The workshop will discuss new insights in the interaction between logic and law, and more precisely the study of different answers to the question: What role does logic play in legal reasoning? It will present both current challenges and historical perspectives in the relation between logic and law. The perspectives to be discussed involve the interface of the following studies.

An ethics reflection group is one of a range of ethics support services developed to better handle ethical challenges in healthcare. The aim of this article is to evaluate the implementation process of interdisciplinary ERGs in psychiatric and general hospital departments in Denmark. To our knowledge, this is the first study of ERG implementation to include both psychiatric and general hospital departments. The implementation and evaluation strategies are inspired by action research, using a qualitative approach and systematic text condensation of (...) 28 individual interviews and 4 focus groups with clinicians, ethics facilitators and ward managers. The implementation process was influenced by both structural factors and factors related to clinicians having different values, interests and experiences. Structural barriers and promotors in the process to implement ERG included the following sub-categories: Organizational factors, recruitment and training of ethics facilitators, the deliberation model, planning and recruitment of participants to the ERGs, the support of the ward managers and the project group. Barriers and promotors found among clinicians included the following sub-categories: Expectations and pre-understandings of ERGs, understandings of a physician’s job, challenges experienced by ethics facilitators. At the end of the study, when it was decided that the ERGs should be continued, the implementation strategies were remodeled by the participants to meet new challenges. The study of ERG implementation identified important structural and professional barriers and promotors that are likely to be relevant to anyone wanting to implement ethics support services across various types of healthcare services. Prominent advocates of posthumanism such as Nick Bostrom and Ray Kurzweil make the case that a drastic increase in the human lifespan would be intrinsically good. This question of the value of an extended lifespan has perhaps become more pressing as medical and scientific advances are seemingly bringing us closer and closer to being able to extend our lives in the way posthumanists envision. In this paper I intend to use Martin Heidegger’s work on death and freedom to develop a (...) potential objection to the claim that an indefinite healthspan is intrinsically desirable. The basic plan will be to make the case that the structure of human agency is such that truly free action is possible only on the basis of the essential finitude of our existence. Assuming that we take this sort freedom to be an important good, we would lose something of crucial importance if we were to radically extend the human healthspan. I am not claiming to present an entirely conclusive argument against posthumanism, or even enhancing the human healthspan to posthuman proportions, but rather, I see my argument here as adding another currently valued dimension of human existence that could very well be lost if we move decisively in the posthumanist direction. Pluralistic ignorance is a socio-psychological phenomenon that involves a systematic discrepancy between people’s private beliefs and public behavior in certain social contexts. Recently, pluralistic ignorance has gained increased attention in formal and social epistemology. But to get clear on what precisely a formal and social epistemological account of pluralistic ignorance should look like, we need answers to at least the following two questions: What exactly is the phenomenon of pluralistic ignorance? And can the phenomenon arise among perfectly rational agents? In (...) this paper, we propose answers to both these questions. First, we characterize different versions of pluralistic ignorance and define the version that we claim most adequately captures the examples cited as paradigmatic cases of pluralistic ignorance in the literature. In doing so, we will stress certain key epistemic and social interactive aspects of the phenomenon. Second, given our characterization of pluralistic ignorance, we argue that the phenomenon can indeed arise in groups of perfectly rational agents. This, in turn, ensures that the tools of formal epistemology can be fully utilized to reason about pluralistic ignorance. (shrink)

Artificial intelligence receives attention in media as well as in academe and business. In media coverage and reporting, AI is predominantly described in contrasted terms, either as the ultimate solution to all human problems or the ultimate threat to all human existence. In academe, the focus of computer scientists is on developing systems that function, whereas philosophy scholars theorize about the implications of this functionality for human life. In the interface between technology and philosophy there is, however, one imperative aspect (...) of AI yet to be articulated: how do intelligent systems make inferences? We use the overarching concept “Artificial Intelligent Behaviour” which would include both cognition/processing and judgment/behaviour. We argue that due to the complexity and opacity of artificial inference, one needs to initiate systematic empirical studies of artificial intelligent behavior similar to what has previously been done to study human cognition, judgment and decision making. This will provide valid knowledge, outside of what current computer science methods can offer, about the judgments and decisions made by intelligent systems. Moreover, outside academe—in the public as well as the private sector—expertise in epistemology, critical thinking and reasoning are crucial to ensure human oversight of the artificial intelligent judgments and decisions that are made, because only competent human insight into AI-inference processes will ensure accountability. Such insights require systematic studies of AI-behaviour founded on the natural sciences and philosophy, as well as the employment of methodologies from the cognitive and behavioral sciences. It is undeniable that computer technology has had a major impact on how we engage enquiry. We use computer devices to store information that helps us in our daily lives—just think of the contacts on your phone and whatever calendar app you might use to keep track of your schedule. Furthermore, people enjoy easy and quick access to a wide range of reliable online resources such as Nature, Reuters, and Encyclopedia Britannica through their laptops or smartphones. Powerful search engines such (...) as Google open up the door to swaths of information, enabling people easily to acquire a wide range of true beliefs through reliable means about all kinds of subject matters. However, what is the status of such true beliefs? In particular, once beliefs cease to be occurrent, do we still have non-occurrent beliefs, and, if true and reliably sustained, do they still qualify as knowledge? If they do, we would have cases of extended belief and knowledge, as these computer devices go beyond onboard capacities such as perception and memory. However, unlike our beliefs and desires, many information-storing apps and resources do not have the capacity automatically to “update” their information in light of new information. Moreover, wouldn’t extended belief and knowledge lead to massive cognitive bloat—an unpalatable explosion of belief and knowledge completely detached from an ability naturally to recall the relevant information? It would seem so given the wide variety of storage repositories and devices at one’s fingertips. Doesn’t cognitive bloat threaten to undermine the notion of expertise? Is it really possible to become an expert on a given topic by simply and easily looking up information via one’s smartphone and saving it? And where, now, would we place cognitive effort—steps taken by individuals to commit details to memory, to apply knowledge, to deliberate, and to assess and reflect? In “Extended Knowledge Overextended?”, Nikolaj Jang Lee Linding Pedersen and Jens Christian Bjerring offer a comprehensive discussion of extended belief and knowledge. They criticize two recent attempts to mitigate concerns about cognitive bloat by arguing that their effectiveness is contingent on the current state of technology—in particular, the fact that computer devices are currently external to us. However, if computer devices seamlessly integrated with our own onboard capacities—the so-called neuromedia—become reality, it may be much more difficult to resist extended belief and knowledge and, with them, massive cognitive bloat. In this paper we explore the potential bearing of the extended mind thesis—the thesis that the mind extends into the world—on epistemology. We do three things. First, we argue that the combination of the extended mind thesis and reliabilism about knowledge entails that ordinary subjects can easily come to enjoy various forms of restricted omniscience. Second, we discuss the conceptual foundations of the extended mind and knowledge debate. We suggest that the theses of extended mind and extended knowledge lead to (...) a bifurcation with respect to the concepts of belief and knowledge. We suggest that this conceptual bifurcation supports a form of pluralism about these concepts. Third, we discuss whether something similar can be said at the metaphysical level. (shrink)

People judge positive information to be more alike than negative information. This good-bad asymmetry in similarity was argued to constitute a true property of the information ecology (Alves, H., Koch, A., & Unkelbach, C. (2017). Why good is more alike than bad: Processing implications. Trends in Cognitive Sciences, 21, 69–79). Alternatively, the asymmetry may constitute a processing outcome itself, namely an influence of phasic affect on information processing. Because no research has yet tested whether phasic affect influences perceived similarity among (...) stimuli, we conducted 5 Experiments that also tested whether phasic affect can account for the higher judged similarity among positive compared to negative stimuli. In three experiments, we affectively charged pictures of different Pokemon by pairing them with monetary gains and losses (Exp. 1a, 1b) as well as positive and negative trait words (Exp. 2); yet, the evaluative charge did not differentially influence perceived similarity among the Pokemon. Experiment 3 replicated the basic similarity asymmetry among positive and negative words, and found that it was unaffected by externally induced phasic affect. Experiment 4 showed that phasic affect had no influence on perceived similarity of non-evaluative words either. We conclude that albeit a weak influence of phasic affect on perceived similarity of stimuli cannot be ruled out entirely, it can most likely not account for the typically medium to large sized asymmetry in similarity among positive and negative stimuli. Statements’ rated truth increases when people encounter them repeatedly. Processing fluency is a central variable to explain this truth effect. However, people experience processing fluency positively, and these positive experiences might cause the truth effect. Three studies investigated positivity and fluency influences on the truth effect. Study 1 found correlations between elicited positive feelings and rated truth. Study 2 replicated the repetition-based truth effect, but positivity did not influence the effect. Study 3 conveyed positive and negative correlations between positivity and (...) truth in a learning phase. We again replicated the truth effect, but positivity only influenced judgments for easy statements in the learning phase. Thus, across three studies, we found positivity effects on rated truth, but not on the repetition-based truth effect: We conclude that positivity does not explain the standard truth effect, but the role of positive experiences for truth judgments deserves further investigation. In this analysis we discuss the change in criteria for triage of patients during three different phases of a pandemic like COVID-19, seen from the critical care point of view. Availability of critical care beds has become a hot topic, and in many countries, we have seen a huge increase in the provision of temporary intensive care bed capacity. However, there is a limit where the hospitals may run out of resources to provide critical care, which is heavily dependent on (...) trained staff, just-in-time supply chains for clinical consumables and drugs and advanced equipment. In the first phase, we can still do clinical prioritisation and decision-making as usual, based on the need for intensive care and prognostication: what are the odds for a good result with regard to survival and quality of life. In the next, the resources are mostly available, but the system is stressed by many patients arriving over a short time period and auxiliary beds in different places in the hospital being used. We may have to abandon admittance of patients with doubtful prognosis. In the last phase, usual medical triage and priority setting may not be sufficient to decrease inflow and there may not be enough intensive care unit beds available. In this phase different criteria must be applied using a utilitarian approach for triage. We argue that this is an important transition where society, and not physicians, must provide guidance to support triage that is no longer based on medical priorities alone. (shrink)

This volume centers on the exploration of the ways in which the canonical texts and thinkers of the phenomenological and existential tradition can be utilized to address contemporary, concrete philosophical issues. In particular, the included essays address the key facets of the work of Charles Guignon, and as such, honor and extend his thought and approach to philosophy. To this end, the four main sections of the volume deal with the question of authenticity, id est what it means to be (...) an authentic person, the ways in which the phenomenological and existential traditions can impact the sciences, how best to understand the fact of human mortality, and, finally, the ways philosophical reflection can help address current questions of value. The volume is designed primarily to serve as a secondary resource for students and specialists interested in rediscovering the practical application of existential and phenomenological thought. The collection of scholarly essays, then, could be used in conjunction with some of the more recent scholarship concerning the practical value of philosophy. Let S2S [WS2S] espectively be the storn [weak] monadic second order theory of the binary tree T in the language of two successor functions. An S2S-formula whose free variables are just individual variables defines a relation on T (rather than on the power set of T). We show that S2S and WS2S define the same relations on T, and we give a simple characterization of these relations.

It is generally agreed that one origin of machine bias is resulting from characteristics within the dataset on which the algorithms are trained, i.e., the data does not warrant a generalized inference. We, however, hypothesize that a different ‘mechanism’ may also be responsible for machine bias, namely that biases may originate from the programmers’ cultural background, including education or line of work, or the contextual programming environment, including software requirements or developer tools. Combining an experimental and comparative design, we study (...) the effects of cultural and contextual metaphors, and test whether each of these are ‘transferred’ from the programmer to the program, thus constituting a machine bias. Our results show that cultural metaphors influence the programmer’s choices and contextual metaphors induced through priming can be used to moderate or exacerbate the effects of the cultural metaphors. Our studies are purposely performed with users of varying educational backgrounds and programming skills stretching from novice to proficient. (shrink)
