The growing importance of researching online activities, such as cyber-deviance and cyber-crime, as well as the use of online tools (e.g. questionnaires, games, and other interactive tools) has created new ethical and legal challenges for researchers, which can be even more complicated when researching adolescents. In this article, we highlight the risks emerging from the current European legal and ethical landscape when researching potentially vulnerable groups, with a special focus on online research. It is not always clear how to (...) differentiate research ethics consent from consent for data processing activities: when can an adolescent independently consent to research, or when is parental consent needed? Additional problems emerge when parents do not consent to research activities, but their adolescent children do. A serious ethical challenge can arise when the parents do not communicate with researchers, but the adolescent wishes to participate, especially when weak parental oversight is coupled with research on sensitive topics. We offer some guidance on what to keep in mind when conducting online research with adolescents and highlight possible ways that these issues can be dealt with in pan-European projects. (shrink)

Through the Erasmus+ Program, in Key Activity 2 – “Strategic Partnerships in Education and Training” – association for promotion of non-formal education, critical thinking and philosophy in practice “Petit Philosophy” has implemented or is implementing seven projects closely related to ethical education. The characteristics of these projects are that they are directed to ethical education in kindergartens and primary and secondary schools. Partners of “Petit Philosophy” in these projects were/are universities, primary and secondary schools, kindergartens, associations and institutions from thirteen (...) countries. Project “ETHOS: Ethical Education in Primary and Pre-primary Schools for a Sustainable and Dialogic Future” is one of the first of these projects. ETHOS was successfully implemented under the Comenius Program from 2012–2014, and afterwards, projects under the Erasmus+ KA2 followed: ETHIKA – Ethics and Values Education in Schools and Kindergartens, LITTLE – Learning Together to Live Together: Teachers Leading Ethical Education for an Inclusive Society, AVAL – Added Value Learning for Preschool Teachers & Pedagogical Coordinators, COMET – A Community of Ethics Teachers in Europe, Integrating Ethics of Sport in Secondary School Curriculum, BEAGLE – Bioethical Education and Attitude Guidance for Living Environment and TRACE – Traditional Children’s Stories for a Common Future. In this article, we will briefly present the projects’ activities, with particular emphasis on materials created for educators, teachers, and students. The emergence of the European Union as an autonomous actor, to some degree independent of its member states, raises the issue of a common European identity. Nowadays, this identity is predominantly understood in universalistic terms. This is evident in Jürgen Habermas’ constitutional patriotism, which represents an attempt to integrate the EU on the basis of universal legal-political norms. This universalism is, however, problematic because identity is a relational notion and requires the constitution of a particular boundary. Although Habermas (...) admits the necessity of drawing a distinction between the inside and the outside, his universalistic approach, which ignores cultural aspects, prevents the marking out of a substantive boundary. By contrast, the article asserts the view that European identity can be delineated only in virtue of its being distinct from some concrete out-groups and that, in addition to the normative dimension, redefined as particular, such an identity must also include a value one. There exists a limited pluralist model of regulating or `managing' religious diversity in contemporary Europe. This pluralist model, however, is in contrast to the limitations that appear at the state level, which reflect an increasingly illiberal, secular Europe. Such contrast stems historically from tensions that exist between the national and transnational aspects of the model itself, but it also reflects the emerging debates on religious pluralism and the democratic state. With the settlement of post-colonial migrants (with Muslims constituting a large (...) majority) a public debate on the role of religion in Europe has resurfaced as these communities exist outside the historical formation of Western church-state relations and are challenging the very underpinning of what comprises a `liberal' democratic state. In particular, it is the role of Islam in secular Europe that frames several questions in this debate: to what extent is it necessary to regulate religious freedoms in the `public sphere' in order to protect the democratic state? What restrictions on minority religions should be considered `necessary in a democratic society’ and what limitations should be placed on state interference in minority religions as protection against the undue influence of a dominant social group? Against this backdrop, this article explores the historical social formation of religious pluralism in the European context and examines the legal and political frameworks at the national and regional levels to `regulate' diversity. The current paper plunges into the reality of a European Research and Innovation project on forced migration, with the aim of explaining the challenge of embedding gender equity approach into the entire process. The level of gender sensitivity of the initiative is analysed, as well as the difficulties and benefits in the implementation of gender equity in a culturally diverse and complex research surrounding of a three year H2020 initiative focused on finding tailored attention and inclusion strategies for (...) forced migrants. Findings show the need for additional training at international level, and the quest for genuinely transformative gender equity strategies. (shrink)

Literary critic and essayist Karl Heinz Bohrer offers a Eurosceptic perspective on the German commitment to a united Europe. This article is a reconstruction of Bohrer's argument. It identifies two distinct critiques. The first is a somewhat prosaic observation that the differences between the national traditions of Europe are simply too great for a united Europe to be viable. The other is a more complex reflection on “European decadence”: Europeans lack the will that is required to project power, (...) and power is a precondition for cultural achievements. Protestantism—the “Protestant mind”—plays a central role in this second critique. The two critiques are connected through Bohrer's conception of the nation-state as an entity that integrates in an agonistic way legal and cultural power. (shrink)

The European Biomedical Ethics Practitioner Education Project (EBEPE), funded by the BIOMED programme of the European Commission, is a five-nation partnership to produce open learning materials for healthcare ethics education. Papers and case studies from a series of twelve conferences throughout the European Union, reflecting the ‘burning issues’ in the participants' healthcare systems, have been collected by a team based at Imperial College, London, where they are now being edited into a series of seven activity-based workbooks (...) for individual or group study. These draft workbooks are now being read by a network of critical readers across Europe, whose comments will be incorporated into the final versions of the workbooks. The result will be the first European-wide and Europe-centred resource for teaching students, practitioners, and members of ethics committees. Topics covered include: • Resource allocation and rationing • The rights of children and young people • Long-term care of the elderly • Mental health and mental illness • Autonomy and patient choice • Decisions at the end of life • A study guide to using the workbooks The collaborative nature of the project has highlighted differentiated national approaches in medical ethics. Against the British and Dutch rights-orientated approach have emerged two other alternative models: the Nordic preference for administrative resolution of entitlement disputes, and the southern European emphasis on deontological codes. A genuinely European reconstruction of autonomy and rights, using hermeneutic, feminist and narrative approaches to counterbalance individualistic models, is emerging across the workbooks. The programme has also uncovered national differences in how ethics should be taught, with the workbooks' style being an experiential approach. Thus the EBEPE project is developing new models in both substantive and pedagogic senses, about both what should be taught and how it should be presented. (shrink)

Different methods have been developed to address ethical issues during research. Most of these methods were developed at universities. In this article ethical parallel research within a Research and Technology Organization is described. Within a European project about perceived security, CPSI, the ethical issues were identified by ethicists cooperating in the project. The project CPSI was aimed at developing a research method that can be used by (local) government to monitor or assess perceived and actual security. (...) Together with the researchers a way was sought to address the ethical issues. Several issues could be addressed by choices with regard to the design of the validation study, in this case a survey. The ethical and legal reasons that were relevant for choices in the design of the validation study were made an integral part of these decisions. Some issues were already identified during the writing of the proposal others were only identified during the research. Participating in the research gave the ethicists access to all relevant information. It made it possible to address the ethical issues when they became relevant. Ethical reasons were part of some of the discussions on research method. It proved possible to address most ethical issues satisfactorily during the research project. (shrink)

The classification of ageing as a disease is fundamental to developing new pharmacological strategies that can target said phenomenon. The European Medicines Agency does not do this and maintains a questionable perspective based on the traditional naturalistic argument and the value-free ideal. An alternative is proposed which, inspired by consequentialism, is committed to considering ageing as a disease in European regulatory contexts as long as the ethical consequences are desirable. Within a realistic framework, I show that making this (...) decision would have moderate positive effects such as increased knowledge about antiageing pharmacology or potential greater chances of completing vital projects. Furthermore, we will see that the main arguments used by critics to show that the negative effects outweigh the positive ones are not sound. Therefore, I conclude that it would be beneficial for the European Medicines Agency to change its position on ageing. (shrink)

This book offers a cutting-edge perspective of design for space to increase astronauts’ wellbeing and performance creating a more sustainable and inclusive environment, but without to forget beauty. The relevant aspect is that these design principles are now also supported and promoted by the European Community with the New European Bauhaus project. It is legitimate to affirm that Space Design is a precursor and inspiring these principles. Space exploration has shown us how results of space research inspire (...) management policies addressing important earth issues such as the responsible use of resources as well as ethical behavior leading to sustainable and inclusive choices. The International Space Station (ISS) is the most successful virtuous example of circular economy and sustainability by almost totally recycling the waste produced. Recently the European Space Agency (ESA) launched the first call for “parastronauts” opening the fly possibilities to people with physical disabilities and thus affirming the principle of inclusion in space. Thanks to design—a bridge between science, technology, and beauty—space opens up to new creative experiments, placing the human being at the center of the interplanetary exploration programs to ensure extra-terrestrial habitats safer, more comfortable, and efficient, where crew will feel “like at home”. Two decades ago, in 1994, in the context of the 4th EU Framework Programme, ELSA was introduced as a label for developing and funding research into the ethical, legal and social aspects of emerging sciences and technologies. Currently, particularly in the context of EU funding initiatives such as Horizon2020, a new label has been forged, namely Responsible Research and Innovation. What is implied in this metonymy, this semantic shift? What is so new about RRI in comparison to ELSA? First of (...) all, for both labels, the signifier was introduced in a top-down manner, well before the concept that was signified by it had acquired a clear and stable profile. In other words, the signifier preceded the research strategies actually covered by these labels. Moreover, the newness of RRI does not reside in its interactive and anticipatory orientation, as is suggested by authors who introduced the term, but rather in its emphases on social-economic impacts. Two questionnaires were administered, and although the response rate was not high a reasonably balanced (...) sample was achieved. The results indicated that although there was a high degree of ethical awareness and a willingness to pursue an ‘integrity approach’ to decision‐making as opposed to a ‘compliance approach’, companies on the whole lacked the institutional tools which would enable them to operationalise an integrity approach to corporate decision‐making. BackgroundWe describe our experience from a multi-national application of a European Union-funded research-driven paediatric trial (DEEP-2, EudraCT 2012-000353-31; NCT01825512). This paper aims to evaluate the impact of the local and national rules on the trial authorisation process in European and non-European countries. National/local provisions and procedures, number of Ethics Committees and Competent Authorities to be addressed, documentation required, special provisions for the paediatric population, timelines for completing the authorisation process and queries received were collected; compliance with the (...) European provisions were evaluated. Descriptive analysis, Wilcoxon Rank-Sum test and General Linear Model analysis were used to determine factors potentially influencing the timelines. The Cluster Analysis procedure was used to identify homogenous groups of cases.ResultThe authorisation process was completed in 7.7 to 53.8 months in European countries and in 17.1 to 27.1 months in non-European countries. The main factors influencing these timelines were the requests for changes/clarifications in European countries and the different national legislations in non-European countries.ConclusionThis work confirms that the procedures and requirements for the clinical trial application of a paediatric trial are different. In the European Union, the timeframes for submission were generally harmonised but longer. In non-European countries, delays were caused by national dispositions but the entire authorisation process resulted faster with less requests from ECs/cas. The upcoming application of Regulation (EU) 536/2014 is expected to harmonise practices in Europe and possibly outside. Networks on paediatric research acting at international level will be crucial in this effort. (shrink)

The article examines Hannah Arendt’s analysis of ‘pan-nationalist Europeanism’ and anti-Americanism which may serve inherently problematic identity-generating functions for the European project. For Arendt, this specific form of Europeanism is often intimately linked to mobilizations of widely spread fears of global sociocultural and economic modernization, which is frequently perceived as ‘Americanization’. In addition, however, those fears may reflect self-referential politics of ‘Americanism’ abroad and also originate in ‘objective’ structural international imbalances. According to Arendt, then, Americanism on one side (...) and Europeanism on the other side of the Atlantic should be challenged as two ideologies facing, fighting and, above all, resembling each other as all seemingly opposed ideologies. In light of the current transatlantic cleavages, it is argued with Arendt that it is in the EU’s best interest to avoid binary, culturalized legitimizations of Europeanism and Americanism. Instead, it is the eminent political task to positively resignify the EU as a new, truly post-national project and polity in its own right. Adapting and expanding Arendt’s framework, conceptual and normative implications for a self-reflexive, unique and future-oriented EU political identity and response to globalization are indicated and discussed. The term “globalization” was popularized by Marshall McLuhan in War and Peace in the Global Village. In the book, McLuhan described how the global media shaped current events surrounding the Vietnam War [1] and also predicted how modern information and communication technologies would accelerate world progress through trade and knowledge development. Globalization now refers to a broad range of issues regarding the movement of goods and services through trade liberalization, and the movement of people through migration. Much has also been (...) written on the global effects of environmental degradation, population growth, and economic disparities. In addition, the pace of scientific development has accelerated, with both negative and positive implications for global health. Concerns for national health transcend borders, with a need for shared human security and an enhanced role for international cooperation and development [2]. These issues have significant bioethical implications, and thus a renewed academic focus on the ethical dimensions of public health is needed. Future developments in science and health policy also require a firm grounding in bioethical principles. These core principles include beneficence; nonmaleficence ; respect for persons and human dignity ; and attention to equity and social justice. According to the World Health Organization [3], global ethical approaches should monitor and update ethical norms for research, as necessary; anticipate ethical implications of advances in science and technology for health; apply internationally accepted codes of ethics; ensure that agreed standards guide future work on the human genome; and ensure that quality in health systems and services is assessed and promoted. In the concept of European citizenship, public and international law intersect. The unity of the European polity results from the interplay between national and European loyalties. Citizens’ allegiance to the European polity depends on how much they see the polity’s identity as theirs. Foundational ideals that shaped the European project’s identity included social reconciliation and peaceful coexistence, economic reconstruction and widespread prosperity, and the creation of supranational structures to rein in nationalism. A broad cultural (...) consensus underlay the first impulse for integration. Europeans had little trouble giving explicit or tacit allegiance to such a project, which resulted in an unparalleled success. However, roughly 60 years and 20 Member States later, social integration is being challenged as immigrants with diverse cultural backgrounds arrive, while far-right political parties surge in reaction; economic integration is confronted with a faltering euro and countries struggling to meet financial commitments; and political integration weakens as the EU seems to fail the democratic test. Cultural assumptions are no longer shared by all. Allegiance to today’s EU is problematic for the ordinary European citizen. This paper submits that careful attention to the spirit of the foundational ideals sheds light on how the present problems as well as future integration could and should be approached. (shrink)

One of the most prominent aspects of the present labour markets is an increase in occupational transitions. Employees experience insecurity to a much larger degree than ever before. Under these circumstances, the questions of blame and responsibility – for job-loss or unemployment –, so far much too readily focused on the individual, have to be re-considered. Transitions will also have to be framed by company based or labour administration interventions.This situation forms the entrance to the scientific evaluation that is central (...) to the SOCOSE project. It aims at the formulation of an integrated European model for outplacement/replacement counselling. Thus, transparency will be added to the process of dismissal from the perspective of the individual employees, and they are assisted in re-entering the labour market at an early stage. This form of guidance will prevent long-term unemployment or might else prevent unemployment completely. (shrink)

Intercultural philosophy is the name of a relatively young discipline that did not emerge in German-speaking universities until the 80s and 90s. Its goal is to establish dialogue and understanding between the diverse, often vastly heterogenous cultures to make a peaceful coexistence possible that became a necessity in the course of globalization. Cultures differ not only in respect of the religious, political and social, but also in the patterns of thinking and acting, i.e. in respect of logic, the conceptions of (...) time and space, causality or analogy etc. It cannot be assumed that there are universals of thought and action. Is it even possible to establish a dialogue under these conditions? Several theories need to be discussed: 1. In case that we assume with Gadamer that philosophy in content and form is a European project that evolved in the west, then true dialogue would only be possible under the same or similar cultural conditions, specifically under the assumption of a euro-centrism that must be imposed on all cultures if a dialogue should be possible. Habermas’ discourse theory too turns out to be a disguised euro-centrism that assumes equality of opportunity for all participants of discourse while relying on identical communicative, constative, representative and regulative speech acts that belong to western logic. 2. In case that we limit philosophy to questions of content that are for example already characteristic of children and not to questions of form that may be different in different cultures, then mutual understanding would not be entirely impossible, but difficult, since the contents would have to be translated into different verbal or averbal modes of explication, e.g. in the case of primitive cultures also into artistic, mimic, gestic modes of expression. In any case, intercultural philosophical understanding is a difficult project that has little to do with soapbox oratories of mutual understanding and the advent of uniform global peace. (shrink)

I present three versions –Grimm, Offe and Streeck—of a general argument that is often used to establish that the EU-institutions meets a legitimacy-disabling condition, the so called “no demos” argument (II), embedding them in the context of the notorious “democratic deficit” suspicions against the legal system and practice of the EU (I). After examining the logical structure behind the no-demos intuition considered as an argument (III), I present principled reasons by Möllers and Habermas that show why the “no demos” argument (...) fails to have bite in discussions of the legitimacy and status of the supranational level in the multi-level EU-architecture. These are complemented by another principled reason arising from John Dewey’s conception of the “public” as a clearer alternative for the “popular” requirement of democratic legitimation (IV). I conclude that all three conceptions together suggest that the hunt after pre-politically existing peoples as foundations of democratic legitimacy expresses no more than methodological nationalism without any footing in the material and conceptual requirements of democratic legitimation. Given the absence of a principled problem with the legitimacy of the priority and interference of supranational EU-law in the national legal and political orders, there are thus also no principled reasons to abandon or discredit the European project in the absence of a European nation or society. The European project was aimed from the outset, alongside reconciliation (peace) and economic reconstruction (prosperity), at a degree of political integration too. Political integration has progressed modestly. Not everybody is convinced of its benefits. Besides, the notion of a European polity opens the question about its sources of cohesion. Those sources are more or less evident in the member states – language, history, legal, political and religious traditions, for instance. They give, say, Latvia, Italy or Hungary a (...) certain degree of unity – a national identity. But what ought to be that source of cohesion – or identity – for the European Union (EU) considered as a whole? This paper analyses five normative conceptions about such ‘European identity’ (EI) – cultural, legal, economic, international and cosmopolitan – and suggests that they are not mutually exclusive, but can be combined in a synthetic notion that promises to reflect in a more comprehensive and accurate way the sources of the minimal unity required to hold the EU polity together. This extended essay on the constitution for Europe represents Habermas’s constructive engagement with the European project at a time when the crisis of the eurozone is threatening the (...) very existence of the European Union. There is a growing realization that the European treaty needs to be revised in order to deal with the structural defects of monetary union, but a clear perspective for the future is missing. Drawing on his analysis of European unification as a process in which international treaties have progressively taken on features of a democratic constitution, Habermas explains why the current proposals to transform the system of European governance into one of executive federalism is a mistake. His central argument is that the European project must realize its democratic potential by evolving from an international into a cosmopolitan community. The opening essay on the role played by the concept of human dignity in the genealogy of human rights in the modern era throws further important light on the philosophical foundations of Habermas’s theory of how democratic political institutions can be extended beyond the level of nation-states. Now that the question of Europe and its future is once again at the centre of public debate, this important intervention by one of the greatest thinkers of our time will be of interest to a wide readership. His central argument is that the European project must realize its democratic potential by evolving from an international into a cosmopolitan community. The opening essay on the role played by the concept of human dignity in the genealogy of human rights in the modern era throws further important light on the philosophical foundations of Habermas’s theory of how democratic political institutions can be extended beyond the level of nation-states. Now that the question of Europe and its future is once again at the centre of public debate, this important intervention by one of the greatest thinkers of our time will be of interest to a wide readership. ABSTRACTThe aim of this article is to sketch a phenomenological theory of political institutions and to apply it to some objections and questions raised by Pierre Manent about the project of the European Union and more specifically the question of “European Construction”, i.e. what is the aim of the European Project. Such a theory of political institutions is nested within a broader phenomenological account of institutions, dimensions of which I have tried to elaborate elsewhere. As (...) a working conceptual delineation, we can describe institutions as stable meaning structures. As such, the definition encompasses phenomena like the European Commission, Belgium, marriage, the Dollar, the Labour Party, but also political subjects themselves. In order to develop said theory of institutions, I will draw primarily upon resources in the work of Maurice Merleau-Ponty and John Searle. (shrink)

Adolescent young carers (AYCs) are a sub-group of young carers who carry out significant or substantial caring tasks and assume a level of responsibility which would usually be associated with an adult. They are a potentially vulnerable group of minors because of the risk factors associated with their caring role. AYCs face a critical transition phase from adolescence to adulthood often with a lack of tailored support from service providers. The recently completed European funded ‘ME-WE’ project, which forms (...) the focus of this paper, aimed to change the ‘status quo’ by advancing the situation of AYCs in Europe, via responsive research and knowledge translation actions. This paper outlines the participatory, co-creation approach employed in the project to optimise AYC’s involvement. It describes the ethical framework adopted by the project consortium to ensure the wellbeing of AYCs within all project activities. Ethical issues that arose in the field study work in all six countries are presented, followed by a discussion of the level of success or otherwise of the consortium to address these issues. The paper concludes with lessons learned regarding ethically responsible research with and for AYCs that are likely transferable to other vulnerable research groups and pan-European projects. The Association Henri Capitant des Amis de la Culture Juridique Française and the Société de législation comparée joined the academic network on European Contract Law in 2005 to work on the elaboration of a "common terminology" and on "guiding principles" as well as to propose a revised version of the Principles of European Contract Law. The results of this work were sent to the European Commission and have already been published in French. The English translation is now (...) being published by sellier.elp. This work could contribute to the wider European project. The part on the guiding principles could be a component of the CFR, in the form of "black letter" model rules or recitals. The part on terminology is, in itself, useful for the elaboration of the final various linguistic versions of the CFR. It finds its place within the materials which will accompany the model rules. Last but by no means least, the revised version of the PECL should be considered by the European institutions as an alternative set of model rules on contract law. (shrink)

The European crisis has provoked widespread critique of capitalist arrangements in most if not all countries in Europe. But to what extent do contemporary social protest and critique indicate a revival of critical capacity? The range of criticisms against the existing capitalist system raised by various social movements is seen as ineffectual and fragmented. Such observations are mirrored in sociological analyses of the critique of capitalism. A distinct type of critique of capitalism has, however, not been explicitly conceptualized. This (...) political critique, denouncing the depoliticization and the erosion of autonomy resulting from capitalist arrangements, indicates the crucial role of the political in formulating common projects. The article will, first, briefly discuss Boltanski and Chiapello’s historical identification of forms of critique of capitalism as well as the contemporary relevance of these. In a second step, it will conceptualize and in a way recuperate a political critique of capitalism. In a third step, it will show that the contours of a critique that explicitly refers to the political is available in the contemporary European context, not least in claims made by movements that pursue a ‘Europe of the Commons’ and an ‘alternative Europe’.
