Studio sulla soggettività in Merleau-Ponty presents precise and original research along several nodes of great importance in Merleau-Ponty’s philosophical production, such as subjectivity, expression, passivity, nature, history. By focusing on, without limiting himself to, the 1950’s period, the author declares that he aims at a denaturalization of nature and a dehistoricization of history: an overcoming of dichotomies which, though faithfully following the Merleau-Pontian path, does not fail to have a Deleuzian overtones. A startup ecosystem is a dynamic environment in which several actors, such as investors, venture capitalists, angels, and facilitators, are the protagonists of a complex interplay. Most of these interactions involve the flow of capital whose size and direction help to map the intricate system of relationships. This quantity is also considered a good proxy of economic success. Given the complexity of such systems, it would be more desirable to supplement this information with other informative features, and a natural choice (...) is to adopt mathematical measures. In this work, we will specifically consider network centrality measures, borrowed by network theory. In particular, using the largest publicly available dataset for startups, the Crunchbase dataset, we show how centrality measures highlight the importance of particular players, such as angels and accelerators, whose role could be underestimated by focusing on collected funds only. We also provide a quantitative criterion to establish which firms should be considered strategic and rank them. Finally, as funding is a widespread measure for success in economic settings, we investigate to which extent this measure is in agreement with network metrics; the model accurately forecasts which firms will receive the highest funding in future years. This essay builds on two questions: the relation of the child with the other and the child’s way of knowing, in which the resistance of the unreflected is not yet problematized. Through a reconstruction of Merleau-Ponty’s critique of Piaget’s idea of the child’s linear intellectual progression toward reflexive abstraction, I highlight the moment of unreflection by taking up the notion of ultra-thing, which Merleau-Ponty borrows from Henry Wallon. These ultra-things are entities with which the child entertains a vague relation and (...) which always remain at the horizon of her perception without yet being possessed in a representation or grasped in a concept. They include, for example, the sun, the sky, the Earth, the body as an object, existence before the birth of the child – uninhabitable dimensions or, to the contrary, ones that are necessarily inhabited. The concept of ultra-thing has not been sufficiently explored in Merleau-Pontian studies and its importance remains underappreciated. This essay thus formulates a hypothesis about the relation between ultra-things and hyper-reflection. (shrink)

This article retraces the main instances at the root of Merleau-Ponty’s project of a « transcendental geology », a project announced in a working note of 1960. This project is linked to the complex intertwining of history and nature, which Merleau-Ponty thematizes as the two non-objectifiable dimensions that pose a challenge to reflexive thought. History and nature, both in their particular subjective manifestations as personal life or one’s own body, as well as in their broader sense as the history of (...) peoples or nature as a domain of the unbuilt, are characterized as unavoidable, as quasi-objects that are the soil of existence. It is in this direction that Merleau-Ponty’s interest in the “ultra-things” of Henri Wallon, those entities that the child can neither conceive nor imagine, seems to be heading. I propose that ultra-things are linked to inhabiting: they are the uninhabitable and the dimensions that cannot be renounced. This relationship with inhabiting restores the relational aspect of the problem of the unreflective in Merleau-Ponty and highlights the timeliness and urgency of the program of a transcendental geology as an ecology of thought and as an ecological philosophy. The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

Il saggio muove da una ricostruzione storico-concettuale dell’interpretazione merleau-pontyana del manoscritto di Husserl Rovesciamento della dottrina copernicana nell’interpretazione della corrente visione del mondo, con cui Merleau-Ponty è in dialogo sin dalla Fenomenologia della percezione, per ripercorrere gli sviluppi del tema della Terra nell’avanzare della riflessione merleau-pontyana sul corpo-proprio, sull’organismo vivente, sulla dimensione carnale dell’essere. La proposta di un ritorno alla Terra, intesa come Boden irriducibile dell’esperienza, trova infatti il suo risvolto ontologico nell’idea di Spielraum, che già Husserl definiva come “ambito (...) di possibilità”, e che in Merleau-Ponty assume il senso di un margine di gioco sempre aperto nella carne. Boden e Spielraum, non a caso tematizzati da Merleau-Ponty in due corsi paralleli tenuti al Collège de France nell’anno 1959-1960, permettono una rivalutazione del vivente secondo un modello che, contro il riduzionismo meccanicista, privilegi la spontaneità e la contingenza, e aprono allo sviluppo dell’ontologia porosa che il filosofo andrà proponendo negli ultimi anni. Ricostruendo la funzione della riflessione sulla corporeità e sul rapporto del vivente al mondo-ambiente in questa maturazione, si argomenterà che la critica che Merleau-Ponty muove al dualismo empirismo-idealismo trovi nell’idea di Terra un momento chiave, che contribuisce ad orientarla in direzione di una filosofia della carne. Questo passaggio riconfigura la Natura stessa, pensata non già come un originario, ma in quanto ambito di possibilità processuale e transindividuale, come quel quasi-oggetto, come lo definiva, ancora, Husserl, che presenta un’irriducibile resistenza ad un pensiero di sorvolo, proprio in quanto è condizione del pensiero stesso e ancoraggio della vita tutta.This essay begins with a historico-conceptual reconstruction of the Merleau-Pontian interpretation of Husserl’s manuscript, “Foundational Investigations of the Phenomenological Origin of the Spatiality of Nature,” with which Merleau-Ponty is in dialogue from Phenomenology of Perception onward, and revisits the development of the theme of the Earth in the progression of Merleau-Ponty’s reflection on le corps propre, the living organism, and the carnal dimension of being. The proposal for a return to the Earth, taken as irreducible Boden of experience, indeed finds its ontological reverse side in the idea of Spielraum, which Husserl already defined as a “milieu of possibilities,” and which in Merleau-Ponty takes on the sense of a margin of play always open in the flesh. Boden and Spielraum, two notions that Merleau-Ponty does not thematize by chance in the two parallel courses given at the Collège de France over the years 1959-1960, enable a reassessment of the living being according to a model that, against mechanistic reductionism, privileges spontaneity and contingency, and opens to the development of the porous ontology that the philosopher would propose in his final years. Reconstructing the function of reflection on corporeality, and on the relationship of the living being with its milieu in the process, it will be argued that the criticism directed by Merleau-Ponty against the dualism of empiricism-idealism finds in the idea of the Earth a key moment that contributes to orienting him in the direction of a philosophy of the flesh. This passage reconfigures Nature itself, no longer conceived of as an originating, but as a milieu of processual and transindividual possibilities, like that quasi-object, as Husserl again defined it, that presents an irreducible resistance against high-altitude thinking, precisely as the condition of thought itself and the anchorage of all life.Cet essai commence avec une reconstruction historico-conceptuelle de l’interprétation merleau-pontienne du manuscrit de Husserl, Renversement de la doctrine copernicienne, avec lequel Merleau-Ponty est en dialogue depuis la Phénoménologie de la perception, et revisite les développement du thème de la Terre dans la progression de la réflexion merleau-pontienne sur le corps propre, sur l’organisme vivant, sur la dimension charnelle de l’être. Legitimate corporations exist within a common space that is shared with a different type of organization, one that is engaged in illicit or criminal activities.Activities taking place in this sector of the global commons threaten the integrity of the global markets and contribute to public distrust of corporations. In addition, they are placing legitimate organizations in an unanticipated and unwelcomed role within a larger law enforcement regime that requires them to participate in preventing the legitimization of illicit monetary gains through (...) money laundering. NOVO CÓDIGO DE PROCESSO CIVIL: REFLEXÕES SOBRE LIBERDADE, IGUALDADE E MUDANÇAS DE PARADIGMAS.

Proponer la existencia de filosofía en América Latina se convierte para muchos en un problema. Más dificultades se generarán ahora al proponer la existencia de una estética latinoamericana, teniendo como representante a un pensador colombiano: Nicolás Gómez Dávila. En medio de la obra de este pensador logramos entresacar una serie de códigos estéticos que, si bien están heredados de las concepciones europeas de la estética, podrían darnos atisbos de una mirada distinta otorgada por la observación de objetos y hechos generados (...) por el mestizaje sucedido en medio de tierras fértiles, agrestes y exuberantes como las de nuestra geografía. Realizar esta presentación implica repasar un legado existente, pero olvidado, por lo que actualizar una experiencia filosófica rica que, aunque presente, no se ha manifestado en nuestro medio de manera suficiente. Como objetivos principales de este ejercicio investigativo están: argumentar a favor del ejercicio filosófico realizado en Latinoamérica;proponer el ejercicio aforístico de Gómez Dávila como una aportación colombiana en torno a la estética filosófica; y repasar algunos tópicos estéticos que queremos entresacar en la obra de este autor para realizar un ejercicio hermenéutico de los mismos. Con este trabajo se espera alcanzar no solamente ecos en nuestro medio sino en las distintas latitudes donde ya el autor es reconocido, pero ahora desde la estética. La metodología empleada en esta investigación es realizada desde un ejercicio hermenéutico, en la perspectiva gadameriana. Esperamos proponer, como resultado principal, argumentos que corroboren las aportaciones de Gómez Dávila a la estética desde una perspectiva latinoamericana. Finalmente, concluimos que la estética de Gómez Dávila es de estilo clásicocon vínculos metafísicos, asociada a un canon griego y con una clara perspectiva cristiana, pero que ha sido elaborada por una mente perteneciente a un contexto latinoamericano, del cual no debemos extraer de ningún modo.AbstractTo suggest the existence of philosophy in Latin America becomes a problem for many. Even more difficulties are generated by proposing the existence of a Latin American Aesthetics, having as its representative a Colombian thinker: Nicolás Gómez Dávila. In the midst of this thinker’s work, we were able to identify a series of aesthetic codes which, although inherited from the European concepts of aesthetics, could give us glimpses of a different perspective given by the observation of objects and events generated by the miscegenation that took place in the midst of lush, rugged and fertile lands as those of our geography. To attempt his presentation involves reviewing an existing but forgotten legacy, and updating a rich philosophical experience that, although present, does not manifest in our environment sufficiently. The objectives of this research are: arguing for the philosophy made in Latin America; propose the aphoristic exercise of Gómez Dávila as a Colombian contribution to the field of aesthetics; and review some aesthetic issues that we want to conclude in the work of this author to conduct a hermeneutic exercise thereof. With this paper I expect to reach not only echoes in our philosophical community but in also in other latitudes where Gomez-Davila is already recognized, but now fromthe point of view of aesthetics. The methodology used in this research entailed a hermeneutic exercise, in the perspective of Gadamer. We propose some arguments supporting the contributions of Gómez-Dávila aesthetics from a Latin American perspective. Finally, we conclude that the aesthetics of Gómez-Dávila is of a classic style with metaphysical links, associated with a Greek canon and with a clear Christian perspective, but that it has been developed by a mind that belongs to a Latin American context, from which we cannot intend to separate it in any way. El trabajo tiene por objeto reflexionar sobre el auge de los códigos deontológicos profesionales, así como sobre la tendencia a extenderlos a las instituciones o los poderes públicos, como el parlamento, el gobierno, la administración y el poder judicial. Las normas deontológicas profesionales pueden ser entendidas como normas morales, propias de un colectivo profesional, que estipulan los principios y valores por los que han de regirse quienes se dedican a tal profesión. Al tratarse de un tipo de normatividad, resulta relevante (...) para la teoría jurídica dar cuenta de las relaciones entre los estándares deontológicos y las normas jurídicas. Por último, se pone el acento en los problemas que surgen a la hora de dilucidar el ámbito de conductas de los poderes que pueden estar bajo regulaciones éticas, con valor de recomendación, y cuáles, por el contrario, resultan de inexorable regulación legal por cuanto entrañan responsabilidades jurídicas. Se ha impuesto la imagen del código de barras para hacer referencia a una secuencia de ADN mitocondrial que es utilizada para medir la distancia genética entre poblaciones animales. Según la interpretación esencialista de esta analogía, este método de medición serviría, por sí mismo, no solo para la rápida identificación de ejemplares, o muestras fragmentarias, de especies previamente clasificadas, sino también para el descubrimiento de nuevas especies. Los taxónomos integrativos han rechazado este último uso del método del código (...) de barras de ADN, dado que la complejidad biológica impide aplicarlo con precisión en eventos de especiación recientes. Argumentaré, sin embargo, que el método falla por razones conceptuales y no meramente empíricas. Aunque no existiera ese impedimento empírico, el código de barras de ADN no podría ser un método de descubrimiento de especies. (shrink)

El presente trabajo recoge un análisis comparativo realizado entre diversos códigos y recomendaciones de buen gobierno tanto a nivel nacional como internacional. Durante el estudio, se ha revisado una amplia muestra de códigos de gobierno corporativo, prestando especial atención a los aspectos incluidos en los mismos relativos a la composición de los consejos de administración, la voluntariedad versus obligatoriedad de las recomendaciones, el tratamiento otorgado a las figuras de Presidente y CEO, etc., identificando las principales diferencias y similitudes entre ellos (...) y mostrando la evolución temporal de las distintas recomendaciones en los diferentes países e instituciones analizadas. Tras el análisis comparativo se observa que la mayoría de los códigos se orientan en la misma dirección, incluyendo apartados similares en todos ellos, aunque también existen pequeñas matizaciones específicas que los diferencian. O presente artigo visa apresentar algumas das regras normativas do código monástico budista relacionadas ao ato de esmolar alimentos pelos renunciantes de ambos os sexos das comunidades budistas, Saṃgha. O ato de esmolar alimentos, assim como todo o conjunto de características comportamentais e morais relacionado aos praticantes monásticos, se tornou um importante elemento que proporcionou identidade para as Saṃghas do Buda, uma vez que benfeitores – que moravam nas cidades e vilas ao entorno das comunidades – acabavam por reconhecer (...) monges, bhikṣus e monjas, bhikṣunīs distinguindo das demais religiosidades e comunidades da Índia Antiga. Essas regras instituídas pelo Buda histórico, e preservadas pelas comunidades, evidenciam o grande cuidado no tocante à nutrição dos praticantes, especialmente em relação ao como e o que se alimentar, a higiene pessoal, bem como o comportamento dos bhikṣus e das bhikṣunīs com todo esse processo. O objetivo da atenção à alimentação não era outro que proporcionar condições adequadas para o desenvolvimento dos praticantes em relação aos estudos e à meditação. (shrink)
