World Athletics have introduced regulations preventing female athletes with certain differences in sex development from competing in the female category. We argue these regulations are not justified and should be removed. Firstly, we examine the reasoning and evidence underlying the position that these athletes have a substantial mean difference in performance from other female athletes such that it constitutes an advantage, and argue it is not sufficient. Secondly, if an advantage does exist, it needs to be demonstrated it is unfair. (...) We argue the advantage would not be unfair because to say otherwise relies on a presupposition about whether these athletes are female, which involves contradictory and inconsistent definitions of sex. Thirdly, we contend that even if it is established that there is an advantage and it is unfair, the response of requiring athletes to take testosterone-suppressing medication is not appropriate and is unfair. Supported decision-making has been promoted at a policy level and within international human rights treaties as a way of ensuring that people with disabilities enjoy the right to legal capacity on an equal basis with others. However, little is known about the practical issues associated with implementing supported decision-making, particularly in the context of dementia. This study aimed to understand the experiences of people with dementia and their family members with respect to decision-making and their views on supported decision-making. Thirty-six (...) interviews were undertaken with fifty-seven participants across three states in Australia. Interpretative Phenomenological Analysis was used as the methodological approach, with relational autonomy as a theoretical perspective. We identified two overarching themes relating to participants’ experiences with decision-making: “the person in relationship over time” and “maintaining involvement.” Participant views on the practical issues associated with supported decision-making are addressed under the themes of “facilitating decision-making,” “supported decision-making arrangements,” “constraints on decision-making,” and “safeguarding decision-making.” While participants endorsed the principles of supported decision-making as part of their overarching strategy of “maintaining involvement” in decision-making, they recognized that progressive cognitive impairment meant that there was an inevitable transition toward greater involvement of, and reliance upon, others in decision-making. Social and contextual “constraints on decision-making” also impacted on the ability of people with dementia to maintain involvement. These themes inform our proposal for a “spectrum approach” to decision-making involvement among people living with dementia, along with recommendations for policy and practice to assist in the implementation of supported decision-making within this population. In an increasingly global landscape, NFP initiatives including those addressing animal protection, are increasingly operating cross-borders. Doing so without respect, local engagement, and a thorough understanding of the issues of concern is fraught with danger, and potentially wasteful of resources. To this purpose, we sought to understand attitudes to the importance of 13 major world social issues in relation to animal protection by surveying 3433 students from at least 103 universities across 12 nations. The emergence of a ‘nature trifecta’ was (...) suggested, with animal and environmental protection and sustainable development recurring as the most highly rated in importance across all countries, with these issues also consistently rating amongst the highest in each individual country. It is concluded that significant differences exist between attributed importance of world issues by nation, pointing towards the benefit of tailoring NFP initiatives by country and region. It is also suggested that nation, or more specifically, sociopolitical and cultural region, is a vitally important demographic for consideration in social development. (shrink)

But these complaints are themselves worthy of careful consideration: they are rooted in Schopenhauer’s philosophy of language, which itself reflects the structure of his metaphysics. I find several of the ideas presented very engaging. Musical form and feeling (...) are very real to me in my experience as a music and liturgy director in the Catholic Church. I wholeheartedly agree with the concept of the processual nature of both, which has been well articulated. In my life experience, the musical form, the feeling inherent in it, and its process of coming to life in a given moment, is a near-weekly event. The church continually solemnizes life events, and musical form is an integral part of that solemnization. My response centers on the following claim: "Feeling is not a product but a process, it follows that the feeling ends when the music stops"; and question, "How can it be educational?"The example of the drama, King Lear, is very interesting. Indeed, as we get caught up in the action of the production, we become connected to the feelings and lives of the characters. I agree that it might be easier to experience feeling in a drama or epic, rather than in the visual arts, or in our sonorous art. The drama connects us to the human condition and we "feel" for the characters. In my position [End Page 64] as a liturgist, I find myself in a situation similar to that of the director of a play. Indeed, at times there is a very fine line between drama and good liturgy. However, in the liturgy we are connecting with real lives, the lives of our assembly members, not the lives of fictitious characters. Good musician liturgists strive to give voice to the emotions of the assembly. While I admit this is not always accomplished in weekly Sunday liturgies, I think especially of funeral liturgies where the music strives to speak of the hope and promise of eternal life for the departed loved one and also of the feelings of grief experienced by the assembled family and friends.I take issue with the idea "that the feeling stops when the music does." Throughout the body of the paper, Reichling highlights Langer's ideas on music's "sonorous image of feeling in an imaginatively perceptible form" and her use of the terms "semblance," "illusion," and "virtual" in regard to feeling. However, in contemplating the points brought forth, I mentally wrestled with the idea of feeling stopping when the music did. Could this position be held because it was based on what might be referred to as a "virtual" experience (for example, a musical concert or show) rather than a "real-life" moment?During the process of this contemplation, I had the occasion to attend the funeral of a friend's husband. This funeral occurred in a faith tradition other than Catholicism and I participated in the service as a member of the congregation. My friend is a music educator, her husband had been a musician, and both had been active in the music ministry of their church for nearly thirty years. As one might imagine, music was a central element in the solemnization of this man's life. The music was brought to life by an extraordinary group of musicians, including many graduate students and faculty members of the Indiana University School of Music. The music was superb and each piece had relevance to the life being celebrated as well as to the moment at hand, saying goodbye. The choir was wonderful, sharing movements from both the Brahms and Fauré Requiems, which were very moving. The soloist was renowned soprano, Sylvia McNair, an "adopted" member of the family since her days years ago as an Indiana University graduate student. Deep ethical interpretivism has been the standard view of the nature of sport in the philosophy of sport for the past seventeen years or so. On this account excellence assumes the role of the foundational, ethical goal that justice assumes in Ronald Dworkin’s interpretivist model of law. However, since excellence in sports is not an ethical value, and since it should not be regarded as an ultimate goal, the case for the traditional account fails. In this paper, I defend a general theory of competition and contrast it with a corresponding general theory of cooperation. I then use this analysis to critique mutualism. Building on the work of Arthur Applbaum and Joseph Heath I develop an alternative adversarial model of competitive sport, one that helps explain and is partly justified by shallow interpretivism, and argue that this model helps shows that the claim that mutualism provides us with the most defensible ethical ideal of sport is (...) false. By replacing that view with an understanding of sporting adversarial ethics we can appreciate that the ethics of sport are more complex than has been commonly recognized. (shrink)

Sinclair Goodlad asks: why is it so difficult to define quality; what are the key issues that should be addressed; and what action can and should be taken in the absence of any agreed definition of quality? In so doing, he examines a number of issues concerning the basic stuff of higher education - curriculum, teaching methods, research, college organization - that go deeper than the administrative shell that is the usual focus of the quality debate. Throughout, his provocative notion of 'heresies' offers grist for discussion wherever the aims, purposes and practices of higher education are being examined. My main goal here is to develop a functional analysis of cheating and corruption in sports, and to differentiate cheating within the broader category of corruption. Whereas officials can act corruptly, they cannot cheat. In contrast, sports participants, since they occupy two roles, can do both. I argue that although acts of cheating are acts of corruption, not all corrupt acts by competitors are acts of cheating. I also respond to some skeptical challenges and criticisms of the concept of ‘cheating’ (...) by providing some opposing arguments and a provisional definition. I argue that cheating in sports occurs in the context of a complex institutional practice. It transpires due to some failing in the efforts and/or limitations of sports officials to prohibit it. In central cases it consists in both the functional and ethical violation of the constitutional norms of a sport in the service of obtaining unearned victory for the cheater. (shrink)

ABSTRACTBernard Suits and other formalists endorse both the logical incompatibility thesis and the view that rule-breakings resulting in penalties can be a legitimate part of a game. This is what Fred D’Agostino calls ‘the problem of penalties’. In this paper, I reject both Suits’ and D’Agostino’s responses to the problem and argue instead that the solution is to abandon Suits’ view that the constitutive rules of all games are alike. Whereas the logical incompatibility thesis applies to games in which players’ (...) actions are perfectly controlled, it does not apply to sports. This insight not only justifies the rejection of formalism as a theory about the nature of sport but it also helps explain the greater normative complexity of sports, which in turn leads to the idea that in sports ‘cheating’ should be interpreted as a genus. This essay reconsiders Davidson's critical attribution of the scheme‐content distinction to Quine's naturalized epistemology. It focuses on Davidson's complaint that the presence of this distinction leads Quine to mistakenly construe neural input as evidence. While committed to this distinction, Quine's epistemology does not attempt to locate a justificatory foundation in sensory experience and does not then equate neural intake with evidence. Quine's central epistemological task is an explanatory one that attempts to scientifically clarify the route from stimulus to science. Donald Davidson has emphasized the importance of what he calls “triangulation” for clarifying the conditions that make thought possible. Various critics have questioned whether this triangular causal interaction between two individuals and a shared environment can provide necessary conditions for the emergence of thought. I argue that these critical responses all suffer from a lack of appreciation for the way triangulation is responsive to the philosophical commitments of Davidson's naturalism. This reply to Davidson's critics helps clarify several metaphilosophical issues concerning (...) the overall significance of this use of triangulation. I illustrate how the network of commitments that make up Davidson's conception of non‐reductive naturalism inform the respective problems and issues that triangulation is introduced to address. This then serves as an example of the way metaphilosophical considerations are useful in clarifying the status of a respective philosophical position and for understanding the philosophical debates surrounding it. This article examines whether and how the participation of women in the firm’s board of directors and senior management enhances financial performance. We use the Fama and French (1992, 1993) valuation framework to take the level of risk into consideration, when comparing firm performances, whereas previous studies used either raw stock returns or accounting ratios. Our results indicate that firms operating in complex environments do generate positive and significant abnormal returns when they have a high proportion of women officers. Although (...) the participation of women as directors does not seem to make a difference in this regard, firms with a high proportion of women in both their management and governance systems generate enough value to keep up with normal stock-market returns. These findings tend to support the policies currently being discussed or implemented in some countries and organizations to foster the advancement of women in business. (shrink)

This text is an introduction to the new English translation of critical theorist René Zavaleta Mercado’s Towards a History of the National-Popular in Bolivia: 1879–1980. It surveys principal themes in the book and discusses why Zavaleta is a pertinent thinker for the global South and capitalist periphery today.

In this paper I explain how to play and administer a game that helps teach students a lesson about the value of cooperation and the role of ethics and the law in obtaining the conditions under which cooperating is reason­able. I also discuss several applications of this Cooperation Game, primarily in courses in social and political philosophy, introductory ethics, and the philosophy of law. The game can usefully be played with a range of groups of students from small tutorial sections (...) to large sections of over one hundred, and the game and post-game analysis can be completed in one or two classes. I shall defend in this paper the thesis that, if there are irreducible powers such as the power to produce a certain object (generative powers), then there are objects that do not exist and they are part of the fundamental level of the universe. Thus, generative powers come together with Meinongianism. After having clarified my argument, I shall examine and criticize Armstrong (1997)’s attempt to reduce powers to other sorts of entities. Finally, I shall deal with five accounts of generative (...) powers that are somehow alternative to Meinongianism and with some (more general) miscellaneous concerns about the truth of this doctrine.
