This article observes that one of the most interesting developments in tort scholarship during recent years has been the emergence of a literature analyzing tort problems from feminist perspectives. The article looks at three of the areas that feminist writers have explored: the possibility of a "reasonable woman" standard as an alternative to the "reasonable man"; the possible recognition of a duty to rescue, which allegedly would be in harmony with feminist ethics; and the issue of how the tort system (...) should respond to types of harms that are disproportionately suffered by women. The article concludes that the feminist discussions of these topics have enriched the discourse of tort. Still, those discussions have been, in significant respects, inadequate. They have failed, for example, to take advantage of the relevant empirical information; and certain key issues relating to legal history and legal theory have remained underdeveloped. (shrink)

The Principles of Fair Information Practice are almost three decades old and need to be broadened to take account of new technologies for collecting personal information such as drug testing, video cameras, electronic location monitoring and the internet. I argue that the ethics of surveillance activity must be judged according to the means, the context and conditions of data collection and the uses/goals and suggest 29 questions related to this. The more one can answer these questions in a way that (...) affirms the underlying principle the more ethical the use of a tactic is likely to be. Four conditions are identified which, when breached, are likely to violate an individual's reasonable expectation of privacy. Respect for the dignity of the person is a central factor and emphasis is put on the avoidance of harm, validity, trust, notice and permission when crossing personal borders. (shrink)

In discussions on the ethics of surveillanceand consequently surveillance policy, thepublic/private distinction is often implicitlyor explicitly invoked as a way to structure thediscussion and the arguments. In thesediscussions, the distinction public and private is often treated as a uni-dimensional,rigidly dichotomous and absolute, fixed anduniversal concept, whose meaning could bedetermined by the objective content of thebehavior. Nevertheless, if we take a closerlook at the distinction in diverse empiricalcontexts we find them to be more subtle,diffused and ambiguous than suggested. Thus,the paper argues (...) for the treatment of thesedistinctions as multi-dimensional, continuousand relative, fluid and situational orcontextual, whose meaning lies in how they areinterpreted and framed. However, the aim ofthis paper is not to finally sort things out. The objective is rather to demonstrate thecomplexities of the distinction in variouscontexts and to suggest that those using thedistinction, when considering the ethics andpolitics of surveillance technologies, wouldbenefit from more clearly specifying whichdimensions they have in mind and how theyrelate. Fear, sadness, surprise, anger, lust and love - virtually nothing was more important in the paintings ofthe Golden Age than convincingly depicting human emotions. In this publication, the Frans Hals Museum and Rembrandt expert Gary Schwartz present a selection of masterpieces in which these emotions are sublimely portrayed. According to seventeenth-century connoisseurs, the beauty of a painting was not even half as important as the passions that could be seen in that painting; they formed the soul of the (...) work. Painters such as Rembrandt, Frans Hals, Maerten van Heemskerck and Cornelis van Haarlem were masters at depicting a range of emotions. Their works are presented in a new context - the emotional life - and with a focus on the flourishing scientific study of emotions in our own time. Emotions will be published in conjunction with the first exhibition in the Netherlands to present this essential component of painting. The qigong state of bigu is believed to be supported by the absorption of qi from the universe. Gamma radiation is ubiquitous in the cosmos and, according to some, may be a possible source of energy for cellular functioning. When the concept of energy is integrated with the concept of dynamical systems, the logic leads to the theory—termed systemic memory—that predicts all systems, from the micro to macro, store information and energy to various degrees. New research indicates that the human (...) body absorbs gamma radiation from the environment and emits high-frequency X rays. There are substantial individual differences in these effects that appear to be related, in part, to the psychological state of the person. Future research can determine if bigu is associated with increased absorption of gamma radiation and/or decreased emission of high frequency X rays. The hypothesis that qi can be viewed as quality information is proposed. (shrink)

Genetic information is widely thought to pose unique risks of reidentifying individuals. Genetic data reveals a great deal about who we are and, the standard view holds, should consequently be treated differently from other types of data. Contrary to this view, we argue that the dangers of reidentification for genetic and nongenetic data—including health, financial, and consumer information—are more similar than has been recognized. Before different requirements are imposed around sharing genetic information, proponents of the standard view must show that (...) they are in fact necessary. We further argue that the similarities between genetic and nongenetic information have important implications for communicating risks during consent for health care and research. While patients and research participants need to be more aware of pervasive data‐sharing practices, consent forms are the wrong place to provide this education. Instead, health systems should engage with patients throughout patient care to educate them about data‐sharing practices. (shrink)

This paper examines Allen Carlson's influential view that knowledge from natural science offers the best (and perhaps only) framework for aesthetically appreciating nature for what it is in itself. Carlson argues that knowledge from the natural sciences can play a role analogous to the role of art-historical knowledge in our experience of art by supplying categories for properly 'calibrating' one's sensory experience and rendering more informed aesthetic judgments. Yet, while art history indeed functions this way, Carlson's formulation leaves out a (...) second (and often more important) role played by art-historical knowledge over the last century - namely, providing the context needed for interpretations of meaning. This paper explores whether natural science can also inform our aesthetic experience of nature in this second sense. I argue that a robust sense of meaning from our aesthetic experience of nature is indeed made possible by coupling our aesthetic experience of animals with knowledge from the natural science of animal ethology. By extending the scope of Carlson's analogy to include interpretations of meaning, my argument shows that the cognitive, scientific model can accommodate a wider range of aesthetic engagement with nature than previously recognised. No one need deny the importance of language to thought and cognition. At the same time, there is a tendency in studies of mind and mental functioning to assume that properties and principles of linguistic, or language-like, forms of representation must hold of forms of thought and representation in general. Consideration of a wider range of symbol systems shows that this is not so. In turn, various claims and arguments in cognitive theory that depend on assumptions applicable only to linguistic (...) systems, do not go through or become difficult to state in a manner that makes them both interesting and plausible. William James’s historic fascination with psychic phenomena, including the possibility of life after death, has become more widely known with the publication of recent books and articles on this controversial aspect of his scientific legacy. However, little is known about the emerging evidence suggesting the possibility that James’s scientific interest in these topics has not waned since he died. This paper reviews preliminary observations, including two exploratory double-blinded mediumship investigations, which are consistent with the hypothesis that James (with others) may (...) be continuing his lifelong quest to address the question of the survival of consciousness after physical death ‘from the other side’. These proof-of-concept investigations illustrate how future systematic laboratory research is possible. The limitations of current neuroscience methods are explicated in terms of investigating the hypothesis of the brain as a possible antenna-receiver for consciousness. If James’s tentative conclusions about the nature of the relationship between consciousness and the brain turn out to be accurate, then it is logically plausible (if not essential) to posit the possibility that his efforts have persisted in the recent past and present, and may even continue in the future. Scientific integrity plus the pursuit of verity require our being open to this important theoretical and empirical possibility. (shrink)

Rutherford and Lindell (2011) review an extensive literature on lateralization of emotion. As they note, an important issue surrounding this question is the nature of emotion, which bears on what, precisely, is lateralized. The present comments are intended to broaden the context of the review, by considering lateralization from the standpoint of a bivariate model of evaluative processes and a neuroevolutionary perspective.

Previous research has demonstrated electroencephalogram (EEG) changes in response to low-odor concentrations, resulting in near-chance detection. Such findings have been taken as evidence for olfaction without awareness. We replicated and extended previous work by examining EEG responses to water-water control, 0.0001, 0.001, 0.01, and 1 ppm isoamyl acetate (IAA) in water paired with water only. Detection was above chance (>50%) for .001 and above, and alpha decreased only to those concentrations, suggesting that EEG changes corresponded to IAA awareness. However, when (...) correct trial EEGs were compared to incorrect trial EEGs during .001 ppm, right posterior/central alpha decreased during incorrect trials and alpha decreased more globally (including frontal sites) during correct trials. These data may not reflect awareness or unawareness per se. Instead, results are discussed regarding activation of perceptual systems in the posterior region during incorrect trials and the activation of frontal action systems during a subset of correct trials.
