The paper is written in response to those who fail to recognize the relation between a patient's mental competency and her state of pain. Some clinicians claim that a proper diagnosis can only be made in the absent of analgesia. Rather, the patient's state of pain directly affects her mental competency and thus her ability to give valid consent. Clinicians should rethink their approach to diagnosis when the patient is in pain.

Soren Kierkegaard and William Faulkner are, to my mind, the most seminal religious thinker and the most brilliant novelist of our time. For a good many years I admired their works from a distance. Then in 1966 or so, my good friend and teacher William H. Poteat of Duke University suggested that I get to know them better by doing an essay on them. Intellectual contribution in the form of authorship is a fundamental component of the academic career. While research has addressed questionable and harmful authorship practices, there has largely been no discussion of how U.S. academic institutions interpret and potentially mitigate such practices through the use of institution-level authorship policies. To gain a better understanding of the role of U.S. academic institutions in authorship practices, we conducted a systematic review of publicly available authorship policies for U.S. doctoral institutions, focusing on components such (...) as specification of authorship criteria, recommendations for discussing authorship, dispute resolution processes, and guidance for faculty-student collaborations. We found that only 24% of the 266 Carnegie R1 and R2 Universities had publicly available authorship policies. Within these policies, the majority specified criteria for authorship, but provided less guidance about actual processes for applying such criteria, handling authorship disputes, and managing faculty-student author teams. Further, we found that any discussion of dispute resolution practices typically lacked specificity. Recommendations grounded in these findings are offered for institutions to leverage their ability to guide the authorship process by adopting an authorship policy that acknowledges disciplinary diversity while still offering substantive guidance. With the rejection of group selectionist derivations of ecological phenomena so incisively given by George Williams in 1966,43 Nicholson's long-ignored messages met with acceptance. Species benefit became, explicitly, incidental. But the reorientation was not just about a point of ecological theory. It was more fundamentally about theoretical style, the element shared by Wynne-Edwards' work and the newer, evolutionary ecology. That current approach is well expressed in an already classic paper by the British plant ecologist John Harper: Ultimately all the (...) discoveries of descriptive, production or population ecology must find their meaning in evolutionary phenomena... Evolutionary thinking concentrates attention on the behaviour of the individual and his descendants. If nothing in biology has meaning except in the light of evolution and if evolution is about individuals and their descendants — i.e. fitness — we should not expect to reach any depth of understanding from studies that are based at the level of the superindividual... What we see as the organised behaviour of systems is the result of the fate of individuals.44The emphasis in this passage is on style of thinking more than on study matter. What is so different from earlier ecologists is the rejection of the superorganism and its associated baggage of selfimposed constraints in an end-oriented process, such as balance of nature or species-level adaptation.The hallmark of post-1959 evolutionary ecology is the recognition, the making explicit of the question that the selective, genetical process of fitness (fates of genes) has to be separated from the observations of different levels of adaptiveness. An easy conflation of cause and result is no longer satisfying; now attempts to disentangle the complex strands tying population phenomena to the different levels of selection are providing the excitement of a new research program. In this program evolutionary theory is used to define the appropriate questions, as exemplified by the organization of the textbook Evolutionary Ecology.45 Our discussion of the invention of a new approach, with a characteristic style and set of interests, must also be about how the practitioners of ecology have perceived themselves. The early attempts of Poulton and Nicholson were not taken up by the vigorously growing science of ecology, which developed first - and intentionally — along a narrower, hierarchically restrained set of questions about population. The depth of Poulton's and Nicholson's submergence is indicated by the fact that even Wynne-Edwards did not argue in the manner of one rescuing a minor tradition. Rather, he thought he had a new approach, that of placing evolution in the foundations of ecology. Although this approach was not exactly original, we should be cautious in grouping all evolutionary concerns within ecology in one intellectual tradition. The particular style of selectionist deduction invigorated by Wynne-Edwards was successful only in the volatile situation of a rapidly growing discipline, full of self-critical examination and new rigor. Many individuals domestically and internationally who strive for peace and justice are concerned about the new National Security Strategy issued by the George W. Bush Administration in September 2002. 1 William Galston, for example, writes in a recent issue of Philosophy and Public Policy Quarterly: A global strategy based on the new Bush doctrine of preemption means the end of the system of international institutions, laws and norms that we have worked to build for more than a half a (...) century. To his credit, Kissinger recognizes this; he labels Bush’s new approach “revolutionary” and declares, “Regime change as a goal for military intervention challenges the international system.” 2 Does the new Bush doctrine end the international legal system? Is the new Bush doctrine making policy declarations that are unprecedented in United States history? While I share many of the concerns critics are expressing about the new national security strategy, I contend that the more serious issue is not the ways in which this strategy represents a departure from those of prior United States presidential administrations but the actual practices of the Bush administration that appeal to this strategy. I will indicate how this new national security strategy does not represent much of a shift in policy, capability, or practice. Instead, this strategy Bush is using the strategy as an enabling device for a disturbing resurgence of United States global imperialism that serves interests that are actually opposed to the political rhetoric of the value of nations aiming for democracy and a market economy. I conclude by commenting on pursuing genuinely democratic values. I suggest that if the United States were truly committed to democratic values, then any military interventions would require the prior consent of the people. Otherwise what the United States refer to as “bringing democracy” to a people will be more like a militarily enforced authoritarianism that too closely resembles old-style exploitive imperialism. The economically deprived come into contact with the criminal court system in disproportionate number. This collection of original, interactive essays, written from a variety of ideological perspectives, explores some of the more troubling questions and ethical dilemmas inherent in this situation. The contributors, including well-known legal and political philosophers Philip Pettit, George Fletcher, and Jeremy Waldron, examine issues such as heightened vulnerability, indigent representation, and rotten social background defenses.

The persistent interpretation problem for quantum mechanics may indicate an unwillingness to consider unpalatable assumptions that could open the way toward progress. With this in mind, I focus on the work of David Bohm, whose earlier work has been more influential than that of his later. As I’ll discuss, I believe two assumptions play a strong role in explaining the disparity: 1) that theories in physics must be grounded in mathematical structure and 2) that consciousness must supervene on material processes. (...) I’ll argue that the first assumption appears to lead us toward Everett’s many worlds interpretation, which suggests a red flag. I’ll also argue that the second assumption is suspect due to the persistent explanatory gap for consciousness. Later, I explore ways that Bohm’s later work holds some promise in providing a better fit with our world, both phenomenologically and empirically. Also, I’ll address the possible problem of realism. His work in philosophy resulted in his being acclaimed, along with Charles S. Peirce and William James, as one of the three great founders of American pragmatism, and his achievements in education led to his being regarded as one of the country's most outstanding educational thinkers and a prime mover in educational reform. The University of Chicago was only four years old when Dewey arrived there, but already it had attained a high standing among the universities of the country. Published in 1896, The Sense of Beauty secured Santayana's reputation as a philosopher and continued to outsell all of his books until the publication of his one novel, The Last Puritan. Even today, it is one of the most widely read volumes in all of Santayana's vast philosophical work. It is a large irony that Santayana disowned The Sense of Beauty from the beginning, and wrote it only to keep his job teaching at Harvard. In 1950 he met with the (...) philosopher Arthur Danto in the Roman convent clinic where he passed his final years, and reminisced that "they let me know through the ladies that I had better publish a book." "On what?" "On art, of course. So I wrote this wretched potboiler" In fact, the book was based on a well known course on the theory and history of aesthetics that Santayana gave at Harvard College from 1892 to 1895. Santayana approaches the study of aesthetics through a naturalistic basis in human psychology: "Beauty is pleasure regarded as the quality of a thing." As such, he observes, beauty does not reside in the object but in the individual's sense of beauty. This in no way reduces the importance or the value of art or aesthetic experience. For Santayana, beauty is not relegated to museum art or to some limited arena of aesthetic experience; rather, beauty informs the whole of human existence. Herman J. Dispositional essentialists U. T. Place, George Molnar, and C. B. Martin hold that dispositions are intrinsically directed to their manifestations. Thomists have noted that this directedness is similar to Thomistic directedness to an end. I argue that Place, Molnar, and Martin would benefit from conceiving of dispositional directedness as the sort of directedness associated with Thomistic inclinations. Such Thomistic directedness can help them to account for the production of manifestations; to justify their reliance on dispositional directedness; to show the (...) causal relevance of dispositions; and to motivate their view that dispositions are not reducible to categorical bases. I argue, moreover, that Thomistic inclination to an end does not succumb to the most common objections to finality: it is not mentalistic or vitalistic, and it does not involve backwards causation. Place, Molnar, and Martin, therefore, can embrace the directedness associated with Thomistic inclination—and reap its benefits—without incurring any high metaphysical cost. (shrink)

Ulrich von Wilamowitz-Moellendorff wrote surprisingly often to British colleagues. Usually it was a matter of a letter or two. The prolonged exchange with Gilbert Murray is the exception. More typical is the brief but important one with Sir James George Frazer. Extant evidence attests that he corresponded with some forty Englishmen and Scots. I omit Anglo-Irish: J.B. Bury, J.P. Mahaffy, L.C. Purser and the papyrologist, J.G. Smyly. The evidence is incomplete because most letters after the letter N were stolen (...) and burned in the Berlin winter 1945–6. A first catalogue of his British correspondents is assembled. Because of the remoteness of much published biographical material, I include references to the important published sources and occasionally publish a document which otherwise would be forgotten. This paper investigates the limits of the constructivist approach to the study of self and emotion in anthropology and outlines a viable alternative to this perspective, namely an experiential approach. The roots of the experiential and constructivist approaches to self and emotion in anthropology are traced to the work of William James and George Herbert Mead respectively. The limitations of the constructivist perspective are explored through a discussion of James's radical empirical doctrine, Anthony P. Cohen's work on creative self-consciousness, (...) and Arlie Hochschild's writings on ‘emotional discrepancy'. A discussion of transpersonal aspects of emotional experience, altered states of consciousness and the experience of ‘pure consciousness’ is used to suggest some further limits of this approach. Finally, connections between this work and some of James’ later writings on self and mystical experience are drawn and the implications of this work for the study of self and emotion are explored.
