Ted Sider has famously argued that existence, in the unrestricted sense of ontology, cannot be vague, as long as vagueness is modeled by means of precisifications. The first section of Chapter 9 exposes some controversial assumptions underlying Sider’s alleged reductio of vague existence. The upshot of the discussion is that, although existence cannot be vague, it can be super-vague, i.e. higher-order vague, for all orders. Based on a qualitative study about expert musicianship, this paper distinguishes three ways of interacting by putting them in relation to the sense of agency. Following Pacherie, it highlights that the phenomenology of shared agency undergoes a drastic transformation when musicians establish a sense of we-agency. In particular, the musicians conceive of the performance as one single action towards which they experience an epistemic privileged access. The implications of these results for a theory of collective intentionality are discussed by addressing (...) two general questions: When several individuals share an intention, does this fact secure plural self-knowledge? And is it possible to have non-observational knowledge about a collective action? Classical modalism about essence is the view that essence can be analysed in modal terms. Despite Kit Fine's influential critique, no general refutation of classical modalism has yet been given. In the first part of the paper, I provide such a refutation by showing that the notion of essence cannot be analysed in terms of any sentential operator definable in the language of standard quantified modal logic. As a reaction to Fine's critique, some have defended sophisticated modalism, which attempts to (...) analyse essence in an enriched modal language quantifying over both possible and impossible worlds. In the second part of the paper, I argue that sophisticated modalism falls prey to variations on Fine's counterexamples to classical modalism. I conclude that the most promising approaches to understanding the notion of essence consist in taking essence either as primitive or as analysable via a combination of modal and non-modal notions. An influential theory has it that metaphysical indeterminacy occurs just when reality can be made completely precise in multiple ways. That characterization is formulated by employing the modal apparatus of ersatz possible worlds. As quantum physics taught us, reality cannot be made completely precise. I meet the challenge by providing an alternative theory which preserves the use of ersatz worlds but rejects the precisificational view of metaphysical indeterminacy. The upshot of the proposed theory is that it is metaphysically indeterminate whether (...) p just in case it is neither true nor false that p, and no terms in ‘p’ are semantically defective. In other words, metaphysical indeterminacy arises when the world cannot be adequately described by a complete set of sentences defined in a semantically nondefective language. Moreover, the present theory provides a reductive analysis of metaphysical indeterminacy, unlike its influential predecessor. Finally, I argue that any adequate logic of a language with an indeterminate subject matter is neither compositional nor bivalent. (shrink)
The threat of ontological deflationism (the view that disagreement about what there is can be non‐substantive) is averted by appealing to realism about fundamental structure—or so tells us Ted Sider. In this paper, the notion of structural indeterminacy is introduced as a particular case of metaphysical indeterminacy; then it is argued that structural indeterminacy is not only compatible with a metaphysics of fundamental structure, but it can even safeguard it from a crucial objection; finally, it is shown that, if there (...) are instances of structural indeterminacy, a hitherto unacknowledged variety of ontological deflationism will arise. Unless structure is shown to be determinate, ontological deflationism remains a live option. Furthermore, I will consider whether structural indeterminacy could be challenged by adopting a naturalistic epistemology of structure; the question is answered in the negative on the basis of a formal result concerning theory choice. Finally, I submit a new way of articulating the epistemology of structure, which hinges on the very possibility of structural indeterminacy. (shrink)
Empirical evidence suggests that while people hold the capacity to control their data in high regard, they increasingly experience a loss of control over their data in the online world. The capacity to exert control over the generation and flow of personal information is a fundamental premise to important values such as autonomy, privacy, and trust. In healthcare and clinical research this capacity is generally achieved indirectly, by agreeing to specific conditions of informational exposure. Such conditions can be openly stated (...) in informed consent documents or be implicit in the norms of confidentiality that govern the relationships of patients and healthcare professionals. However, with medicine becoming a data-intense enterprise, informed consent and medical confidentiality, as mechanisms of control, are put under pressure. In this paper we explore emerging models of informational control in data-intense healthcare and clinical research, which can compensate for the limitations of currently available instruments. More specifically, we discuss three approaches that hold promise in increasing individual control: the emergence of data portability rights as means to control data access, new mechanisms of informed consent as tools to control data use, and finally, new participatory governance schemes that allow individuals to control their data through direct involvement in data governance. We conclude by suggesting that, despite the impression that biomedical big data diminish individual control, the synergistic effect of new data management models can in fact improve it. (shrink)
Alessandro Ferrara explains what he terms 'the democratic horizon' - the idea that democracy is no longer simply one form of government among others, but is instead almost universally regarded as the only legitimate form of government, the horizon to which most of us look. Professor Ferrara reviews the challenges under which democracies must operate, focusing on hyperpluralism, and impresses a new twist onto the framework of political liberalism. He shows that distinguishing real democracies from imitations can be difficult, (...) responding to this predicament by enriching readers' understanding of the spirit of democracy; clearing readers' views of pluralism from residues of ethnocentrism; and conceiving multiple versions of democratic culture, rooted in the diversity of civilizational contexts. Within emotion theory, envy is generally portrayed as an antisocial emotion because the relation between the envier and the rival is thought to be purely antagonistic. This paper resists this view by arguing that envy presupposes a sense of us. First, we claim that hostile envy is triggered by the envier's sense of impotence combined with her perception that an equality principle has been violated. Second, we introduce the notion of â hetero-induced self-conscious emotionsâ by focusing on the paradigmatic cases (...) of being ashamed or proud of somebody else. We describe envy as a hetero-induced self-conscious emotion by arguing that the impotence felt by the subject grounds the emotion's self-reflexivity and that the rival impacts the subject's self-assessment because the rival is framed by the subject as an in-group member. Finally, we elaborate on the asset at stake in envy. We contend that this is esteem recognition: The envier covets the esteem that her reference group accords to the rival. Because, in envy, the subject conceives of herself as member of a group to which the other is also understood to belong, we conclude that envy is a social emotion insofar as it presupposes a sense of us. On one influential view, metaphysical fundamentality can be understood in terms of joint‐carving. Ted Sider has recently argued that (i) some first order quantifier is joint‐carving, and (ii) modal notions are not joint‐carving. After vindicating the theoretical indispensability of quantification against recent criticism, I will defend a logical result due to Arnold Koslow which implies that (i) and (ii) are incompatible. I will therefore consider an alternative understanding of Sider's metaphysics to the effect that (i) some first order quantifier is (...) joint‐carving, and (iii) intensional notions are not joint‐carving. Another result due to Koslow entails that (i) and (iii) are also incompatible. I will argue that this second result is inconclusive. Nevertheless, (iii) is incompatible with another tenet of Sider's metaphysics, namely that (iv) ‘being joint‐carving’ is itself joint‐carving. In order to resolve the inconsistency, I will tentatively argue that condition (iv) should be renounced. (shrink)
A number of companies allocate ownership rights to stakeholders different from shareholders, despite the fact that the law attributes these rights to the equity holders. This article contributes to an understanding of this evidence by developing a contingency model for the allocation of ownership rights. The model sheds light on why companies, despite pressures from the law, vary in their allocation of ownership rights. The model is based on the assumption that corporations increase their chance to survive and prosper if (...) the stakeholders supplying “critical contributions” receive the ownership rights. According to the model, “critical” contributions involve (1) contractual problems due to specific investments, long-term relationships, and low measurability; (2) the assumption of the uncertainty resting on the company; and (3) the supply of scarce and valuable resources. The model is dynamic because it also provides a basis for understanding why the allocation of ownership rights changes with time. Finally, the article presents the strategies companies can use to realize an efficient distribution of ownership rights among their stakeholders. (shrink)
Keenan (1987) observed that trivial determiners built from basic existential determiners (e.g.,either zero or else more than zero) are allowed inthere-insertion contexts, and that trivial determiners built from basic non-existential determiners (e.g.,either all or else not all) are not. This result is unexpected under the analyses ofthere-sentences proposed in Barwise and Cooper (1981), Higginbotham (1987), and Keenan (1987). I argue that the class of NPs barred from the postverbal position ofthere-sentences (strong NPs) is correctly characterized in presuppositional terms, as suggested (...) in de Jong and Verkuyl (1985) and Lumsden (1988). According to this characterization, strong NPs share one of the defining components of definiteness proposed in Heim (1982), namely the Descriptive Content Condition (DCC). How to derive the prohibition against strong NPs inthere-insertion contexts (definiteness effect) from the fact that strong NPs meet the DCC is not obvious, however. I argue that accounting for this prohibition involves regarding the XP-coda in [there be NP XP] as providing the contextual domain for the interpretation of the postverbal NP. (shrink)
According to a widespread view in metaphysics and philosophy of science, all explanations involve relations of ontic dependence between the items appearing in the explanandum and the items appearing in the explanans. I argue that a family of mathematical cases, which I call “viewing-as explanations”, are incompatible with the Dependence Thesis. These cases, I claim, feature genuine explanations that aren’t supported by ontic dependence relations. Hence the thesis isn’t true in general. The first part of the paper defends this claim (...) and discusses its significance. The second part of the paper considers whether viewing-as explanations occur in the empirical sciences, focusing on the case of so-called fictional models. It’s sometimes suggested that fictional models can be explanatory even though they fail to represent actual worldly dependence relations. Whether or not such models explain, I suggest, depends on whether we think scientific explanations necessarily give information relevant to intervention and control. Finally, I argue that counterfactual approaches to explanation also have trouble accommodating viewing-as cases. (shrink)

As people look for a way to ground their judgments of moral, political, aesthetic claims in the face of the postmodernists who claim nothing can be grounded, Reflective Authenticity attempts to rescue some of the critical ideals of the Enlightenment without falling prey to those who say that the Enlightenment's tenets of objectivity, reason, liberalism makes this impossible and in the face of multiculturalism, difference, and the death of subject, are outdated. Alessandro Ferrara suggests that the notion of reflective (...) authenticity offers the key to a new kind of exemplary universalism which, different from the generalizing universalism typical of modern thought, does not fall under the critique of foundationalism articulated by postmodernist thinkers. It has been argued that a combination of game-theoretic semantics and independence-friendly (IF) languages can provide a novel approach to the conceptual foundations of mathematics and the sciences. I introduce and motivate an IF first-order modal language endowed with a game-theoretic semantics of perfect information. The resulting interpretive independence-friendly logic (IIF) allows to formulate some basic model-theoretic notions that are inexpressible in the ordinary quantified modal logic. Moreover, I argue that some key concepts of Kripke’s new theory of reference are (...) adequately modeled within IIF. Finally, I compare the logic IIF to David Lewis' counterpart theory, drawing some morals concerning the interrelation between metaphysical and semantic issues in possible-world semantics. (shrink)
The problem of truth in fiction concerns how to tell whether a given proposition is true in a given fiction. Thus far, the nearly universal consensus has been that some propositions are ‘implicitly true’ in some fictions: such propositions are not expressed by any explicit statements in the relevant work, but are nevertheless held to be true in those works on the basis of some other set of criteria. I call this family of views ‘implicitism’. I argue that implicitism faces (...) serious problems, whereas the opposite view is much more plausible than has previously been thought. After mounting a limited defence of explicitism, I explore a difficult problem for the view and discuss some possible responses. (shrink)
This article examines recent theories of democratic citizenship as well as the institutional separation of religion and politics in light of shortcomings with the traditional secularization thesis. Due to the fact that juridical norms and forms of consciousness develop at a more rapid pace than religious ones, received accounts of both democratic equality and toleration need to be reconceptualized. Questions concerning the legitimacy and neutrality of religious reasoning in democratic politics, as pursued in the work of Rawls and Habermas, also (...) need to be informed by further reflection on the confessional context and other empirical features of post-secular societies. Comparing the politics of same-sex marriage in Canada and Italy helps to illustrate this point. (shrink)
Lewis proposed to test the validity of a modal thesis by checking whether its possible-world translation is a theorem of counterpart theory. However, that criterion fails to validate many standard modal laws, thus raising doubts about the logical adequacy of the Lewisian framework. The present paper considers systems of counterpart theory of increasing strength and shows how each can be motivated by exhibiting a suitable intended model. In particular, perfect counterpart theory validates all the desired modal laws and therefore provides (...) a way out of the logical objection. Languages involving modalities and languages involving vagueness have each been thoroughly studied. On the other hand, virtually nothing has been said about the interaction of modality and vagueness. This paper aims to start filling that gap. Section 1 is a discussion of various possible sources of vague modality. Section 2 puts forward a model theory for a quantified language with operators for modality and vagueness. The model theory is followed by a discussion of the resulting logic. Philosophers of science since Nagel have been interested in the links between intertheoretic reduction and explanation, understanding and other forms of epistemic progress. Although intertheoretic reduction is widely agreed to occur in pure mathematics as well as empirical science, the relationship between reduction and explanation in the mathematical setting has rarely been investigated in a similarly serious way. This paper examines an important particular case: the reduction of arithmetic to set theory. I claim that the reduction is unexplanatory. In defense (...) of this claim, I offer evidence from mathematical practice, and I respond to contrary suggestions due to Steinhart, Maddy, Kitcher and Quine. I then show how, even if set-theoretic reductions are generally not explanatory, set theory can nevertheless serve as a legitimate foundation for mathematics. Finally, some implications of my thesis for philosophy of mathematics and philosophy of science are discussed. In particular, I suggest that some reductions in mathematics are probably explanatory, and I propose that differing standards of theory acceptance might account for the apparent lack of unexplanatory reductions in the empirical sciences. The aim of this chapter is to mine, reconstruct, and evaluate the phenomenological notion of practical intentionality. It is claimed that the phenomenologists of the Munich and Göttingen Circles substantially modify the idea of practical intentionality originally developed by Franz Brentano. This development, it is further contended, anticipates the switch that occurred within contemporary theory of action from a belief-desire to a belief-desire-intention model of deliberation. While Brentanoâ s position can be interpreted as a variant of the BD model, early (...) phenomenologists propose a general theory of deliberation that, in line with the BDI account, puts the notion of intention at the very core of practical intentionality. On their understanding, the concept of intention points to a primitive kind of mental state that cannot be reduced to a combination of beliefs and desires. (shrink)
Whereas exemplarity has long been thought to belong to the domain of aesthetics, this book explores the other uses to which it can be put in our philosophical predicament, especially in the field of politics.
In a recent paper Berto introduces a semantic system for a logic of imagination, intended as positive conceivability, and aboutness of imaginative acts. This system crucially adopts elements of both the semantics of conditionals and the semantics of analytical implications in order to account for the central logical traits of the notion of truth in an act of imagination based on an explicit input. The main problem left unsolved is to put forward a complete set of axioms for the proposed (...) system. In the present paper I offer a solution to this problem by providing a complete axiomatization of a generalization of the original semantics. The difficulty in proving completeness lies in the fact that the modalities that capture the notion of truth in an act of imagination are neither standard nor minimal, so that the construction of the canonical model and the proof of the truth lemma are to be substantially modified. I introduce and defend the semantic notion of counterfactual identity, distinguishing it from the metaphysical notion of transworld identity. After showing that Lewis's counterpart theory misconstrues counterfactual identity facts, I outline and motivate a ‘Leibnizian counterpart theory’ where the notion of counterfactual identity is adequately modelled. Finally, I show that counterfactual identity can be characterized without relying on some implausible features of Lewis's theory of conditionals.
Within the author’s long-term project of updating John Rawls’s paradigm of “political liberalism” to a historical context different from the original one, this paper focuses on how political liberalism can help us understand populism and help liberal democracy survive the populist upsurge. In the first section, political liberalism is argued to be of help in directing our attention to three constitutive aspects of all sorts of populism: the conflation of “the people” with the electorate and the electorate with the nation, (...) the attribution of constituent power to the electorate, and a penchant for so-called “justified intolerance.” In the second section, enfeebled democracies and postliberal democracies are discussed as two distinctly dangerous outcomes of populist contagion. An important international discussion began because of some pioneer studies carried out by Young (1996a) on the internet addiction disorder (IAD). In the fifth and most recent version of the Diagnostic, and Statistical Manual of Mental Disorders (DSM) there is no mention of this disorder and among researchers there are basically two opposite positions. Those who are in favor of a specific diagnosis and those who are claiming the importance of specific criteria characterizing this behavior and the precise role it (...) has in the patient’s life. The aim of the present paper is to answer the question whether it is possible or not to formulate diagnoses of internet-related disorders. We revised literature on the history of diagnostic criteria, on neurocognitive evidence, on the topic debate and on IAD instrumental measures. We found that the disorder was not univocally defined and that the construct was somehow too broad and generic to be explicative for a diagnosis. Indeed, the models are borrowed from other addiction pathologies and they are often formulated before the development of internet as intended in current society. In conclusion, we think we need a more innovative, integrated and comprehensive model for an IAD diagnosis. (shrink)
Precision medicine promises to develop diagnoses and treatments that take individual variability into account. According to most specialists, turning this promise into reality will require adapting the established framework of clinical research ethics, and paying more attention to participants’ attitudes towards sharing genotypic, phenotypic, lifestyle data and health records, and ultimately to their desire to be engaged as active partners in medical research.Notions such as participation, engagement and partnership have been introduced in bioethics debates concerning genetics and large-scale biobanking to (...) broaden the focus of discussion beyond individual choice and individuals’ moral interests. The uptake of those concepts in precision medicine is to be welcomed. However, as data and medical information from research participants in precision medicine cohorts will be collected on an individual basis, translating a participatory approach in this emerging area may prove cumbersome. Therefore, drawing on Joseph Raz’s perfectionism, we propose a principle of respect for autonomous agents that, we reckon, can address many of the concerns driving recent scholarship on partnership and public participation, while avoiding some of the limitations these concept have in the context of precision medicine. Our approach offers a normative clarification to how becoming partners in precision is compatible with retaining autonomy.Realigning the value of autonomy with ideals of direct engagement, we show, can provide adequate normative orientation to precision medicine; it can do justice to the idea of moral pluralism by stressing the value of moral self-determination: and, finally, it can reconcile the notion of autonomy with other more communitarian values such as participation and solidarity. Much recent work on mathematical explanation has presupposed that the phenomenon involves explanatory proofs in an essential way. I argue that this view, ‘proof chauvinism’, is false. I then look in some detail at the explanation of the solvability of polynomial equations provided by Galois theory, which has often been thought to revolve around an explanatory proof. The paper concludes with some general worries about the effects of chauvinism on the theory of mathematical explanation.
Until recently, an almost perfect parallelism seemed to hold between theories of identity through time and across possible worlds,as every account in the temporal case(endurantism,perdurantism, exdurantism) was mirrored by a twin account in the modal case (trans-world identity, identity-via-parts, identity-via-counterparts). Nevertheless, in the recent literature, this parallelism has been broken because of the implementation in the debate of the relation of location. In particular, endurantism has been subject to a more in-depth analysis, and different versions of it, corresponding to different (...) ways an entity can be located in time, emerged. In this article, we provide a precise map of the conceptions at stake, complete the debate by introducing a version of endurantism not yet considered in the debate — we call transcendentism — and show that it allows us to provide an effective interpretation of the relation of trans-world identity and an intuitive solution in the temporal case. Elaborating on the notions that humans possess different modalities of decision-making and that these are often influenced by moral considerations, we conducted an experimental investigation of the Trolley Problem. We presented the participants with two standard scenarios (‹lever’ and ‹stranger’) either in the usual or in reversed order. We observe that responses to the lever scenario, which result from (moral) reasoning, are affected by our manipulation; whereas responses to the stranger scenario, triggered by moral emotions, are unaffected. Furthermore, when asked (...) to express general moral opinions on the themes of the Trolley Problem, about half of the participants reveal some inconsistency with the responses they had previously given. In this study, we analyse the notion of “differential heterogenesis” proposed by Deleuze and Guattari on a morphogenetic perspective. We propose a mathematical framework to envisage the emergence of singular forms from the assemblages of heterogeneous operators. In opposition to the kind of differential calculus that is usually adopted in mathematical-physical modelling, which tends to assume a homogeneous differential equation applied to an entire homogeneous region, heterogenesis allows differential constraints of qualitatively different kinds in different points of space and time. (...) These constraints can then change in time, opening the possibility for new kinds of differential dynamics and the emergence of distinct entities and forms. Formally, we show that operators with different phase spaces can be assembled on the basis of a result of Rothschild & Stein. Furthermore, operators with different dynamics can be assembled by means of a partition of the unit. After stating the concept of differential heterogenesis in terms of contemporary mathematics, we show that this construction sheds light on the constitution of the semiotic function. In fact, both the Merleau-Pontian and the Deleuzian approaches share a common conceptualisation of the semiotic function and its emergence in terms of a morphodynamics of heterogeneous assemblages with a divergent actualisation. This divergent actualisation allows the co-constitution of various expression and content planes. Finally, we show that the divergent actualisation can be interpreted as the directions of principal eigenvectors of the actualized flow. (shrink)
In the last few decades the role played by models and modeling activities has become a central topic in the scientific enterprise. In particular, it has been highlighted both that the development of models constitutes a crucial step for understanding the world and that the developed models operate as mediators between theories and the world. Such perspective is exploited here to cope with the issue as to whether error-based and uncertainty-based modeling of measurement are incompatible, and thus alternative with one (...) another, as sometimes claimed nowadays. The crucial problem is whether assuming this standpoint implies definitely renouncing to maintain a role for truth and the related concepts, particularly accuracy, in measurement. It is argued here that the well known objections against true values in measurement, which would lead to refuse the concept of accuracy as non-operational, or to maintain it as only qualitative, derive from a not clear distinction between three distinct processes: the metrological characterization of measuring systems, their calibration, and finally measurement. Under the hypotheses that (1) the concept of true value is related to the model of a measurement process, (2) the concept of uncertainty is related to the connection between such model and the world, and (3) accuracy is a property of measuring systems (and not of measurement results) and uncertainty is a property of measurement results (and not of measuring systems), not only the compatibility but actually the conjoint need of error-based and uncertainty-based modeling emerges. The goal of this paper is methodological. It offers a comprehensive mapping of the theoretical positions on the ethical criticism of art, correcting omissions and inadequacies in the conceptual framework adopted in the current debate. Three principles are recommended as general guidelines: ethical amenability, basic value pluralism, and relativity to ethical dimension. Hence a taxonomy distinguishing between different versions of autonomism, moralism, and immoralism is established, by reference to criteria that are different from what emerging in the current literature. The (...) mapping is then proved capable of (1) locating the various theories that have been proposed so far and clarifying such theories’ real commitments, (2) having the correct relationship with actual art making and art criticism practices, and (3) showing the real weight of the alleged counter-example to a moralist position of a work that succeeds artistically because of its immorality. John Searle’s account of collective intentions in action appears to have all the theoretical pros of the non-reductivist view on collective intentionality without the metaphysical cons of committing to the existence of group minds. According to Searle, when we collectively intend to do something together, we intend to cooperate in order to reach a collective goal. Intentions in the first-person plural form therefore have a particular psychological form or mode, for the we-intender conceives of his or her intended actions as (...) singular contributions by means of which – or: by way of which – a collective goal is pursued. Accordingly, we-intentions are held to have a psychological mode with a “collective goal by means of singular contribution” structure, which makes them primitive and irreducible to intentions in the I-form. It is further contended that, albeit primitive and irreducible, we-intentions are not the mental states of an alleged group mind but always of an individual’s mind. This paper targets Searle’s claim of irreducibility by developing an argument whose aim is to show that, pace Searle, it is possible to track the idea of intentions with a psychological mode structured in terms of “collective goal by means of singular contribution” back to the concept of intentions in the I-form. The argument mainly relies on the idea that Searle’s technical expressions “being a collective goal by means of singular contribution intention in action” or “being a collective goal by way of singular contribution intention in action” are susceptible to conceptual analysis. The upshot of this analysis is that we-intentions can be reduced to complex bundles of mental states, all of which come in the first-person singular form. If this argument is sound, Searlean we-intentions do not belong to a primitive kind of mental states. (shrink)
After focusing on the understanding and the prospect of post-secular society (2008), probing the fruitfulness of expanding multiculturalism into multicultural jurisdictions (2009) and investigating a possible realignment of major liberal notions (2010), in 2011 the so-called ‘trap of resentment’ has been at the center of the İstanbul Seminars. The three sections of this special issue – which collects together the contributions discussed in İstanbul between 19 to 24 May 2011 – are devoted to various facets of the task of inverting (...) the trend and setting a virtuous circle of understanding and trust across cultural and religious divides: (a) identifying the sources and consequences of xenophobic and anti-Moslem resentment as well as the possible remedies (Abdullahi A. What kind of reality is legal reality, how is it created, and what are its a priori foundations? These are the central questions asked by the early phenomenologists who took interest in social ontology and law. While Reinach represents the well-known “realist” approach to phenomenology of law, Felix Kaufmann and Fritz Schreier belonged to the “positivist” “Vienna School of Jurisprudence,” combining Hans Kelsen’s Pure Theory of Law with Edmund Husserl’s phenomenology—and thereby challenging Reinach’s views on how legal reality and the (...) legal a priori were to be conceived. This paper addresses the controversy between these positivist and realist approaches to phenomenology of law, with the goal of introducing the lesser known theories of Kaufmann and Schreier. The special focus on their critique of Reinach’s outline should give us an overview of their positions vis-à-vis the basic and a priori elements of which legal reality consists and the role that phenomenology plays in analyzing them. There is one general tendency to be noted: While the phenomenological legal positivists see the root of legal reality in an act of interpretation according to a “normative scheme of interpretation,” Reinach locates the roots of legal reality in social interaction and argues for the existence of entities independent of any interpretation.
