes engaged in the same contact sport as controls to ensure a matched metabolite profile at baseline. (shrink)

John Martin Fischer is one of the leading proponents of semi-compatibilism, one of the ideas proposed in the debates on free will and determinism. According to him, even if it is not possible to make a free choice once determinism is accepted, persons can be held morally responsible for their actions. Thus, the ability to choose one of several alternatives, i.e. to act otherwise, is not necessary for moral responsibility. This study aims to reveal patterns of e-petition co-signing behavior that are indicative of the political mobilization of online “communities”. We discuss the case of We the People, a US national experiment in the use of social media technology to enable users to propose and solicit support for policy suggestions to the White House. We apply Baumgartner and Jones's work on agenda setting and punctuated equilibrium, which suggests that policy issues may lie dormant for periods of time until some event (...) triggers attention from the media, interest groups, and elected representatives. In the case study presented, we focus on 21 petitions initiated during the week after the Sandy Hook shooting in opposition to gun control or in support of policy proposals that are alternatives to gun control, which we view as mobilized efforts to maintain stability and equilibrium in a policy system threatening to change. Using market basket analysis and social network analysis we found a core group of petitions in the “support law-abiding gun owners” theme that were highly connected and four “communities” of e-petitioners mobilizing in opposition to change in gun control policies and in favor of alternative proposals. This essay seeks to shed light on the connections between elevated isnād and al-sābiq wa’l-lāhiq (distance between the first and last narrator of traditionist). Since the 2nd/8th century, when the search for elevated isnāds began, intense interest has been seen by the traditionists. The article looks at how these initiatives to elevated isnād helped pave the way for the emergence of al-sābiq wa’l-lāhiq. Similarly, it is investigated if al-sābiq wa’l-lāhiq promotes the look for elevated isnād. First, the data documentation approach (...) was applied to data taken from the history of hadith, various hadith techniques, and biographical dictionaries to ascertain the relationship between two notions. The relationship between two themes is then made clear using information from Khatīb Baghdādī’s (d. 463/1071) al-Sābiq wa’l-lāhiq, the first work authored in this field. Significance of the study of Khatīb Baghdādī’s work is further increased by the fact that he was the first to present the idea. The relationship between the subjects has been looked at in the article from three different theoretical angles. First, historical information has been used to assess how the orientation of hadiths concerning elevated isnād created the stage for the conception of al-sābiq wa’l-lāhiq. Then, the connection between subjects was examined through explanations of hadith methodology and biographical dictionaries authors. When the historical records of hadiths are reviewed, it becomes clear that the traditionist supported the hearing of elevated isnād and its transmission starting in the 2nd/8th century, particularly in the 3rd/9th and 4th/10th centuries. al-Sābiq wa’l-lāhiq was founded as a consequence of factors including the existence of grandfathers and grandchildren who reported from a single hadith due to orientation in elevated isnād and the fact that certain traditionists took pride in passing down the narrations of the elders to the younger generations. In addition, as the century moved away from the Prophet, the elevated isnāds that enable to reach him with a short isnād gained more importance. This situation explains why al-sābiq wa’l-lāhiq was formed in the 5th/11th century. It was also discovered that Khatīb Baghdādī’s introduction of this idea to the discussion was not a coincidence, and it was stated that this was due to his interest in elevated isnād. The connection established by the authors of hadith methodology between two concepts is that al-sābiq wa’l-lāhiq encourages the audition of elevated isnād. al-Lāhiq in other words hadith aspirants who want to be the last person who transmits hadith from a traditionist, that is, turning to mu‘ammerūn (long-lived) teachers at a young age supports the audition of elevated isnād. The efforts of biographical dictionaries authors to record elevated isnads that reached al-lāhiq were evaluated as a different manifestation of this situation. The connection between two subjects has also been examined in the work of Khatīb Baghdādī, which has the same name as the concept and various findings were obtained about al-sābiq wa’l-lāhiq and traditionists who were attributed to him as al-sābiq wa’l-lāhiq. According to this, it has been understood that traditionists who were compared to al-sābiq wa’l-lāhiq were chosen from among the long-lived people. A study was conducted on 6 traditionists, in whom Khatīb determined the ratio of al-sābiq wa’l-lāhiq to 10 or more. According to this, it has been determined that the narrators, who are mentioned as al-sābiq, are generally attributed to teachers or peers of traditionists. However, it has been revealed that there is no obligation to be a teacher or peer, and sometimes there are al-sābiqs among the students. The fact that most of the al-sābiqs are teachers and peers shows that the concept is considered a rarity. Because in the history of hadith, isnād generally goes from student to teacher. In addition, the narration of peers from each other or the teacher from students showed that narrators, who are called al-sābiq, have descending isnāds from that teacher. However, it has been determined that not all the narrations of al-sābiq were descending, only of whose narrations from that traditionist would be regarded as descending. As al-lāhiq, on the other hand, is the last person to transmit hadith from traditionist, he already has elevated isnād and all of them are long-lived people. However, the missing part of Khatīb’s book is that he does not pay attention to whether al-lāhiq is reliable or abandoned. In addition, it was stated that al-lāhiq should be chosen only from reliable, and in this case, it would not affect the distance between al-sābiq and al-lāhiq. (shrink)

Il montre en effet que la transmission de la clinique de l'analyste participe de la dynamique de la sublimation de celui-ci. La topologie du fantasme, avec laquelle cette folie féminine - qui s'inscrit dans la suite de (...) Marguerite Anzieu (cas Aimée) et des soeurs Papin - est abordée, ouvre le lecteur à une dynamique transférentielle et de sublimation par son articulation à la pulsion. En même temps que Lacan parle de la sublimation, il est ravi par le texte et fait acte de sublimation dans l'écriture de son Hommage, en nouant l'objet de sa propre pulsion au Ravissement de Lol V. Stein et à Marguerite Duras elle-même. Dans un mouvement de retour sur sa lecture de ce texte, Lacan élève la lettre à la dignité de la Chose (définition de la sublimation) ; le style devient condition d'accès au cas et fait lui-même cas. Hz. Peygamber’in ashâbı, bir takım şahsî özellikleri açısından hadis rivayetine farklı şekillerde katkı sunmuşlardır. Bu çalışmada da Yahudilikten ihtidâ etmiş bir sahâbî olması özelliğiyle dikkatleri çeken Abdullah b. Selâm ve hadis rivayeti ele alınmıştır. Müslüman olmadan önce Medine Yahudilerinin önemli ilim adamlarından biri olan Abdullah b. Selâm, Müslümanlar arasında da ilmî açıdan önemli bir yere sahip olmuştur. Sahâbîlerin ona sorular yönelterek onun eski dinine dair ilminden istifade ettikleri görülmektedir. Hatta Hz. Peygamber dahi bazı hususlarda onun Tevrat bilgisinden yararlanmıştır. Abdullah b. (...) Selâm, hakkında birtakım ayetler nazil olan, aynı zamanda pek çok ayetin tefsirinde de kendisinden bahsedilen bir sahâbîdir Kur’an’ın Yahudi kökenli oldu-ğuna dair iddialarda adının zikredilmesi de Abdullah b. Selâm’ı önemli bir isim kılmaktadır. Hadis rivayeti açısından bakıldığında Abdullah b. Selâm’ın yetmiş beş rivayeti tespit edilmiştir. Bu yetmiş beş rivayet içerik olarak incelendiğinde ise aslında bunların toplamda elli rivayetin farklı versiyonları olduğu görülmektedir. Bu rivayetler çerçevesinde Abdullah b. Selâm’dan rivayette bulunan elli râvî tespit edilmiştir. Bunlar içerisinde sahâbî, muhadram ve tâbînden olanlar bulunmaktadır. İsrâiliyat üzerinden eleştiriye maruz kalan Abdullah b. Selâm’ın mevkuf rivayetleri içerikleri itibariyle incelendiğinde İsrâiliyat konularıyla alakalı olabilecek yirmi iki tane mevkuf rivayeti olduğu görülmüştür. Bu rivayetlerin içeriği genel itibariyle yaratılış, peygamberler tarihi, ahiret ahvâli, kıyamet alametleri, fiten ve melâhîm ile alakalıdır. Bu tür rivayetlerinin miktarı göz önünde bulundurulduğunda aslında onun İsrâiliyat konusunda çok abartılacak bir etkisinin bulunmadığını söylemek mümkündür. (shrink)

Bu çalışmanın amacı İbn Kesîr’in (öl. 774/1373) el-Bidâye ve’n-nihâye isimli tarih çalışmasının siyer bölümünde Sahîhayn hadislerini muhteva açısından tenkidinin araştırılması ve tahlilidir. Çalışmamızın konusu ise İbn Kesîr’in mezkûr eserinde yirmi Sahihayn hadisini Kur’ân-ı Kerîm (3 hadis), akıl (1 hadis), icmâ (1 hadis), sahih hadisler (7 hadis) ve sağlam târihî bilgilere (8 hadis) uygunluk/aykırılık kıstaslarını kullanarak tenkidi ve on dört hadiste izah getiremediği yanlışların birer hata olduğunu kaydetmesidir. İbn Kesîr’in incelenen hadislerin muhteva tenkidine müsait bir hâle gelmesine yol açan râvi tasarruflarına (...) dair verdiği bilgiler ayrıca kıymetlidir. Bu çalışmanın kapsamını oluşturan hadislerden yedi tanesi hem Sahîh-i Buhârî hem Sahîh-i Müslim, altı tanesi sadece Sahîh-i Buhârî, yedi tanesi de sadece Sahîh-i Müslim’de yer almaktadır. Araştırmamızın sonucunda eleştirilen hadislerin büyük bir kısmında İbn Kesîr’in değerlendirmelerinin İbn Hacer ve Nevevî gibi muhaddislerinkinden farklı olduğu görülmüştür. Çalışmamızın önemi İbn Kesîr’in tenkitlerinin muhaddislerin senedin sıhhatinin metnin sıhhatini temin etmeyeceğine dair tespitlerinin uygulamadaki somut delillerini oluşturmasıdır. Kısaca İbn Kesîr’in, eserine güçlü tenkit zihniyetini, özgün görüşlerini ve geniş ilmî birikimini başarıyla yansıttığı görülmektedir. (shrink)

Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

Whidden IIISTUDENTS OF THOMAS AQUINAS have argued over many issues in the last 150 years or so; in fact, it is nearly impossible to get out of the very first question of the Summa Theologiae without entering into a century-long debate about the status of sacred doctrine as an Aristotelian science. We ponder whether theology meets (...) the requirements of a scientia and argue about just how to understand the task of theology in the face of Aquinas’s concern about theology as a scientia. Part of this ongoing argument is shaped by the philosophical and epistemological needs of theologians attempting to justify their positions in an academic world driven by the secular and scientific norms of the Enlightenment. Additionally, some interest in theology as a scientia is driven by the desire to provide a philosophically acceptable alternative to secular forms of reason—thus Leo’s XIII’s promotion of Thomistic philosophy.The interest in theology as a science was shaped by the historical work of Chenu in his influential articles on the topic and then by almost every other important Thomist in the last fifty years.1 Theology as a scientia is such a pressing topic that it would almost be fair to say that Thomists have developed their own scientia of theology as a scientia. [End Page 273]Beyond the modern and, perhaps, postmodern concerns driving this interest, there are good reasons to pay attention to Aquinas on the status of theology. If we focus on theology as a scientia, it is because Aquinas invites us to do so by taking up this question in one form or another at the beginning of his major theological syntheses. We are, after all, only following his lead and pondering with him just what we are thinking about, and how we are thinking, when we think about God.Within the Thomistic corpus there is, however, a minority report with regard to the status of theology. In his prologue to his commentary on Boethius’s Hebdomads, Aquinas looks at theology in a very different way, one that can supplement our understanding of sacred doctrine in its role as both an intellectual and an affective enterprise. In this commentary Aquinas journeys into a different territory and explores theology, not as a scientia, but as a kind of play—a play that evokes delight and pleasure in the one who pursues wisdom.My approach will be first to describe Aquinas’s theology with regard to regular play—the kind of recreational activities we all engage in, whether they are physical or verbal. He takes up the question of the morality of play in several places and in a way that will inform our understanding of what he means when he describes theology as play. With this understanding of regular play in place, we will then explore theology as play, based on the supposition that there is something analogical between regular play and theology as play. I will finish with some reflections on how this might contribute to our present understanding of theological work.IWhile he scatters comments about play across his corpus and mentions it in all of his theological syntheses, Aquinas gives sustained attention to play in two places: first, in his commentary on Aristotle’s Ethics, and second, in question 168 of the Secunda secundae (in the treatise on temperance) of the Summa theologiae. Upon discovering that certain beliefs we hold are contingent on arbitrary features of our background, we often feel uneasy. I defend the proposal that if such cases ofcontingency anxietyinvolve defeaters, this is because of the epistemic significance of disagreement. I note two hurdles to our accepting thisDisagreement Hypothesis. Firstly, some cases of contingency anxiety apparently involve no disagreement. Secondly, the proposal may seem to make our awareness of the influence of arbitrary background factors irrelevant in determining whether to revise our (...) beliefs. Dame Iris Murdoch is familiar to most people as a witty and en· gaging novelist whose twenty-four hooks of fiction can he read on a variety of levels. They are wonderful stories, hut the philosophically acute reader will also enjoy Murdoch's judgments, polemics, and inhouse jokes about philosophers and philosophical (...) views. Comparatively few people are aware of Murdoch's previous scholarly studies: Sartre, Romantic Rationalist, The Sovereignty of the Good, The Fire and the Sun; and Acastos. Even so, those familiar with these hooks will recognize the profound impact she has had on debates within moral philosophy. She has been at the forefront of the move· ment that has rehabilitated the central importance of such notions as goodness, the Good, virtue, and the moral life as a journey. So it is not surprising that Murdoch has returned to the genre of philosophical argument to advance her views on the relationship between metaphysics and morals. But it is surprising that her argument exhibits neither the clarity of thought characteristic of the analytic philosophy in which she was trained nor the dramatic narrative of her novels. Indeed the hook reads like a collage of lecture notes, complete with extensive quotations from other people's thoughts with minimal com· mentary. Further, the chapter titles (e.g., " Fact and Value," " Schopenhauer," " Consciousness and Thought-I," " Derrida and Struc· turalism," " Consciousness and Thought-II," "Notes on Will and Duty," " Axioms, Duties, Eros," " Void ") shed little light on the overall structure or argument of the hook. One cannot help hut have the impression that Murdoch spent less time crafting the argument of this hook than she does in crafting the story line and characters of her novels. This is not to say, of course, that there is not much to he learned from Murdoch's perspective. She is remarkably erudite, and her discussion of various themes, figures, and issues often yields fascinating insights. But the whole is considerably less than the sum of its often interesting parts. I have already suggested that this is partly because of the structure and style in which the hook is written. But the hook 687 688 BOOK REVIEWS is also disappointing, and perhaps more determinatively, because of the overall perspective she seeks to deploy and defend. Readers of Murdoch's work have heretofore often wondered about the relationship between her avowed Platonism and her interest in Christianity. Metaphysics as a Guide to Morals has the virtue of clarifying that relationship, hut the result is unpersuasive. At the heart of Murdoch's Platonism is her recasting of the allegory of the cave from The Republic. The moral life is an arduous struggle to ascend from the cave (represented, as in her earlier works, by " the fat, relentless ego ") by a dispossession of the self so that we can apprehend a little less imperfectly the perfect form of the Good. As Murdoch puts it, Plato assumes the internal relation of value, truth, cogmtion. Virtue (as compassion, humility, courage) involves a desire for and achievement of truth instead of falsehood, reality instead of appearance. Goodness involves truth.seeking knowledge and ipso facto a discipline of desire. ' Getting things right ', as in meticulous grammar or mathematics, is truth-seeking as virtue. Learning anything properly demands (virtuous ) attention. Here the idea of truth plays a crucial role (as it does also in Kant) and reality emerges as the object of truthful vision, and virtuous action as the product of such vision. This is a picture of the omnipresence of morality and evaluation in human life (p. 39). Such a depiction ought to resonate quite deeply with Christians, something not lost on Murdoch when she writes a few pages earlier: "There are innumerable points at which we have to detach ourselves, to change our orientation, to redirect our desire and refresh and purify our energy, to keep on looking in the right direction: to attend upon the grace that comes through faith " (p. 25). The genetic modification of pigs as a source of transplantable organs is one of several possible solutions to the chronic organ shortage. This paper describes existing ethical tensions in xenotransplantation (XTx) that argue against pursuing it. Recommendations for lifelong infectious disease surveillance and notification of close contacts of recipients are in tension with the rights of human research subjects. Parental/guardian consent for pediatric xenograft recipients is in tension with a child’s right to an open future. Individual consent to transplant is (...) in tension with public health threats that include zoonotic diseases. XTx amplifies concerns about justice in organ transplantation and could exacerbate existing inequities. The prevention of infectious disease in source animals is in tension with the best practices of animal care and animal welfare, requiring isolation, ethologically inappropriate housing, and invasive reproductive procedures that would severely impact the well-being of intelligent social creatures like pigs. Motivated ignorance is an incentivized absence of knowledge that arises in circumstances of unequal power relations, a self-protective non-knowing which frees individuals from having to reflect on the privileges they have in virtue of membership in a dominant social group. In philosophical discussions, the term “motivated ignorance” gets used interchangeably with “willful ignorance.” In the first half of this paper, using Charles Mills’ (2007) white ignorance as the defining case, I argue that this is a mistake. A significant swath of (...) cases of motivated ignorance are non-willful, or deep, following Rik Peels (2010). But in all cases, benefits accrued to some in virtue of their social position are gained and maintained at the expense of harms to others. In the second half of this paper, I argue that these harms are what ground attributions of culpability in cases of motivated ignorance and drive the normative requirement that the subject know better, so long as the facts in question are ordinarily and easily knowable (in a sense to be specified). Willfulness is not a necessary condition for culpability, even if it is a sufficient one. (shrink)

To construct their first lexicon, infants must determine the relationship between native phonological variation and the meanings of words. This process is arguably more complex for bilingual learners who are often confronted with phonological conflict: phonological variation that is lexically relevant in one language may be lexically irrelevant in the other. In a series of four experiments, the present study investigated English–Mandarin bilingual infants’ abilities to negotiate phonological conflict introduced by learning both a tone and a non-tone language. In a (...) novel word learning task, bilingual children were tested on their sensitivity to tone variation in English and Mandarin contexts. Their abilities to interpret tone variation in a language-dependent manner were compared to those of monolingual Mandarin learning infants. Results demonstrated that at 12–13 months, bilingual infants demonstrated the ability to bind tone to word meanings in Mandarin, but to disregard tone variation when learning new words in English. In contrast, monolingual learners of Mandarin did not show evidence of integrating tones into word meanings in Mandarin at the same age even though they were learning a tone language. However, a tone discrimination paradigm confirmed that monolingual Mandarin learning infants were able to tell these tones apart at 12–13 months under a different set of conditions. Later, at 17–18 months, monolingual Mandarin learners were able to bind tone variation to word meanings when learning new words. Our findings are discussed in terms of cognitive adaptations associated with bilingualism that may ease the negotiation of phonological conflict and facilitate precocious uptake of certain properties of each language. During psychotherapy, patient and therapist tend to spontaneously synchronize their vocal pitch, bodily movements, and even their physiological processes. In the present article, we consider how this pervasive phenomenon may shed new light on the therapeutic relationship– or alliance– and its role within psychotherapy. We first review clinical research on the alliance and the multidisciplinary area of interpersonal synchrony. We then integrate both literatures in the Interpersonal Synchrony (In-Sync) model of psychotherapy. According to the model, the alliance is grounded in (...) the coupling of patient and therapist’s brains. Because brains do not interact directly, movement synchrony may help to establish inter-brain coupling. Inter-brain coupling may provide patient and therapist with access to another’s internal states, which facilitates common understanding and emotional sharing. Over time, these interpersonal exchanges may improve patients’ emotion-regulatory capacities and related therapeutic outcomes. We discuss the empirical assessment of interpersonal synchrony and review preliminary research on synchrony in psychotherapy. Finally, we summarize our main conclusions and consider the broader implications of viewing psychotherapy as the product of two interacting brains. (shrink)

The purpose of the article is distinguishing between "internal" and "external" public human through comprehending the phenomenon of Self in its virtual-digital essence as a popular demonstrative-project space "BETWEEN" aggression and harmony. Theoretical basis of the work is based on the study of the phenomenon of modern human aggression in the virtual-digital space and the "project space" of the living environment through understanding the nature of the human "I". The penetration limits of the Self of the public human into the (...) "project space" are comprehended and the nature of the self-realization and self-search models of human through the "transcendent ego" is revealed. Originality is demonstrated through comprehending the Self phenomenon of the public human, which forms new anthropological research direction and represents a conceptual paradigm of relationship of "human I – publicity – human We – the living space of the Other". Conclusions. The Self of the public human as the space "BETWEEN" does not completely "dissolve" in a separate ontological basis, but is the basis for the formation of his/her "I", while only participation in the existence of others reveals the meaning of his/her own existence. Such interaction requires significant human efforts – skills and competencies of public communication, which are able to create a successful self-identification of a public human without aggression and conflict. Current theories suggest that the brain is the sole source of mental illness. However, affective disorders, and major depressive disorder (MDD) in particular, may be better conceptualized as brain-body disorders that involve peripheral systems as well. This perspective emphasizes the embodied, multifaceted physiology of well-being, and suggests that afferent signals from the body may contribute to cognitive and emotional states. In this review, we focus on evidence from preclinical and clinical studies suggesting that afferent thermosensory signals contribute to well-being and (...) depression. Although thermoregulatory systems have traditionally been conceptualized as serving primarily homeostatic functions, increasing evidence suggests neural pathways responsible for regulating body temperature may be linked more closely with emotional states than previously recognized, an affective warmth hypothesis. Human studies indicate that increasing physical warmth activates brain circuits associated with cognitive and affective functions, promotes interpersonal warmth and prosocial behavior, and has antidepressant effects. Consistent with these effects, preclinical studies in rodents demonstrate that physical warmth activates brain serotonergic neurons implicated in antidepressant-like effects. Together, these studies suggest that (1) thermosensory pathways interact with brain systems that control affective function, (2) these pathways are dysregulated in affective disorders, and (3) activating warm thermosensory pathways promotes a sense of well-being and has therapeutic potential in the treatment of affective disorders. Isaac Newton's Scientific Method examines Newton's argument for universal gravity and his application of it to resolve the problem of deciding between geocentric and heliocentric world systems by measuring masses of the sun and planets. William L. Harper suggests that Newton's inferences from phenomena realize an ideal of empirical success that is richer than prediction. Any theory that can achieve this rich sort of empirical success must not only be able to predict the phenomena it purports to explain, but also (...) have those phenomena accurately measure the parameters which explain them. Harper explores the ways in which Newton's method aims to turn theoretical questions into ones which can be answered empirically, by measurement from phenomena, and to establish that propositions inferred from phenomena are provisionally accepted as guides to further research. This methodology, guided by its rich ideal of empirical success, supports a conception of scientific progress that does not require construing it as progress toward Laplace's ideal limit of a final theory of everything, and is not threatened by the classic argument against convergent realism. Newton's method endorses the radical theoretical transformation from his theory to Einstein's. Harper argues that it is strikingly realized in the development and application of testing frameworks for relativistic theories of gravity, and very much at work in cosmology today. (shrink)

Measuring responsiveness to gain accurate diagnosis in populations with disorders of consciousness (DOC) is of central concern because these patients have such complex clinical presentations. Due to the uncertainty of accuracy for both behavioral and neurophysiological measures in DOC, combined assessment approaches are recommended. A number of standardized behavioral measures can be used with adults with DOC with minor to moderate reservations relating to the measures’ psychometric properties and clinical applicability. However, no measures have been standardized for use with pediatric (...) DOC populations. When adapting adult measures for children, confounding factors include developmental considerations for language-based items included in all DOC measures. Given the lack of pediatric DOC measures, there is a pressing need for measures that are sensitive to the complex clinical presentations typical of DOC and that can accommodate the developmental levels of pediatric populations. The music therapy assessment tool for awareness in disorders of consciousness (MATADOC) is a music-based measure that has been standardized for adults with DOC. Given its emphasis on non-language based sensory stimuli, it is well-suited to pediatric populations spanning developmental stages. In a pre-pilot exploratory study, we examined the clinical utility of this measure and explored trends for test-retest and inter-rater agreement as well as its performance against external reference standards. In several cases, MATADOC items in the visual and auditory domains produced outcomes suggestive of higher level functioning when compared to outcomes provided by other DOC measures. Preliminary findings suggest that the MATADOC provides a useful protocol and measure for behavioral assessment and clinical treatment planning with pediatric DOC. Further research with a larger sample is warranted to test a version of the MATADOC that is refined to meet developmental needs of pediatric DOC populations. (shrink)

Both trolleys and war leave innocent victims to suffer death and injury. Trolley problems accounting for the injured, and not only the dead, tease out intuitions about liability that enhance our understanding of the obligation to provide compensation and medical care to civilian victims of war. Like many trolley victims, civilians in war may suffer justifiable, excusable, or negligent harms that demand compensation. Chief among these is collateral harm befalling civilians. Collateral harm is endemic to war and comprises permissible but (...) unavoidable death or injury following necessary and proportionate military operations. Although state armies sometimes offer condolence payments for civilian death, injury, and property loss, they deny liability. Instead, they use compensation to enhance counterinsurgency efforts and assuage feelings of agent regret. As part of the medical rules of eligibility, Coalition forces in Iraq and Afghanistan also provided medical care to victims of collateral harm. However, they denied care to similarly sick or injured civilians. While compensation is often justified to cure the harm civilians suffer, the differential use of medical resources is not. Rather, medical care remains subject to the principle of beneficence and medical need. The duty to provide civilian healthcare in war, particularly in wars of humanitarian intervention, is far-reaching and imposes significant costs that military and medical ethics are yet to recognize. Así, se sostiene que parece razonable pensar que el conocimiento es un tipo de acción cuyo fin último es la felicidad. What is the constituent nature of God? Most scholars project the idea that God is an absolute, pure spirit devoid of matter. In this paper, I engage this position from the African philosophical place. First, I contend that the postulation that God is pure spirit stems from an ontological system known as dualism. This system bifurcates reality into spirit and matter and sees spirit as good, and matter as evil. Therefore, scholars who subscribe to this theory of dualism, posit that (...) God, the Supreme Being is the ultimate good that is, and is pure spirit. Secondly, I disagree with this position. Using the African theory of duality, I argue that everything that is has both spirit and matter, and that spirit and matter are good. Thus, God as an existent reality consists of spirit and matter. I will support my argument using Asouzu’s Ibuanyidanda ontology and Ijiomah’s Harmonious Monism, two African culture-inspired philosophical systems. In this paper, I employ conversationalism as my philosophical method. (shrink)

The following text is a translation of Semyon Frank’s “L’intuition fondamentale de Bergson” published in Henri Bergson: Essais et témoignages inédits, edited by Albert Béguin and Pierre Thévenaz, Neuchâtel: Éditions de la Baconnière, 1941. In this article, Frank addresses Bergson’s notion of intuition, his anti-intellectualism, his mysticism, his closeness to Lebensphilosophie, the notion of lived experience, the distinction between intuition as pure contemplation and intuition as living knowledge, the distinction between cognition of the atemporal essence of reality and cognition of (...) the world of becoming, pragmatism, the disinterested and open intuitive spiritual attitude vs the utilitarian attitude of social groups closed in on themselves, the transrational vs the irrational, spiritual life, psychic life, the Absolute, and the temporal flux. The article contains criticisms of Bergson on the issues of time and intuition: the durée, the intuitive time, is incomprehensible without an atemporal foundation. Therefore, according to Frank, Plato was correct—contra Bergson—to define time as the moving image of eternity. And, if there is such an atemporal foundation, then, contrary to what Bergson seems to think, intuition as living knowledge cannot be the sole mode of intuition.
