Clinicians and administrators have a professional obligation to contribute to improvement of healthcare quality. At the same time, participation in embedded research poses risks to healthcare institutions. Disclosure of an institution’s sensitive information could endanger relationships with patients and undermine its reputation. The existing ethical framework for learning healthcare systems does not address the conflict between the OTC and institutional interests. Ethical guidance and policy regulation are needed to create a safe environment for embedded research. In this article we analyse (...) the EF for LHSs and the concept of professionalism. We suggest that the EF should be supplemented with an obligation to protect provider’s legitimate interests. We define legitimate interests as those that enable providers to discharge their primary duties. We argue that both the OTC and the obligation to protect legitimate interests are grounded in the concept of medical professionalism and can be understood as a matter of contract between a democratic society and medical professionals. The proposed supplemented EF can be implemented into a regulatory system in three different ways: the self-regulating: where providers decide themselves how to balance the ethical claims, the centralised: where a governmental institution decides the right balance between providers’ interests and interests of a health system; and the mediating: where medical professionals, the state and patients negotiate their interests. Our article contributes to the discussion on ethical relevance of providers’ interests and the regulatory model for weighing opposite interests in LHSs. (shrink)

This chapter provides a critical perspective on the role of connectomes in neuroscientific practice and asks how the connectomic approach fits into a larger context in which network thinking permeates technology, infrastructure, social life, and the economy. In the first part of this chapter, we argue that, seen from the perspective of ongoing research, the notion of connectomes as “complete descriptions” is misguided. Our argument combines Rachel Ankeny’s analysis of neuroanatomical wiring diagrams (...) as “descriptive models” with Hans-Joerg Rheinberger’s notion of “epistemic objects,” i.e., targets of research that are still partially unknown. Combining these aspects we conclude that connectomes are constitutively epistemic objects: there just is no way to turn them into permanent and complete technical standards because the possibilities to map connection properties under different modeling assumptions are potentially inexhaustible. In the second part of the chapter, we use this understanding of connectomes as constitutively epistemic objects in order to critically assess the historical and political dimensions of current neuroscientific research. We argue that connectomics shows how the notion of the “brain as a network” has become the dominant metaphor of contemporary brain research. We further point out that this metaphor shares (potentially problematic) affinities to the form of contemporary “network societies.” We close by pointing out how the relation between connectomes and networks in society could be used in a more fruitful manner. The aim of this article is to look at an early 17th-century analysis of a prince’s management of an ‘agglomerate polity’ in order to obtain a view of its chief focuses, concerns, and terms of analysis. Four main types of issues appear (apart from Grotius’ general analysis of Philip’s person and policies, which are also discussed): 1. Acceptation and legitimacy of a prince who was perceived to ignore local customs, rights and interests of his various territories; 2. The king’s representatives (...) and intermediaries, their (mis)management of their task, or the King’s (mis)management of them; 3. The conflicting demands of international politics; 4. Controlling armies and the connected issue of financial resources. The ‘Tacitean’ mode of writing history was regarded as the most ‘true’ and ‘revealing’ historiography in Grotius’ time. However Tacitean perceptiveness and analysis were not about what historians today regard as deeper historical processes and causation (like those associated with the ‘philosophic’ histories from the Enlightenment onwards, e.g. in Edward Gibbon), but about understanding personal motives and (hidden) immediate causes and intentions behind particular events and decisions. This historic differences in historical explanation should be taken into account when judging the value of Grotius’ history of his own time. (shrink)

This is a short presentation by the Guest Editors of the series of Special Issues of the journal _Philosophies_ under the common title “Contemporary Natural Philosophy and Philosophies” in which we present Part 2. The series will continue, and the call for contributions to the next Special Issue will appear shortly.

When there are two lines of argument that contradict each other but still end up with the same conclusion, this conclusion is called a floating conclusion. It is an open topic in skeptical defeasible reasoning if floating conclusions ought to be accepted. Inter- estingly, the answer seems to be changing for different examples. In this paper, we propose a solution for explaining the different treatments of the floating conclusion in the various examples from the literature. We collect the examples from (...) the literature, extend them with additional examples and test various hypotheses for explaining the difference by means of the examples. We will argue for a framework that accepts a floating conclusion by default but allows for reasons to deviate from the default in order to reject it. These reasons nicely explain the different underlying patterns of our intuitions. (shrink)

ABSTRACT Ernst Fraenkel’s seminal study about Nazi law, in which he described the co-existence of a ‘normative state’ and a ‘prerogative state’ as principles of government, is to be rediscovered in the new age of the prerogative. Through a critical reading of The Dual State and other important texts by Fraenkel, this article seeks to contribute to the contemporary debate on regime types and governmental power in three regards: first, by clarifying Fraenkel’s concept of and perspective on law; second, by (...) discussing the methodological demands for the beneficial application of the dual state concept; and, third, by showing the usefulness of such an application, even beyond the field of authoritarian states in the narrower sense. Law-eroding prerogative developments cannot only be witnessed in hybrid regimes, but also in democratic states, which resort to reflections and practices of an ‘enemy criminal law’, and in the European Union’s recent crisis politics. This chapter delves into the museological side of ‘the way forward’ to conservation for planetary health bioethics. Specifically, it highlights the crucial role that museums play – their curatorial or exhibition interventions, conservation operations, development policies, or practices – which present or represent the vital relationship between human and planetary health. While it is not new to stress the significance of museums’ link to the environment and environmental education, it is necessary to re-examine recent cases in light of the rapid (...) changes brought about by climate change and the constant call for sustainability. We thus offer a review of some recent literature that appraises the museum’s role in bioethically considering the health of our living planet. Learning this role taps into relatively new themes such as ecomuseums and architectural heritage, or critical eco-museology. (shrink)

The “Human Brain Project” (HBP) is a large-scale European neuroscience and information communication technology (ICT) project that has been a matter of heated controversy since its inception. With its aim to simulate the entire human brain with the help of supercomputing technologies, the HBP plans to fundamentally change neuroscientific research practice, medical diagnosis, and eventually the use of computers itself. Its controversial nature and its potential impacts render the HBP a subject of crucial importance for critical studies of science and (...) society. In this paper, we provide a critical exploratory analysis of the potential mid- to long-term impacts the HBP and its ICT infrastructure could be expected to have, provided its agenda will indeed be implemented and executed to a substantive degree. We analyse how the HBP aspires to change current neuroscientific practice, what impact its novel infrastructures could have on research culture, medical practice and the use of ICT, and how, given a certain degree of successful execution of the project’s aims, potential clinical and methodological applications could even transform society beyond scientific practice. Furthermore, we sketch the possibility that research such as that projected by the HBP may eventually transform our everyday world, even beyond the scope of the HBP’s explicit agenda, and beyond the isolated ‘application’ of some novel technological device. Finally, we point towards trajectories for further philosophical, historical and sociological research on the HBP that our exploratory analysis might help to inspire. Our analysis will yield important insights regardless of the actual success of the HBP. What we drive at, for the most part, is the broader dynamics of scientific and technological development of which the HBP agenda is merely one particularly striking exemplification. (shrink)

This article is about the ontological dispute between finitists, who claim that only finitely many numbers exist, and infinitists, who claim that infinitely many numbers exist. Van Bendegem set out to solve the 'general problem' for finitism: how can one recast finite fragments of classical mathematics in finitist terms? To solve this problem Van Bendegem comes up with a new brand of finitism, namely so-called 'apophatic finitism'. In this article it will be argued that apophatic finitism is unable to represent (...) the negative ontological commitments of infinitism or, in other words, that which does not exist according to infinitism. However, there is a brand of infinitism, so-called 'apophatic infinitism', that is able to represent both the positive and the negative ontological commitments of apophatic finitism. Unfortunately, apophatic finitism cannot adopt that way without losing the ability to represent the positive ontological commitments of infinitism. (shrink)

En este artículo, examino la transformación del gesto hermenéutico de Heidegger respecto a los grandes textos de la filosofía occidental. Defiendo que, entre 1920 y 1939, Heidegger pasa de un trabajo de «destrucción fenomenológica», donde la interpretación se mide a partir de la experiencia de fenómenos positivos (la historia, el sí-mismo, la fe, la existencia) a un trabajo de «destrucción poiética», dirigido hacia una historia «por venir», ligada a una «experiencia originaria» de la cual tan solo el poeta (Hölderlin) y (...) el pensador (Heidegger) parecen tener la llave. Sin embargo, el pensar heideggeriano amenaza así con hundirse en una forma de hybris (o de desmedida), al sobrepasar la finitud constitutiva de toda hermenéutica digna de ese nombre. (shrink)

This paper deals with the exact constructions of the regular heptagon in Greek and Arabic geometry, which are preserved in a number of mainly unpublished Arabic manuscripts. Appended are editions of the Arabic texts and English translations of Propositions 17 and 18 of the “Book of the Construction of the Circle, Divided into Seven Equal Parts”, attributed to Archimedes, and of the “Book on the Construction of the Heptagon in the Circle and the Division of the Rectilineal Angle into Three (...) This article identifies a distinct strand of 20th-century liberal thought that was exemplified by Isaiah Berlin, Raymond Aron and, to a lesser extent, Karl Popper. I offer a stylized account of their common ideas and shared political sensibility, and argue that their primarily negative liberalism was a variety of what Judith Shklar called the `liberalism of fear' — which put the imperative to avoid cruelty and atrocity first. All three founded their liberalism on a `politics of knowledge' that was directed (...) primarily against Marxist philosophies of history and less against the idea of bureaucratic planning, as, in contrast, was the case with Friedrich von Hayek's thought. Moreover, all three subscribed to more or less explicit versions of value pluralism, and claimed that, in the circumstances of modernity, Weber's `clash of values' was exacerbated and required a particularly prudential approach to politics; this prudential management of value conflicts in turn was best entrusted to cultivated bureaucratic elites. All shared an image of a tolerant and humane society — essentially an idealized version of Britain — but said perhaps too little on the question how societies without the appropriate traditions of moderation and compromise were to be liberalized. In this paper, I provide some evidence for the view that a common charge against those who adopt vegetarianism is that they would be sentimental. I argue that this charge is pressed frequently by those who adopt moral absolutism, a position that I reject, before exploring the question if vegetarianism might make sense. I discuss three concerns that might motivate those who adopt vegetarian diets, including a concern with the human health and environmental costs of some alternative diets, a concern (...) about inflicting pain on animals, and a concern with the killing of animals. While I argue that vegetarianism does not make sense in some situations, I hope that this paper shows that there are many good reasons why the adoption of vegetarian, and—even more so—vegan diets might be appropriate in some situations. In carving out this position, I focus primarily on the question whether a morally relevant distinction between the killing of plants and the killing of animals should be made. I engage primarily with the views of two of the most prominent authors on this issue, arguing that neither Peter Singer nor Tom Regan provide a satisfactory account on the ethics of killing nonhuman organisms. Two views are challenged in particular, the view that relatively simple animals such as molluscs, as well as plants, lack awareness, and the view that animals without a preference to continue living stand to lose little or nothing by being killed. I provide some evidence to support the claim that many share my view that it is more problematic to kill animals than to kill plants, before analyzing why some suppress the negative feelings they associate with killing animals. By exploring these issues I hope to shed some light on the issue of whether the feelings of those who adopt vegetarianism are sentimental or make sense, and to stimulate reflection amongst those with an interest in food ethics. This essay in honour of Carlos Steel examines a fundamental thesis behind the medieval metaphysics of the good, namely the «goodness of being» thesis, according to which everything that is is good. The basic text used is a Quodlibet disputed by the Parisian master Gerard of Bologna at the beginning of the fourteenth century, in which he discusses various determinations of the nature of the good. This discussion reveals the difficulties to which the metaphysics of the good can lead: is (...) it really the case that every being is good? (shrink)

The focus of this article is on an ambivalent conception in medieval thought, namely the term ‘transcendens’, which on the one hand signifies a reality beyond created beings, i.e. God, and on the other hand signifies something common to all beings. Armandus de Bellovisu, in his Declaratio difficilium terminorum, has thematized exactly this difference between transcendence that follows from ‘nobility of being’ and that which follows from ‘commonness of predication’. The medieval term ‘transcendens’, because of its ambiguity, thus includes two (...) fundamental concepts, which represent divergent philosophical tendencies concerning the specification of First Philosophy: the one understands it as «Philosophy of Transcendence», the other as «Transcendental Philosophy». The history of metaphysics is characterized by the tension between these two tendencies, but as we shall see, it also shows that they are intimately connected. (shrink)
