The disconnection between the idea of nation-based citizenship and the current practices of migrants presents the opportunity to reconceptualize and redefine the idea of citizenship and thereby grasp the realities of movement. I employ Giambattista Vico's theories of universal rights and his history of civilizations to interrogate rhetorically national origins and expand on what I call a renovation of citizenship. This is a process that embraces daily practices of nation-based citizenship and encourages us to imagine new ways to express citizenship, (...) ways that comport with the realities of a mobile world, specifically the human right of freedom of movement. In formulating this renovation of citizenship based on mobility, I introduce the metaphor of stochastic citizenship to resolve the tension between the legal structures governing citizenship and the promotion of mobility as a human right. ZusammenfassungAktuelle Untersuchungen zum Gene Editing an menschlichen Embryonen zeigen große Erfolge bei der Korrektur vererbbarer Krankheiten und treiben die Grundlagenforschung sowie die Präimplantations-Gendiagnostik enorm voran. Was von Forschungen dieser Art aus ethischer Sicht zu halten ist, ist dagegen weniger eindeutig. Ein Blick auf den aktuellen Diskurs zeigt, dass diese Entwicklungen sehr kontrovers diskutiert werden und eine Einigung darüber, ob sie vorangebracht werden sollen oder nicht, keineswegs in Sicht ist. Zum Zweck der Orientierung und auch besseren Positionierung in der aktuellen Debatte (...) befasst sich die vorliegende Untersuchung zum einen mit der Art des Wissens vom Gene Editing sowie dessen epistemischen Grundlage und zum anderen mit den ethisch-normativen Überzeugungen, an die die Befürworter und Gegner in der ethischen Bewertung des Gene Editing jeweils appellieren. Dabei zeigt sich, dass die Überzeugungen, auf die sich die Befürworter stützen, der speziellen Art dieses Wissens und seiner epistemischen Grundlage stärker Rechnung tragen, während das von den Überzeugungen, auf die sich die Gegner berufen, gerade nicht zu erwarten ist. Few emotions have divided opinion as deeply as shame. Some scholars have argued that shame is essentially a maladaptive emotion used to oppress minorities and reinforce stigmas and traumas, an emotion that leaves the self at the mercy of powerful others. Other scholars, however, have argued that the absence of a sense of shame in a subject--their shamelessness--is tantamount to a vicious moral insensitivity. As the twelve original chapters in this collection attest, however, shame scholars are entering a new phase, (...) one in which scholarship no longer attempts to defend one side of shame against the other, but rather accepts both faces as faithful to the phenomenon to be explained. At the core of our understanding of shame there are profound disagreements about the importance of the Other in shaping our moral identity. Der Beitrag weist im ersten Teil nach, dass der Autor des Buches, das die nationalsozialistische Rassenlehre aus christlicher Sicht entschieden zurückweist, in Wirklichkeit jedoch der Jesuitenpater Pierre Lorson, ein gebürtiger Deutscher, war. Der zweite Teil dokumentiert die deutsch-französische Vermittlertätigkeit Pater Lorsons. Die Übersetzung von Guardinis Werk „Der Herr", die er während des (...) Zweiten Weltkriegs anfertigte , wurde in Frankreich mehrfach aufgelegt . Außerdem präsentierte der Jesuit, ein engagierter Repräsentant der Pax Christi, den französischen Lesern im Jahre 1948 einen Vortrag Guardinis an der Sorbonne zur Friedensidee .The book „Le chrétien devant le racisme" that emphatically rejects the National Socialist ideology of racism from the Christian viewpoint was published under a pseudonym, "Lucien Valdor", in 1939. French libraries and distinguished scholars like Henri de Lubac attribute it to Romano Guardini. In the first part of the present contribution, however, the Jesuit father Pierre Lorson who was of German origin is identified as the true author. The second part reports on father Lorson's role as a German-French mediator. His translation of Guardini's book "Der Herr" , prepared during World War II, was published in 1946 und reprinted in France several times . Moreover, in 1948 this Jesuit who was a committed advocate of the Pax Christi Movement presented the French readership to a lecture on the idea of peace held by Guardini at the Sorbonne. (shrink)

Die Leitfrage der Untersuchung ist, ob die externalistische These von der extra-mentalen Konstitution propositionaler Gedankeninhalte mit der Cartesischen Theorie der Selbstgewißheit der eigenen Gedanken vereinbar ist. Anhand von Burges Theorie des privilegierten Selbstwissens wird gezeigt, daß die mit dem Externalismus verträgliche epistemische Asymmetrie zwischen Selbst- und Fremdzuschreibungen von Einstellungen um vieles eingeschränkter ist als von Cartesianern behauptet wird. Einerseits kann man sich hinisichtlich der mit den eigenen propositionalen Inhalten notwendigerweise verbundenen Gegebenheitsweisen oder Attitüden irren. Andererseits kann durch Introspektion allein nicht (...) entschieden werden, ob man überhaupt über intentiolnale Zustände verfügt, d.i. ob die eigenen Gehirnzustände Träger propositionaler Ghalte sind. Health care resource distribution is a subject of debate among health policy analysts, economists, and philosophers. In the United States, there is a widening gap between the more-and less-advantaged socioeconomic sub-populations in terms of both health care resource distribution and outcomes. Conventional wisdom suggests that there is a tradeoff, a zero-sum game, between efficiency and fairness in the distribution of health care resources. Promoting fairness in the distribution of health care resources and outcomes is not efficient in terms of maximization (...) of a health outcome production function. On the other side of the coin, improving efficiency comes at the expense of fairness. Such conventional wisdom is supported in part by standard static Paretian welfare analysis. However, in this paper it is shown that in a dynamic setting in which there are efficiency gains in the health production function, fairness in distribution of health care resources can improve simultaneously. Im zweiten Abschnitt werde ich vier Domänen kognitiver Erweiterung auseinanderhalten, nämlich eine Erweiterung in die körperliche, physikalische, 'informatorische' und soziale Umgebung betreffend. Um die These der erweiterten Kognition vor dem Einwand der kognitiven Inflation zu schützen, muss man für jeden dieser Bereiche (und gegebenenfalls noch spezieller) spezifische Bedingungen und Mechanismen der kognitiven Kopplung an die externen Komponenten angeben. Im dritten Abschnitt unterscheide ich die These der (...) erweiterten Kognition, von der sich im ersten Abschnitt bereits zeigen wird, dass sie eine These kognitiver Vehikel ist, von einer externalistischen Gehaltsthese. Letztere bezeichne ich im Anklang an Clark und Chalmers als aktiven Externalismus und illustriere dessen Unterschiede und Besonderheiten gegenüber den bekannten 'passiven' Formen des semantischen oder mentalen Externalismus in der Philosophie des Geistes, die sich mit den Namen Putnam, Millikan und Burge verbinden. Im vierten Abschnitt verfolge ich die spezifische Idee, die Mechanismen geteilter Intentionalität als Kopplungsmechanismen kognitiver Erweiterung in die soziale Umgebung, speziell soziale Interaktionspartner, anzusehen. Dazu mache ich in einigem Detail von Bratmans bekannter Plan-Konzeption geteilter Intentionalität Gebrauch. Anhand der Ergebnisse dieser Analyse wird sich im fünften und letzten Abschnitt zeigen, in welchem Sinne es sich dabei im Keim bereits um einen sozialen Externalismus handelt. Im Zusammenspiel von Verfassern, geistlichen Beratern – dem Hofklerus – und zunächst einmal adligen Damen entstehen die Texte, denen eine hofklerikale Perspektive auf Fragen feudaladliger Existenz eignet: Die ästhetisch komplexen volkssprachigen Texte lassen klare Problembezüge erkennen. Im Rahmen dieses Modells literarischer Kommunikation wird der Erec Hartmanns von Aue als Absage an Versuche ritterlicher Selbsterlösung gedeutet, denen der sich der göttlichen (...) Gnade öffnende Wille des demütig Gläubigen gegenübergestellt wird. Der Tristan Gottfrieds von Straßburg scheint mit Blick auf die Protagonisten ein Negativexempel zu entwickeln, wobei durch suggestive Gestaltungsdynamiken das Abrücken der edelen herzen von Tristan und Isolde zunächst verhindert und dann umso stärker forciert wird.A specific social-historical embedding can be assumed for the Middle High German novels around 1200, which has consequences for a model of literary communication: In the interplay of authors, spiritual advisers and first of all noble women, the texts are created for which a courtly-clerical perspective on questions of feudal noble existence is suitable. Making better choices about future technologies that are being researched or developed is an important motivator behind lay ethics interventions. However, in practice, they do not always succeed to serve that goal. Especially authors who have noted that lay ethicists sometimes take recourse to well-known themes which stem from old, even ‘archetypical’ stories, have been criticized for making too little room for agency and decision-making in their approach. This paper aims to contribute to a reflection on how lay ethics can (...) acquire more practical relevance. It will use resources in narrative ethics to suggest that in order to be relevant for action, facilitators of lay ethics interventions need to invite participants to engage in a narrative quest. As part of a quest, lay ethicists should be asked to reflect on a specific question or choice, use diverse input which is informative about the heterogeneity of viewpoints that are defended in society and argue for their standpoints. The existence of objective knowledge and the possibility of communicating it by means of language have traditionally been taken for granted by educators. Recent developments in the philosophy of science and the historical study of scientific accomplishments have deprived these presuppositions of their former plausibility. Sooner or later, this must have an effect on the teaching of science. In this paper I am presenting a brief outline of an alternative theory of knowing that takes into account the thinking organism's cognitive (...) isolation from 'reality'. This orientation was proposed by Vico at the beginning of the 18th century, disregarded for two hundred years, and then propounded independently by Piaget as a developmentally grounded constructivist epistemology. The paper focuses specifically on the adaptive function of cognition, Piaget's scheme theory, the process of communication, and the subjective perspective on social interaction. In the concluding section it then suggests some of the consequences the shift of epistemological presuppositions might have for the practice of teaching. (shrink)

The aim of this paper is to bring clarity to these debates by offering a critical reconstruction of the notion of essential contestedness. I argue that we should understand essentially contestable concepts as concepts that refer to ideals or to concepts and phenomena that can only be fully understood in light of ideals and that are, as a consequence, open to pervasive contestation. (...) Moreover, some concepts are second-order essentially contested: it may be a matter of ongoing dispute as to whether they should be regarded as essentially contested. The concept of law is an example. Some authors argue that it is ideal-oriented, whereas others claim it is not. This insight that ‘law’ is a second-order essentially contested concept may explain some of the disagreements between legal positivism and its various opponents. (shrink)

Jahrhunderts, bekannt als Pseudo-Alexander, (Bücher 6--?14) stammenden Kommentar zur Metaphysik des Aristoteles eine überragende Bedeutung zu. Der Wert des durch fundierte Kenntnisse der Philosophie des Aristoteles ausgezeichneten Kommentars ist sowohl für die denkerische Durchdringung der aristotelischen Metaphysik als auch für die Geschichte der griechischen Philosophie nicht genug hochzuschätzen. Den Denkern des Mittelalters (...) lag der Text aber nicht vor. Erst im Jahre 1527 machte der berühmte spanische Humanist Juan Ginés de Sepúlveda (1490?-1573) der breiten Öffentlichkeit den Kommentar zur Metaphysik erst zugänglich. Ein Nachdruck der 'editio princeps' dieser lateinischen Übersetzung, die 1561 zum fünften und letzten Mal erschienen ist, ist nicht nur ein Akt der antiquarischen Pietät, sondern kommt gerade im digitalen Zeitalter einer Forderung der Forschung nach. Is the law good? How can it be improved? These questions are frequently addressed, both in traditional doctrinal research and in interdisciplinary legal research. In this article, I elaborate a general argumentative framework for justifying evaluations and recommendations for legislative reform, and I identify the chains of argument for making evaluations and recommendations. This may help researchers to make their arguments explicit and transparent, and then to justify the choices made for each of the steps in the argument. This enables (...) readers - as well as authors - to assess whether the argument’s conclusions are sound and convincing. A key problem in making these arguments concerns the choice of standards for evaluation. I suggest that they can be best understood in terms of the underlying values. In order to make all-things-considered evaluations and normative recommendations, interdisciplinary cooperation between doctrinal, socio-legal, and legal-philosophical researchers is necessary. Therefore, individual researchers will usually have to settle for pro tanto evaluations and recommendations. (shrink)

Leadership is instrumental to resolution of collective action dilemmas, particularly in large, heterogeneous groups. Less is known about the characteristics or effectiveness of leadership in small-scale, homogeneous, and relatively egalitarian societies, in which humans have spent most of our existence. Among Tsimane’ forager-horticulturalists of Bolivia, we (1) assess traits of elected leaders under experimental and naturalistic conditions and (2) test whether leaders impact or differentially benefit from collective action outcomes. We find that elected leaders are physically strong and have more (...) kin and other exchange partners. Their ranks on physical dominance, kin support, and trustworthiness predict how well their groups perform, but only where group members have a history of collaborative interaction. Leaders do not take more of the spoils. We discuss why physically strong leaders can be compatible with egalitarianism, and we suggest that leaders in egalitarian societies may be more motivated by maintaining an altruistic reputation than by short-term rewards of collective action. Like Hayek, Mises moved beyond economics in his later years to address questions regarding the foundation of all social science. But unlike Hayeks attempts, Misess writings on these matters have received less attention than they deserve. Theory and Histor, writes Rothbard in his introduction, "remains by far the most neglected masterwork of Mises. Here Mises defends his all-important idea of methodological dualism: one approach to the hard sciences and another for the social sciences. The Royal Dutch Medical Association recently completed a researchproject aimed at investigating how guidelines for `appropriatemedical care' should be construed. The project took as a startingpoint that explicit attention should be given to ethical andpolitical considerations in addition to data about costs andeffectiveness. In the project, two research groups set out todesign guidelines and cost-effectiveness analyses (CEAs) for twocircumscribed medical areas (angina pectoris and majordepression). Our third group was responsible for the normativeanalysis. We undertook an explorative, qualitative pilot study ofthe (...) normative considerations that played a role in constructingthe guidelines and CEAs, and simultaneously interviewedspecialists about the normative considerations that guided theirdiagnostic and treatment decisions. Explicating normativeconsiderations, we argue, is important democratically: the issuesat stake should not be left to decision analysts and guidelinedevelopers to decide. Moreover, it is a necessary condition for asuccessful implementation of such tools: those who draw uponthese tools will only accept them when they can recognizethemselves in the considerations implied. Empirical normativeanalysis, we argue, is a crucial tool in developing guidelinesfor appropriate medical care. (shrink)

Ethical analysis may result in recommendations for legal reform. This article discusses the problem of how academic researchers can go from ethical normative judgments to recommendations for law reform. It develops a methodological framework for what may be called ‘ethical transplants’: transplanting ethical normative judgments into legislation. It is an inventory of the issues that need to be addressed, but not a substantive normative theory. It may be especially helpful for Ph.D. students and beginning researchers working in interdisciplinary projects combining (...) ethical and legal analysis.I distinguish three stages in the process from ethics to law: translation, transformation, and incorporation. The latter stage can be divided into three clusters of issues, these being legal, empirical, and normative ones. Most of the philosophical literature on the legal enforcement of morals focuses on the normative issues. My aim is to broaden the perspective in two ways. First, I show that this is only one relevant issue and that we should address legal and empirical issues and the processes of translation and transformation as well.
