This article shows how descriptive imagery can be used to hijack evolved psychological instincts and prejudice the judgment of others, particularly in the legal and political domains. When this happens, logic may be unseated in favor of deep-seated instinctual responses, often to a problematic degree. Laws, therefore, can serve as one potential testing ground for new theories about the content and structure of intuitions. Here the model of ownership psychology as an evolved cognitive adaptation is evaluated against long-standing features of property law.

From the desire to find support and confirmation for our personal sensory observations, and from the human interest in sharing our experiences with others, there emerges a basic principle of scientific method: We demand the possibility of intelligible communication and agreement concerning individuals' sensory perceptions in particular and their experiences in general. This requirement is made both for the natural and social sciences. This article argues that Dr. Kornu has failed to demonstrate how Jonathan Edward’s theology of beauty can substantively contribute to a contemporary Christian theology of medicine. Edward’s appropriation of Neo-Platonic language is contrasted with the use of the same language by the Orthodox Church Fathers. It is argued that the absence of a mystical understanding of theology, sacramental church structure, and ascetical discipline within the Reformed Tradition renders any attempt to appropriate a Neo-Platonic understanding of beauty ineffectual.

In the Bayesian approach to quantum mechanics, probabilities—and thus quantum states—represent an agent’s degrees of belief, rather than corresponding to objective properties of physical systems. In this paper we investigate the concept of certainty in quantum mechanics. Particularly, we show how the probability-1 predictions derived from pure quantum states highlight a fundamental difference between our Bayesian approach, on the one hand, and Copenhagen and similar interpretations on the other. We first review the main arguments for the general claim that probabilities (...) always represent degrees of belief. We then argue that a quantum state prepared by some physical device always depends on an agent’s prior beliefs, implying that the probability-1 predictions derived from that state also depend on the agent’s prior beliefs. Quantum certainty is therefore always some agent’s certainty. Conversely, if facts about an experimental setup could imply agent-independent certainty for a measurement outcome, as in many Copenhagen-like interpretations, that outcome would effectively correspond to a preexisting system property. The idea that measurement outcomes occurring with certainty correspond to preexisting system properties is, however, in conflict with locality. We prove a Gleason-type theorem for the quantum probability rule using frame functions defined on positive-operator-valued measures, as opposed to the restricted class of orthogonal projection-valued measures used in the original theorem. The advantage of this method is that it works for two-dimensional quantum systems and even for vector spaces over rational fields—settings where the standard theorem fails. Furthermore, unlike the method necessary for proving the original result, the present one is rather elementary. In the case of a qubit, we (...) investigate similar results for frame functions defined upon various restricted classes of POVMs. For the so-called trine measurements, the standard quantum probability rule is again recovered. Various philosophers have wanted to move from a (P.F.) “Strawsonian” understanding of the “practices of moral responsibility” to a non-skeptical result. I focus on a strategy moving from a “response-dependent” theory of responsibility. I aim to show that a key analogy associated with this strategy fails to support a compatibilist result. It seems clear that nothing could show that nothing we have been laughing at has really been funny. If “the funny” is similar to “the blameworthy”, then perhaps it would (...) follow that nothing could show that no one we have ever blamed has really been blameworthy. The comparison is interesting, but inconclusive: even if we grant that these properties are normatively similar, the latter has substantive empirical presuppositions, whereas the former does not. One important upshot: even if the standards operative in our practices cannot be mistaken, it could nevertheless be that no one has ever met these standards Ruling out this possibility seemingly requires re-engaging in all of the so-called "metaphysical" debates Strawsonians are keen to avoid. It is true that Hegelian historicism has indeed led to a dominant ethos of moral relativism bound up with the belief that individual self-actualization is the highest value, thus creating a society that is, in the phrase of H. Tristram Engelhardt, Jr. “after God.” Nevertheless, this egocentric and nihilistic relativism exists alongside a robust and militant moral totalitarianism enforced by the modern clerisy of the media, multi-national corporations, and government bureaucrats, that is, a “managerial elite.” This article argues that the (...) transcendental idealism of Kant and the subsequent historicization of Kant’s dialectic by Hegel has served to reconceptualize the older, Baconian view of science, creating the idea that scientific progress is moving toward the goal of a future perfection of absolute rational unity. The a priori rational structure of reality that makes science possible is not a Platonic Ideal, but something that unfolds within history. This is what allowed Marx to conceive of dialectical materialism as a science, and this is what allows the managerial elite of the present to claim a scientific and objective basis for their programs while at the same time using the tools of historical and cultural criticism to relativize and historicize the claims of all competing moral and social “constructs.”. Inductively defined structures are ubiquitous in mathematics; their specification is unambiguous and their properties are powerful. All fields of mathematical logic feature these structures prominently: the formula of a language, the set of theorems, the natural numbers, the primitive recursive functions, the constructive number classes and segments of the cumulative hierarchy of sets. -/- This dissertation gives a mathematical characterization of a species of inductively defined structures, called accessible domains, which include all of the above examples except the set of (...) theorems. The concept of an accessible domain comes from Wilfried Sieg's analysis of proof-theoretic practices, starting with his dissertation. In particular, he noticed the special epistemological character of elements of an accessible domain: they can always be uniquely identified with their build-up. Generally, the unique build-up of elements justifies the principles of induction and recursion. -/- I use category theory to give an abstract characterization of accessible domains. I claim that accessible domains are all instances of initial algebras for endofunctors. Grounded in the historical roots of Sieg's discussions, this dissertation shows how the properties of initial algebras for endofunctors and accessible domains coincide in a satisfying and natural way. -/- Filling out this characterization, I show how important examples of accessible domains fit into this broad characterization. I first characterize some accessible domains by relatively simple functors (e.g. finite, polynomial, those that preserve certain colimits) where we can see how iterating the functor can produce the accessible domain. Then I describe accessible domains that result from more involved specifications (e.g. ordinals and segments of the cumulative hierarchies associated with CZF, IZF, and ZF) by relying heavily on algebraic set theory. I end with a discussion of some of the methodological features of category theory in particular that helped characterize accessible domains. (shrink)

Relating war to ideology, this book is based on the proposition that men act as they think, and think as they believe, and that belief - religious or otherwise - conditions attitudes toward the nature and conduct of war. Carlton conducts his lively discussion in a historical and comparative setting, with case studies of war in eleven societies , in each of which the enemy is differently perceived.
