Theories that recognize group rights face an important challenge from both friends of rights and friends of groups: that rights discourse cannot accord priority to the needs of group life over those of any individual person because the theory of moral value which underwrites rights language cannot recognize groups as having oveniding interests or importance. The full import of this objection has often been missed by those against whom it is levelled because they focus on claims by groups against (...) non-group members. However the full weight of the problem is most apparent in claims groups make against their own members (what Kymlicka calls "internal restrictions"). In this paper I look more closely at the objection from internal restrictions to clarify what is -- and what is not -- at stake. I clarify: (i) why the moral theory that underpins rights language poses a problem that must be addressed; and (ii) why the strategies most commonly pursued by advocates of group rights do not make this problem go away. However, although it is true that some forms of collectivism are ruled out by rights discourse, distinguishing between the ethical and methodological commitments of a theory makes apparent that adopting some form of methodological collectivism need not imply a collectivist theory of moral value. Neither the (ethical) individualism of rights theory nor the (methodological) collectivism of most theories that value group membership are grounds for rejecting the coherence of group rights. The universe appears fine-tuned for life. Bayesian confirmation theory is utilized to examine two competing explanations for this fine-tuning, namely design (theism) and the existence of many universes, in comparison with the ’null’ hypothesis that just one universe exists as a brute fact. Some authors have invoked the so-called ’inverse gambler’s fallacy’ to argue that the many-universes hypothesis does not explain the fine-tuning of ’this’ universe, but flaws in this argument are exposed. Nevertheless, the hypothesis of design, being simpler, (...) is arguably of higher prior probability and, therefore, to be preferred. The hypothesis of the single brute-fact universe is disconfirmed. The value relevance of corporate social responsibility performance disclosures for financial markets participants remains uncertain despite advances in the literature and the recent proliferation of CSR disclosures around the world. Using an experimental approach involving MBA students at universities in the United States and Lebanon, we study the value relevance of CSR disclosures by testing whether they affect participants’ personal portfolio management investment decisions. We also examine whether the degree to which the CSR disclosures affect these decisions is influenced by (...) corporate governance quality. To examine these issues, we examine the effect of environmental performance on investment decisions in Experiment 1, and the effect of labor performance on investment decisions in Experiment 2. Results from both experiments show that investment decisions are affected by CSR performance. Analysis shows that governance strength exerts a marginal effect on the investment decision only when CSR performance is strong. Lebanese participants appear to be more sensitive to weak performance than U.S. participants. Overall, our findings extend the CSR disclosures literature by documenting the value relevance of CSR performance for financial markets participants’ decision making. These findings also extend the governance literature by documenting that consistent with attribution theory, the effects of governance quality are contingent upon the information and decision context, and that efforts to decontextualize governance may be counterproductive. In A Moral Theory of Political Reconciliation Colleen Murphy develops a rich and potentially transformative account of political reconciliation. The potential of this account is not fully realized because of limitations in how Murphy conceptualizes political relationships. For example, group-differentiated integration into states opens up important questions about partial legality and group-differentiated experiences of repression that Murphy does not address. Murphy’s framework is well-suited to take up these questions, once they are acknowledged. But doing so requires a revised understanding (...) of how states’ relationships with individuals structure individuals’ relationships with one another. (shrink)

International human rights concepts and documents figure prominently within theories of global justice. Appeals to human rights often rely on theories and interpretations that rank human rights in relation to one another designating some as more important or more crucial than others such that they may or must be given priority. In this paper I argue that hierarchical ranking of human rights should be rejected by theorists of global justice because such ranking: (a) undermines the effectiveness with which human rights (...) operate as principled constraints on state actors; and (b) is inconsistent with the international legal framework and practice from which the human rights concepts and documents draw their rhetorical force. Instead theorists of global justice should accept the indivisibility principle, which states that all human rights are interrelated and interdependent and must be treated on the same footing and given the same emphasis. The attraction of hierarchical ordering rests on misguided concerns about the practicality of indivisibility that fail to properly distinguish between rights and claims and ignore important dimensions of human rights implementation and assessment. I argue that indivisibility is both pragmatically defensible, provides a better theoretical grounding for understanding complaints about violations, and offers a better framework for understanding the relationship between human rights and legitimacy than hierarchical ordering. Are there wrongs for which states cannot apologise? In this chapter, I argue that the answer is 'Yes'. I begin with the simple observation that reasoning as a state official requires a conception of what officials do, and so a conception of what is - and is not - properly undertaken on behalf of the state. To act as an official, then, requires a theory of what happens in a well functioning state: it requires a 'normative theory of (...) the state. What officials believe to be necessary for a state to be a good example of its kind will affect what they recognise as outside the bounds of what a state official ought to do. This limit on what can be recognised as something prior officials ought not to have done is illustrated by Canada's official apology for imposing residential schools on indigenous peoples. Canada's official apology left out a crucial feature of the schools policy in part because of the influence of integrationist theories of the state. An integrationist view of good statehood has limited officials' ability to see the project of restructuring indigenous communities and inculcating attachment to an overarching identity as a wrong in itself, and distorted officials' diagnosis of what went wrong in previous policy. One effect has been to allow contemporary officials to offer a sincere and comprehensive apology for past officials' human rights violations in indigenous communities while themselves pursuing policies in these communities that violate human rights. The lesson of the Canadian apology is that how state officials theorise the state can undermine their capacity to recognise human rights violations for what they are and distort their judgements of what must be done in remedy. Everyone agrees that the international community must develop better mechanisms for responding to humanitarian crises. The best mechanism for responding is simply to intervene to prevent a crisis from developing in the first place. However, because the principle of sovereignty imposes strict constraints on action across state borders, international actors are often unwilling or unable to interpose themselves until after conditions have escalated into a full-blown crisis, by which time it has usually become a matter of managing human misery rather (...) than ending or averting it. Respect for sovereignty is an organizing principle of the existing international legal system, and so abandoning it would fundamentally change how the units of international politics are constituted and relate to one another. The strongest argument against abandoning sovereignty is the potential for unintended consequences with respect to peace, political stability, and the effective protection and promotion of human rights. One way to defuse this worry is to frame interventions across borders as principle-based exceptions to a general rule of state sovereignty. If we assume that protecting and promoting individual human rights is the primary goal of the international system, and that both state sovereignty and peace and security are important to us primarily as vehicles for achieving this, then (it is argued) we may use the standards of international human rights to identify, and limit, cases in which the presumption of sovereignty may legitimately be set aside. However, the relationship between sovereignty and humanitarian crises is more complex than this picture allows. Theorizing about humanitarian crises inevitably includes recommendations about states and this makes it a species of non-ideal theory. All actual states are rife with injustice, both in their internal structures and in the relationships these structures establish with those outside a state’s borders. This fact must be reflected in our reasoning about humanitarian responses. (shrink)

In political philosophy and political theory justification is an important element of normative force – of rightful pull to compliance. To justify is to address a subject in a form or with a substantive content in virtue of which the subject is supposed to be bound. Theories of justification spell out how addresses are supposed to establish subjects as rightfully bound. All arguments that purport to establish that a practice, institution, requirement or legal regime rightfully exerts a pull to (...) compliance employ or make use of a theory of justification, and so are susceptible to challenges based in scepticism about the adequacy of that theory of justification. Theories of justification typically have epistemological and moral dimensions. The epistemological dimension of justification concerns features of the form or content of an address that generate normative force in virtue of their relationship or contribution to cognitive processes. The moral dimension of justification concerns features of the form or content of an address that generate normative force in virtue of their relationship or contribution to the requirements of morality. Both the epistemological and moral dimensions of theories of justification purport to explain what makes the form or content of an address rightfully compelling. Whether the explanation purports to explain compellingness in epistemological or moral terms, and how, precisely, the cognitive or ethical features of the address are supposed to bind is key to understanding how a specific theory of justification works. Is there something special about group rights? Many would say "yes". For some, only certain kinds of groups---ones that are oppressed, or play a special role in well-being---may have rights. For others, the kind of group is not as important as the group's culture and internal structure. At the very least, many argue, group rights ought to be more restricted than individualistic ones. For these reasons, arguing the merits of a group right is often thought to require a theory (...) of groups or of group identity. If only certain kinds of groups may have rights then one has to identify the roles that various groups and/or identities play in personal well-being. If a group's culture or internal structure must meet certain standards then one must develop a theory of how culture or the internal organization of a minority influences people. ;I argue that it is a mistake to think that arguing a group right requires a theory of groups. This mistake reflects a tendency to think about group membership as a kind of good and to focus on its internal, psychological significance. But if one thinks about group membership as a vehicle of action, and focuses on the concrete effects it may have, it becomes apparent that arguing for a group right does not require a theory of groups, group identity or culture. For in the end, the issues that one must address in arguing a group rights are issues about groups. Rather, they are issues about political and moral authority, and about the extent to which moral and political norms ought to recognize and reinforce the ways that people depend upon one another. These are important issues and they raise pressing questions for political philosophy. But they are not about groups. (shrink)

This book offers a rationale for a new 'ramified natural theology' that is in dialogue with both science and historical-critical study of the Bible. Traditionally, knowledge of God has been seen to come from two sources, nature and revelation. However, a rigid separation between these sources cannot be maintained, since what purports to be revelation cannot be accepted without qualification: rational argument is needed to infer both the existence of God from nature and the particular truth claims of the Christian (...) faith from the Bible. Hence the distinction between 'bare natural theology' and 'ramified natural theology.' The book begins with bare natural theology as background to its main focus on ramified natural theology. Bayesian confirmation theory is utilised to evaluate competing hypotheses in both cases, in a similar manner to that by which competing hypotheses in science can be evaluated on the basis of empirical data. In this way a case is built up for the rationality of a Christian theist worldview. Addressing issues of science, theology and revelation in a new framework, this book will be of keen interest to scholars working in Religion and Science, Natural Theology, Philosophy of Religion, Biblical Studies, Systematic Theology, and Science and Culture. The article starts by offering a definition of fake kindness focused on the dissociation between the behavioural components of kindness and the intent to sincerely pay some heed to the needs of others. Using the sociological theory of Pierre Bourdieu, this definition is then used to articulate how fake kindness can be conceptualized as a specific form of symbolic violence. Such a view allows explanations as to how and why the prevalence and effectiveness of fake kindness vary according to (...) microsociological norms and values. The generic definition and conceptualization of fake kindness as a form of symbolic violence are then used to discuss how nursing’s enthrallment with the concept of caring and its operationalization as a moral compass likely fosters the growth of fake kindness within the profession. In this view, the institutional enforcement of propriety and well-behaved professionalism is more likely to lead to toxic environments than to healthy workplaces. We hope that being able to understand how professional norms and institutional rules are sometimes turned into social tools to enforce obedience and existing hierarchies can empower victims of those phenomena to resist them more effectively. It might also contribute to increasing the awareness of well-meaning nurses or people in position of authority who have been socialized in environments where fake kindness is normalized. (shrink)

Although dominated by consequentialist and deontological thinking, the debate about human enhancement has been enriched by several arguments from virtue theory and from virtue ethics. This article provides an overview of the virtue ethical arguments in the debate and identifies several topics in the ethics of human enhancement where the argumentative resources of virtue ethics have not yet been sufficiently considered.

This work emerged from funded research examining collaboration among stake-holder organizations present at three U.S. nuclear weapons complex sites. The authors examine issues such as how and why stakeholder groups form collaborative alliances when dealing with the target organization, what leaders of stakeholder organizations actually think about when collaborating to deal with the target organization, and what outcomes result from the collaboration process. Drawing on stakeholder theory and research in interorganizational collaboration, the authors used an inductive, interview-based (...) methodology to build a model of collaboration among nonprofit stakeholder groups. The model contributes to the descriptive stream of stakeholder theory and, in turn, has implications for the instrumental stream. The model also offers implications for future researchers, leaders of stakeholder alliances, and leaders of target organizations. (shrink)

We understand responsible leadership as a social-relational and ethical phenomenon, which occurs in social processes of interaction. While the prevailing leadership literature has for the most part focussed on the relationship between leaders and followers in the organization and defined followers as subordinates, we show in this article that leadership takes place in interaction with a multitude of followers as stakeholders inside and outside the corporation. Using an ethical lens, we discuss leadership responsibilities in a stakeholder society, thereby following Bass (...) and Steidelmeier’s suggestion to discuss “leadership in the context of contemporary stakeholder theory” (1999: 200). Moreover, from a relational and stakeholder perspective we approach the questions: What is responsible leadership? What makes a responsible leader? What qualities are needed? Finally, we propose a so-called “roles model” of responsible leadership, which gives a gestalt to a responsible leader and describes the different roles he or she takes in leading stakeholders and business in society. This study provides empirical evidence on how corporate sustainability performance (CSP), as proxied by membership of the Dow Jones sustainability index, is reflected in the market value of equity. Using a theoretical framework combining institutional perspectives, stake-holder theory, and resource-based perspectives, we develop a set of hypotheses that relate the market value of equity to CSP. For a sample of North American firms, our preliminary results show that CSP has significant explanatory power for stock prices over the (...) traditional summary accounting measures such as earnings and book value of equity. However, further analyses suggest that we should not focus on corporate sustainability itself. Our findings suggest that what investors really do is to penalize large profitable firms with low level of CSP. Firms with incentives to develop a high level of CSP not engaging on such strategy are, thus, penalized by the market. (shrink)

The case "Caprica Energy and Its Choices" concerns a fictionalized energy corporation choosing between three potential drilling sites. According to the published Teaching Note, the case is an exercise in the stakeholder approach to business: it requires balancing profit considerations with potential harm to those who live near those drilling sites. Though unintended, the case raises a further question not addressed in the case or in the Teaching Note: what gives Caprica Energy the right to impose risk on members of (...) the communities surrounding its drilling sites? The first section of the present article argues that, in such cases, manage- ment can only justify imposing risk on the local community by securing those stakeholders' consent. The second section outlines the implications for stakeholder theory and stake- holder management. The third section outlines one con- nection between this material and recent literature on the imposition of risk and moral theory; that section offers an account of what make this particular instance of imposing risk morally problematic, with reference to the directedness of the imposition. The primary appeal of stakeholder theory in business ethics derives from its promise to help solve two large and often morally difficult problems: (1) how to manage people fairly and efficiently and (2) how to determine the extent of a firm's moral responsibilities beyond its obligations to enhance its profits and economic value. This article investigates a variety of conceptual quandaries that stakeholder theory faces in addressing these two general problems. It argues that these quandaries pose intractable obstacles (...) for stakeholder theory which prevent it from delivering on its large promises. Acknowledging that various versions of stakeholder theory have made a contribution in elucidating the complex nature of firms and business decision making, the article argues that it is time to move on. More precise explications of the nature of modern firms focusing on the application of basic moral principles to different business contexts and situations are likely to prove more accurate and useful. This essay responds to Hasnas’s recent article “The Normative Theories of Business Ethics: A Guide for the Perplexed” in Business Ethics Quarterly. Hasnas claims that the stockholder theory is more plausible than commonly supposed and that the stakeholder theory is prone to significant difficulties. I argue that Hasnas’s reasons for favoring the stockholder over the stakeholder theory are not asstrong as he suggests. Following Hasnas, I examine both theories in light of two sets of normative considerations: utilitarian (...) anddeontological. First, I show that utilitarian considerations clearly favor the stakeholder theory. I then argue that though Hasnas rightly accents the basic deontological constraint at the core of the stockholder theory, he is wrong to think that acknowledging such a constraint necessarily counts against the stakeholder theory. Here, I develop Ross’s notion of prima facie obligations to show how a viable stakeholder theory might be developed within a deontological framework. (shrink)

It has become customary to locate the origins of modern measurement theory in the works of Helmholtz and Hölder. If by ‘modern measurement theory’ is meant the representational theory, then this may not be an accurate assessment. Both Helmholtz and Hölder present theories of measurement which are closely related to the classical conception of measurement. Indeed, Hölder can be interpreted as bringing this conception to fulfilment in a synthesis of Euclid, Newton, and Dedekind. The first explicitly representational (...) theory appears to have been Russell's. Contextualists and Subject Sensitive Invariantists often cite the knowledge norm of assertion as part of their argument. They claim that the knowledge norms in conjunction with our intuitions about when a subject is properly asserting in low or high stakes contexts provides strong evidence that what counts as knowledge depends on practical factors. In this paper, I present new data to suggest they are mistaken in the way they think about cases involving high and low stakes and I show how (...) insensitive invariantists can explain the data. I exploit recent work done on the distinction between flouting a norm and being blamed for that violation to formulate a rigorous theory of rational expected blameworthiness that allows insensitive invariantists to explain the data cited. I provide a critical review of Moti Mizrahi's The Relativity of Theory, expounding on the book's strengths and then providing an extended argument that Mizrahi mischaracterizes the epistemic attitude of concern to antirealism about science as well as the practical stakes involved in adopting the antirealist position.

The presence of experts holding patents and simultaneously providing policy advice on areas where they hold patents pose several normative questions. Through a comparative study of several IPCC reports, this article documents the scope of this phenomenon and discusses it with respect to a theory of conflict of interest. Seemingly, it is more likely to be patent-holders on issues of infrastructures, industry and transport rather than for single technologies as such. According to insights from studies on conflict of interest, (...) there is an increased risk for bias. The article investigates the possible relations between patenting and conflicts of interest according to theoretical and empirical insights from the relation between science and society. (shrink)

Of the many possible individual factors bearing on test preparation, one is how individuals’ motivational and cognitive perceptions affect test-driven preparation practices. This study reports an investigation into test preparation of a high-stakes writing test from the perspective of expectancy-value theory. Undergraduate students on their test preparation for the writing tasks of China’s Graduate School Entrance English Examination were recruited voluntarily from 11 universities in mainland China. The perceptions of GSEEE test takers, which included goal, task value, task demand, (...) and expectation of success, were identified. Five types of preparation practices were identified for the GSEEE writing tasks: memorizing practice, test familiarization, comprehensive learning, skills development and drilling practice. Structural equation modeling revealed that the expectancy-value model held up well for the paths from test takers’ perceptions to test-driven preparation practices, which were not construct-oriented but goal-motivated. The GSEEE test takers’ goal, determined by the high-stakes nature of admission test, explained their motivation and determined their behavior toward test preparation. Results also indicated that task demand was inadequate to be termed a strong factor in affecting test preparation. As such, the findings of this study offer evidence regarding how an expectancy-value model fit into test preparation mechanism and provide insights into the nature and scope of test preparation for high-stakes writing tests. In this paper, I aim to establish that, according to almost all democratic theories, instrumentalist considerations often dominate intrinsic proceduralist considerations in our decisions about whether to make extensive use of undemocratic procedures. The reason for this is that almost all democratic theorists, including philosophers commonly thought to be intrinsic proceduralists, accept ‘High Stakes Instrumentalism’. According to HSI, we ought to use undemocratic procedures in order to prevent high stakes errors - very substantively bad or unjust outcomes. However, democratically produced (...) severe substantive injustice is much more common than many proponents of HSI have realised. Proponents of HSI must accept that if undemocratic procedures are the only way to avoid these high stakes errors, then we ought to make extensive use of undemocratic procedures. Consequently, according to almost all democratic theorists, democratic theory ought, for practical purposes, to be reoriented towards difficult moral and empirical questions about the instrumental quality of procedures. Moreover, this is potentially very practically important because if there are available instrumentally superior undemocratic procedures, then wholesale institutional reform is required. This is one of the most potentially practically important findings of normative democratic theory. In spite of this, no-one has yet explicitly recognised it. (shrink)

People who defend “pragmatic encroachment” about knowledge generally advocate two ideas: you can rationally act according to what you know; knowledge is harder to achieve when more is at stake. In their chapter in this volume, Charity Anderson and John Hawthorne argue that these two ideas may not fit together so well. This chapter extends Anderson and Hawthorne’s argument. By applying some standard decision theory, we can calculate a precise quantity of “how much is at stake” that (...) does fit together with knowledge and action. While this calculated quantity matches intuitions about how much is at stake in certain standard cases, in others it does not.Keywords. (shrink)

Trust is a kind of risky reliance on another person. Social scientists have offered two basic accounts of trust: predictive expectation accounts and staking (betting) accounts. Predictive expectation accounts identify trust with a judgment that performance is likely. Staking accounts identify trust with a judgment that reliance on the person’s performance is worthwhile. I argue (1) that these two views of trust are different, (2) that the staking account is preferable to the predictive expectation account on grounds of intuitive adequacy (...) and coherence with plausible explanations of action; and (3) that there are counterexamples to both accounts. I then set forward an additional necessary condition on trust, according to which trust implies a moral expectation. The content of the moral expectation is this: W hen A trusts B to do x, A ascribes an obligation to B to do x, and holds B to this obligation. This moral expectation account throws new light on some of the consequences of misplaced trust. I use the example of physicians’ defensive behavior to illustrate this final point. (shrink)

I extend their argument by working out what “high stakes” would have to mean for the two ideas to line up, using decision theory.

This chapter evaluates whether AI systems are or will be rights-holders, explaining the conditions under which people should recognize AI systems as rights-holders. It develops a skeptical stance toward the idea that current forms of artificial intelligence are holders of moral rights, beginning with an articulation of one of the most prominent and most plausible theories of moral rights: the Interest Theory of rights. On the Interest Theory, AI systems will be rights-holders only if they have interests or (...) a well-being. Current AI systems are not bearers of well-being, and so fail to meet the necessary condition for being rights-holders. This argument is robust against a range of different objections. However, the chapter also shows why difficulties in assessing whether future AI systems might have interests or be bearers of well-being—and so be rights-holders—raise difficult ethical challenges for certain developments in AI. This paper presents the results of a within-subject experiment testing whether an increase in the monetary stakes by a factor of 50 – which had never been done before – influences individual behavior in a simple ultimatum bargaining game. Contrary to current wisdom, we found that lowest acceptable offers stated by the responder are proportionally lower in the high-stake condition than in the low-stake condition. This result may be interpreted in terms of the type of utility functions which (...) characterize the subjects. However, in line with prior results, we find that an important increase of the monetary stakes in the ultimatum game has no effect on the offers made by the proposer. Yet, the present research suggests that the reasons underlying these offers are quite different when the stakes are high. (shrink)

Bergson's engagement with evolutionary theory was remarkably up to date with the science of his time. One century later, the scientific and social landscape is undoubtedly quite different, but some of his insights remain of critical importance for the present. This paper aims at discussing three related aspects of Bergson's philosophy of evolution and their relevance for contemporary debates: first, the stark distinction between the affirmation of the reality of change and becoming, on the one hand, and any notion (...) of progress on the other; second, the insistence on the intimate interplay between forms of knowledge and forms of life; third, his idea that machines and organisms, technology and biology, are not separate domains but, rather, stem from and answer to the same problems and needs that living beings express. Such a Bergsonian framework may prove very helpful in reassessing the implicit assumptions of several contemporary debates on the ethical and political stakes of evolution, biosciences, and technologies, as well as the increasingly problematic boundary between “biology” and “culture.”.
