This paper aims to answer the question: what does the realism of laws of nature consist of? To achieve this, in the first part, three philosophical accounts of laws of nature are presented and examined: the universalist, the dispositionalist and the counter-factualist. The presentation and examination focuses on the answer given by each of these accounts to the question: what is a law of nature? Later, in the second part, convergences and divergences between these three accounts are shown. Finally, in (...) the third section, the points of agreement between them are put together to advance the fundamental thesis that encompasses each of these accounts as realist accounts of laws of nature. This thesis, I argue, is at the end the core of the general realist stance on laws of nature that I name “Realism of Laws of Nature”. (shrink)

In this paper, I argue that if one is already an advocate of scientific realism, then one would be also a realist about laws of nature. To show this, I argue that only scientific realists would accept that non-accidental regularities require explanation and that their genuine explanation is given by laws of nature. Then, from this conclusion, it seems that scientific realists have reason to believe that there are laws of nature in an objective sense. If this is correct, the (...) conclusion is that there are no reasons for advocates of scientific realism to be skeptics about laws of nature. (shrink)

It does not seem particularly daring to say that one objective of science education is to enable students to understand different phenomena in the world in their mutual relationship. This is roughly equivalent to promoting knowledge of scientific explanations, which involve resorting to regular relationships between certain phenomena and which, certainly, is different from knowledge of this or that type of event taken in isolation. In this text, we will draw attention to two opposing tendencies that, however, tend towards the (...) common result of hindering the achievement of such an objective. On the one hand, we find characterizations of scientific explanation that assimilate it to argumentation and, therefore, lose sight of what specifically makes explanations explanatory; that is, they ask too little of a scientific explanation. On the other hand, those that consider paradigmatic cases of scientific explanation −such as those achieved by subsuming phenomena such as tides to Newton's laws− do not really constitute explanations but merely descriptions; it is about asking too much of an explanation here. We will therefore point out that a greater attention to the elaborations provided by the philosophy of science about the notion of explanation is crucial to better serve educational purposes. El propósito de este ensayo es proponer una interpretación de los conceptosde “ley de naturaleza” y de “pacto” para disolver algunos problemas dela teoría de Hobbes. Para ello, primero, muestro que hay justicia en el estadode guerra de Hobbes, lo que implica que las leyes de naturaleza son vinculantesen tal Estado. Segundo, arguyo que en el estado de guerra no puedehaber justicia, lo que implica que las leyes de naturaleza no son vinculantes.Lo anterior me permitirá señalar una contradicción (...) con respecto a las leyesde naturaleza. Tercero, sugiero una interpretación para disolver dicha contradicción. Finalmente, muestro que en la propuesta contractual de Hobbeshay un círculo vicioso y, valiéndome de lo dicho en la tercera parte, sugierouna posible solución. Partiendo de la distinción filosófica entre las leyes de la ciencia y las leyes de la naturaleza, en el presente artículo se defiende la indispensabilidad explicativa de las leyes de la ciencia en el campo de las ciencias cognitivas. Se sostiene que las leyes de la ciencia desempeñan un papel epistémico indispensable tanto en el análisis funcional como en la explicación mecanicista de las capacidades cognitivas. De esta manera, se ofrece una elucidación plausible del poder explicativo (...) de las ciencias cognitivas en términos del papel epistémico de las leyes de la ciencia, suspendiendo el juicio, de manera prudente, respecto del controvertido estatus metafísico de las leyes naturales. Se pone en evidencia que tanto quienes defienden como quienes rechazan el compromiso ontológico con leyes causales intencionales presuponen que esas leyes no contribuyen a la explicación funcionalista ni mecanicista de los fenómenos que describen. Sin embargo, en el presente trabajo se argumenta, primero, que el análisis funcional requiere la especificación de leyes científicas no causales y, segundo, que la representación científica precisa de las actividades y de la organización dinámica de un mecanismo se despliega mayoritariamente, en el contexto de un modelo mecanicista, mediante la especificación de leyes científicas. La conclusión es que las leyes científicas (aunque no necesariamente las leyes de la naturaleza) desempeñan un papel indispensable en la explicación en ciencias cognitivas. (shrink)

Según la noción clásica el derecho es el objeto de la justicia; también clásicamente se dice que el ius es lo justo, lo debido. Según esto, el ius naturale es lo justo que se funda en la naturaleza y es lo debido por naturaleza. Frente a estas nociones clásicas Thomas Hobbes define al ius naturale como la libertad que cada hombre tiene de usar su propio poder como quiera, para la conservación de su propia naturaleza, es decir, de su vida. También podemos marcar la diferencia entre la concepción clásica de la ley natural como dictamen de la razón práctica que ordena al hombre hacia el fin inscripto en su naturaleza, permitiendo reconocer el bien y el mal afin de realizar el primero y evitar el último, de la noción moderna hobbesiana que concibe la lex naturalis como norma general que obliga a realizar lo que preserve mejor su vida u omitir lo que pueda destruirla o privarle de los medios de conservarla. El objetivo de este artículo es mostrar cómo y porqué se llega a estas diferencias tan marcadas. (shrink)

Uno de los tópicos principales de la teoría clásica del derecho natural es el de la relación entre derecho natural y positivo. Para todos los autores clásicos, el derecho positivo encuentra su origen en los principios universales del derecho, que Santo Tomás ha llamado lex naturalis. Pero estos principios universales del derecho son tan generales e inespecíficos, que para formar parte de un ordenamiento jurídico concreto (en una comunidad política concreta) necesitan de alguna especificación. Este modo de «especificar» los preceptos (...) naturales de moralidad es lo que se llama determinación, que es el tema de nuestro trabajo. (shrink)

Este texto analiza la teoría del naturalismo ético de Finnis y su relevancia en la fundamentación de la ley y el derecho, con el fin de señalar cómo las ideas de este autor proporcionan una alternativa al iuspositivismo. En su obra Ley natural y derechos naturales, Finnis propone una ética de la racionalidad práctica que demuestra la posibilidad de hacer juicios objetivos sobre lo bueno y razonar sobre el bien. En este sentido, la racionalidad práctica adquiere un papel fundamental (...) en la justificación de la ley y el derecho, dado que implica decidir sobre acciones coherentes con principios morales objetivos. Con el fin de facilitar el diálogo y la comprensión de la teoría de Finnis, esta es discutida en relación con las perspectivas de Tughendhat y Habermas. (shrink)

El que existan o no leyes psicofísicas tiene consecuencias para el problema mente-cuerpo en general y en particular para las diversas teorías de identidad de lo mental y lo físico, sobre todo en relación con la posibilidad de reducción de la psicología a alguna ciencia física. En este artículo me propongo examinar uno de los argumentos en contra de la existencia de leyes psicofísicas que se basa en la teoría de las clases naturales propuesta por Putnam y (...) Kripke. El esquema general del argumento, propuesto por McGinn, es el siguiente: 1) Cualquier término que aparezca en una ley deberá ser un término de clase natural. 2) Los términos mentales no son términos de clases naturales. Por lo tanto, 3) Ninguna ley puede incluir términos mentales. Este argumento excluye la posibilidad de leyes que contengan términos mentales, esto es, va en contra tanto de leyes psicofísicas como de leyes puramente psicológicas. A lo largo del articulo argumentaré a favor de las premisas de este argumento, sobre todo a favor de la segunda. (shrink)

William Connolly is in error when he remarks that I begin my article with a discussion of scientific accounts that reduce the emotions to a few genetically wired categories and that I suggest that the cultural theorists who are interested in affect are driven in the same reductive direction.

The purpose of my article, “The Turn to Affect: A Critique,” was to show that the theorists whose work I analyzed are all committed to the mistaken idea that affective processes are responses of the organism that occur independently of cognition or intention.1 My aim was not to emphasize the differences among the authors under consideration—differences that, as I noted in my article, of course do exist—but rather to demonstrate that those theorists share certain erroneous assumptions about the separation presumed (...) to obtain between the affect system on the one hand and intention, cognition, and meaning on the other and to lay out the unfortunate consequences of their doing so.If Adam Frank and Elizabeth A. Wilson wish for another kind of essay than the one I have written—an essay that would stress the divergences between the ideas of Silvan S. Tomkins and those of the other affect theorists I consider, especially those of Paul Ekman, in order to show what was distinctive about Tomkins's contributions—let them write it. But in such an essay they will have to acknowledge certain facts about the relationship between Tomkins and Ekman that, in their haste to separate Tomkins's theories from Ekman's, they are in danger of neglecting or misrepresenting. African jurisprudence, like African philosophy, continues to be hotly debated. This article contends that the debate straddles the uniqueness claim which either emphasises the existence or possibility of a peculiar legal framework on the continent, and a historical co-extensional position reiterating that African jurisprudence is a continuum of other legal traditions. The article argues that there is no uniquely African jurisprudence, and that what obtains within the structures of jurisprudence on the continent also exists within various legal traditions elsewhere, and (...) as such can at best be described as ‘jurisprudence in Africa’ rather than ‘African jurisprudence’. It defends this thesis through analytic and comparative explications of the content of natural law theory and legal positivism as experienced on the continent. It concedes that relics of the colonial legal experience create contestations that inform scholars’ calls for a return to traditional legal systems. It concludes that a reconstructive jurisprudence in Africa must take cognisance of the continent’s historical and evolutionary legal experiences, but that a unified or monolithic theory may not be sufficient to address the choice of functional jurisprudence. Socially Responsible Investment (SRI) has grown considerably over the past three decades. One form of SRI, engagement-SRI, is today by far the most practiced form of SRI (in assets managed) and has the potential to mainstream SRI even further. However, lack of formalized engagement procedures and evaluation tools leave the engagement practice too opaque for such a mainstreaming. This article can be considered as a first step in the development of a standard for the engagement practice. By developing an engagement (...) heuristic, this article offers a more transparent engagement dialog. Drawing on Stevenson's and Austin's speech-act theories, this article develops a classification of management's responses to the signaling of allegations and controversies on two dimensions: a factual dimension concerning (dis)agreements on factual claims and an attitudinal dimension concerning (dis)agreements on responsibilities, values, and norms. On the basis of the distinctions this article develops, the authors provide for a synoptic table and offer a next-step heuristic for the engagement process that started with signaling a concern to management. The article uses an engagement logic that, while keeping the exit option for the investor open, allows management to address signaled concerns without having to let down or to opt out at the first setback in the dialog process between investor and investee corporation. In recent years, emotions have become a major, vibrant topic of research not merely in the biological and psychological sciences but throughout a wide swath of the humanities and social sciences as well. Yet, surprisingly, there is still no consensus on their basic nature or workings. Ruth Leys’s brilliant, much anticipated history, therefore, is a story of controversy and disagreement. The Ascent of Affect focuses on the post–World War II period, when interest in emotions as an object of study began (...) to revive. Leys analyzes the ongoing debate over how to understand emotions, paying particular attention to the continual conflict between camps that argue for the intentionality or meaning of emotions but have trouble explaining their presence in non-human animals and those that argue for the universality of emotions but struggle when the question turns to meaning. Addressing the work of key figures from across the spectrum, considering the potentially misleading appeal of neuroscience for those working in the humanities, and bringing her story fully up to date by taking in the latest debates, Leys presents here the most thorough analysis available of how we have tried to think about how we feel. The last decade has seen rise in technologies that allow humans to send and receive intimate touch across long distances. Drawing together platform studies, digital intimacy studies, phenomenology of touch, and ethics of technology, we argue that these new haptic communication devices require specific ethical consideration of consent. The paper describes several technologies, including Kiiroo teledildonics, the Kissenger, the Apple Watch, and Hey Bracelet, highlighting how the sense of touch is used in marketing to evoke a feeling of connection within (...) the digital sphere. We then discuss the ambiguity of skin-to-skin touch and how it is further complicated in digital touch by remediation through platforms, companies, developers, manufacturers, cloud storage sites, the collection and use of data, research, satellites, and the internet. Lastly, we raise concerns about how consent of data collection and physical consent between users will be determined, draw on examples in virtual reality and sex-robotics, and ultimately arguing for further interdisciplinary research into this area. Relevant semiotic theory is meaningfully integrated into each chapter.

Discussing authorial power, landscape metaphor and the notions of community and sense of place, this explores the ways in which spatial and cultural analysis have found much common ground in making sense of ourselves and the landscape we inhabit.

We re-examine the geometry lesson in the Meno, focusing on the interaction between interlocutors in the practice of recollection. We appeal to an analogy with interactive memory to suggest how Plato could think that inquiry could be successful even when participants have no awareness of what would satisfy their inquiry. This exposes a feature of recollection that needs no metaphysical assumptions, and which emphasises interaction. This feature, which has escaped the notice of philosophers, is more fundamental to the Meno than (...) a theory of innate ideas. Such a theory may be superimposed on the view about interactive memory we describe for the Meno, but to focus on Plato’s epistemological theory without first understanding what he has to say about the social dimensions of memory is putting the cart before the horse. This paper explores semi‐formal interactions between SRI‐investors that take the governance route rather than deploy a best‐in‐class logic or exclusionary screening. On the basis of a stakeholder typology of the investor and of the chosen topic of interaction, namely compliance with the core ILO labour conventions, the paper formulates 10 expectations about management reactions to the concerns raised by investors. These expectations cover responsiveness, acknowledgment of positions and general attitude. The expectations are then related to the factual discourse by management (...) responding to such concerns raised by investors. Based on data obtained from the Portfolio21‐correspondence, which is a joint initiative of European investors, it is found that management is very willing to discuss cases but at the same time denies the truth‐value of the allegations. This study investigates how social capital affects managers’ use of corporate resources. We find that for firms located in U.S. counties with a high level of social capital, (i) corporate cash holdings have higher marginal value, (ii) the contribution of capital expenditures to shareholder value is higher, and (iii) acquirers experience higher announcement-period abnormal stock returns. We further find that social capital decreases both over- and under-investment, and thus improves ex post corporate investment efficiency. Our evidence suggests that in communities (...) with a high level of social capital, strong social norms and dense social networks constrain unethical corporate behavior, which induces more efficient use of corporate resources.
