): This study answers the following question: How does John M. Finnis introduce in his Theory of Law the hartian and razian concept of “an exclusionary reason for action”? The search for an answer entails at least the following items: (a) the generic concept of a “reason for action” and its distinction from other possible motivations for action; (b) the distinctive elements of a legal reason for action, and its difference from other classes of reasons for action; (c) the correlative (...) concepts of authority and obligation, as applied to Law. This analysis will highlight some descriptive and evaluative achievements in Finnis’ proposal, particularly regarding his positivist predecessors, but also some theoretical difficulties, which we presume are linked to Finnis’ aim in trying to conciliate Legal Positivism and Natural Law Theory.Resumen:Este estudio intenta responder a la siguiente pregunta: ¿cómo introduce John M. Finnis en la teoría ius-naturalista del derecho, la idea hartiana y raziana de que el derecho proporciona razones excluyentes para la acción? En la búsqueda de una respuesta se abordarán los siguientes ejes temáticos: (a) el concepto genérico de razón para actuar, y su distinción de otras motivaciones posibles para la acción; (b) los rasgos propios de la razón jurídica para obrar, que la diferencian de otro tipo de razones para la acción; (c) los conceptos correlativos de autoridad y obligación en referencia al derecho. En este análisis se señalarán algunas fortalezas en la propuesta de Finnis con respecto a sus predecesores de la tradición positivista, pero también algunas debilidades descriptivas e inconsistencias teóricas. The claim of this paper is to argue contra Waluchow’s and Raz’s versions of legal positivism – as main representatives of the inclusive and exclusive variants – that legal interpretation always requires an appeal to law’s rea- son or purpose. The main thesis could be expressed as follows: one technique of legal interpretation (the author labels it as systematical), one that demands that the interpreter interprets the law through its general pur- poses in legal practice, is not one technique amongst (...) many, it is necessary in all legal interpretation.The second purpose of the paper is to argue that this systematic approach towards legal interpretation enables an evaluative role on the part of the interpreter that may be called “interpretative creativity”. Due to this, the creative role in legal interpretation is not an exception, but a necessary element in all interpretation. This creative role is not a defect or an inevitable evil in law, but is functional and instrumental to law’s coordinating activity of citizen’s conducts in a reasonable manner.Resumen:Este trabajo se propone mostrar, en contraposición al positivismo jurídico de Wilfrid Waluchow y Joseph Raz —como representantes, respectiva- mente, de la versión incluyente y excluyente del positivismo contemporáneo—, que la interpretación jurídica supone atender siempre, y no de modo excepcional o recortado, a las razones o fines del derecho. La expresión metodológica de esta tesis podría enunciarse diciendo que la interpretación teleológica-sistemática, mediante la cual el intérprete determina el sentido de las normas a la luz de los fines globales de la práctica jurídica, no es un método interpretativo más, sino el modo necesario de toda interpretación jurídica.El segundo propósito de este trabajo es argumentar que la dimensión teleológica sistemática de la interpretación abre un espacio para la valoración por parte del intérprete que podría denominarse, “creatividad interpretativa”. Por esto mismo, la creatividad en la interpretación jurídica no es una excepción, sino una nota general y necesaria de toda interpretación. Much controversy has emerged on the demarcation between legal positivism and non-legal positivism with some authors calling for a ban on the -as they see it- nonsensical labelling of legal philosophical debates. We agree with these critics; simplistic labelling cannot replace the work of sophisticated and sound argumentation. In this paper we do not use the term ‘legal positivism’ as a simplistic label but identify a specific position which we consider to be the most appealing and plausible view on legal (...) positivism. This is the view advocated by Gardner in his paper 'Legal Positivism: 5½ Myths’, where he carefully scrutinises the most convincing and unifying postulates of legal positivism, which he calls “the thin view”. The study shows that this thin view presupposes an empirical conception of action that is untenable and implausible since it makes acts of engagement with the law unintelligible to an observer of such acts. Lafter in the same article, Thomas offers a practical formulation of the same principle, "Good is to be done and pursued and evil avoided"; but in law, since it is contained in propositions (airmations and negations) as distinct from ideas regarding the pursuit of goods, the prior formulation is the more immediately relevant of the two.The book under review is important in that, by going through the legal history regarding abortion and related issues in a number of different countries—the United States, Canada, Italy, Spain, Poland, Ireland (Eire), Costa Rica, Argentina, Chile, Mexico, and Peru—it causes to emerge any number of times the realization that legislation and judicial decisions in favor of abortion "rights" invariably infect a legal system with contradictions and inconsistencies of various sorts. [End Page 1323]William Saunders's very clear and comprehensive first chapter is entitled, "Judicial Interference in the Protection of Human Life in the United States: Actions and Consequences." In it, he describes, among other things, the Human Cloning Prohibition Act passed by the U.S. House of Representatives in 2003, which prohibited "any person or entity, public or private" from performing human cloning (23). He speaks also of a bill proposed in the U.S. Senate once the Human Cloning Prohibition Act had passed in the House of Representatives. This Senate bill (which was entitle, "The Human Cloning Ban and Stem Cell Research Protection Act") would have prohibited "any person or other legal entity" from conducting human cloning, even while allowing nuclear transplantation, which it defines as "transferring the nucleus of a human somatic cell into an oocyte from which the nucleus... ha[s] been... removed or rendered inert." The problem here, as Saunders explains, is that this latter definition "is the very definition of cloning" (25). In other words, in the same year, two pieces of legislation were considered in the Congress of the United States, both purporting to ban human cloning, one of which would have permitted what the other described (correctly) as human cloning and so prohibited.In the second chapter, "Whither United States Abortion Law?" by Gerard V. Bradley, discussed, among other things, is the inconsistency between the United States Supreme Court's pro-abortion decision Roe v. For many, it was anxiety and uncertainty that “knock[ed] at the door”; for others, however, those same feelings of unease prompted one of hopefulness: reflecting on the possibilities for resilience and regeneration in the process of changing our vision of the world.1 The Knock at the Door conference brought contemporary utopianism to the forefront of thinking about how to respond to global crises while remaining attentive to other adversities of daily life. Scholars and artists answered the knock in an attempt to examine paths toward utopia, and to take advantage of the regenerative and resilient potential of the present.The conference was the culmination of author/activist Larissa Lai’s fellowship period at the University of Huelva. The 2022–23 María Zambrano Fellowship for the academic year2 allowed Lai to complete the project “Utopian Dreams for Post-Covid Times,” carried out in collaboration with the Huelva research group led by Professor Pilar Cuder-Domínguez, who hosted a number of online and in-person seminars on speculative fiction with Lai. El «mundo entero» vive un gran desasosiego al estar inmiscuido en la dominación de la Naturaleza sustentada en la gran inversión económica, desde el paradigma antropocéntrico neoliberal. El objetivo del presente trabajo es reconocer y abrazar epistemologías y metodologías alternativas, entre ellas validar las contribuciones de los pueblos indígenas (PI) como protagonistas de la sustentabilidad y soberanía alimentaria. La investigación es de corte documental y la reflexión personal de más de 20 años de labor junto a los PI en Mesoamérica (...) y los Andes. Valorar dichas contribuciones, es centrarse en sus acervos y corpus cognoscitivos, antes que sea tarde. Son los sabios guardianes de la sustentabilidad biocultural de la Naturaleza y la Vida. Se concluye principalmente que son quienes conocen las claves, llaves y secretos que dan respuesta al reto de estelarizar la sustentabilidad y seguridad alimentaria global, que tanto persigue la humanidad. La sociedad en general y en particular las instancias oficiales, formativas, políticas, corporativas, industriales, de extensión y académicas, deben distinguir a estos actores sociales que soportan hoy la seguridad alimentaria mundial. Desde la mirada de los estudios de la cultura y la hegemonía del poder esta investigación explora desde la perspectiva de sus habitantes, el sentir popular y la apropiación de la celebración religiosa de San Pedro y San Pablo en la parroquia Picoazá (Portoviejo – Ecuador). Para el fin se acude a la metodología cualitativa, utilizando la entrevista como herramienta de corte etnográfico. Los resultados plantean un colectivo apegado a la religión con connotaciones significativas en la organización social y cultural (...) del entorno, dando paso a la reproducción de tradiciones heredadas de generación en generación. Es el caso del archivo personal de Jorge Medina, en el que se encuentran catalogados diversos documentos, los que contienen material relativo, (...) tanto al complejo trayecto de la actuación de la reforma litúrgica como a la primera recepción y aplicación de la constitución Sacrosanctum concilium en Chile. A la luz de esta documentación inédita, este trabajo, que tiene como telón de fondo la publicación del motu proprio Sacram Liturgiam, estudia las propuestas que, en materia litúrgica, el episcopado chileno elevó a la santa sede para poner en marcha la reforma en el país. Nadie mejor que la propia autora para presentarnos el significado de esta obra: “«Claros del bosque» dentro de mi pensamiento vertido en lo impreso, salvo alguna excepción, aparece como algo inédito salido de ese escribir irreprimible que brota por sí mismo y que ha ido a parar a cuadernos y hojas que (...) nadie conoce, ni yo misma, reacia que soy a releerme. Tenía que suceder por fuerza. Mas creo que el carácter de ofrenda de «Claros del bosque» a la persona a quien va dedicado en su tránsito tiene que ver en ello, acentuando así el carácter de ofrenda que todo lo que he publicado tiene desde siempre. Nada es de extrañar que la razón discursiva apenas aparezca. Con anterioridad esbocé una ‘Crítica de la razón discursiva’ que no podría prometerme que salga de ese estado. Creo, pues, que como libro es el que más responde a esa ‘idea’ hace tiempo formulada de que ‘pensar es ante todo –como raíz, como acto–– descifrar lo que se siente’, entendiendo por sentir el ‘sentir originario’, expresión usada por mí desde hace años. Y también que ‘el hombre es el ser que padece su propia trascendencia’ en un incesante proceso de unificación entre pasividad y conocimiento, entre ser y vida. The present global financial crisis has revived the notion that competitive markets may lead some directors and executives to behave in opportunistic ways considered unethical and even illegal, through the pursuit of self-interest. This article proposes and tests an integrated model that offers new insights into the relationship between board structure, independence and firm value. By incorporating the proportion of independent directors on the board as a moderating factor in this relationship, this study contributes to a better understanding of the (...) entrenchment and convergence-of-interests hypotheses. Using empirical data obtained from 114 Spanish listed companies in a context of economic crisis, from 2007 to 2010, we conclude that having a board with a greater proportion of independent directors reduces the negative association existing between firm value and a large board size and significant board share ownership. Este artículo propone reconsiderar, en el marco de la filosofía política, el enfoque tradicional del problema del deber moral de obedecer al Estado. Se postula la relevancia de atender las objeciones del anarquismo filosófico en contra de tal deber, partiendo de algunas críticas esbozadas por R.P. Wolff y J. A. Simmons; dos de los representantes más significativos de esta rama de la filosofía en tiempos contemporáneos. Siguiendo esta línea argumental, se afirma la inexistencia del deber moral de obedecer al Estado, (...) abogando así por una posición crítica respecto de la autoridad, sin llegar a la conclusión del anarquismo político, según la cual existe la obligación de abolir o combatir la autoridad política. Así, se propone que la pregunta por la legitimidad del Estado solo puede abordarse casuísticamente, desde un análisis de ética aplicada sobre las diferentes imposiciones de la autoridad. (shrink)

A number of bioethicists have been critical of the power of the family to “veto” a patient’s decision to posthumously donate her organs within opt-in systems of organ procurement. One major objection directed at the family veto is that when families veto the decision of their deceased family member, they do something wrong by violating or failing to respect the autonomy of that deceased family member. The goal of this paper is to make progress on answering this objection. I do (...) this in two stages. First, I argue that the most plausible interpretation of what happens when a person registers as an organ donor in an opt-in system is that she gives her consent to the state to posthumously remove her organs for transplantation purposes. Call this the Authorization Account. Second, given the Authorization Account, I argue by analogy that when families veto an individual’s decision to donate and the individual’s organs are not in the end removed, neither the doctors nor the family violate the individual’s autonomy in any morally objectionable sense. Call this the Nonremoval Thesis. I argue that since the Nonremoval Thesis is true, we do not violate or fail to respect the autonomy of registered donors when we fail to remove their organs because their family has objected. ABSTRACT My aim in this paper is to present a pluralist thesis about the inferential role of logical constants, which embraces classical, relevant, linear and ordered logic. That is, I defend that a logical constant c has more than one correct inferential role. The thesis depends on a particular interpretation of substructural logics' vocabulary, according to which classical logic captures the literal meaning of logical constants and substructural logics encode a pragmatically enriched sense of those connectives. The paper is divided (...) into four parts: first, I introduce the motivation for the pluralist thesis of the paper; second I introduce the calculus for the different logics endorsed in the pluralist thesis; third, I motivate how the different behaviors of the logical vocabulary of these logics can be pragmatically interpreted, and fourth, I motivate how the different inferential roles that each substructural logic attribute to logical constants can coexist, and how we should reason with a logical constant c given this plurality. “Opt-out” organ procurement policies based on presumed consent are typically advertised as being superior to “opt-in” policies based on explicit consent at securing organs for transplantation. However, Michael Gill has argued that presumed consent policies are also better than opt-in policies at respecting patient autonomy. According to Gill’s Fewer Mistakes Argument, we ought to implement the procurement policy that results in the fewest frustrated wishes regarding organ donation. Given that the majority of Americans wish to donate their organs, it is (...) plausible that a presumed consent policy would result in fewer frustrated wishes compared to the current opt-in policy. It follows that we ought to implement a policy of presumed consent. In this paper, I first consider and find wanting an objection to the Fewer Mistakes Argument developed recently by Douglas MacKay. I also consider an objection put forth by James Taylor but argue that there is a methodological reason to prefer my own argument to Taylor’s. Finally, I argue for two theses: first, that Gill’s major argument in favor of the crucial premise of the Fewer Mistakes Argument is flawed, and second, that the major premise of the Fewer Mistakes Argument is false. When addressing the first principles of the science of the being and physics, Aristotle presents a special kind of proof in favor of the principle of non-contradiction and the principle of movement. This paper explores the nature of such proofs and tries to show important parallels between them. Indeed, in both cases Aristotle makes use of dialectical arguments which aim to demonstrate that whoever denies these principles necessarily assumes a series of commitments related to language that involve the very principles (...) in question. It is thus shown to what extent the principles which are discussed are a condition of possibility of the discourse itself. Thus, both series of arguments exhibit transcendental aspects, which, especially regarding disputes with the monist, have been often overlooked, and which illustrate the scope of dialectics when it comes to opening the way towards the first principles. Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

Der vorliegende Aufsatz stellt das Erbe der Kantischen Theorie der Konstitutions- und Regulationsleistung der Erfahrung – die Analytik der Grundsätze – dar, das unserer Auffassung nach zur Begründung der rein spekulativen Philosophie Hegels führt. In diesem Zusammenhang werden einerseits die transzendental-konstitutiven Grundsätze – Axiome der Anschauung und Antizipationen der Wahrnehmung – und andererseits die transzendental-regulativen Grundsätze – Analogien der Erfahrung und Postulate des empirischen Denkens überhaupt – als grundlegendes Material der Exegese benutzt. Als Resultat der Deutung erscheint das Problem des (...) Doppel-Verhältnisses zwischen Erfahrung und Verstandesgrundsätzen. Ein solches Verhältnis entfaltet sich nicht nur als die erfahrungsmäßige Verwirklichung der Grundsätze, sondern auch als die grundsätzliche Ermöglichung der Erfahrung. Der notwendige Charakter der Wahrheit in transzendentaler Hinsicht begründet sich dabei durch die allgemeine Beziehung der transzendentalen Grundsätze des reinen Verstandes zur Gesamtheit der Erfahrung. Es wird die These vertreten, dass die Auffassung der Natur – d.h. die das Dasein der Erscheinungen in der Zeit ermöglichende Einheit – das Hauptvermächtnis Kants für den Deutschen Idealismus im Allgemeinen und für Hegels Philosophie im Besonderen darstellt. Some philosophers and physicians have argued that alcoholic patients, who are responsible for their liver failure by virtue of alcoholism, ought to be given lower priority for a transplant when donated livers are being allocated to patients in need of a liver transplant. The primary argument for this proposal, known as the Responsibility Argument, is based on the more general idea that patients who require scarce medical resources should be given lower priority for those resources when they are responsible for (...) needing them and when they are competing with patients who need the same resources through no fault of their own. Since alcoholic patients are responsible for needing a new liver and are in direct competition with other patients who need a new liver through no fault of their own, it follows that alcoholic patients ought to be given lower priority for a transplant. In this article, I argue against the Responsibility Argument by suggesting that in order for it to avoid the force of plausible counter examples, it must be revised to say that patients who are responsible for needing a scarce medical resource due to engaging in behavior that is not socially valuable ought to be given lower priority. I'll then argue that allocating organs according to social value is inconsistent or in tension with liberal neutrality on the good life. Thus, if one is committed to liberal neutrality, one ought to reject the Responsibility Argument. (shrink)

In this paper, we study a stability transfer theorem in d-tame metric abstract elementary classes, in a similar way as in 2, but using superstability-like assumptions which involves a new independence notion instead of ℵ0-locality.

This article argues that current data for the safety and efficacy of fecal microbiota transplants as a treatment for any indication, including recurrent Clostridioides difficile infection, is low-quality. It develops a governance proposal that encourages production of high-quality evidence by incentivizing well-designed RCTs of stool and stoolderived microbial products. The proposal would require that FDA change its current enforcement approach, but it would not require any change in statutes or regulations.

This essay identifies two legal lineages underlying the common heritage concept, and applies each to the human genome. The essay notes some advantages and disadvantages of each approach, and argues that patenting of human genes would be allowable under either approach.

The article analyzes the presence of the anthropocentric and ecocentric argument in the jurisprudence of the Inter-American Court of Human Rights related to environmental issues. To this effect, at first, it presents the content of these two approaches, explaining their contributions and limitations. With this theoretical framework, identifies four stages in the Court's jurisprudence, which show the gradual transition from anthropocentrism to ecocentrism within its reflections on human rights. Finally, the results of the analysis offer light on the possible development (...) of the right to a healthy environment as an autonomous right in inter-American human rights system. (shrink)

This article describes and analyzes the design and functioning of the Statistical Ethics System (SETE) in Colombia’s National Statistical Office. It presents the methodology and general process of planning and implementation of the System, supported by a conceptual analysis of the requirements for an ethical functioning of official statistics. The general objective of the article is to make a practical contribution to the understanding of conceptual and practical features that ought to be considered in the implementation of an ethical system (...) in the operation of the public sector, particularly in the area of the production of official statistics. The text is divided into five parts. In the first part, we make a general introduction to the ethical value of official statistics. In the second and third parts, we make a presentation and analysis of the principles and risks that were selected as the basic ethical framework for the production of official statistics at the National Administrative Department of Statistics (DANE). The fourth section presents the conceptual and practical bases of how SETE operates. The fifth section we present some concluding remarks. (shrink)
