When is industry self-regulation (ISR) a legitimate form of governance? In principle, ISR can serve the interests of participating companies, regulators and other stakeholders. However, in practice, empirical evidence shows that ISR schemes often under-perform, leading to criticism that such schemes are tantamount to firms marking their own homework. In response, this paper explains how current management theory on ISR has failed to separate the pragmatic legitimacy of ISR based on self-interested calculations, from moral legitimacy based on normative approval. The (...) paper traces three families of management theory on ISR and uses these to map the pragmatic and moral legitimacy of ISR schemes. It identifies tensions between the pragmatic and moral legitimacy of ISR schemes, which the current ISR literature does not address, and draws implications for the future theory and practice of ISR. This paper presents results found through searching publicly available U.S. data sources for information about how to handle incidental fndings (IF) in human subjects research, especially in genetics and genomics research, neuroimaging research, and CT colonography research. We searched the Web sites of 14 federal agencies, 22 professional societies, and 100 universities, as well as used the search engine Google for actual consent forms that had been posted on the Internet. Our analysis of these documents showed that there is very (...) little public guidance available for researchers as to how to deal with incidental fndings. Researchers in the health sciences regularly discover information of potential health importance unrelated to their object of study in the course of their research. However, there appears to be little guidance available on what researchers should do with this information, known in the scientific literature as incidental findings. The study described here was designed to determine the extent of guidance available to researchers from public sources. This empirical study was part of a larger two-year project funded by the National Human (...) Genome Research Institute to generate guidance on how incidental findings should be managed in human subjects research, especially genetics, genomics, and imaging research. We generated empirical analysis of publicly available guidance and consent forms to help guide a multidisciplinary Working Group of experts in their formulation of normative recommendations reported in this symposium. Why is there a felt asymmetry between cases in which agents defer to testifiers for certain moral beliefs, and cases in which agents defer on many other matters? One explanation influential in the literature is that having understanding of a proposition is both in tension with acquiring belief in the proposition by deferring to another's testimony and distinctively important when it comes to moral propositions, as compared with what we might think of as many ‘garden variety’ facts. My project in (...) this paper is to offer a new and more defensible version of this explanation. This will involve re-conceiving understanding as a richer state than it is commonly thought to be, requiring affective and motivational engagement with reasons as well as cognitive facility. I also offer a new explanation of the tension between understanding and deference to testimony. (shrink)

Infallibilism is the view that a belief cannot be at once warranted and false. In this essay we assess three nonpartisan arguments for infallibilism, arguments that do not depend on a prior commitment to some substantive theory of warrant. Three premises, one from each argument, are most significant: if a belief can be at once warranted and false, then the Gettier Problem cannot be solved; if a belief can be at once warranted and false, then its warrant can be transferred (...) to an accidentally true belief; if a belief can be at once warranted and false, then it can be warranted and accidentally true. We argue that each of these is either false or no more plausible than its denial. Along the way, we offer a solution to the Gettier Problem that is compatible with fallibilism. (shrink)

This is a short essay that presents what I take to be the main questions regarding the epistemology of disagreement.

This paper compares two theories of the firm used to interpret firms’ corporate social strategies in order to derive new insights and questions in this research area. Researchers from many branches of strategic management agree that firms can strategically allocate resources in order to achieve both long-term social objectives and competitive advantage. However, despite some progress in investigating corporate social strategy, studies rely on fundamentally diverging theoretical approaches. This paper will identify, compare and begin to integrate two competing theories of (...) the firm implicit in corporate social strategy scholarship: the resource-based and behavioural theories of the firm. I discuss the implications of these two theories for both researchers and practitioners on key debates within corporate social strategy, and conclude by suggesting several fruitful avenues for future research based on the emerging integration of these two theories of the firm within the strategy literature. A new kind of skepticism about philosophy is articulated and argued for. The key premise is the claim that many of us are well aware that in the past we failed to have good responses to substantive objections to our philosophical beliefs. The conclusion is disjunctive: either we are irrational in sticking with our philosophical beliefs, or we commit some other epistemic sin in having those beliefs.

Many people with religious beliefs, pro or con, are aware that those beliefs are denied by a great number of others who are as reasonable, intelligent, fair-minded, and relatively unbiased as they are. Such a realization often leads people to wonder, “How do I know I’m right and they’re wrong? How do I know that the basis for my belief is right and theirs is misleading?” In spite of that realization, most people stick with their admittedly controversial religious belief. Use your imagination to think of worlds that are much, much, much worse than you think Earth is when it comes to horrific suffering. Isn’t there some conceivable scenario which, if you were in it, would make you say “Ok, ok. God doesn’t exist, at least in the way we thought God was. We were wrong about that”? Flannery provides English readers with a glossary of terms to bring further understanding to Maritain s original words. Jacques Maritain was a French Catholic philosopher and political thinker. He was born in Paris in 1882, where he spent most of his life. His father was a prominent lawyer and his mother the daughter of a statesman. He attended the Sorbonne to study philosophy and natural science, and after marrying, he and his wife converted to Catholicism. It was after this he became a well-known scholar of St. Thomas Aquinas and Thomistic philosophy. He published widely on philosophical and political thought, and by the 1930s, he was an established thinker in the Catholic community. After the outbreak of WWII, Maritain relocated to the United States, where he taught at Princeton University and Columbia University. Later in life, he and his wife returned to France, where he continued to write and study Catholic scholarship until his death in 1973. (shrink)

There is a long history of using facts about disagreement to argue that many of our most precious beliefs are false in a way that can make a difference in our lives. In this essay I go over a series of such arguments, arguing that the best arguments target beliefs that meet two conditions: (i) they have been investigated and debated for a very long time by a great many very smart people who are your epistemic superiors on the matter (...) and have worked very hard under optimal circumstances to figure out if the belief is true, and (ii) as far as you know these people have not come to any significant agreement on the belief and as far as you know those who agree with you are not, as a group, in a better position to judge the belief than those who disagree with you. Philosophers defend, and often believe, controversial philosophical claims. Since they aren’t clueless, they are usually aware that their views are controversial—on some occasions, the views are definitely in the minority amongst the relevant specialist-experts. In addition, most philosophers are aware that they are not God’s gift to philosophy, since they admit their ability to track truth in philosophy is not extraordinary compared to that of other philosophers. In this paper I argue that in many real-life cases, such beliefs in controversial (...) claims are irrational. This means that most philosophers have irrational philosophical beliefs. (shrink)

We all can identify many contemporary philosophy professors we know to be theists of some type or other. We also know that often enough their nontheistic beliefs are as epistemically upstanding as the non-theistic beliefs of philosophy professors who aren’t theists. In fact, the epistemic-andnon-theistic lives of philosophers who are theists are just as epistemically upstanding as the epistemic-and-non-theistic lives of philosophers who aren’t theists. Given these and other, similar, facts, there is good reason to think that the pro-theistic beliefs (...) of theistic philosophers are frequently epistemically upstanding. Given their impeccable epistemic credentials on non-theistic matters, the amount of careful thought that lies behind their theism, the large size of the community of philosophical theists, as well as other, similar facts, it would be surprising if all or even most of their pro-theistic beliefs were epistemically blameworthy in some or other signicant sense tied to charges such as ‘He should know better than to believe that’ (so mere false belief need not be blameworthy in this sense; the use of ‘blameworthy’ will be claried below). Of course some of the pro-theistic beliefs of some theistic philosophers are epistemically blameworthy; the mere large numbers of fallible theistic philosophers almost guarantees it. My point here is that it would be unexpected if most of the pro-theistic beliefs of theistic philosophers were epistemically blameworthy. (shrink)

Since the early nineteenth century it has been known that Frances Reynolds, the sister of Sir Joshua, was the author of an essay on taste, which she had printed but did not publish. Yet persistent search failed to turn up a single copy. It remained one of those lost pieces which every research scholar hoped someday to discover. In 1935 it appeared that the search was over. Among some manuscripts of Mrs. Thrale-Piozzi, long hidden in Wales, was found a (...) printed copy of an anonymous _Enquiry Concerning the Principles of Taste, and of the Origin of Our Ideas of Beauty, which seemed to be the lost essay.
