The humanity formulation of Kant's Categorical Imperative demands that we treat humanity as an end in itself. Because this principle resonates with currently influential ideals of human rights and dignity, contemporary readers often find it compelling, even if the rest of Kant's moral philosophy leaves them cold. Moreover, some prominent specialists in Kant's ethics have recently turned to the humanity formulation as the most theoretically central and promising principle of Kant's ethics. Nevertheless, it has received less attention than many other (...) aspects of Kant's ethics. Richard Dean offers the most sustained and systematic examination of the humanity formulation to date. He presents an original analysis of what it means to treat humanity as an end in itself, and examines the implications both for Kant scholarship and for practical guidance on specific moral issues. Health care reform that includes universal coverage could lower a major barrier to care for people of color and ethnic minorities—the inability to pay for care. But universal coverage alone, even with comparable fee-for-service payment or appropriately risk-adjusted capitated reimbursement, will not eradicate the racial and ethnic inequities in health care delivery. Restrictive admissions practices, geographic inaccessibility, culture, racial stereotypes, and the failure to employ minority health care professionals will still create barriers to minority health care. This paper extends the discussion of business ethics by examining the issue of corruption, its definition, the solutions being proposed for dealing with it, and the ethical perspectives underpinning these proposals. The paper’s findings are based on a review of association, think-tank, and academic reports, books, and papers dealing with the topic of corruption, as well as the pronouncements, websites, and position papers of a number of important global organizations active in the fight. These organizations include the World Bank, the (...) International Monetary Fund, the Organization for Economic Co-operation and Development, Transparency International, USAID, the United Nations, the International Chamber of Commerce, the Organization of American States, and the Council of Europe. Our discussion departs from prior analyses by adopting a Foucaultian theoretical framing and by incorporating insights found in the virtue ethics literature. Social media is changing social accountability practices. The release of the Panama Papers on April 3, 2016 by the International Consortium of Investigative Journalists (ICIJ) unleashed a tsunami of over 5 million tweets decrying corrupt politicians and tax-avoiding business elites, calling for policy change from governments, and demanding accountability from corporate and private tax avoiders. The current study uses 297,000+ original English-language geo-codable tweets with the hashtags #PanamaGate, #PanamaPapers, or #PanamaLeaks to examine the trajectory of Twitter-based social accountability conversations and (...) the potential for the emergence of a longer-term social accountability user network. We propose that it is the combination of financial inscriptions and evaluative ethical utterances that incite and sustain social accountability conversations and social accountability networks. Financial inscriptions simultaneously remind audiences of both the information event that fomented the initial public reaction and the monetary magnitude of the event. Value-based ethical messaging, in turn, enunciates an ethical stance that simultaneously evaluates existing practices and emphasizes the need for accountability. It is the combining of these two types of messaging that helps to construct and sustain a normative narrative about social accountability. The results illustrate how the repetition and re-working of these two forms of messaging facilitated the construction of a normative narrative that coalesced into a social accountability network which persisted beyond the initial Panama Paper information event and which was re-activated in 2017 when the ICIJ published the Paradise Papers. In this chapter, Mark Budolfson and Dean Spears analyse the marginal effect of philanthropic donations. The core of their analysis is the observation that marginal good done per dollar donated is a product (in the mathematical sense) of several factors: change in good done per change in activity level of the charity in question, change in activity per change in the charity’s budget size, and change in budget size per change in the individual’s donation to the charity in question. They then discuss the “hidden zero problem” that some of the terms in the equation (in particular, the last term) might be “hidden zeros” that prevent donations from doing any good—or worse, imply that they do harm—even if the charity is at the top of effective altruism rankings based on the other factors. A sample of 227 business students from the United States and Australia was used to evaluate factors that impact business students' ethical orientation and factors that impact students' perceptions of ethical classroom behaviors. Perceptions of classroom behaviors was considered a surrogate for future perceptions of business behaviors. Independent factors included age, gender, religious orientation, country of origin, personality, and ethical orientation. One fateful day in May 1975, Foucault dropped acid in the southern California desert. In letters reproduced here, he described it as among the most important events of his life, one which would lead him to completely rework his History of Sexuality. That trip helped redirect Foucault's thought and contributed to a tectonic shift in the intellectual (...) life of the era. He came to reinterpret the social movements of May '68 and reposition himself politically in France, embracing anti-totalitarian currents and becoming a critic of the welfare state. Mitchell Dean and Daniel Zamora examine the full historical context of the turn in Foucault's thought, which included studies of the Iranian revolution and French socialist politics, through which he would come to appreciate the possibilities of autonomy offered by a new force on the French political scene that was neither of the left nor the right: neoliberalism. This article examines four leading multi-stakeholder labour monitoring organizations. All operating in the maquiladora industry, these organizations are viewed in light of the growing global trend toward industry self-regulation, or what has been referred to as the 'global out-sourcing of regulation'. Their Board compositions, codes of conduct and monitoring and enforcement strategies are all examined as a means of tentatively positioning these organizations along an 'egoist-instrumentalist-moralist' ethical culture continuum. Such a framing provides insights into the perceived salience of these organizations' (...) broader stakeholders, the effectiveness of codes of conduct on workplace practices more generally, and the role that ethics plays in the governance and accountability of these increasingly important types of organizations. The tension between external forces for better ethics in organizations, represented by legislation such as the Sarbanes–Oxley Act (SOX), and the call for internal forces represented by increased educational coverage, has never been as apparent. This study examines business school faculty attitudes about recent corporate ethics lapses, including opinions about root causes, potential solutions, and ethics coverage in their courses. In assessing root causes, faculty point to a failure of systems such as legal/professional and management (external) and declining personal values (...) (internal). We also found that faculty recommend external forces as a remedy more often than increased ethics educational coverage; we contextualize this finding with recent ethics education literature. We conclude by proposing that neither legislation nor ethics education alone are complete when addressing widespread unethical corporate acts and offer a multi-faceted approach to ethics educational opportunities. Physical activities are generally accepted as promoting important psychological benefits. However, studies examining martial arts as a form of physical activity and mental health have exhibited many methodological limitations in the past. Additionally, recent philosophical discussion has debated whether martial arts training promotes psychological wellbeing or illness. Self-efficacy has an important relationship with mental health and may be an important mechanism underpinning the potential of martial arts training to promote mental health. This study examined the effect of martial arts training (...) on the psychological construct of self-efficacy. A total of 283 secondary school students with a mean age of 12.76 (SD = 0.68) years were recruited to complete a time-limited (10-session) martial arts intervention, which was examined using a randomised controlled trial. Univariate ANOVAs found that the intervention improved the experimental group’s self-efficacy compared to the control group, which was sustained at follow-up. Regression analysis indicated that socio-educational status moderated this outcome. These findings support the martial arts-based intervention’s potential to improve self-efficacy and promote wellbeing through physical activity. Martial arts training may be an efficacious psychosocial treatment that can be used as a complementary approach to promote mental health. (shrink)

AbstractBoardroom backscratching, or cronyism, is an unethical practice where CEOs conspire with directors to receive remuneration beyond performance- and market-related factors. Premised on the theory of planned behavior, this study investigates whether CEO generalist experience magnifies the likelihood of boardroom backscratching. Using 9482 firm-year observations spanning 1999–2018, our analysis shows that firms with greater CEO generalist managerial experience are more likely to engage in boardroom backscratching, via both cash- and equity-based compensation. We provide further evidence that backscratching firms with CEOs (...) that possess greater generalist experience tend to overinvest, particularly via non-capital expenditure, as a channel for empire building and private rent extraction. We also find that a higher portion of female independent directors sitting on the board and the compensation committee mitigates the positive relationship between CEO generalist managerial experience and boardroom backscratching, which we attribute to greater ethicality of, and increased monitoring exercised by, female independent directors. O presente trabalho tem como tema a influência das mudanças climáticas nos conflitos do Sudão, em especial em Darfur. Desde a conquista da independência, em 1956, o Sudão teve de lidar com disputas tanto na região Sul (que culminou com a separação do Sudão do Sul, em 2011), quanto em Darfur, resultando em um conflito aberto em 2003. Nos últimos dois decênios, as mudanças climáticas passaram a ser consideradas crescentemente como potenciais fatores de exacerbação dessas tensões locais. Diante disso, busca-se (...) responder à seguinte questão: quais são as implicações das mudanças climáticas para o panorama securitário do Sudão, particularmente em Darfur? Em termos teóricos, o artigo adota a perspectiva crítica de segurança, com a finalidade de compreender o caráter multidimensional das fontes não tradicionais de ameaça à segurança do país, como a ameaça climática. Em termos metodológicos, fez-se uso de uma abordagem qualitativa e hermenêutica, com a análise de relatórios de órgãos da ONU, de documentos do governo sudanês e de outras obras. Embora os fenômenos climáticos tenham contribuído para a exacerbação da instabilidade no Sudão e das disputas em Darfur, conclui-se que sua influência ocorreu de forma indireta, em conjugação com outras dimensões sociais, econômicas e políticas. Entende-se, porém, que a inclusão dos aspectos climáticos seria uma ferramenta importante para se reduzir a instabilidade local. (shrink)

Whether or not one employs the vocabulary and methods of psychoanalysis to do so, this approach to aesthetics has become so widespread in the humanities that (...) it qualifies as a contemporary critical norm. As a norm, it may be subject to debate and even contestation. Today it is normative to read literature, film, and other cultural texts primarily as evidence about the societies that made them—evidence that necessarily requires our hermeneutic labor in order to yield its significance. This methodological protocol remains in place whether one inhabits critical perspectives as ostensibly disparate as historicist, materialist, or psychoanalytic modes of thinking; it is also a grounding assumption of cultural studies, irrespective of how one defines that critical practice. Indeed, the issue I want to address is quite as much a Marxist problem as it is a psychoanalytic one, and therefore the way in which Žižek articulates Lacan with Marx makes his work especially fertile terrain on which to engage this matter. As Žižek reminds us in The Sublime Object of Ideology, Lacan claimed that Marx invented the symptom [SO 11]—an observation that Žižek has been keen to exploit from the very beginning of his work.Žižek's combining psychoanalysis with Marxism in novel ways has helped make Lacan more palatable to contemporary critical sensibilities by politicizing psychoanalysis, demonstrating how it offers less an account of the individual than of society and culture. In Žižek's hands psychoanalytic theory appears less vulnerable to the standard criticisms that it is ahistorical and apolitical. While a number of critiques of Žižek have reiterated these common objections, nevertheless his politicizing of psychoanalysis has been particularly important during a period that witnessed the rise of new historicism, the institutionalization of cultural studies, and the escalating importance of "the political" as a sign—perhaps the sign—of humanities professors' seriousness.1 Žižek's work has gone a long way toward making Lacan seem indispensable to cultural studies, just as Juliet Mitchell's and Jacqueline Rose's work a decade earlier made Lacan seem indispensable to theoretically rigorous feminism. At a moment when the poststructuralist variant of Lacanian theory was being displaced by historicist modes of thought, Žižek emerged on the scene to revivify psychoanalysis and make it exciting again. Thus his work's appeal has an historical basis quite apart from Žižek's own personal charisma and his remarkable productivity. It is his politicizing of psychoanalysis, as much as his [End Page 21] rendering Lacan newly accessible, that has made Žižek popular. I want to argue, however, that his style of politicizing psychoanalysis carries a significant ethical cost, one that follows partly as a consequence of Žižek's failure to work through his theoretical relation to Althusser, from whom he derives the practice of symptomatic reading while claiming to displace the latter's version of psychoanalytic Marxism. Modulating connectivity measures in EEG-based neurofeedback studies is assumed to be a promising therapeutic and training tool. However, little is known so far about its effects and trainability. In the present study, we investigated the effects of up- and down-regulating SMR coherence by means of neurofeedback training on EEG activity and memory functions. Twenty adults performed 10 neurofeedback training sessions in which half of them tried to increase EEG coherence between Cz and CPz in the SMR frequency range, while the (...) other half tried to down-regulate coherence. Up-regulation of SMR coherence led to between- and within-session changes in EEG coherence. SMR power increased across neurofeedback training sessions but not within training sessions. Cross-over training effects on baseline EEG measures were also observed in this group. Up-regulation of SMR coherence was also associated with improvements in memory functions when comparing pre- and post-test results. Participants were not able to down-regulate SMR coherence. This group did not show any changes in baseline EEG measures or memory functions comparing pre- and post-test. Our results provide insights in the trainability and effects of connectivity-based neurofeedback training and indications for its practical application. (shrink)

Since his untimely death, Bataille has become very famous. Oxford Studies in Metaphysics is the forum for the best new work in this flourishing field. Much of the most interesting work in philosophy today is metaphysical in character: this series is a much-needed focus for it.

There are complex considerations when planning to disclose an attenuated psychosis syndrome diagnosis. In this review, we evaluate ethical, legal, and clinical perspectives as well as caveats related to full, non- and partial disclosure strategies, discuss societal implications, and provide clinical suggestions. Each of the disclosure strategies is associated with benefits as well as costs/considerations. Full disclosure promotes autonomy, allows for the clearest psychoeducation about additional risk factors, helps to clarify and/or correct previous diagnoses/treatments, facilitates early intervention and bolsters communication (...) between providers but there are important considerations involving heritability, comorbidity, culture, and stigma. Non-disclosure advances nonmaleficence by limiting stigma and stress, and confusion in a sensitive developmental period but is complicated by varying patient preferences and the possibility that, as new treatments without adverse effects become available, the risk with false positives no longer justifies the accompanying loss of autonomy. Partial disclosure balances ethical considerations by focusing on symptoms instead of labels, but evidence that laypersons may interpret this information as a pseudo-diagnosis and that symptoms alone also contribute to stigma limits the efficacy of this approach. In addition, there are notable societal considerations relating to disclosure involving conservatorship, the reach of insurance companies, and discrimination. We advocate a hybrid approach to disclosure and recommend future research aimed at understanding the effects of stigma on clinical course and a renewed focus on those help-seeking cases that do not transition but remain clinically relevant. We were drawn to this question, perhaps like our interviewees, because we are interested in a certain mystique in Ballard, because we enact something important about it when we go to its coffee shops and restaurants, and because we are transients from other places. Furthermore, we are not always sure of our place in the city, or how our points of reference here may be changing. Much can be said about Seattle’s role in white settlement and in its original industries: shipping, canning, and logging. Much can be said about the arrival of Scandinavian laborers in Ballard, or how the town of Ballard came to be incorporated into Seattle. But as in maps, while these accounts may ground key details, they do not encompass our imaginations of place. Over the last few decades, new meanings in Ballard have been drawn from the built environment. An old railroad track, since converted into a bike path, allows close-up views of storage lots, dry docks and shipyards still lining the ferryway at Ballard’s south edge. Hardware stores and auto repair shops remain clustered along an early bridge and what used to be the city’s first major highway. Nearby, along Market Street and Ballard Avenue, a parallel world of leisure has sprung up celebrating craft processes of work. This is a world of artisan beer, gluten-free pizza, organic coffee, vintage clothing, designer furniture, and one of the city’s finest year-round farmer’s markets. In the past, a noodle shop, a tapas bar, and a Mexican food cart might all have been out of place, but today, they all hang in the balance. As a widening array of consumer spaces channels urban trajectories into the future, contemporary landscapes and lifestyles are retrofitted to traces of the past. The functional and aesthetic components of cities are affected by scales far outside the neighborhood. But as Ballard’s rapidly changing housing market attests, people resituate themselves and the places around them by winnowing out distances and connections between self and other. Condo owners, young couples, single adults, students, senior citizens, and the homeless scramble, revise and recompile landscapes in dynamic and uneven ways. Since his untimely death, Bataille has become very famous. Now, according to Jürgen Habermas, this former librarian at the Bibliothèque Nationale, editor of Critique, author of covertly circulated erotic books and other works that did not sell well, stands first in a line of French intellectuals leading from “Bataille via Michel Foucault to Jacques Derrida” [Habermas 14]. 1 Bataille’s remains are located in the posthumanist pantheon: his work is joined to the giants of the French philosophical, psychoanalytic, and literary heritage, including Jean-Paul Sartre, Jacques Lacan, and Maurice Blanchot; he has been the subject of countless literary exegeses and even of a prizewinning biography [see Surya]. Bataille no longer has the merit of being unknown.But who is the Bataille we pretend to know? He is the one with whom many critics identify, yet his work is necessarily misunderstood, sometimes (but not always) in the interests of preserving its insights. Critical work on Bataille naturally emphasizes his theory of dépense (expenditure), his mysticism, his attraction to the sacrificial, sadomasochistic erotics of fascist politics, and tends, viscerally if implicitly, to identify with Bataille’s refusal to be hard in the conventional sense—his repudiation of impermeable, phallic masculinity and its association with moral resolve. In 1945, Bataille wrote that he was the “contrary of him who tranquilly watches the dismasted vessels from the shore, because in fact... I cannot imagine anyone so cruel that he could notice the one who is dismasted with such carefree laughter. Sinking is something altogether different, one can have it to one’s heart’s content...” [OC 6:358]. In 1966, a sensitive critic wrote: “Bataille’s cogito, thus, reads: ‘I sink therefore I am’” [Hollier 138]. In other words, Bataille was no proponent of a sink-or-swim philosophy, but of “the hard desire to endure”—words he wrote to describe Vincent Van Gogh, whose self-mutilation was, from Bataille’s perspective, the necessary precondition of his art. This hard desire is paradoxically the hard labor of unbinding the self, a project that entails yet moves beyond empathizing with those caught in the storm: Bataille insisted that creation required symbolic castration rather than the phallic virtue of the moral man or the swollen pride of those who volunteer heroically for the rescue mission (“Heroism,” he said, “is an [End Page 3] attitude of flight” [OC 5: 347]). As countless critics have demonstrated, even Bataille’s most relentlessly hard-core texts use sexuality as an allegory for the self-shattering of the phallic body.The sacrificial constitution of the man who would sink—for this Bataille was giddily embraced after his death. By 1990, when Yale French Studies devoted a special issue to him, the embrace was equally enthusiastic, but giddiness had given way to some defensiveness. Those theorists who did not admire Bataille equated his repudiation of phallic virtue with the ego-dissolving sublimity of fascism. After all, some of his friends and intellectual heirs had been subjected to public scrutiny for their anti-Semitic, often fascist sympathies. Implicitly defending Bataille, the editor of that special issue insisted on Bataille’s “ethics” of sacrifice. He claimed that Bataille held “onto the possibility of an ethics” through a paradoxically “incessant repositing of the ethical” [Stoekl 2, 5]. Moral injury occurs when a person perpetrates, bears witness to, or fails to prevent an act that transgresses their deeply held moral beliefs. The deeply held moral belief that physicians share is the oath they take when completing their lengthy training and embarking on their career: Put the needs of patients first. In today's American healthcare system, doctors, nurses, and other healthcare providers are increasingly forced to consider the demands of other stakeholders -- insurers, hospitals, even their own financial security (...) -- before the needs of their patients. Whenever they are forced to make a decision that contravenes their patient's best interest, they feel a sting of moral injustice. Over time, these repetitive insults amass into moral injury. Moral injury and its causes help explain why healthcare workers started leaving the field in droves long before the COVID-19 pandemic exposed weaknesses in the US system, why a rich country has such poor outcomes in certain categories, why there is a shortage of young doctors training for critical areas, and why patients feel so frustrated. In If I Betray These Words, Wendy Dean explores and exposes the impacts of moral injury through vividly told stories that are at once bewildering and eye-opening. Her book serves as a roadmap through a healthcare landscape that can be confounding, and at times even hellish, for those who must navigate it, and it suggest alternative routes for healers and their patients. Editor's Note: We are happy to print the following comment by Leonard Dean as a reminder that the arbitrary, improvisatory nature of practical criticism has its origins in a much more homely and familiar phenomenon. A muddler naturally feels flattered by any kind of praise from the world of theory, as, for example, by Robert Scholes' generous remark that "muddling along, in literary theory as in life, is often more humane and even more efficient than the alternatives offered by (...) political, ethical, or aesthetic systems. We may in fact 'know' more than we can systematize about certain kinds of human behavior, so that our intuitions may indeed be superior to our more reasoned positions" . For a moment praise like that makes a muddler feel the way the ghost of Shakespeare must have felt when he was called a natural genius in the days of the Rules, but then you remember how it really was and is. Like Shakespeare and the New Dealers we patched things together under pressure, and like them we borrowed from anybody. New critical methods were a godsend for anyone who was trying to revive an old survey course into a discussion of literature, and equally useful were old critical methods like those used by Dr. Johnson for the job of general public education. Oxford Studies in Metaphysics is the forum for the best new work in this flourishing field. Much of the most interesting work in philosophy today is metaphysical in character: this series is a much-needed focus for it.

In this mixed methods study we identify and assess ethical and pragmatic issues and dilemmas surrounding e-health technologies in the context of primary care, including what is already in the literature. We describe how primary healthcare professionals can access reliable and accurate data, improve the quality of care for patients, and lower costs while following institutional guidelines to protect patients. Using qualitative and quantitative methodologies we identify several underlying ethical and pragmatic burdens and benefits of e-health technologies. The 41 study (...) participants reported more burdens than benefits, and were generally ambivalent about their level of satisfaction with their institutions’ ehealth technologies, their general knowledge about the technologies, and whether e-health can improve team-based communication and collaboration. Participants provided recommendations to improve e-health technologies in primary care settings. (shrink)
