The extant clinical literature indicates profound problems in the assessment, monitoring, and documentation of care in long-term care facilities. The ever expanding array of electronic monitoring technologies in the clinical research arena demands a conceptual and pragmatic framework for the resolution of ethical tensions inherent in the use of such innovative tools. CareMedia is a project (...) that explores the utility of video, audio and sensor technologies as a continuous real-time assessment and outcomes measurement tool. In this paper, the authors describe the seminal ethical challenges encountered during the implementation phase of this project, namely privacy and confidentiality protection, and the strategies employed to resolve the ethical tensions by applying principles of the interest theory of rights. The nature of moral action versus moral judgment has been extensively debated in numerous disciplines. We introduce Virtual Reality (VR) moral paradigms examining the action individuals take in a high emotionally arousing, direct action-focused, moral scenario. In two studies involving qualitatively different populations, we found a greater endorsement of utilitarian responses–killing one in order to save many others–when action was required in moral virtual dilemmas compared to their judgment counterparts. Heart rate in virtual moral dilemmas was significantly increased when compared (...) to both judgment counterparts and control virtual tasks. Our research suggests that moral action may be viewed as an independent construct to moral judgment, with VR methods delivering new prospects for investigating and assessing moral behaviour. Artificial intelligence (AI) systems have demonstrated impressive performance across a variety of clinical tasks. However, notoriously, sometimes these systems are 'black boxes'. The initial response in the literature was a demand for 'explainable AI'. However, recently, several authors have suggested that making AI more explainable or 'interpretable' is likely to be at the cost of the accuracy of these systems and that prioritising interpretability in medical AI may constitute a 'lethal prejudice'. In this paper, we defend the value of interpretability (...) in the context of the use of AI in medicine. Clinicians may prefer interpretable systems over more accurate black boxes, which in turn is sufficient to give designers of AI reason to prefer more interpretable systems in order to ensure that AI is adopted and its benefits realised. Moreover, clinicians may be justified in this preference. Achieving the downstream benefits from AI is critically dependent on how the outputs of these systems are interpreted by physicians and patients. A preference for the use of highly accurate black box AI systems, over less accurate but more interpretable systems , may itself constitute a form of lethal prejudice that may diminish the benefits of AI to - and perhaps even harm - patients. Childcare robots are being manufactured and developed with the long term aim of creating surrogate carers. While total childcare is not yet being promoted, there are indications that it is 'on the cards'. We examine recent research and developments in childcare robots and speculate on progress over the coming years by extrapolating from other ongoing robotics work. Our main aim is to raise ethical questions about the part or full-time replacement of primary carers. The questions are about human rights, privacy, (...) robot use of restraint, deception of children and accountability. But the most pressing ethical issues throughout the paper concern the consequences for the psychological and emotional wellbeing of children. We set these in the context of the child development literature on the pathology and causes of attachment disorders. We then consider the adequacy of current legislation and international ethical guidelines on the protection of children from the overuse of robot care. (shrink)

What, if anything, is problematic about the involvement of celebrities in democratic politics? While a number of theorists have criticized celebrity involvement in politics (Meyer 2002; Mills 1957; Postman 1987) none so far have examined this issue using the tools of social epistemology, the study of the effects of social interactions, practices and institutions on knowledge and belief acquisition. This paper will draw on these resources to investigate the issue of celebrity involvement in politics, specifically as this involvement relates to (...) democratic theory and its implications for democratic practice. We will argue that an important and underexplored form of power, which we will call epistemic power, can explain one important way in which celebrity involvement in politics is problematic. This is because unchecked uses and unwarranted allocations of epistemic power, which celebrities tend to enjoy, threaten the legitimacy of existing democracies and raise important questions regarding core commitments of deliberative, epistemic, and plebiscitary models of democratic theory. We will finish by suggesting directions that democratic theorists could pursue when attempting to address some of these problems. (shrink)

The development of the CRISPR gene editing technique has been hyped as a technique that could fundamentally change scientific research and its clinical application. Unrecognized is the fact that it joins other technologies that have tried and failed under the same discourse of scientific hype. These technologies, like gene therapy and stem cell research, have moved quickly passed basic research into clinical application with dire consequences. Before hastily moving to clinical applications, it is necessary to consider basic research and determine (...) how CRISPR/Cas systems should be applied. In the case of single gene diseases, that application is expected to have positive impacts, but as we shift to more complex diseases, the impact could be unintentionally negative. In the context of common disabilities, the level of genetic complexity may render this technology useless but potentially toxic, aggravating a social discourse that devalues those with disabilities. This paper intends to define the issues related to disability that are associated with using the CRIPSR/Cas system in basic research. It also aims to provide a decision tree to help determine whether the technology should be utilized or if alternative approaches beyond scientific research could lead to a better use of limited funding resources. We assess John Bishop’s theory of the nature of Christian faith in God, as most recently expressed in ‘Reasonable Faith and Reasonable Fideism’, although we dip into other writings as well. We explain several concerns we have about it. However, in the end, our reflections lead us to propose a modified theory, one that avoids our concerns while remaining consonant with some of his guiding thoughts about the nature of Christian faith in God. It is not enough to simply claim that one has every right to do whatever they desire to do because there is always the possibility of false empowerment. Through the presence of BDSM in mass media, it has caught enough attention for it to elicit influence and uneducated inclusion to their lifestyle. I attempt to revive the debate between the abolitionist versus the sex-positive because there is a necessity to provide a critical analysis of BDSM today in the age of (...) post-sex revolution. Despite of the backlash it received from the thinkers from different walks of field, it is an empowering act because there is mutual respect, condemnation of abuse, and recognition of one’s individuality despite of its coercive, violent, and possessive act. In this paper, we document the counter-data action and data activism of a grassroots affordable housing advocacy group in Atlanta. Our observation and insight into these data activities and strategies are achieved through ethnographic and engaged research and participatory design. We find that counter-data action through community-collected data is rooted in a legacy of Atlanta’s black activism and black scholarship; that this data activism enabled resource mobilization and critical conscious making; and that design and media production are essential post counter-data (...) action activities in data activism. Based on these findings, we urge the field of open government data to broaden their concept of social impact of data to include the use data to mobilize resources within oppressed communities not to influence policy and government but to build capacities within community in order to transform, not join, political structures. We also advocate that scholars within the fields of open government data, critical data studies, and data activism recognize the legacy and historic practice of data activism by black communities working towards social change. This issue’s “Legal Briefing” column covers recent legal developments involving voluntarily stopping eating and drinking (VSED). Over the past decade, clinicians and bioethicists have increasingly recognized VSED as a medically and ethically appropriate means to hasten death. Most recently, in September 2013, the National Hospice and Palliative Care Organization (NHPCO) called on its 2,000 member hospices to develop policies and guidelines addressing VSED. And VSED is getting more attention not only in healthcare communities, but also in the general public. For (...) example, VSED was recently highlighted on the front page of the New York Times and in other national and local media. Nevertheless, despite the growing interest in VSED, there remains little onpoint legal authority and only sparse bioethics literature analyzing its legality. This article aims to fill this gap. Specifically, we focus on new legislative, regulatory, and judicial acts that clarify the permissibility of VSED. We categorize these legal developments into the following seven categories: 1. Context Opioid treatment agreements (OTAs) are documents that clinicians present to patients when prescribing opioids that describe the risks of opioids and specify requirements that patients must meet to receive their medication. Notwithstanding a lack of evidence that OTAs effectively mitigate opioids’ risks, professional organizations recommend that they be implemented, and jurisdictions increasingly require them. We sought to identify the jurisdictions that require OTAs, how OTAs might affect the outcomes of lawsuits that arise when things go wrong, and instances in (...) which the law permits flexibility for clinicians and health care institutions to adopt best practices. -/- Methods We surveyed the laws and regulations of all 50 states and the District of Columbia to identify which jurisdictions require the use of OTAs, the circumstances in which OTA use is mandatory, and the terms OTAs must include (if any). We also surveyed criminal and civil judicial decisions in which OTAs were discussed as evidence on which a court relied to make its decision to determine how OTA use influences litigation outcomes. -/- Findings Results show that a slight majority (27) of jurisdictions now require OTAs. With one exception, the jurisdictions’ requirements for OTA use are triggered at least in part by long-term prescribing. There is otherwise substantial variation and flexibility within OTA requirements. Results also show that even in jurisdictions where OTA use is not required by statute or regulation, OTA use can inform courts’ reasoning in lawsuits involving patients or clinicians. Sometimes, but not always, OTA use legally protects clinicians from liability. -/- Conclusions -/- Our results show that OTA use is entwined with legal obligations in various ways. Clinicians and health care institutions should identify ways for OTAs to enhance clinician–patient relationships and patient care within the bounds of relevant legal requirements and risks. (shrink)

Responding to a major pandemic and planning for allocation of scarce resources under crisis standards of care requires coordination and cooperation across federal, state and local governments in tandem with the larger societal infrastructure. Maryland remains one of the few states with no state-endorsed ASR plan, despite having a plan published in 2017 that was informed by public forums across the state. In this article, we review strengths and weaknesses of Maryland’s response to COVID-19 and the role of the Maryland (...) Healthcare Ethics Committee Network in bridging gaps in the state’s response to prepare health care facilities for potential implementation of ASR plans. Young children, like adults, understand that human agents can flexibly choose different actions in different contexts, and they evaluate these agents based on such choices. However, little is known about children's tendencies to attribute the capacity to choose to robots, despite increased contact with robotic agents. In this paper, we compare 5‐ to 7‐year‐old children's and adults’ attributions of free choice to a robot and to a human child by using a series of tasks measuring agency attribution, action prediction, and (...) choice attribution. In morally neutral scenarios, children ascribed similar levels of free choice to the robot and the human, while adults were more likely to ascribe free choice to the human. For morally relevant scenarios, however, both age groups considered the robot's actions to be more constrained than the human's actions. These findings demonstrate that children and adults hold a nuanced understanding of free choice that is sensitive to both the agent type and constraints within a given scenario. (shrink)

While many authors have theorized about the ability of the humanities to enhance business ethics education, scant empirical work exists to support this speculation. We therefore conduct a study to measure the impact of a live theatre performance on ethical reasoning. We asked students to analyze an ethically-laden historical disaster scenario both before and after attending a performance featuring related narrative themes. Our hypothesis is that attending a live performance would cause students to take a more ethical view of an (...) industrial disaster case study. Results show support for the notion that live theatre may impact individuals’ ethical decision-making as applied to a representative business case. Specifically, we found a significant difference in what parties students hold responsible, what actions students think should have been taken, and how cultural norms affect students’ perceptions of ethical obligations. We therefore suggest that live theatre may be a novel pedagogical tool in business ethics education. (shrink)

This monograph analyzes Nicholas Rescher's system of pragmatic idealism. It also looks at his approach to prediction in science. Coverage highlights a prominent contribution to a central topic in the philosophy and methodology of science. The author offers a full characterization of Rescher's system of philosophy. She presents readers with a comprehensive philosophico-methodological analysis of this important work. Her research takes into account different thematic realms: semantic, logical, epistemological, methodological, ontological, axiological, and ethical. The book features three, thematic-parts: I) General (...) Coordinates, Semantic Features and Logical Components of Scientific Prediction; II) Predictive Knowledge and Predictive Processes in Rescher's Methodological Pragmatism; and III) From Reality to Values: Ontological Features, Axiological Elements, and Ethical Aspects of Scientific Prediction. This insightful analysis offers a critical reconstruction of Rescher's philosophy. The system he created is often characterized as pragmatic idealism that is open to some realist elements. He is a prominent representative of contemporary pragmatism who has made a great deal of contributions to the study of this topic. Although generally philosophers have put a high valuation on reason, increasingly the role of emotions in motivating action is being recognized. The essays in this volume explore the emotions from a variety of perspectives, ranging from Aristotelian views of the passions to the new findings of cognitive science, and from such diverse starting points as medieval literature and psychological studies.

In particular, she finds in the late novels of Henry James an alternative to the reductive, pseudoscientific prose of contemporary analytic philosophy, which she argues inhibits the range of possible answers to the basic ethical question "How should one live?"1 James's prose shows "attention to particulars, a respect for the emotions, and a tentative and non-dogmatic attitude to the bewildering multiplicities of life" (LK, p. 27), and thus it exemplifies the Aristotelian ethical conception she advocates.In this essay I want to disentangle Nussbaum's theory of the ethical significance of fictional form—which I endorse—from her preoccupation [End Page 190] with James—which I do not. Far from being, as she believes, egalitarian, humane, and morally responsible, the Jamesian consciousness Nussbaum would have us emulate is elitist, exclusionary, and morally inert; further, in its commitment to indeterminacy, mystery, and obscurity, the Jamesian model is in fact profoundly anti-philosophical.2 I propose instead George Eliot's Middlemarch as exemplary of fiction's potential contribution to "the job of moral philosophy" (LK, p. 138). Nussbaum may admire the subtlety and density of The Golden Bowl, but I will argue that in its narrative strategies and its integration of novelistic perception and philosophic reflection, Middlemarch proves a better ethical guide and a better example of literature that is also philosophy.In making this argument, I will rely on the terms set by Nussbaum herself for the ethical evaluation of fiction. Unlike other philosophers who invoke literature only as a "rich source of examples awaiting illumination by philosophy," Nussbaum insists that analysis of a text's literary properties is the essential methodology of ethical criticism.3 Every aspect of form and style "expresses a sense of life and of value, a sense of what matters and what does not" (LK, p.5). We discover this "sense of life" through close reading; "our engaged experience line by line," as Wayne Booth says, reveals the character of the implied author, the would-be friend urging on us a particular "pattern of desires."4On Nussbaum's reading, James's prose is ethically exemplary because it is "the prose of Aristotelian perception":It depicts in its cadences the moral effort of straining to see correctly and to come up with the appropriate picture or description; its tensions, obliquities, and circumnavigations express the sheer difficulty of finding the right description or picture for what is there before one. If, as James says, to "put" is to "do," showing this is showing moral activity of a valuable kind.(LK, p. 88)But Nussbaum ends up at James because her alternative moral theory begins there, not because moral philosophy that is literary inevitably sounds like James or supports Aristotle.5 As Nussbaum's gestures towards a more general theory of the role of "the novel" in philosophy indicate, novels may share generic features which complement or correct conventional philosophical discourse, but investigating other novels in this way may also lead us to other, non-Aristotelian, non-Jamesian ethical conceptions. My commentary on Middlemarch presents one such alternative. Nos últimos anos, a restituição de bens culturais tem chamado atenção de teóricos, governos, órgãos internacionais e regulamentações jurídicas. Contudo, há pouca informação sobre a forma como essa realidade se apresenta e é discutida. Este ensaio é uma proposta de investigação sobre a restituição dos bens culturais retirados no contexto do colonialismo, considerando a relação de países europeus com países africanos. Trata-se de analisar a constituição (...) do regime internacional de proteção e restituição do patrimônio cultural, seus princípios, limites e possibilidades, tendo em vista alguns casos de processos restitutivos realizados a partir da década de 1990 e suas narrativas. Indirect speech acts—responding “I forgot to wear my watch today” to someone who asked for the time—are ubiquitous in daily conversation, but are understudied in current neurobiological models of language. To comprehend an indirect speech act like this one, listeners must not only decode the lexical-semantic content of the utterance, but also make a pragmatic, bridging inference. This inference allows listeners to derive the speaker’s true, intended meaning—in the above dialog, for example, that the speaker cannot provide the time. In (...) the present work, we address this major gap by asking non-aphasic patients with behavioral variant frontotemporal dementia and brain-damaged controls with amnestic mild cognitive impairment to judge simple question-answer dialogs of the form: “Do you want some cake for dessert?” “I’m on a very strict diet right now,” and relate the results to structural and diffusion MRI. Accuracy and reaction time results demonstrate that subjects with bvFTD, but not MCI, are selectively impaired in indirect relative to direct speech act comprehension, due in part to their social and executive limitations, and performance is related to caregivers’ judgment of communication efficacy. MRI imaging associates the observed impairment in bvFTD to cortical thinning not only in traditional language-associated regions, but also in fronto-parietal regions implicated in social and executive cerebral networks. Finally, diffusion tensor imaging analyses implicate white matter tracts in both dorsal and ventral projection streams, including superior longitudinal fasciculus, frontal aslant, and uncinate fasciculus. These results have strong implications for updated neurobiological models of language, and emphasize a core, language-mediated social disorder in patients with bvFTD. (shrink)

ABSTRACT What leads people to contribute to public life, to strengthen social cohesion, and work to better society? We investigated how co-curricular aspects of college life relate to social cognitive processes foundational for civic virtues and contribute to their development. We examined one widespread type of co-curricular college experience—studying abroad. When studying abroad, students encounter different social norms and cultures and often interact with others using a non-native language. How does immersion in an unfamiliar society affect psychological capacities, such as (...) epistemic humility and regard for others, that may be central to civic virtues? We compared measures of civic virtues across students who studied abroad, students interested in studying abroad who had not yet had that experience, and students with no interest in studying abroad to understand how differences in civic engagement and civility relate to aspects of students’ psychology such as epistemic humility, empathy, and need for cognition. Purpose: to characterize ethics course content, structure, resources, pedagogic methods, and opinions among academic administrators and course directors at U.S. medical schools. Method: An online questionnaire addressed to academic deans and ethics course directors identified by medical school websites was emailed to 157 Association of American Medical Colleges member medical schools in two successive waves in early 2022. Descriptive statistics were utilized to summarize responses. Results: Representatives from 61 (39%) schools responded. Thirty-two (52%) respondents were course directors; 26 (43%) were (...) deans of academic affairs, medical education, or curriculum; and 3 with other roles also completed the survey (5%). All 61 schools reported some form of formal ethics education during the first year of medical school, with most (n = 54, 89%) reporting a formal mandatory introductory course during preclinical education. Schools primarily utilized lecture and small-group teaching methods. Knowledge-based examinations, attendance, and participation were most commonly used for assessment. A large majority regarded ethics as equally or more important than other foundational courses, but fewer (n = 37, 60%) provided faculty training for teaching ethics. Conclusions: Despite a response rate of 39 percent, the authors conclude that medical schools include ethics in their curricula in small-group and lecture formats with heterogeneity regarding content taught. Preclinical curricular redesigns must innovate and implement best practices for ensuring sound delivery of ethics content in future curricula. Additional large-scale research is necessary to determine said best practices. (shrink)
