Bioethics represents a dramatic revision of the centuries-old professional ethics that governed the behavior of physicians and their relationships with patients. This paper identifies brand age as an important factor in consumers’ brand evaluations following unethical firm behavior. In two experiments, we assess the effect of brand age on three types of brand evaluations: perceived quality, brand credibility, and behavioral intentions following a brand crisis. The findings suggest that disclosing an older brand’s age can not only improve consumers’ brand evaluations in general, but can also provide a buffering effect when the firm is involved in unethical behavior. Moreover, the relationship between (...) brand age and consumers’ post-crisis intentions is mediated by perceived brand credibility. By exploring consumers’ attitudes following the most common firm response strategies, this research also identifies a boundary condition of the mitigating effect of brand age. Pursuant to the aims and scope of the Special Issue it is part of, this invited contribution seeks to shed new light on the nature and working logic of legal reasoning. It does so by engaging with two of the most authoritative views on the subject which have recently been put forward in the Common law world—namely, Lord Hoffmann’s, and Larry Alexander and Emily Sherwin’s. A key-concern of the Anglophone debate on legal reasoning is whether it is a specialistic type (...) of reasoning requiring ad hoc education and training, or ordinary reasoning subject to ordinary rules of language (i.e. sentence construction, interpretation, etc.). The article argues that compelling though they are, these sorts of enquiries do not help to understand what legal reasoning really is and how it operates. In particular, it argues that if we are to understand what legal reasoning is and how it works, we ought to examine the propositions it aims to craft and support. In so arguing, the article further shows that exploring law’s nature and operations as an intellectual means for social ordering also helps to understand how law works as a regulatory phenomenon more generally. A theme of growing importance in both the law and philosophy and socio-legal literature is how regulatory dynamics can be identified and normative expectations met in an age when transnational actors operate on a global plane and in increasingly fragmented and transformative contexts. A reconsideration of established theories and axiomatic findings on regulatory phenomena is an essential part of this discourse. There is indeed an urgent need for discontinuity regarding what we know about, among other things, law, legality, sovereignty and (...) political legitimacy, power relations, institutional design and development, and pluralist dynamics of ordering under processes of globalisation and transnationalism. Making an important contribution to the scholarly debate on the subject, this volume features original and much-needed essays of theoretical and applied legal philosophy as well as socio-legal accounts that reflect on whether legal positivism has anything to offer to this intellectual enterprise. Albert Lautman (1908-1944) was a French philosopher of mathematics whose work played a crucial role in the history of contemporary French philosophy. His ideas have had an enormous influence on key contemporary thinkers including Gilles Deleuze and Alain Badiou, for whom he is a major touchstone in the development of their own engagements with mathematics. Mathematics, Ideas and the Physical Real presents the first English translation of Lautman's published works between 1933 and his death in 1944. El tercer enfoque despliega una aproximación filosófico-política. Estos enfoques permiten introducir tres “horizontes de pregunta” principalmente relacionados con el método, con lo popular y con lo indígena, que son expuestos como (...) asuntos centrales en toda su obra. Estos “horizontes de pregunta” buscan comprender los alcances de la filosofía de Kusch y su contribución al pensamiento filosófico americano. This paper analyses the work of Rodolfo Kusch remarking his main philosophical proposals through three correlated perspectives. The first perspective refers to phenomenology and culture. The second focuses on the influence of anthropology and the problem of symbols. The third posits a political-philosophical approximation. These perspectives operate interdependently as the background for Kusch’s philosophy and allow us to introduce three “questioning horizons” related to the method, the popular and the indigenous as the central issues of his philosophical work. Thus, these “questioning horizons” build a platform to understand Kusch’s philosophy and his contribution to the Latin American philosophy. (shrink)

Blending social analysis and philosophy, Albert Borgmann maintains that technology creates a controlling pattern in our lives.

An accurate classification of bacteria is essential for the proper identification of patient infections and subsequent treatment decisions. Multi-Locus Sequence Typing (MLST) is a genetic technique for bacterial classification. MLST classifications are used to cluster bacteria into clonal complexes. Importantly, clonal complexes can serve as a biological species concept for bacteria, facilitating an otherwise difficult taxonomic classification. In this paper, we argue for the inclusion of terms relating to clonal complexes in biomedical ontologies.

Tyler Burge offers a theory of testimony that allows for the possibility of both testimonial a priori warrant and testimonial a priori knowledge. I uncover a tension in his account of the relationship between the two, and locate its source in the analogy that Burge draws between testimonial warrant and preservative memory. I contend that this analogy should be rejected, and offer a revision of Burge's theory that eliminates the tension. I conclude by assessing the impact of the revised theory (...) on the scope of a priori knowledge. (shrink)

The study examines the argumentative competencies of people with Asperger syndrome (AS) and compares this with those of normal – or what are called neurotypical (NT) – subjects. To investigate how people with AS recognise, evaluate and engage in argumentation, we have adapted and applied the empirical instrument developed by van Eemeren, Garssen and Meuffels to study the conventional validity of the pragma-dialectical freedom rule (van Eemeren, Gars- sen & Meuffels 2003a; 2003b; 2005a; 2005b; van Eemeren & Meuffels, 2002). In the recent literature on concepts, two extreme positions concerning animal minds are predominant: the one that animals possess neither concepts nor beliefs, and the one that some animals possess concepts as well as beliefs. A characteristic feature of this controversy is the lack of consensus on the criteria for possessing a concept or having a belief. Addressing this deficit, we propose a new theory of concepts which takes recent case studies of complex animal behavior into account. The main aim (...) of the paper is to present an epistemic theory of concepts and to defend a detailed theory of criteria for having concepts. The distinction between nonconceptual, conceptual, and propositional representations is inherent to this theory. E. J. Lowe offers an account of modal knowledge that involves two primary theses. First, the basis of modal knowledge is essential knowledge, and the source of essential knowledge is grasp of essence. Second, all empirical knowledge ultimately depends on some modal knowledge. This article assesses Lowe’s account and defends four conclusions. First, there is a tension in Lowe’s account of grasp of essence; it wavers between an undemanding version, which holds that grasp of essence requires no more than our (...) ordinary understanding of propositions, and a more demanding version, which holds that it requires rational insight into necessary relationships between essences. Second, both versions face serious challenges. Third, Lowe’s account of knowledge of essence does not provide a basis for modal knowledge. Fourth, Lowe’s supporting argument for his second thesis contains two significant gaps and the principles necessary to close the gaps reveal further tensions in his epistemological views. (shrink)
