The healthcare crisis that has developed in the last two decades during China's economic reform has caused healthcare and hospital financing reforms to be largely experienced by patients as a crisis in the patient–healthcare professional relationship (PPR) at the bedside. The nature and magnitude of this crisis were epitomized by the "Harbin Scandal"—an incident that took place in August 2005 in a Harbin teaching hospital in which the family of an elderly patient hospitalized in the intensive care unit (ICU) for (...) 66 days paid over RMB ¥6 million. The news was publicized globally and ended in the firing of six top hospital administrators including the hospital president and the ICU director. This paper seeks to show that the Chinese healthcare crisis is ultimately linked to a conflict of interests between patients and healthcare professionals (HCPs), which is inherent in the reformed healthcare system of China. Hence the crisis is, at its core, a crisis of fidelity and confidence that must be restored to the PPR. At the "macro" level, it is simplistic to blame the crisis on the failure of the market system, and at the "micro" level, it is naïve to expect that a contractual understanding of the PPR will effectively restore the confidence of patients. This paper will show that the fiduciary relationship and medical professionalism share similar attributes, with fidelity being the core value of both. It concludes that the loss of medical fidelity implies the dissolution of the PPR and the demise of the medical profession and challenges Chinese HCPs to keep their fidelity as a means to both protect their patients’ interests and to preserve their profession's survival. Background Residual dried blood spots (rDBS) from newborn screening programmes represent a valuable resource for medical research, from basic sciences, through clinical to public health. In Hong Kong, there is no legislation for biobanking. Parents’ view on the retention and use of residual newborn blood samples could be cultural-specific and is important to consider for biobanking of rDBS. Objective To study the views and concerns on long-term storage and secondary use of rDBS from newborn screening programmes among Hong Kong Chinese (...) parents. Methods A mixed-method approach was used to study the views and concerns on long-term storage and secondary use of rDBS from newborn screening programmes among Hong Kong Chinese parents of children 0–3 years or expecting parents through focus groups (8 groups; 33 participants) and a survey (n = 1012, 85% mothers) designed with insights obtained from the focus groups. We used framework analysis to summarise the themes as supportive factors, concerns and critical arguments for retention and secondary use of rDBS from focus group discussion. We used multiple logistic regression to assess factors associated with support for retention and secondary use of rDBS in the survey. Results Both in focus groups and survey, majority of parents were not aware of the potential secondary use of rDBS. Overall secondary use of rDBS in medical research was well accepted by a large proportion of Hong Kong parents, even if all potential future research could not be specified in a broad consent. However parents were concerned about potential risks of biobanking rDBS including leaking of data and mis-use of genetic information. Parents wanted to be asked for permission before rDBS are stored and mainly did not accept an “opt-out” approach. The survey showed that parents born in mainland China, compared to Hong Kong born parents, had lower awareness of newborn screening but higher support in biobanking rDBS. Higher education was associated with support in rDBS biobanking only among fathers. Conclusion Long-term storage and secondary use of rDBS from newborn screening for biomedical research and a broad consent for biobanking of rDBS are generally acceptable to Hong Kong parents given their autonomy is respected and their privacy is protected, highlighting the importance of an accountable governance and a transparent access policy for rDBS biobanks. Dans cette contribution, nous présentons la base CLAPI développée au laboratoire ICAR dans le contexte de l’évolution des bases de données de langues parlées en France au cours des trente dernières années. Nous détaillons les deux composantes de CLAPI, l’archive de corpus de langue parlée en interaction audio et vidéo enregistrés dans des situations sociales naturelles variées, et la plateforme d’outils.L’usage et l’apport de CLAPI sont illustrés par deux études. L’une décrit comment la base peut être utilisée pour des travaux (...) de linguistique interactionnelle intégrant la multimodalité (« oh là là ») ; l’autre concerne une recherche combinant données et métadonnées (« trop »). L’article est aussi l’occasion d’un bilan plus général. La mise en perspective montre en effet qu’après la période des questions est venue celle des dilemmes. La période des questions, choix et décisions à toutes sortes de niveaux a accompagné la mise en place des bases de données. L’expérience permet maintenant de mesurer leurs indéniables apports en termes non seulement de quantité de données disponibles (et traitables grâce aux outils), mais aussi de qualité (comme conséquence des exigences de standardisation liées au partage des données). La période des dilemmes nous conduit à nous interroger sur les meilleurs choix à opérer aujourd’hui dans les relations entre la poursuite des recherches sur des corpus variés (et parfois sensibles) et les exigences des bases de données ouvertes. Whether or not a public relations code of ethics should be enforced, among others, has become one of the most widely controversial topics, especially after the Hill and Knowlton case in 1992. I take the position that ethical codes should be enforced and address this issue from eight aspects: (a) Is a code of ethics an absolute prerequisite of professionalism? (b) Should problems of rhetoric per se in a code of ethics become a rationale against code enforcement? (c) Is a (...) code of ethics of any significance? (d) Is the ethical code is enforceable, (e) Would the licensure system interfere with the freedom of expression of the practitioners? (f) Do PR practitioners choose to be ethical (if they do) because they have to be or because they want to be? (g) Would the public interest be virtually assured as a result of a public relations? and (h) Can education in ethics overcome the ethical problems in public relations? (shrink)

A well put together introduction to twentieth century philosophy and philosophers. Trotignon has achieved a good balance by dividing his book into two parts, the first containing twenty- to thirty-page summaries of Sartre and Merleau-Ponty, the second paragraph-long to eight-page presentations of lesser figures. Sartre and Merleau-Ponty are set at two extremes of Husserlian existentialist phenomenology through a series of polarizations : e.g., Sartre's Husserl is the Husserl of Ideen I, Merleau-Ponty's the Husserl of Erfahrung und Urteil, Méditations cartésiennes, and (...) the Krisis. Trotignon's précis of minor figures, consistently to the point, fall into three categories: "Phenomenological currents" "Philosophy of history", and "Twenty years after or the crisis of philosophy". In concluding, Trotignon announces Structuralism, a new "Practical subjectivity," as the philosophy of the future. There follows a three-page bibliography of primary sources for minor figures, with primary and secondary sources for Sartre and Merleau-Ponty.--C. M. R. (shrink)

C’est grâce à son essai Politische Romantik, publié en 1919, que Carl Schmitt fait une entrée remarquée sur la scène intellectuelle allemande. L’ouvrage se présente comme une charge systématique et radicale contre la tradition allemande du « romantisme politique », et fut vivement discuté dans les années qui suivirent sa publication. Mais aujourd’hui il se trouve relégué parmi les œuvres de jeunesse de Schmitt et reste rarement étudié par la recherche, qui le lit au mieux comme une belle contribution à (...) l’histoire culturelle du xixe siècle.Pourtant, une étude approfondie de l’essai, ainsi que du contexte historique dans lequel il s’insère, fait apparaître que ce n’est pas dans une telle perspective que Politische Romantik manifeste toute sa portée : bien plus qu’une étude historique, cet essai constitue un élément de réponse à la crise du conservatisme allemand tel qu’il apparaît dans l’après-guerre. Le rejet du « romantisme politique » marque la rupture de Schmitt avec l’idéal « apolitique » des intellectuels allemands de l’époque, et par là constitue le premier moment du projet schmittien, tel qu’il se verra développé de manière croisée dans son étude sur le catholicisme et sa Théologie politique. La beauté est-elle radicalement indépendante du bien? Un homme peut-il être à la fois beau et veule, un roman ou un film beau et malsain? Oui, a massivement répondu la modernité en instituant une scission tranchée entre l'éthique et l'esthétique. Aujourd'hui cette affirmation ne va plus de soi : nombre de traités récents reconsidèrent les formes infiniment variées des relations qu'elles entretiennent et Umberto Eco affirme que “ce n'est pas le Moyen-âge qui était dépourvu d'une esthétique : c'est le monde (...) moderne qui en possède une trop étriquée”. Il faut donc reconsidérer la nature des liens du beau et du bien. Les philosophes qui, de l'Antiquité à nos jours, ont apporté des contributions magistrales à l'instruction de ce dossier complexe, peuvent nous y aider. Cet ouvrage propose donc une histoire philosophique des rapports du beau et du bien, réunissant les contributions de spécialistes de chacun des auteurs considérés. Un ouvrage unique en son genre, fruit d'une collaboration internationale, qui met l'histoire de la philosophie au service de la réflexion la plus actuelle sur les liens de la beauté et du bien. La réception extraordinairement féconde de Heidegger, singulièrement en France, est entrée dans une phase nouvelle et le moment semble propice pour demander « ce qui est vivant » et « ce qui est mort » dans sa pensée, en interrogeant ses percées réelles comme ses impasses. La publication de l'édition intégrale en 102 volumes touche à sa fin : au-delà de tous les textes publiés du vivant de Heidegger, nous avons désormais à disposition tous les cours de Fribourg et de (...) Marbourg, les traités « ésotériques » rédigés dans le sillage des Beiträge dans les années 1930-1940 et les Cahiers noirs de cette période. Le colloque de Québec, documenté par le présent ouvrage et complété par des textes inédits, se concentrait moins sur le maître-ouvrage Être et temps que sur la période complexe initiée avec la conférence "L'essence de la vérité". C'est en effet à partir du « tournant » des années 1930 qu'émergent les concepts qui guident la pensée de l'Ereignis inscrite dans une « Histoire de l'être », selon ses dimensions phénoménologique et herméneutique, mais aussi théologique et politique.Les contributions ici réunies, portant sur l'histoire, la technique, l'art, le politique, le mythe ou le divin, tentent d'éclairer la nature et les limites de ce legs philosophique majeur du XXe siècle en envisageant la question de sa postérité et de son actualité pour nous, aujourd'hui. Hui Shi (370-310B.C.E.?) is a unique one among the pre-Qin scholars. The object and orientation of his scholarship emphasized on “chasing after the materials” or the research for objective knowledge of natural things. He shows a tendency of tolerating and advocating diversity and variety, and intentionally pursuing new and unusual ideas. In certain degree he judges the value of knowledge by its truthfulness rather than its usefulness. As pointed out by Wing-tsit Chan, Hui shi represents a “tendency in ancient China (...) toward intellectualism for its own sake”. (shrink)

Background: Breaches of publication ethics such as plagiarism, data fabrication and redundant publication are recognised as forms of research misconduct that can undermine the scientific literature. We surveyed journal editors to determine their views about a range of publication ethics issues. Methods: Questionnaire sent to 524 editors-in-chief of Wiley-Blackwell science journals asking about the severity and frequency of 16 ethical issues at their journals, their confidence in handling such issues, and their awareness and use of guidelines. Results: Responses were obtained (...) from 231 editors (44%), of whom 48% edited healthcare journals. The general level of concern about the 16 issues was low, with mean severity scores of <1 (on a scale of 0–3) for all but one. The issue of greatest concern (mean score 1.19) was redundant publication. Most editors felt confident in handling the issues, with <15% feeling “not at all confident” for all but one of the issues (gift authorship, 22% not confident). Most editors believed such problems occurred less than once a year and >20% of the editors stated that 12 of the 16 items never occurred at their journal. However, 13%–47% did not know the frequency of the problems. Awareness and use of guidelines was generally low. Most editors were unaware of all except other journals’ instructions. Conclusions: Most editors of science journals seem not very concerned about publication ethics and believe that misconduct occurs only rarely in their journals. Many editors are unfamiliar with available guidelines but would welcome more guidance or training. (shrink)

Most authors who work with moral status automatically dismiss the possibility that plants are the kinds of entities that have moral status. This dismissal coheres with our intuitions about common-sense morality: if plants do not have moral status then we do not have any direct moral obligations to plant life. An implication of such a view is that any suggestion otherwise commits one to be in favour of an absurd conclusion. However, given the recent literature and empirical evidence on plant (...) minds, there are reasons to accept a different perspective that finds the absurd conclusion plausible. (shrink)

Investigates the resolution of contradictions and ambiguous derogations in a code, by means of the imposition of partial orderings. Although formulated as a study in the logic of norms, it provided the initial ideas for work on the logic of theory (or belief) change, developed by the authors in a series of papers by the authors and Peter Gardenfors beginning in 1985.

This essay explores a tragic event that happened in China, which garnered much attention, the Li case: a young woman who was nine months pregnant and her baby died as a result of the failure to receive a medically necessary c-section due to the hospital having failed to secure her family's consent for the c-section. Differing from some critiques, this essay argues that the Li case should not be used to blame the Confucian family-determination model that has been applied in (...) Chinese society for thousands of years. Based on summarizing the reasons supporting the model, this essay indicates that it is an integral part of the model that, in emergency or special cases, the physician must take medical action to save the patient, without the need to secure the consent of a family member. In order to prevent tragic cases like the Li case from happening, we recommend that relevant Chinese laws be further developed and specified and that, most importantly, Chinese physicians must cultivate the Confucian virtue of benevolence in their practice of taking care of patients in a virtuous way, along with patients’ families. This article examines and edits an anonymous text from the late 1330s, which was written to refute the arguments presented in a lost quaestio disputata by an unknown Parisian philosopher. At the heart of this scholastic dispute was the question whether the astrological branch known as interrogations was an effective and legitimate means of predicting the future. The philosopher’s negative answers to this question as well as the rebuttals preserved in our anonymous text offer valuable new insights into the debate (...) over astrology that raged at the University of Paris during the fourteenth century. Besides arguing at length for the internal coherence and philosophical soundness of interrogations, the text contains a bold defence against the Augustinian view that astrologers consort with demons. This defence was later rebutted as part of an anti-astrological polemic by the astronomer Heinrich Selder, who is known to have studied in Paris during the 1370s. (shrink)

ABSTRACT This article is devoted to a thirteenth-century Latin text on how to construct, set up, and use a version of the so-called armillary instrument (instrumentum armillarum), which was first described in Ptolemy’s Almagest as a tool for measuring ecliptic coordinates. Written in 1264 by Guillaume des Moustiers, bishop of Laon, this hitherto unstudied Tractatus super armillas survives in a single manuscript, where it is accompanied by a copious set of glosses. The text and its glosses jointly offer an unusually (...) detailed account of the instrument’s material aspects and methods of assembly. In addition, they reflect a keen awareness of the potential sources of error that may arise in the context of astronomical observation, while making suggestions on how these errors may be minimized or avoided. The Tractatus super armillas accordingly is a valuable source on the observational side of medieval European astronomy, which has often been minimized in modern historical accounts. (shrink)
