We provide an intuitive motivation for the hyperreal numbers via electoral axioms. We do so in the form of a Socratic dialogue, in which Protagoras suggests replacing big-oh complexity classes by real numbers, and Socrates asks some troubling questions about what would happen if one tried to do that. To what extent should we focus on implicit bias in order to eradicate persistent social injustice? Structural prioritizers argue that we should focus less on individual minds than on unjust social structures, while equal prioritizers think that both are equally important. This article introduces the framework of transactive memory into the debate to defend the equal priority view. The transactive memory framework helps us see how structure can emerge from individual interactions as an irreducibly social product. If this is right, (...) then debiasing interventions are structural interventions. The assumption that environmental ethics must be nonanthropocentric in order to be adequate is mistaken. There are two forms of anthropocentrism, weak and strong, and weak anthropocentrism is adequate to support an environmental ethic. Environmental ethics is, however, distinctive vis-a-vis standard British and American ethical systems because, in order to be adequate, it must be nonindividualistic.Environmental ethics involves decisions on two levels, one kind of which differs from usual decisions affecting individual fairness while the other does not. The latter, called (...) allocational decisions, are not reducible to the former and govern the use of resources across extended time. Weak anthropocentrism provides a basis for criticizing individual, consumptive needs and can provide the basis for adjudicatingbetween these levels, thereby providing an adequate basis for environmental ethics without the questionable ontological commitments made by nonanthropocentrists in attributing intrinsie value to nature. Freedom of conscience is a core element of human rights respected by most European countries. It allows abortion through the inclusion of a conscience clause, which permits opting out of providing such services. However, the grounds for invoking conscientious objection lack clarity. Our aim in this paper is to take a step in this direction by carrying out a systematic review of reasons by midwives and nurses for declining, on conscience grounds, to participate in abortion. We conducted a systematic review (...) of ethical arguments asking, “What reasons have been reported in the argument based literature for or against conscientious objection to abortion provision by nurses or midwives?” We particularly wanted to identify any discussion of the responsibilities of midwives and nurses in this area. Search terms were conscientious objection and abortion or termination and nurse or midwife or midwives or physicians or doctors or medics within the dates 2000–2016 on: HEIN legal, Medline, CINAHL, Psychinfo, Academic Search Complete, Web of Science including publications in English, German and Dutch. Final articles were subjected to a rigorous analysis, coding and classifying each line into reason mentions, narrow and broad reasons for or against conscientious objection. Of an initial 1085 articles, 10 were included. We identified 23 broad reasons, containing 116narrow reasons and 269 reason mentions. Eighty one narrow reasons argued in favour of and 35 against conscientious objection. Using predetermined categories of moral, practical, religious or legal reasons, “moral reasons” contained the largest number of narrow reasons. The reasons and their associated mentions in this category outnumber those in the sum of the other three categories. We identified no absolute argument either for or against conscientious objection by midwives or nurses. An invisibility of midwives and nurses exists in the whole debate concerning conscientious objection reflecting a gap between literature and practice, as it is they whom WHO recommend as providers of this service. While the arguments in the literature emphasize the need for provision of conscientious objection, a balanced debate is necessary in this field, which includes all relevant health professionals. This collection of essays foregrounds the concepts of health and illness and patient experience within the philosophy of medicine, reflecting on the relationship between the ill person and society. Mental illness is considered alongside physical disease, and the important ramifications of society's differentiation between the two are brought to light. While the research programs in early cognitive science and artificial intelligence aimed to articulate what cognition was in ideal terms, much research in contemporary computational neuroscience looks at how and why brains fail to function as they should ideally. This focus on impairment affects how we understand David Marr's hypothesized three levels of understanding. In this essay, we suggest some refinements to Marr's distinctions using a population activity model of cortico-striatal circuitry exploring impulsivity and behavioral inhibition as a case study. (...) In particular, we urge that Marr's computational level should be redefined to include a description of how systems break down. We also underscore that feed-forward processing, cognition disconnected from behavioral context, and representations do not always drive cognition in the way that Marr originally assumed. (shrink)

While abortion has been legal in most developed countries for many years, the topic remains controversial. A major area of controversy concerns women’s rights vis-a-vis the rights of health professionals to opt out of providing the service on conscience grounds. Although scholars from various disciplines have addressed this issue in the literature, there is a lack of empirical research on the topic. This paper provides a documentary analysis of three examples of conscientious objection on religious grounds to performing abortion-related care (...) by midwives in different Member States of the European Union, two of which have resulted in legal action. These examples show that as well as the laws of the respective countries and the European Union, professional and church law each played a part in the decisions made. However, support from both professional and religious sources was inconsistent both within and between the examples. The authors conclude that there is a need for clear guidelines at both local and pan-European level for health professionals and recommend a European-wide forum to develop and test them. (shrink)

Many studies have observed modulation of the amplitude of the neural index mismatch negativity (MMN) related to which member of a phoneme contrast [phoneme A, phoneme B] serves as the frequent (standard) and which serves as the infrequent (deviant) stimulus (i.e., AAAB vs. BBBA) in an oddball paradigm. Explanations for this amplitude modulation range from acoustic to linguistic factors. We tested whether exchanging the role of the mid vowel /ε/ vs. high vowel /ɪ/ of English modulated MMN amplitude and whether (...) the pattern of modulation was compatible with an underspecification account, in which the underspecified height values are [−high] and [−low]. MMN was larger for /ε/ as the deviant, but only when compared across conditions to itself as the standard. For the within-condition comparison, MMN was larger to /ɪ/ deviant minus /ε/ standard than to the reverse. A condition order effect was also observed. MMN amplitude was smaller to the deviant stimulus if it had previously served as the standard. In addition, the amplitudes of late discriminative negativity (LDN) showed similar asymmetry. LDN was larger for deviant /ε/ than deviant /ɪ/ when compared to themselves as the standard. These findings were compatible with an underspecification account, but also with other accounts, such as the Natural Referent Vowel model and a prototype model; we also suggest that non-linguistic factors need to be carefully considered as additional sources of speech processing asymmetries. For older workers, self-employment is an important alternative to waged employment. Drawing on social learning theory and social cognitive career theory we examine how attitudes toward one’s own aging, future time perspective (captured by perceived time left to live) and perceived support from referent individuals predict self-efficacy for entrepreneurship and outcome expectations, influencing self-employment interest. Findings from a sample of professional association members (n = 174, mean age 52.5 years), revealed that an open-ended time perspective relates positively to entrepreneurial self-efficacy, (...) while social support relates positively to outcome expectations. Consistent with social cognitive career theory, entrepreneurial self-efficacy mediated the relationship between future time perspective and interest in self-employment, and outcome expectations mediated the relationship between social support and interest in self-employment. This study extends current career and entrepreneurship theory in several ways. First, the inclusion of age-related psychosocial and sociocultural factors in the study model shed light on the intersection between older age, the contextual environment and development of self-employment interest. Second, the findings support earlier arguments that older entrepreneurship is a social process whereby the social context in which people work and live influences their interest in entrepreneurship, and that entrepreneurial behavior among older peop... Through this case study, we show the possible misunderstandings linked to the duality of two « worlds » : that of the teacher who experiments with CPI in her classroom and that of the researcher who is responsible for the design of this type of session. The « world » is defined as « conceptual, axiological and praxical background ». Several recent authors have recommended that “sense of place” should become an important concept in our evaluation of environmental policies. In this paper, we explore aspects of this concept, arguing that it may provide the basis for a new, “place-based” approach to environmental values. This approach is based on an empirical hypothesis that place orientation is a feature of all people’s experience of their environment. We argue that place orientation requires, in addition to a home perspective, a sense of the (...) space around the home place and that this dual aspect can be modeled using a “hierarchical” methodology. We propose a “triscalar,” place-oriented system for the analysis of environmental values, explore the characteristics of place-orientation through several examples, and employ these characteristics to distinguish acceptable and unacceptable aspects of the NIMBY (not-in-my-backyard) idea. Theorists of legal translation generally describe it as an interdisciplinary activity whose methodology draws deeply upon comparative law. In practice, how can we apply this theoretical paradigm to translator training? This article examines methods of integrating comparative law with the acquisition of knowledge and know-how that constitute the translator’s core competences, emphasizing the resolution of legal terminology problems resulting from incongruencies between legal systems. Given that the goal is to compare law for the purposes of translation, it is useful to (...) approach these problems from a functionalist viewpoint, principally through confronting a range of cases and situations likely to challenge the professional translator. Therefore, the author proposes including, along with other teaching methods, targeted work on terminological problems which necessitate the study of comparative law. Patient safety has assumed a prominent role on the policy agenda since the Institute of Medicine report To Err Is Human was released in November 1999. The report maintained that medical error is the predominant mechanism by which patients in the United States and around the world are injured. This finding, along with the report’s recommendation for a “systems” approach to reducing medical error, provided an extremely important insight into the operation of our medical delivery system. Clearly, while advances in (...) medical technology, diagnostic techniques, and knowledge provide the foundation for saving lives, medical error has resulted in their loss. However, recognition that medical error is a primary cause of these avoidable patient injuries and deaths is a key one and may result in improvements within our system of health-care delivery as well as minimization of the emotional and financial toll that iatrogenic injury causes. In this essay, we present three case studies which suggest that sometimes we are better off supporting a so–called irrational suicide, and that emotional or psychological distress – even if medically controllable – might justify a suicide. We underscore how complicated these decisions are and how murky a physician's moral role can be. We advocate a more individualized route to end–of–life care, eschewing well–meaning, principled, generalizations in favor of a highly contextualized, patient–centered, approach. We conclude that our Western traditions of (...) promoting reasoned behavior and life themselves may at times be counter–productive. (shrink)

If environmentalists are to combat effectively the continuing environmental decay resulting from more and more intense human exploitation of nature, they need a plausible and coherent rationale for preserving sensitive areas and other species. This need is illustrated by reference to two examples of controversies concerning large public projects in wilderness areas. Analyses of costs and benefits to presently existing human beings and the utilitarian theory which supports such theories are inadequate to provide such a rationale, as other writers have (...) shown. A number of environmentalists have suggested that ascriptions of rights to nonhuman animals, plants, and other natural objects may provide the necessary rationale. I argue that such ascriptions can only be effective if they are supported by a general theory of rights. Although no such general theory is developed, I state four minimal conditions which must be fulfilled by all rights holders as entailments of the concept of a right and, hence, as necessary conditions on rights holding, regardless of the general theory of rights espoused. I then argue that no appeals to rights of nonhumans can simultaneously fulfill these four minimal conditions and, on the other hand, satisfy the need for a coherent rationale for environmental preservation. In the central argument of the essay I exploit the distinction between the concern of vegetarians and antivivisectionists who rest their case for animal rights on the analogy ofanimal suffering to human suffering and the concern of environmentalists to protect the integrity of holistic ecosystems. I then conclude that even if the case for nonhuman rights can be made convincingly, the rights defended are insufficient for the development of a complete and coherent rationale for environmental preservation. The notion of “expression”, which infuses the whole Leibnizian thought, originates, at least partially, from mathematics, for it appears explicitly in the corpus of the author, after his Parisian initiation to modern mathematics. The crucial point then consists in drawing the path that leads Leibniz from his first mathematical works about quadrature of the circle, differential calculus and series, and his discovery of perspective projection, to the notion of “expression”. Then, many mathematical elements seem to be inscribed in the very (...) nature of “expression”: the idea of transformation and preservation, of relationship between finite and infinite, or still of envelopment and development. Now, it turns out that these elements, if they are considered merely in their mathematical dimension, are sometimes more problematic than enlightening when the question is grasping what “expression” means in its metaphysical instances, and consequently that “expression” cannot be reduced to a mere mathematical notion. The article presents a portrait and analysis of the existential-psychocultural situation in postmodern Sweden. Drawing from recent research exploring psychology of religion and existential worldviews, and the Swedish findings from the international World Values Survey, an argument is made for thinking about existential function and dysfunction as public health issues. This is portrayed against the background of Sweden as one of the most secularized countries and simultaneously a country with one of the most encompassing welfare systems. Psychology of religion's updated (...) role here would be to take responsibility for identifying and assessing the categories of function and dysfunction for an existential public health system. This role would also include the planning of policy for societal existential wellbeing, as well as planning prevention and intervention efforts for avoiding existential epidemiology. This new role fits well with public health's third revolution agenda focusing on health, wellbeing and quality of life. (shrink)

Lawyers in many jurisdictions are ageing, and yet there is little information concerning the age profile of the legal profession. This paper presents the first consideration of the age profile of lawyers outside of the US, showing that Australian lawyers are ageing and delaying retirement. These findings have serious implications. Problems associated with a growing proportion of older lawyers include an increasing risk of lawyers suffering from age-related cognitive and physical impairment, and the related rise of complaints and malpractice claims (...) against older lawyers. It is also clear that the Australian legal profession is unprepared to address these problems. The legal profession has ignored important gender-specific implications of ageing, such as female lawyers experiencing menopause and the lower savings of female lawyers moving into retirement. Regulatory regimes have not considered the impact of the profession's ageing profile, and there is no mandatory reporting of lawyers suffering from age-related impairment or provisions should a lawyer die. The profession also has not provided strategies to positively transition lawyers into retirement, and there is a lack of flexible working arrangements and succession planning, especially in firms located outside urban centres. In _The Sources of Normativity_, Christine M. Korsgaard argues that unconditional obligation can be accounted for in terms of practical identity. My argument in this paper is that practical identity cannot play this foundational role. More specifically, I interpret Korsgaard's argument as beginning with something analogous to Kant's fact of reason, viz. with the fact that our minds are reflective. I then try to show that her determination of this fact is inadequate and that this causes the argument concerning practical (...) identity to fail. Finally, I argue that a conception of the fact of reason more in line with what I take to be Kant's own is necessary to account for unconditional obligation. (shrink)

If the value of intrinsic value accounts lies in the establishment of an impetus to accept duties with respect to nature and to make sense of specific feelings of attachment and affection toward nature, then these goals can be met equally well through the virtue of compassion. Compassion is an other-directed emotion, and is thus not anthropocentric when directed toward nature. It requires us to be capable of relating to and identifying suffering in another. However, basing an ethic on compassion (...) requires a hermeneutic shift in how we think about nature and particular places such that we consider more closely how time is related to suffering. Since suffering is inevitable, there are several ways that compassion might be embodied in our actions, all of which share the feature of promoting the wildness of a place. (shrink)
