Central to these claims has been an assertion that women have been (...) inadequately represented as subjects of clinical studies and that as a result neither health conditions unique to women—e.g., menopause—nor women's manifestations of health problems affecting both sexes—e.g., heart disease—have been investigated sufficiently.The scientific community, including federal agencies that sponsor and regulate clinical studies, is increasingly responsive to these claims and is taking steps to raise the level of women's participation in clinical studies. Controversy and concern have surrounded these actions, however. Two of the claims that have been made are: (1) that women are more difficult to study than men because of their cyclical hormonal changes; and (2) that conducting gender-specific subgroup analyses would increase the size of study populations, raise the cost of studies, and thereby reduce the number of studies that could be performed with the limited resources available. In addition, controversy over the inclusion of women of childbearing potential and pregnant women has been particularly salient. Concerns have been expressed about avoiding potential harm to existing or potential fetuses and about the possible legal and financial ramifications of such harm. A further concern involves the perceived difficulties in enrolling women in studies and retaining them for the duration of the studies.Against this backdrop, the Office of Research on Women's Health at the National Institutes of Health (NIH) asked the Institute of Medicine (IOM) in October 1992 to establish the Committee on the Ethical and Legal Issues Relating to the Inclusion of Women in Clinical Studies. The Committee's charge was to: (1) consider the ethical and legal implications of including women, particularly pregnant women and women of childbearing potential, in clinical studies; (2) examine known instances of litigation regarding injuries to research subjects [End Page 55] and describe existing legal liabilities and protections; and (3) provide practical advice on these issues for consideration by NIH, institutional review boards (IRBs), and clinical investigators.The 16 Committee members came from diverse backgrounds: bioethics, law, epidemiology and biostatistics, public health policy, obstetrics and gynecology, clinical research, pharmaceutical development, social and behavioral sciences, and clinical evaluative sciences.1 Chaired by two of the authors of this article, Ruth Faden and Daniel Federman, and coordinated by the third, IOM Study Director Anna Mastroianni, the Committee met five times over a fourteen-month period, convened a one-and-one-half day invitational workshop, and commissioned several background papers. The Committee's deliberations were complicated by the announcement of new federal policies late in its term. Specifically, the Food and Drug Administration (FDA) issued guidelines (FDA 1993) to replace its 1977 guidelines, which prohibited the inclusion of women of childbearing potential in early phases of most clinical drug trials. In addition, Congress passed the NIH Revitalization Act of 1993 (P.L. 103-43), which contains provisions mandating the inclusion of women and racial and ethnic minorities in NIH-sponsored clinical research. In February 1994, the IOM Committee publicly issued its final report and recommendations, Women and Health Research: Ethical and Legal Issues of Including Women in Clinical Studies, publishing the workshop presentations and commissioned papers in a separate volume.Deliberations of the CommitteeA number of issues arose at the outset as the Committee considered its charge. A few members initially believed that verification of the underrepresentation of women relative to men in clinical studies as a whole was a prerequisite to providing policy recommendations. U.S. researchers and scholars often point to two legal factors as significant obstacles to the inclusion of pregnant women in clinical research: the Department of Health and Human Services’ regulatory limitations specific to pregnant women's research participation and the fear of liability for potential harm to children born following a pregnant woman's research participation. This article offers a more nuanced view of the potential legal complexities that can impede research with pregnant women than has previously been reflected in the literature. (...) It reveals new insights into the role of legal professionals throughout the research pathway, from product conception to market, and it highlights a variety of legal factors influencing decision-making that may slow or halt research involving pregnant women. Our conclusion is that closing the evidence gap created by the underrepresentation and exclusion of pregnant women in research will require targeted attention to the role of legal professionals and the legal factors that influence their decisions. Nearly one year has passed since the release of the Committee’s final report and recommendations, and it seems an appropriate time to invite discourse and reflection on the influence and impact of the Committee and (...) its efforts. Our intent is to advance understanding of the Committee and its work, its place in the evolution of bioethics and public policy, as well as the broader legacy of restoring trust in the conduct of human subjects research.In 1993, President Clinton and Secretary of Energy Hazel O’Leary initiated an investigation of America’s involvement in radiation experiments on its citizens during the Cold War. The investigation resulted in the appointment of the Committee in January 1994. Some issues raised by these radiation experiments were brought to the attention of the nation by revelations contained in a Pulitzer Prize-winning series of newspaper stories about plutonium injections carried out by the government on allegedly unsuspecting subjects during the Cold War. The Committee faced a broad mandate, which included piecing together the history of Cold War radiation experiments and human subjects research, as well as recommending remedies for past wrongs and mechanisms to ensure that such wrongs could not be repeated in the future.This issue of the Journal consists of articles and accompanying commentaries on historical, philosophical, policy, and political aspects of the Committee’s work that are important to bioethics. This collection of articles, authored by Committee members, staff, and leading scholars, is designed to paint a picture of the breadth and complexity of the Committee’s efforts and to provide context and to stimulate discussion of significant issues.In the first article, Ruth Faden provides her unique perspective as chair of the Committee. She goes beyond the necessary overview and background of the Committee to reflect on the impact and meaning of the Committee’s work to bioethics and public policy.Much of the Committee’s effort was directed at gathering and uncovering information about the history of Cold War radiation experiments, an endeavor fairly foreign to bioethics but critically important to understanding the context in which to make moral judgments about the past. : During the nearly 10 years since its introduction, preimplantation genetic diagnosis (PGD) has been used predominantly to avoid giving birth to a child with identified genetic disease. Recently, PGD was used by a couple not only to test IVF-created embryos for genetic disease, but also to test for a nondisease trait related to immune compatibility with a child in the family in need of an hematopoetic stem cell transplant. Public health ethics, like the field of public health it addresses, traditionally has focused more on practice and particular cases than on theory, with the result that some concepts, methods, and boundaries remain largely undefined. This paper attempts to provide a rough conceptual map of the terrain of public health ethics. We begin by briefly defining public health and identifying general features of the field that are particularly relevant for a discussion of public health ethics.Public health is primarily concerned with (...) the health of the entire population, rather than the health of individuals. Its features include an emphasis on the promotion of health and the prevention of disease and disability; the collection and use of epidemiological data, population surveillance, and other forms of empirical quantitative assessment; a recognition of the multidimensional nature of the determinants of health; and a focus on the complex interactions of many factors—biological, behavioral, social, and environmental—in developing effective interventions. At its core, public health introduces tensions between individuals' autonomy and the need to account for the perspectives and needs of communities and populations. It further raises social justice issues, including fair allocation of limited resources. This article examines and elaborates on these tensions and their resolutions using specific public health examples. The manuscript was commissioned by the bishop Giovanni Capogallo, when he was in Lombardy in close contact with the court of the duke Gian Galeazzo Visconti. The article examines the cultural milieu of Pavia in the early 15th century, highlighting the role of the Order of the Hermits of Saint Augustine in the monastery of San Pietro in Ciel d’Oro. (...) The two incipit pages ff. 1r and 239r, illuminated by Michelino da Besozzo, are an example of the International Gothic style and this article analyses not only their stylistic aspect, but also their allegorical meaning, as an interesting case of decoration of a patristic text. This study belongs to the ethnomethodological tradition of identifying the everyday practices accounting for the oiled machinery of social organization and applies this approach to understanding direction light usage. We observe a set of episodes videorecorded in North-East Italy in the urban traffic. We first unpack the meaning of direction light usage from a pragmatic perspective and then test our interpretation against the cases in our collection that seem to deviate from it. We argue that direction lights’ usage works as (...) an announcement to some road users and a request to a subset of them; in both cases, direction lights convey contextualized (indexical) coordinates about the vehicle’s prospective trajectory. We then explain the cases in which signaling is omitted and draw some implications for traffic coordination and safety. (shrink)

Entretanto, a despeito do anonimato da obra, ela tornou-se um dos textos mais famosos dentre a filosofia clandestina do século XVIII, aludindo a um filósofo que foi uma das maiores vítimas da superstição e do fanatismo de sua época: Giordano Bruno. O título do escrito é uma espécie de homenagem ao pensador italiano, mas não há no decorrer da (...) obra uma menção sequer que comprove que o autor anônimo tenha lido uma linha de suas obras, mesmo que seja considerado o elo filosófico de união entre o brunismo da primeira metade do século XVII e o da segunda metade do século XVIII. É em um encadeamento de ideias progressivo no Jordanus Brunus que nos permite encontrar o fio condutor das reflexões do autor: a sua formulação do ateísmo caracteriza-se por sua abordagem não dogmática, dissimulada, preparando o solo para o racionalismo ateu que estaria por vir. O presente artigo limitar-se-á à terceira e quarta partes do manuscrito, nas quais o autor anônimo vai tratar diretamente da questão da existência de deus e fazer diversas objeções às provas de sua existência. If only implicitly, social anthropology has long incorporated joint attention as a research technique employed in what anthropologists call “the field”. This paper outlines the crucial role joint attention plays in anthropolgical fieldwork—specifically in Participant Observation—and advances the position that joint attention is a goal rather than a starting point of fieldwork practice. Exploring how anthropologists tentatively use attention as a methodological tool to understand other people’s lifeworlds, this paper draws parallels between Participant Observation and ordinary everyday interactions, thus teasing (...) out a view of _joint_ attention as a goal to be reached only by means of knowing what matters to others in the context of the lifeworld they inhabit. Johann Heinrich Tieftrunk has a place among the early Kantians in Halle as both a theologian and a philosophical thinker. After situating Tieftrunk within this intellectual history and determining his theological and philosophical position, this paper provides a chronological account of the concept of hope—which lies at the basis of Kant’s moral philosophy—in Tieftrunk’s writings on philosophy of religion. In particular, the discussion centers on the relationship between the foundation of hope in the moral law and the exclusion of a (...) legalistic fulfilment of hope. The “love of the law,” which emerges especially in Tieftrunk’s work, takes a prominent position in the interpretation. The investigation is accompanied by an evaluation of Tieftrunk’s role in the early reception of Kant. (shrink)

Analyzing the rate at which languages change can clarify whether similarities across languages are solely the result of cognitive biases or might be partially due to descent from a common ancestor. To demonstrate this approach, we use a simple model of language evolution to mathematically determine how long it should take for the distribution over languages to lose the influence of a common ancestor and converge to a form that is determined by constraints on language learning. We show that modeling (...) language learning as Bayesian inference ofnbinary parameters or the ordering ofnconstraints results in convergence in a number of generations that is on the order ofn log n. We relax some of the simplifying assumptions of this model to explore how different assumptions about language evolution affect predictions about the time to convergence; in general, convergence time increases as the model becomes more realistic. This allows us to characterize the assumptions about language learning (given the models that we consider) that are sufficient for convergence to have taken place on a timescale that is consistent with the origin of human languages. These results clearly identify the consequences of a set of simple models of language evolution and show how analysis of convergence rates provides a tool that can be used to explore questions about the relationship between accounts of language learning and the origins of similarities across languages. Americans increasingly cite moral values as a factor in how they vote, but when we define morality simply in terms of a voter's position on gay marriage and abortion, we lose sight of the ethical decisions that guide our everyday lives. In our encounters with friends, family members, nature, and nonhuman creatures, we practice a nonutilitarian morality that makes sacrifice a rational and reasonable choice. Recognizing these everyday ethics, Anna L. Peterson argues, helps us move past the seemingly irreconcilable (...) conflicts of culture and refocus on issues that affect real social change. Peterson begins by divining a "second language" for personal and political values, a vocabulary derived from the loving and mutually beneficial relationships of daily life. Even if our interactions with others are fleeting and fragmentary, they provide a viable alternative to the contractual and atomistic attitudes of mainstream culture. Everyday ethics point toward a more just, humane, and sustainable society, and to acknowledge moments of grace in our daily encounters is to realize a different way of relating to people and nonhuman nature—an alternative ethic to cynicism and rank consumerism. In redefining the parameters of morality, Peterson enables us to make fundamental problems such as the distribution of wealth, the use of public land and natural resources, labor and employment policy, and the character of political institutions the preferred focus of debate and action. The focus of this paper is the discussion between supporters of the intentional account of SD and supporters of the causal account. Between these two options the author argues that SD is the unintentional outcome of intentional steps taken by the agent. More precisely, she argues that SD is a complex mixture of things that we do and that happen to us; the outcome is however unintended by the subject, though it fulfils some of his practical, though short-term, goals. In (...) her account, SD is produced after a fashion similar to those beneficial social phenomena which serve some collective purpose, are the product of human action, but not of human design, such as money, language and many social conventions; and similarly SD can be accounted by invisible hand explanation. The paper will critically analyze both the intentional and the causal accounts, and then present the invisible hand explanation which avoids the most puzzling aspect of the intentional view, while keeping the distinctiveness of SD in the realm of motivated irrationality. A brief discussion of the issue of responsibility for SD will conclude the paper. (shrink)

La literatura jurídica está dedicando cada vez más atención a los estereotipos perjudiciales en los distintos momentos procesales, desde la fase de instrucción hasta que se dicta sentencia. En este trabajo la estereotipación judicial, como mala praxis de la argumentación judicial, se enfocará en la sentencia. Después de evidenciar el fundamental papel de la motivación como lugar donde poder ejercer un control de las decisiones judiciales (2), así como lugar donde detectar la estereotipación judicial (3), se propondrá reflexionar sobre dos (...) tipos de conocimiento que pueden vehicular los sesgos de una cultura discriminatoria: el sentido común (4) y la pseudo-ciencia (5). Si bien son dos tipos de conocimiento que se emplean en la motivación de la sentencia para alcanzar un mejor entendimiento de los hechos, se observa la necesidad de que el órgano judicial adopte una actitud crítica para detectar la subyacente práctica discriminatoria potencialmente presente en ambas formas de conocimiento. Recent progress in synthetic biology has enabled the development of novel therapeutic opportunities for the treatment of human disease. In the near future, first-in-human trials will be indicated. FIH trials mark a key milestone in the translation of medical SynBio applications into clinical practice. Fostered by uncertainty of possible adverse events for trial participants, a variety of ethical concerns emerge with regards to SynBio FIH trials, including ‘risk’ minimization. These concerns are associated with any FIH trial, however, due to the (...) novelty of the approach, they become more pronounced for medical applications of emerging technologies like SynBio. To minimize potential harm for trial participants, scholars, guidelines, regulations and policy makers alike suggest using ‘risk assessment’ as evaluation tool for such trials. Conversely, in the context of emTech FIH trials, we believe it to be at least questionable to contextualize uncertainty of potential adverse events as ‘risk’ and apply traditional risk assessment methods. Hence, this issue needs to be discussed to enable alterations of the evaluation process before the translational phase of SynBio applications begins. In this paper, we will take the opportunity to start the debate and highlight how a misunderstanding of the concept of risk, and the possibilities and limitations of risk assessment, respectively, might impair decision-making by the relevant regulatory authorities and research ethics committees, and discuss possible solutions to tackle the issue. The present study analyzes metaphors of life, self, emotional states, and relationships in forty life stories that differ in their communicative situations and narrative goals. Twenty interviews were conducted with people who were seeking psychological help. Another twenty interviews were conducted with Russian celebrities for publication in popular psychology magazines. Metaphors in happy stories were more numerous and diverse than in unhappy stories. Some conceptual metaphors (e.g., “LIFE IS A CONTAINER,” “LIFE IS A JOURNEY,” and “EMOTION IS A PHYSICAL IMPACT”) (...) were found in both happy and unhappy narratives. More specific metaphors demonstrated significant differences between the two types of narratives. The metaphors of life as a “purposeful journey,” self as “alive and flexible object,” and emotional states as “internal and controlled forces” were used more often in happy narratives. This may reflect higher levels of activity, responsibility, and awareness of the authors of happy narratives. Specific for unhappy stories were metaphors “LIFE IS DEATH” and “SELF IS A DEAD OBJECT,” which may indicate a low level of personal well-being and serve as specific markers of personal unhappiness. The results of our study suggest that metaphors may help to construct the subjective reality of happy and unhappy life. By telling their life stories people are able to redefine their past experiences and future perspectives. Specific metaphors play an important part in defining subjective happiness or unhappiness. Almaatouq et al. propose an integrative experiment design space combined with large samples for scientific advancement. We argue recent innovative designs combining closed-loop experiment designs and Bayesian optimisation allow for integrative experiments at an individual level during a single session, circumventing the necessity for large samples. This method can be applied across disciplines, including developmental and clinical research.
