The “New Natural Law” Theory (NNL) of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators offers a distinctive account of intentional action, which underlies a moral theory that aims to justify many aspects of traditional morality and Catholic doctrine. -/- In fact, we show that the NNL is committed to premises that entail the permissibility of many actions that are irreconcilable with traditional morality and Catholic doctrine, such as elective abortions. These consequences follow principally from two aspects of the (...) NNL. The first aspect is its distinctive version of the planning theory of intention, in which adopting the 'first-person perspective' of an agent is a sufficient, and not merely necessary, condition for determining the nature of his intentional action; this planning theory rests upon an implicitly Cartesian conception of human behavior, in which behavior chosen by an agent has no intrinsic “intentionalness” apart from what he confers upon it as part of his plan. The second aspect is the NNL's distinctive account of basic human goods' incommensurability, according to which there is no common factor shared by basic human goods that allows them to be comparatively ranked in any way that directs practical deliberation. -/- The entailments of these two aspects of the NNL, we argue, amount to a reductio ad absurdum. Pace the proponents of the NNL account, we sketch an alternative hylomorphic conception of intentional action that avoids untoward moral implications by grounding human agency in the exercise of basic powers that are either (a) essential constituents of human nature or (b) acquired through participation in social practices. So my keen interest in this book and its topic is more than just theological [End Page 209] curiosity. It includes personal and emotional dimensions, as I'm sure it will for many readers.This book is an attempt to understand modern adoptive practices from a primarily Christian/Catholic perspective, with helpful allusions to the beliefs and practices of the other Abrahamic faiths. Overall, I believe the book succeeds in presenting a solid theological foundation for adoption in general and, more specifically, for its current mainstream manifestation in the developed world. The author doesn't shy away from the various controversies related to adoption—like assisted reproduction, LGBTQ adoption, embryo adoption—and he takes on other authors who make claims about adoption that he believes distract or obscure the central purpose of adoption, which is to provide a child a "needed place of belonging" within the network of loving relationships that is the ideal of the family (38).My reservations about the book are two. The first has to do with the inconsistent tone of the book, which tends to swing, abruptly at times, from a theological and analytical tone to one that feels more popular and homiletic—even to the point of being maudlin. As stated earlier, I have high regard for most of the analytical sections and find the overarching thesis convincing. Generally, in these sections, the method begins with the lived experience of adoptees and their parents and works through scripture, tradition, and critical reflection to arrive at a reasonable conclusion. However, occasionally the book drifts into uncritical and merely emotive territory, and this is especially the case in the sections called "interludes," where the author presents letters to adoptees from their parents reprinted from the Christian Century magazine. These seem out of place and even distracting. Of even greater concern is the concluding chapter, where the author should be summarizing and highlighting the strengths of his thesis. Instead he chose to draw homiletic lessons from Anne of Green Gables (110).My second reservation is not so much a critique of this book but of the state of contemporary Catholic sexual ethics, which forms a backdrop for the entire book. The book accurately reflects a mainstream position in Catholic sexual ethics, which abandoned a narrow focus on procreation decades ago in favor of one highlighting the unitive and relational aspects of human intimacy. This move away from a strictly deontological framework stressing the duty to procreate and toward a teleological ethic stressing the need to model human relationships after divine ones has been celebrated for good reasons, but it has not come without costs. Like all teleological ideals, this sexual ethic is attractive to purveyors of high philosophy but tends to be thoroughly abstract and almost entirely incapable of offering concrete, practical guidance. Because it is so abstract, its application to specific moral issues can seem arbitrary and at the whim of the author. Such is the case in this book, for instance, when this teleological ideal is wielded to shed doubt on LGBTQ adoption. It is particularly telling [End Page 210] that the author neglects to consult lived experience in this section, ignoring the mountains of evidence readily available that LGBTQ families can be just as loving and nurturing as those of traditional families. In our contemporary post-modern context, it has become increasingly awkward to talk about a good that is shared by all. This is particularly true in the context of mammoth multi-national corporations operating in global markets. Nevertheless, it is precisely some of these same enormous, aggrandizing forces that have given rise to recent corporate scandals. These, in turn, raise questions about ethical systems that are focused too myopically on self-interest, or the interest of specific groups, locations or cultures. The obvious traditional (...) alternative to moral bellybutton gazing is the common good, which challenges the modern business enterprise to realize non-instrumental values that can only be attained in our life together. The common good dictates that leadership should be judged, first of all, according to moral criteria rather than professional competence. It helps correct the distorted prioritization of the maximization of profit in every business decision, recognizing that businesses have a multitude of rights and responsibilities, and the common good reminds us that the first of these is not always profit-making. The 2015 Paris Agreement set a global warming limit of 2°C above preindustrial levels. Corporations play an important role in achieving this objective, and methods have recently been developed to map global climate targets to specific industries, and individual corporations within those industries. In this article, we assess whether Sustainability ratings capture corporate performance in meeting the 2°C target. We analyze nine rating schemes used by investors and three commonly used in academic studies. Most rating schemes do consider corporate greenhouse (...) gas emissions in their analysis, whereas only a minority scale emissions by factors that have the potential to allow benchmarking against science-based targets. None take the final step of mapping climate indicators against the 2°C target. Furthermore, we find a lack of consistency in the climate change ratings of the databases used in academic studies. These results are concerning in the context of being able to meet global climate change goals. (shrink)

In order to promote social distancing during the recent COVID-19 pandemic, physicians and healthcare systems have made efforts to replace in-person with virtual clinic visits when feasible. While these efforts have been well received and seem compatible with sound clinical practice, they do not perfectly replicate the experience of a face-to-face exchange between doctor and patient. This essay attempts to describe features of the virtual visit that distinguish it from its face-to-face analog and considers the phenomenological work of Emmanuel Levinas (...) in arguing that these differences may limit the force of the ethical summons a provider would otherwise experience before the face of a patient. The diminishment of this signal therapeutic experience may engender vocational as well as clinical consequences, which should be weighed against the practical benefits of the virtual visit as we consider whether our enthusiasm for this mode of practice should continue. The dominant model for bioethical inquiry taught in medical schools is that of principlism. The heritage of this methodology can be traced to the Enlightenment project of generating a universalizable justification for normative morality arising from within the individual, rational agent. This project has been criticized by Alasdair MacIntyre who suggests that its failure has resulted in a fragmented and incoherent contemporary ethical framework characterized by fundamental intractability in moral debate. This incoherence implicates principlist conceptions of bioethics. Medical ethics as (...) practiced, though, is partially in keeping with teleological alternatives to principlism. Nonetheless, the hegemony of principlism threatens to harm the practice of good medicine whenever it is used to provide justification for the sanction or prohibition of practices, despite not being equipped to grant moral authority to such justifications. An example of this failure and its resulting harm is expressed in the growing obsolescence of living donor liver transplantation. (shrink)

This article analyses the relations that teachers and school leaders establish with themselves and with others—especially those who would seek to govern them—through the professional and personal–professional activities that increasingly accompany pedagogical and administrative practice today. Specifically, the article seeks to analyse the conditions under which such ‘ethical-governmental’ relations have become possible and to clarify the lines of power, truth and ethics that are in play within them. In this way, it is argued, their intelligibility may be recovered; their contingencies (...) disclosed. The article first posits a non-psychologised, ‘enfolded’ notion of the self on which analysis rests before turning to an analytics of government of the conditions themselves. An important element within this entanglement of diverse events, discourses, practices and foldings is the ensemble of policies and practices developed by the Australian Institute for Teaching and School Leadership. The article argues that the programmes of this national agency are a salient and widespread force for acting upon teachers’ and school leaders’ self-constitution as a subject of their own actions—a subject which, in consequence, is enjoined to be more agile, self-reliant, engaged and entrepreneurial than its ‘routine-bound’ predecessors; a subject we describe as the ‘adaptive professional’. First, we question the extent to which O'Brien & Opie have established that the classical approach is unable to support a viable vehicle theory of consciousness. Second, assuming that connectionism does have the resources to support a vehicle theory, we explore how the activity of the units of a PDP network might sum together to form phenomenal experience (PE).

This article analyses ‘performance government’ as an emergent form of rule in advanced liberal democracies. It discloses how teachers and school leaders in Australia are being governed by the practices of performance government which centre on the recently established Australian Institute for Teaching and School Leadership (AITSL) and are given direction by two major strategies implicit within the exercise of this form of power: activation and regulation. Through an ‘analytics of government’ of these practices, the article unravels the new configurations (...) of corporatized expert and academic knowledge—and their attendant methods of application—by which the self-governing capacities of teachers and school leaders are being activated and regulated in ways that seek to optimize the performance of these professionals. The article concludes by outlining some of the dangers of performance government for the professional freedom of educators and school leaders. (shrink)

Research about the Olympic Games has primarily focused on preparing athletes for competition. Less attention has been paid to the post-Olympic-phase and athlete well-being during this time. This study explored Australian Olympic athletes’ experiences following the conclusion of the 2016 Rio Olympic Games, including the factors that may have contributed to or challenged their well-being during this time. Eighteen athletes participated in semi-structured interviews and thematic analysis revealed that when Olympic performance appraisal met prior expectations, when athletes planned for a (...) return to work or study, and when support from a variety of sources was readily available, this positively influenced athletes’ well-being during the POP. When these factors were not in place, more challenging post-Games experiences were present, and well-being was compromised. The findings contribute to the broader literature on elite athlete well-being and at an applied level, may be used to inform targeted programs that focus on supporting athletes after an Olympic campaign. The title of the volume alludes to a phrase found in Plato, Aristotle and Plotinus, referring to aspects of living behaviour involving both body and soul, and is a commonplace in ancient philosophy, dealt with in very different ways by different authors.

This dossier article contains four short and varied contributions from activists and other service and healthcare providers who have been agitating and working on the frontlines of HIV/AIDS in Ireland since the early 1980s. The dossier contains: (1) a history, by Bill Foley, of the early collective efforts of a group of gay men to provoke government action and healthcare under the umbrella of Gay Health Action (GHA) (2) a speech delivered by Dr. Erin Nugent to government officials on the (...) re-branding of HIV Ireland in 2015; (3) a brief history, recounted by Noel Donnellan, of ACT UP Dublin since it was revitalized in 2016 by a small cohort of dedicated activists from a dormant group into a vibrant collective that has achieved great legislative change with regards to pre-exposure prophylaxis (PrEP); and (4) a polemic, written by Thomas Strong, on living with HIV as a queer man in Ireland that demonstrates the ways in which HIV stigma not only thrives in but molds and shapes twenty-first-century gay men’s communities, both in real life and online. Humanist sociologists are activists rooted in the reality of history and change and guided by a concern for the 'real life' problems of equality, peace, and social justice. They view people as active shapers of social life, capable of creating societies in which everyone's potential can unfold. The recent interest in wisdom in professional health care practice is explored in this article. Key features of wisdom are identified via consideration of certain classical, ancient and modern sources. Common themes are discussed in terms of their contribution to ‘clinical wisdom’ itself and this is reviewed against the nature of contemporary nursing education. The distinctive features of wisdom (recognition of contextual factors, the place of the person and timeliness) may enable their significance for practice to be promoted in more (...) coherent ways in nursing education. Wisdom as practical knowledge (phronesis) is offered as a complementary perspective within the educational preparation and practice of students of nursing. Certain limitations within contemporary UK nursing education are identified that may inhibit development of clinical wisdom. These are: the modularization of programmes in higher education institutions, the division of pastoral and academic support and the relationship between theory and practice. (shrink)

This article aims to describe underlying principles of paradigm shifts in clinical medicine by means of analysis of typical examples. Retrospectively, profound shifts of ruling paradigms can be shown in diverse fields such as outcome research, in the redefining of patient's and doctor's autonomies, in the challenges presented by consumer medicine and the free market economy. This has provoked controversy between doctors, patients and the community. The judgement on whether recent shifts in paradigms in medicine have improved the health care (...) delivered today is by no means uncontroversial. Aiming to demonstrate how shifts of paradigms in medicine occur and what consequences can result from such shifts we reflect on the works of Thomas S. Kuhn, the eminent philosopher of science. An analysis of his theories lends important insight into the observed shifts in paradigms. (shrink)

Oaksford & Chater (O&C) have rejected logic in favor of probability theory for reasons that are irrelevant to mental-logic theory, because mental-logic theory differs from standard logic in significant ways. Similar to O&C, mental-logic theory rejects the use of the material conditional and deals with the completeness problem by limiting the scope of its procedures to local sets of propositions.

A contemporary debate concerning the epistemology of testimony is portrayed by its protagonists as having its origins in the eighteenth century and the respective views of David Hume and Thomas Reid. Hume is characterized as a reductionist and Reid as an anti-reductionist. This terminology has been widely adopted and the reductive approach has become synonymous with Hume. In Sect. 1 I spell out the reductionist interpretation of Hume in which the justification possessed by testimonially-acquired beliefs is reducible to the (...) epistemic properties of perception, memory and inductive inference. This account of testimony is taken to be found in the section ‘On Miracles’ of Hume’s Enquiry concerning Human Understanding. In Sect. 2 I introduce the distinction between global and local reductionism, and Coady’s interpretation of Hume as a global reductionist. He takes Hume’s position to be untenable. The rest of the paper explores alternative interpretations of Hume. Section 3 develops a local reductionist interpretation of Hume on testimony. It is argued, though, that such an approach is unstable and, in response, Sect. 4 turns to anti-reductionism in its contemporary forms and in Reid’s teleological account. In Sect. 5 I argue for an anti-reductionist account of Hume, one drawn from his discussion of the testimony of history in the Treatise of Human Nature, thus moving away from the usually exclusive focus upon the discussion of miracles in the first Enquiry, upon which the reductionist interpretation is based. Given the standard meaning of ‘Humeanism’ in the current debate, my interpretation amounts to the claim that Hume is not a Humean with respect to testimony. (shrink)

The form of beauty is the ultimate correlate of love in Socrates' account of Diotima's teaching in the Symposium . To arrive at this insight, Socrates aims to show the `absurdity' of adopting any more specific correlate as a definition of the very nature of love. Were love defined as love `for a father or a mother', we could never love anyone who was not our father or our mother. An obvious absurdity.

Many egalitarians believe that there is a pro tanto reason to remedy inequalities of opportunity in access to higher education. This consensus, I argue, masks practical disagreement among egalitarians: in many real-world choice contexts, egalitarians will disagree about which policies are to be endorsed, both from the point of view of equality and all things considered. I focus my discussion on a real-world case (the ‘big squeeze’ – so-called because the children of welloff families ‘squeeze out’ the children of less (...) well-off families from access to highly selective US universities) that has recently been discussed by Amy Gutmann. I argue that while (a) the ‘big squeeze’ is condemned by the ideal of equal opportunity, nevertheless (b) different egalitarians will favor different policies in response to the ‘big squeeze’, and (c) one intuitive, and apparently egalitarian, response lacks support from most plausible egalitarian views. Aristotle (wrongly) took one formulation of the law of the unity of opposites to imply an endless succession of the one and the many, and therefore the agreement of Heraclitus with Empedocles. It forms part of certain theories about the beginnings of culture current in late antiquity. These are notoriously difficult to trace to their sources, but they already existed in some form in the fifth century b.c. One idea common to these theories is that of progress, and for this reason a fragment of Xenophanes (...) is sometimes cited as their remote prototype: ‘The gods did not reveal all things to men from the beginning; instead, by seeking, men discover what is better in time’. Mainly on the strength of this fragment, Ludwig Edelstein devoted the first chapter of his book The Idea of Progress in Classical Antiquity to Xenophanes, and W. K. C. Guthrie has even declared that there is good reason to attribute to him a fuller account of progress, one that would include details found in later authors who speak of the early life of mankind. One of these details is the statement that the life of primitive men was ‘brutal’ or ‘beastlike’ . In these authors the implication of that term varies from ‘unschooled in the basic crafts’ to ‘inhumanly violent and bloodthirsty’. In one sense or the other it is repeatedly encountered in ancient references to this subject. Accounts of primitive brutishness which make use of the word θηριώδης (or θηριωδς can be found in the Suppliants of Euripides, in the Hippocratic treatise On Ancient Medicine, in three passages of Diodorus, one of which is thought by some to contain Democritean doctrine, in four passages of Isocrates, in a fragment from a satyr-play Sisyphus which the ancient sources attribute variously to Euripides and to Critias, in a fragment of Athenion, in a second-century inscription, in Plutarch, in Tatian, in Themistius, and in a scholion to Euripides.
