Don Isaac Abravanel was one of the first Jewish thinkers to express republican positions, yet very little is known about his knowledge of humanistic republican conceptions. Had he read Leonardo Bruni’s republican writings? Had he even heard of them? In this essay I attempt to address this philological gap by comparing Abravanel’s republican commentary on 1 Samuel 8 with Bruni’s Laudatio florentinae Urbis, especially the motif of the plea to God to authorize a political regime. This comparison is particularly useful (...) for illuminating their respective positions on republicanism, their shared interests and conceptions, as well as their divergent attitudes to their own political and historical environment. One century after Gustav Landauer’s death, in a time marked by a deep doubt concerning modern politics, the volume proposes a fascinating overview of the articulation between _skepsis_ and _antipolitics_ in his multifaceted unconventional anarchism.

Based on evidence from press articles covering 39 corporate fraud cases that went public during the period 1992-2005, the objective of this article is to examine the role of managers' behavior in the commitment of the fraud. This study integrates the fraud triangle (FT) and the theory of planned behavior (TPB) to gain a better understanding of fraud cases. The results of the analysis suggest that personality traits appear to be a major fraud-risk factor. The analysis was further validated through (...) a quantitative analysis of keywords which confirmed that keywords associated with the attitudes/rationalizations component of the integrated theory were predominately found in fraud firms as opposed to a sample of control firms. The results of the study suggest that auditors should evaluate the ethics of management through the components of the TPB: the assessment of attitude, subjective norms, perceived behavioral control and moral obligation. Therefore, it is potentially important that the professional standards that are related to fraud detection strengthen the emphasis on managers' behavior that may be associated with unethical behavior. Prior research has documented the continued existence of an expectation gap, defined as the divergence between the public’s and the profession’s conceptions of auditor’s duties, despite the auditing profession’s attempt to adopt standards and practices to close this gap. In this paper, we consider one potential explanation for the persistence of the expectation gap: the role of media bias in shaping public opinion and views. We analyze press articles covering 40 U.S. corporate fraud cases discovered between 1992 and 2011. We (...) compare the auditor’s duties, described by the auditing standards, with the description of the fraud cases as found in the press articles. We draw upon prior research to identify three sources of the expectation gap: deficient performance, deficient standards, and unreasonable expectations. The results of our analysis provide evidence that the performance gap can be reduced by strengthening auditor’s willingness and ability to apply existing auditing standards concerning fraud detection; the standards gap can be narrowed by improving existing auditing standards; and unreasonable expectations, however, involve elements beyond the profession’s sphere of control. As a result, the expectation gap is unlikely to disappear given the media’s tendency to bias, with an overemphasis of unreasonable expectations in their coverage of frauds and press articles tending to reinforce the view that the auditor should take more responsibility for detecting fraud, irrespective of whether this is feasible at a reasonable cost. In addition to the primary role of the press in perpetuating the expectation gap, a second reason for continuation of the expectation gap is that the rational auditor will have difficulty in assessing subjective components of fraudulent behavior. A theory of planned behavior framework was employed to investigate the impact of corporate social responsibility perceptions on the job choice intentions of American, Chinese, and Lebanese college students. Attitudes toward CSR, subjective norm, and perceived behavioral control explained moderate levels of the variance in job choice intention in all three countries. Attitudes toward CSR, which entailed individual evaluations of CSR, were positively related to job choice intentions among Lebanese and American respondents, but not Chinese respondents. Subjective norm, the importance (...) accorded the views of significant others, was most strongly related to job choice intentions among Chinese respondents. Perceived behavioral control, the perceived degree of control over one’s actions and outcomes, had the strongest relationship to job choice intentions among American respondents. The authors concluded that respondents in the three countries did not differ in the extent to which they intend to work for socially responsible firms but tended to derive their intentions in different ways. Implications for tailoring CSR and recruitment efforts across countries are derived based on the findings. (shrink)

Figurative drawing is a skill that takes time to learn, and it evolves during different childhood phases that begin with scribbling and end with representational drawing. Between these phases, it is difficult to assess when and how children demonstrate intentions and representativeness in their drawings. The marks produced are increasingly goal-oriented and efficient as the child’s skills progress from scribbles to figurative drawings. Pre-figurative activities provide an opportunity to focus on drawing processes. We applied fourteen metrics to two different datasets (...) (_N_ = 65 and _N_ = 344) to better understand the intentional and representational processes behind drawing, and combined these metrics using principal component analysis (PCA) in different biologically significant dimensions. Three dimensions were identified: efficiency based on spatial metrics, diversity with color metrics, and temporal sequentiality. The metrics at play in each dimension are similar for both datasets, and PCA explains 77% of the variance in both datasets. Gender had no effect, but age influenced all three dimensions differently. These analyses for instance differentiate scribbles by children from those drawn by adults. The three dimensions highlighted by this study provide a better understanding of the emergence of intentions and representativeness in drawings. We discussed the perspectives of such findings in comparative psychology and evolutionary anthropology. (shrink)

Mais le contrat peut-il s'appliquer à la sexualité?? A-t-il les moyens de clarifier la relation humaine la plus intime qui (...) soit, de résoudre toutes les tensions liées au contact avec l'altérité?? Cédric Lagandré reprend le débat du statut culturel de la sexualité en Occident pour défendre, sur le socle du consentement mutuel, sa nature nécessairement infra-juridique. On ne peut accéder innocemment à la sexualité, non au sens où le désir sexuel serait moralement coupable, mais au sens où il implique un vertige, une angoisse et une mise à nu. La forme juridique, loin de civiliser la sexualité, l'enferme donc dans un cadre défini par la prostitution, et ne la repousse pas moins que la pornographie dans le registre trivial du besoin. L'effort contemporain pour passer l'intégralité du réel au crible des catégories juridiques ne peut donc qu'échouer devant l'ordre du symbolique: l'obscurité du désir rend la sexualité insaisissable à toute volonté de l'encadrer par la règle. In 2013, Bennett proposed a mereological theory in which the parthood relation is defined on the basis of two primitive relations: a is a part of b iff a fills a slot owned by b. However, this theory has issues counting how many parts an entity has. We explore the various counting problems and propose a new theory to solve them. Keeping the core idea of Bennett’s slots, this theory introduces mereological relations between slots. This theory enables us to solve (...) all known counting problems and to go beyond the limits of Bennett’s theory by theorising expected features of mereological theories: supplementation principles and mereological sum and fusion. Major depression is associated with a decrease of 1st person visual perspective in autobiographical memory, even after full remission. This study aimed to examine visual perspective in healthy never-depressed subjects presenting with either genetic or psychological vulnerability for depression. Sixty healthy participants performed the Autobiographical Memory Test with an assessment of visual perspective. Genetic vulnerability was defined by the presence of at least one S or LG allele of the polymorphism of the serotonin-transporter-linked promoter region . Psychological vulnerability was defined (...) by high scores of harm avoidance measured by the Temperament and Character Inventory. Life stress exposure, depressive mood, rumination, and familial history of depression were assessed through standardized procedures. Visual perspective for positive memories was independently predicted by both harm avoidance and a gene by environment interaction between the 5-HTTLPR polymorphism and life stress exposure. Visual perspective and vulnerability for depression may share some biological bases. (shrink)

In this article, I will discuss possible differences between ecosystems and organisms on the basis of their intrinsic complexity. As the concept of complexity still remains highly debated, I propose here a practical and original way to measure the complexity of an ecosystem or an organism. For this purpose, I suggest using the concept of logical depth (LD) in a specific manner, in order to take into account the difficulty as well as the time needed to generate the studied object. (...) I illustrate this method with fully controlled Daisyworld simulations (i.e., simulations based on the Gaia hypothesis) that have often been proposed to mimic living systems. The method consists of the following sequential stages: (1) identification of the shortest program able to numerically model the studied system (also called the Kolmogorov–Solomonoff complexity); (2) running the program, once if there are no stochastic components in the system, several times if stochastic components are there; and (3) computing the time needed to generate the system with LD complexity. This measure is supposed to estimate the system complexity. It appears in this study that LD estimations fit well with the intuition we have of complex systems, with higher complexities being found for more realistic Daisyworlds. With such a method of capturing the time needed to build a system, we expect to detect in future studies any quantified differences between complex ecosystems and organisms. (shrink)

Most syntacticians, no matter their theoretical persuasion, agree that features are the most important units of analysis. Within Chomskyan generative grammar, the importance of features has grown steadily and within minimalism, it can be said that everything depends on features. They are obstacles in any interdisciplinary investigation concerning the nature of language and it is hard to imagine a syntactic description that does not explore them. For the first time, this book turns grammar upside down and proposes a new model (...) of syntax that is better suited for interdisciplinary interactions, and shows how syntax can proceed free of lexical influence. The empirical domain examined is vast, and all the fundamental units and properties of syntax are rethought. Opening up new avenues of investigation, this book will be invaluable to researchers and students in syntactic theory, and linguistics more broadly. (shrink)

The thought of Henry Nelson Wieman is ripe unto the harvest. Although several scholars have written extensively on the thought of Wieman, they have tended to concentrate on what has been dubbed the “most” important aspect of Wieman’s thought, namely, his concept of “God.” And these scholars, still more narrowly, have tended to treat Wieman’s concept of God based on their looking at only one book by Wieman, The Source of Human Good. How the Arab media construct Middle Eastern women as political actors, frame their leadership roles, and narrate their activities to the public are important questions largely ignored in the growing scholarship on women’s political participation in the Middle East and North Africa. Drawing on Nancy Fraser’s reflections on the politics of recognition and distribution, I examine the construction of women’s leadership in Morocco during the four-month period leading to the local elections of June 2009. Analysis of 1,738 news items from (...) five print media sources reveals that the “symbolic annihilation” of political women, a thesis traditionally applied to Western contexts, is disturbingly robust in Morocco. The Moroccan case alerts us that institutional mechanisms supporting women’s leadership might begin to address gender biases in the distribution of political power, but they do not guarantee the recognition of gender equality in the cultural sphere of knowledge production and opinion formation. Struggles over gender equity in Morocco and elsewhere in MENA should engage more fully with the politics of recognition given the disjuncture between women’s leadership competences and achievements and the dominant ideological frames constructing women’s leadership. This article focuses on the gender dimension of poverty in Morocco. It questions the inadequate parameters relied on in the existing studies on the subject and underlines their blindness to the complex causes and effects of poverty among the female population in the country. The article then approaches female poverty from its multidimensional perspective in order to underline the social, cultural, legal as well as economic aspects and implications of poverty. Self-sufficient ideographies are rare because they are stifled by the issue of standardization. Similar issues arise with abstract art or drawings created by young children or great apes. We propose that mathematical indices and artificial intelligence can help us decode ideography, and if not to understand its meaning, at least to know that meaning exists.

Flagging labor governance in far-flung supply networks has prompted greater scrutiny of instrumental CSR and calls for models that are tethered more closely to accountability, constraint, and oversight. Political CSR is an apt response, but this paper seeks to buttress its deliberative moorings by arguing that the agonist notion of ‘domesticated conflict’ provides a necessary foundation for substantive deliberation. Because deliberation is more viable and effective when coupled with some means of coercion, a concept of CSR solely premised on reciprocal (...) corporate-stakeholder engagement is pre-mature; efforts should first be directed toward the antecedents of reciprocity and how it is to be achieved, and only then does deliberation become a reliably substantive exercise. The resulting account of agonistic CSR is generated through agonistic principles of realism, pro-action, contestation, and countervailence, and illustrated by the Bangladesh Accord. (shrink)

The actualism/possibilism debate in ethics is traditionally formulated in terms of whether true counterfactuals of freedom about the future (true subjunctive conditionals concerning what someone would freely do in the future if they were in certain circumstances) even partly determine an agent's present moral obligations. But the very assumption that there are true counterfactuals of freedom about the future conflicts with the idea that freedom requires a metaphysically open future. We develop probabilism as a solution to the actualism/possibilism debate, a (...) solution that accommodates an open future requirement for freedom. We argue that probabilism resolves the conflicting intuitions that arise between actualists and possibilists and maintains certain distinct advantages over actualism and possibilism. (shrink)

This article revisits an historic exchange between two black ex-communists, Harold Cruse and Harry Haywood, a debate that prefigured many of the central contradictions of the black-power era. Their exchange followed Cruse’s influential 1962 essay forStudies on the Left, ‘Revolutionary Nationalism and the Afro-American’, which declared that the American Negro was a ‘subject of domestic colonialism’. Written against the prevailing liberal integrationist commitments of the civil-rights movement, his essay called for black economic and political independence, and inspired many of the (...) younger activists who would give birth to the black-power movement. In a series of essays for the Bay Area black radical journalSoulbook, Haywood criticised Cruse’s mishandling of class politics among blacks, and his retreat from anti-capitalism. This forgotten episode is important on its own terms, for what it says about the character and limitations of left-political thinking during the sixties, and equally for understanding and contesting those commonsensical notions of African-American public life in our times which too often remain rooted in the vanished social context and political realities of the twentieth-century racial ghetto. ABSTRACT:This paper argues that, although stakeholder engagement occurs within the context of power, neither market-centered CSR nor the deliberative model of political CSR adequately addresses the specter of power asymmetries and the inevitability of conflict in stakeholder relations, particularly for powerless stakeholders. Noting that the objective of stakeholder engagement should not be benevolence toward stakeholders, but mechanisms that address power asymmetries such that stakeholders are able to protect their own interests, I present a framework of stakeholder engagement based on agonistic (...) pluralism that seeks to structure and utilize discord rather than reduce or eliminate it. I then propose arbitration as an agonistic mechanism to address power asymmetries in stakeholder engagement and explore its implications. (shrink)

Most Probably: Epistemic Modality in Old Babylonian by Nathan Wasserman is the first attempt to provide a description of the domain of epistemic modality in Old Babylonian Akkadian. This attempt is not entirely successful, for several reasons. Methodological inconsistency often impairs the author’s ability to convince the reader of his solutions. Both primary data and existing secondary literature are used only selectively, which renders the proposed description problematic. Identifying genomic homology within and between genomes is essential when studying genome evolution. In the past years, different computational techniques have been developed to detect homology even when the actual similarity between homologous segments is low. Depending on the strategy used, these methods search for pairs of chromosomal segments between which either both gene content and order are conserved or gene content only. However, due to fact that, after their divergence, homologous segments can lose a different set of genes, these (...) methods still often fail to detect genomic homology. The United Kingdom case R v Lee EWCA Crim 1404 resulted in a pharmacist being convicted for an inadvertent dispensing error and paved way for the decriminalisation of such errors by way of a due diligence defence enacted in 2018. In relation to Hong Kong, what is its legal position for dispensing errors, and can it follow the decriminalising steps of UK? The primary objective of this paper is to explore whether and how HK can reach the normative position for (...) a dispensing error legal regime: I posit that the normative position for healthcare professional liability for dispensing errors should prioritise the public interest of minimisation of future dispensing errors over the retribution of past wrongs; I illustrate HK’s current position for the liabilities of HCPs on dispensing errors, focusing analysis on the relatively controversial aspects of HK’s criminal liability, referencing the landmark cases Hin Lin Yee v HKSAR 13 HKCFAR 142 and Kulemesin v HKSAR 16 HKCFAR 195 to assist my analysis of the requisite mental element for relevant statutory offences; through comparison with UK’s development post-R v Lee and application of Rule of Law principles, HK’s current position is critiqued, coming to the conclusion that while there are compelling reasons for the decriminalisation of dispensing errors in HK, the prerequisite for this to happen is an overhaul of regulatory frameworks by significantly increasing levels of accountability.
