Background:Little is known about case managers’ ethical issues and professional values.Objectives:This article presents an overview of ethical issues in case managers’ current practice. Findings are examined in the light of nursing ethics, social work ethics and principle-based biomedical ethics.Research design:A systematic literature review was performed to identify and analyse empirical studies concerning ethical issues in case management programmes. It was completed by systematic content analysis of case managers’ national codes of ethics.Findings:Only nine empirical studies were identified, eight of them from (...) North America. The main dilemmas were how to balance system goals against the client’s interest and client protection against autonomy. Professional codes of ethics shared important similarities, but offered different responses to these two dilemmas.Discussion:We discuss the respective roles of professional and organizational ethics. The main purpose of this second article devoted to T. Piketty’s Capital in the Twenty-First Century (the first was published in the previous issue of Actuel Marx) is to introduce our alternative reading of history. The tendencies manifest during the last decades of the 20th century and the early 21st century are not, it is argued, the replication of the tendencies which prevailed prior to World War I. The starting-point for our analysis is the beginning of the 20th century, a (...) moment characterized by the dynamics of a “managerial capitalism” built around the “tripolar” class pattern of capitalists, managers, and popular classes. The main quantitative manifestation of these trends was the steady rise in the share accounted for by wages (compared to capital income) in the income of upper classes (notably the top 1 percent). In place of Piketty’s impact of shocks, we focus on the chain of successive configurations of class domination and alliances, in a succession of “social orders” marking the historical advance of managerial capitalism : the first financial hegemony, in the years leading up to the Great Depression ; the postwar social-democratic compromise ; and its successor, neoliberalism, involving a new alliance to the right, between the managerial and popular classes. This the first part of a study (in two parts) devoted to Piketty’s theses on the history of capitalism. A summary of Pikety’s analysis is first presented, concerning the dynamics of total wealth (measured as a ratio to national income) and its components, and the tendency of wealth and income inequalities within major capitalist countries. The amplitude of the fall of total wealth in the United-Kingdom and France during World War I is questioned. Piketty explains the profile of these variables (...) concerning wealth and wealth inequalities in reference to historical mechanisms in which the rate of growth of output, the rate of savings, and the return on wealth are considered. The relevance of these mechanisms is basically questioned. We interpret the third component of wealth, other domestic capital, as a form of the capital of enterprises and substitute an alternative, more performing, model to account for the profile of this variable. Cet article constitue la réponse à une note critique publiée dans le n° 71 d’ Actuel Marx, dans laquelle Fabien Foureault discutait les travaux de G. Duménil et D. Lévy concernant l’actuelle transition entre le capitalisme et un nouveau mode de production, le managérialisme. Le premier argument est le fait que les hauts managers sont rétribués par la distribution de stock-options, considérés comme des revenus du capital par Foureault bien que ces options n’aient pas de rapport avec la détention antérieure (...) d’actions par les bénéficiaires. La forme de la rémunération l’emporte sur les pratiques qui la motivent. Foureault utilise, par ailleurs, les calculs réalisés au sein des Distributional National Accounts qui montrent que la part des revenus du capital au sein du revenu total du 1 % supérieur de la hiérarchie des revenus n’a pas décru. Ces nouvelles estimations sont, pour GD et DL, inutilisables hors des finalités comparatives pour lesquelles elles ont été conçues. Enfin, les auteurs considèrent que Foureault se méprend radicalement quant à la nature de leurs interprétations politiques. (shrink)

Dans cet entretien consacré à leur livre Managerial Capitalism : Ownership, management and the coming new mode of production (Pluto Press, 2018), G. Duménil et D. Lévy reviennent sur les implications de leur analyse du capitalisme managérial pour l’étude du capitalisme historique, de ses structures de classes fondamentales, et de ses alliances de pouvoirs variables. La thèse du marxisme traditionnel identifiant les managers à une fraction de classe capitaliste s’en trouve critiquée, de même que les présupposés véhiculés par le concept (...) de « capitalisme d’État ». Invités à revenir plus précisément sur leur distinction entre modes de production et « ordres sociaux », comme configurations variables de hiérarchies de pouvoirs et d’alliances de classe, les auteurs clarifient les raisons pour lesquelles ils introduisent une nouvelle catégorie de mode de production managérial qui impose de repenser le mode de production capitaliste lui-même suivant une logique de « l’hybridité ». Celle-ci permet de complexifier les tendances du capitalisme historique sur la longue durée, d’approfondir l’analyse de classe du capitalisme managérial, et d’y spécifier différentiellement, par rapport au « compromis » d’après-guerre (caractérisé par une alliance entre managers et classes populaires sous la direction des premiers), le dernier ordre social en date caractérisé par une alliance « au sommet » entre managers et capitalistes (au détriment des classes populaires) : le néolibéralisme. Entrée comme officier dans la Marine en 1970, affectée en 1983 à la Direction du personnel, Chantal Desbordes participe à la politique de féminisation des effectifs. Première femme brevetée de l’Ecole supérieure de Guerre navale elle est nommée contre-amiral en conseil des ministres du 19 décembre 2001. Elle est ainsi le premier officier général féminin dans la Marine française. Actuellement adjointe au directeur du personnel militaire de la Marine, elle est chargée de la gestion des compétences des marins. L’entretien de (...) deux heures, réalisé le 24 octobre 2003 au ministère de la Défense (Paris), portait sur sa trajectoire personnelle et sur le développement du recrutement féminin au sein de la Marine. Considérer saint Thomas d'Aquin comme un philosophe : la gageure est moindre que pour saint Augustin. Les images d'Epinal ne sont pas toujours mensongères et, s'il en est une qui dit la vérité, c'est bien celle de la distinction que Thomas tient entre foi et raison, théologie et philosophie. A condition toutefois de préciser que les deux disciplines ne sont par lui distinguées que pour unir, sinon leurs principes, leurs méthodes et leurs résultats, du moins la totalité du spectre de (...) la sagesse. Cette philosophie aux coudées franches s'avère de premier rang. Elle séduit par sa force spéculative et sa clarté, et trouve ces dernières années un public de plus en plus large. Ce volume est donc consacré à la philosophie de saint Thomas. Il couvre la plupart des domaines majeurs où Thomas impose sa marque, assumant les traditions qu'il fait siennes et aussi qu'il dépasse dans une synthèse originale : philosophie de la connaissance, métaphysique, Dieu, éthique, politique. Sans s'interdire des interactions avec les domaines de la théologie, de l'Ecriture et de la mystique, sans non plus négliger quelques-uns des recoins les plus inattendus de la pensée thomasienne, ni ses liens avec les autres doctrines médiévales, ni l'influence qu'elle exerce sur la littérature moderne. Un tel ensemble témoigne des derniers acquis universitaires, sur les questions qu'il traite, d'une nouvelle génération de chercheurs, ainsi que d'un souci pédagogique d'exposition. On se rappelle l’un des problèmes soulevés, en 1975, par John Greville Agard Pocock dans son ouvrage intitulé Le Moment machiavélien : dans l’Angleterre du XVIIe siècle, les idées républicaines et machiavéliennes devaient trouver à se développer dans un environnement intellectuel dominé par des concepts monarchiques, juridiques et théologiques, peu à même de conduire à une définition de l’Angleterre comme polis ou de l’Anglais comme citoyen. Dans ce même ouvrage, Pocock indiquait en outre, sans toutefois développer cette indication, que Francis (...) Bacon connaissait Machiavel à un degré qui aurait mérité d’être discuté plus en détail. Il s’agit de prendre cette dernière remarque au sérieux et, du coup, de tenter de mesurer, en confrontant notamment la pensée politique de Bacon à celle de Juste Lipse et à celle de Giovanni Botero, comment est déjà en germe, dans l’œuvre du Lord Chancelier, une reconceptualisation proprement civique des institutions politiques. In democratic political systems, political equality is often defined as an equality of opportunity for influence. But inequalities in resources and status affect the capacity of disadvantaged citizens to achieve an effective political equality. One common thread running through recent democratic innovations is the belief that appropriate institutional devices and procedures can alleviate the impact of background inequalities on the presence and voice of the disadvantaged within those designs. My objective is to achieve a clearer understanding of the conception of (...) political equality that informs a specific subset of these designs: deliberative mini-publics. I focus firstly on the methods of participant selection advocated to secure equal presence. According to what principle is participation distributed? If it is according to the ‘equal probability’ principle, rather than ‘equal opportunity’, what difference does this make in terms of political equality? Secondly, achieving equality of voice is usually conceived in terms of equalising opportunities for influence among participants. How is this objective understood and what does this say about the underlying conception of political equality? (shrink)

In diesem Zusammenhang setzt er sich mit Tendenzen auseinander, die derzeit in der Psychoanalyse im Umgang mit Traumata zu beobachten sind: Steht ein Trauma im Zentrum ihrer Aufmerksamkeit, tendierten Psychoanalytiker dazu, darin ein für ihre klinische Arbeit spezielles oder gar außergewöhnliches Problem zu sehen, das nach »etwas Anderem« als der grundlegenden Methode der Psychoanalyse verlangt. Demgegenüber wird die Auffassung vertreten, dass ein Trauma untrennbar mit dem Seelenleben verwoben (...) ist. So etwas wie eine nichttraumatische Psychopathologie, so der Autor, gibt es nicht. Jede traumatisierte Psyche, unabhängig von der Intensität des Traumas, stehe darum im Grunde vor demselben Problem: Wie lässt sich der grundsätzliche Mechanismus der Wiederholung überwinden und eine ergebnisoffene Symbolisierung erreichen? Is there a specifically "Hobbesian moment" in the extremely complex history of the idea of conscience? In order to answer this question and to understand why Hobbes's conception of conscience was so innovative, one needs to look at the materials he used to build his system, including the medieval doctrine of synderesis. The article examines the way this doctrine was both perpetuated and altered in Renaissance England.

The analysis of identity in cases of memory loss, particularly in Alzheimer’s disease, sheds light on relevant philosophical and practical concerns, such as decision-making processes, autonomy, and the improvement of interaction with patients. Literature on psychological continuity recognizes identity when there are no disruptions in memory, which is certainly not the case in Alzheimer´s disease. Narrative identity, particularly in its relational and non-relational versions, delivers tools which are not exempt from difficulties. Either the caregivers’ narrative or the patient’s narrative is (...) dismissed. Furthermore, if there is a contradiction of narratives in relational theories, we are advised to either find the best narrative or seek agreement. However, one option rejects one narrative, while the other is unattainable in practice for the case in question. Hence, we propose drawing from ironism (Rorty, 1989), which suggests duality of dialogues when dealing with problems. This will be used to defend that the narratives of both, a person with Alzheimer and those close to them, are valid when constituting identity of the former. In this case, we will articulate and defend relational ironism, which allows us to embrace inconsistent narratives without seeking agreements. According to this, personal identity in this case is in constant tension between the narratives of those who suffer Alzheimer’s disease and the narratives of those close to them. We close illustrating possible benefits for how best to interact with patients. (shrink)

Public surveys conducted in many countries report widespread willingness of individuals to donate a kidney while alive to a family member or close friend, yet thousands suffer and many die each year while waiting for a kidney transplant. Advocates of financial incentive programs or “regulated markets” in kidneys present the problem of the kidney shortage as one of insufficient public motivation to donate, arguing that incentives will increase the number of donors. Others believe the solutions lie—at least in part—in facilitating (...) so-called “altruistic donation;” harnessing the willingness of relatives and friends to donate by addressing the many barriers which serve as disincentives to living donation. Strategies designed to minimize financial barriers to donation and the use of paired kidney exchange programs are increasingly enabling donation, and now, an innovative program designed to address what has been termed “chronologically incompatible donation” is being piloted at the University of California, Los Angeles, and elsewhere in the United States. In this program, a person whose kidney is not currently required for transplantation in a specific recipient may instead donate to the paired exchange program; in return, a commitment is made to the specified recipient that priority access for a living-donor transplant in a paired exchange program will be offered when or if the need arises in the future. We address here potential ethical concerns related to this form of organ “banking” from living donors, and argue that it offers significant benefits without undermining the well-established ethical principles and values currently underpinning living donation programs. Parmi les nombreux problèmes que pose l’ouvrage de Carl Schmitt Le Léviathan dans la doctrine de l’État de Thomas Hobbes, il en est un, majeur, qui concerne l’utilisation de la « mythologie politique » pour expliquer la réalité ou les doctrines politiques. Il y a là, à n’en pas douter, l’expression de l’un des versants de l’irrationalisme de Schmitt. La thèse de l’auteur est très claire : parce que Hobbes ne possédait aucun « sens mythologique », il s’est trompé de (...) monstre biblique, appelant Leviathan son traité consacré au pouvoir d’État, alors qu’il aurait dû l’appeler plus adéquatement Behemoth, manquant du coup la Meeresbild caractérisant l’Angleterre de son temps. La thèse peut paraître séduisante, elle s’appuie néanmoins sur un présupposé fort contestable, car Hobbes ne vise nullement à créer des mythes. Il s’agit donc d’interroger la théorisation hobbesienne de la piraterie, d’une part, et de la dissidence religieuse « sauvage », d’autre part, afin de montrer que le choix par Hobbes des monstres du Livre de Job est un choix rationnellement assumé. La notion de « commerce d’amour-propre » telle qu’elle a été élaborée par Pierre Nicole constitue-t-elle une sorte de préfiguration de l’utilitarisme moderne ? Il est commun de le penser. Mais c’est peut-être là faire trop peu de cas du soubassement théologique augustinien de la doctrine de Nicole. Pour analyser le problème, il convient de confronter la pensée de Nicole à celles de Pascal, de Hobbes et de saint Augustin lui-même.

Afin de comprendre avec exactitude la manière dont Francis Bacon envisage la question de la prolongation de la vie humaine, il faut impérativement examiner l’assise théologique de la réflexion du philosophe à ce sujet. Il convient aussi de restituer l’intégration de cette réflexion dans les objectifs plus amples de la philosophie naturelle nouvelle. Enfin, il est nécessaire de comprendre les dimensions proprement morales de la question. Car la prolongation de la vie humaine n’est pas seulement, au sein de la philosophie (...) naturelle nouvelle, un cas parmi d’autres des recherches qu’il faut désormais effectuer : en réalité, c’est elle qui lui donne et qui lui fixe son sens ; avec elle se joue l’effectivité de l’identité espérée entre science et puissance. Mais il faut encore préciser qu’il ne s’agit aucunement pour l’homme de vieillir pour vieillir : il s’agit pour lui de pouvoir vieillir bien. Les leçons que Bacon tire de la fable de Tithon sont ici véritablement décisives. (shrink)

Informed by medical science and biotechnology, Karoline Georges’s novel Under the Stone offers a reflection on suffering bodies and imagines responses to an overwhelming sense of fear and passivity that embodied trauma and the world’s many crises can create. In line with the editors’ reclaiming of the milieu for the medical humanities, I draw on Deleuze and Guattari’s geophilosophy and Sara Ahmed’s notions of stranger and encounter for reading the novel’s spatialization of oppressive power dynamics and its imagination of subversive (...) emergence. I also complicate the literary text’s discourse on space and body by relying on wonder studies to examine further its alternative forms of careful attunement enacted through the protagonist’s affective and disembodied awakening, the latter fueled by his escape from “the incessant movement of automatic components that delineat[e] [his] presence in the world” (Georges 2016, 61). Happening from and because of the Tower’s milieu, this escape becomes a mitigating force to physical, affective, and social struggles. I thus contend that Georges’s text provides thought-provoking material about the functions and effects of art for addressing the dangers and promises of bioethics, body sovereignty, and life protection. Environmental education usually appeals to the students’ knowledge and rational understanding. Even though this is needed, there is a neglected aspect of learning ecologically fruitful action; that of the lived-body. This paper introduces the lived-body as an important site for learning ecological action. An argument is made for the need of a biophilia revolution, in which refined experience of the body and enhanced capabilities for sensing are seen as important ways of complementing the more common, knowledge-based environmental education. Alienation from (...) the physical environment is seen as one key element in producing environmental devastation. Consequently, human alienation from nature is seen as closely related to alienation from one's body. It is claimed that through overcoming the dualist alienation of human consciousness from its lived body, we can decrease the alienation of human beings from their environment. Methods of contemplative pedagogy are introduced for addressing alienation. By getting in touch with the tangible lived-body in yoga or mindfulness meditation we reconnect to the material world of nature. Contemplative pedagogy cultivates the body and its senses for learning intrinsic valuation and caring for the environment. Lived-body experience is challenging to conceptualise; we use Maurice Merleau-Ponty's concept of the flesh in our attempt to do so. Finally, this paper suggests some contemplative practices of the lived-body for environmental education. Experiencing the flesh of oneself and the world as one and the same is an environmentally conducive experience that gives value and meaning to the flourishing of all life, human and non-human. Ces thèmes sont au coeur des différents textes qui composent ce livre dont le point commun est que, comme peut-être aucune autre science, la philosophie vit de la réflexion des penseurs sur ce qui donne à penser et de la discussion avec (...) d'autres penseurs. C'est ici que se situe l'étude de sa propre tradition, comme l'a montré Dominique Kahang'a Rukonkish. Ceci est particulièrement nécessaire dans des situations de crise comme celle que traverse l'Afrique contemporaine. Ce qui importe dans ce cas est de questionner le passé à partir du contexte actuel en vue de ses potentialités à venir, tout en l'ouvrant à la possibilité d'une rencontre avec les autres traditions. Les auteurs des contributions réunies dans ce livre remercient Dominique Kahang'a Rukonkish pour ce qu'ils sont devenus grâce à lui. C'est pour eux un devoir de mémoire auquel ils se plient. (shrink)
