. A new approach to the formalization of concepts used in legal reasoning such as obligation and cause is presented. The formalization is based on the linguistic use of the concepts both in legal language and in ordinary language, and has been motivated by work on a legal expert system with a natural language interface. Particularly for the concept of obligation this yields quite different results from those obtained by the usual approach of deontic logic: So‐called paradoxes are avoided, quantification (...) over obligations becomes possible, no restriction to a “single‐agent system” is required, and collisions of obligations can be formulated. My purpose here is to describe a type of argument characterized by the fact that one of its premises is a directive—i.e. what is expressed by a directive sentence: a general instruction how to proceed or act. This directive premise brings an ostensive mechanism for the inclusion of visual or multimodal elements in an argument. If an argument is an invitation to inference, by using such a directive utterance the addresser is inviting the addressee to make an inference from an (...) image, not from a proposition. La concepción predominante de la argumentación sigue privilegiando la dimensión representacional del lenguaje y, en consecuencia, ignora o infravalora las funciones compromisorias, directivas o expresivas de la argumentación. En este artículo examino los usos de la argumentación en la esfera pública -con especial atención a la deliberación y a la negociación- para poner de manifiesto y reivindicar la importancia de las funciones no persuasivas de la argumentación, entre las que se destaca la construcción y moldeado de identidades sociales.

References to Popper’s concept of three worlds occupy a central position in ontological and human ecological questions in the recent literature on theoretical geography. This article demonstrates that Popper’s ideas and concepts have not been fully understood, causing problems for integrative research. Firstly, we critically review the discussion of Popper’s concept of three worlds in geography. We criticize its popular ontological interpretation, and furthermore we point out that Popper’s evolutionary basis has been consistently neglected. Subsequently we present an interpretation of (...) Popper’s concept of three worlds which seems most plausible. We thereby identify his intentions and emphasize the evolutionary foundation of our interpretation of his theory. Finally, perspectives for human ecological research in geography on the basis of theories of evolution and emergence will be outlined. (shrink)

It can be challenging to introduce the philosophy of social science (PoS) to students in the social sciences. Noting the lack of literature providing guidance to the prospective PoS teacher, this paper outlines several pieces of advice on how to engage social science undergraduates in the subject. This advice centres on showing the relevance of the PoS in academia and beyond, reducing complexity and presenting only a few contending PoS perspectives. It is also proposed to use textbooks with caution or (...) avoiding them altogether, illustrating how PoS assumptions are embedded in contemporary social research and showing the connection between the PoS on one hand and research questions, methods, and theory on the other. Finally, the importance of showing students how they can make use of the PoS in their own work and teaching the subject in a ‘hands on’ manner is emphasized. (shrink)

Phronesis is often described as a ‘practical wisdom’ adapted to the matters of everyday human life. Phronesis enables one to judge what is at stake in a situation and what means are required to bring about a good outcome. In medicine, phronesis tends to be called upon to deal with ethical issues and to offer a critique of clinical practice as a straightforward instrumental application of scientific knowledge. There is, however, a paucity of empirical studies of phronesis, including in medicine. (...) Using a hermeneutic and phenomenological approach, this inquiry explores how phronesis is manifest in the stories of clinical practice of eleven exemplary physicians. The findings highlight five overarching themes: ethos (or character) of the physician, clinical habitus revealed in physician know-how, encountering the patient with attentiveness, modes of reasoning amidst complexity, and embodied perceptions (such as intuitions or gut feeling). The findings open a discussion about the contingent nature of clinical situations, a hermeneutic mode of clinical thinking, tacit dimensions of being and doing in clinical practice, the centrality of caring relations with patients, and the elusive quality of some aspects of practice. This study deepens understandings of the nature of phronesis within clinical settings and proposes ‘Clinical phronesis’ as a descriptor for its appearance and role in the daily practice of (exemplary) physicians. What does it entail to study the climate crisis from – or consistently with – a critical realist perspective? The paper addresses this question in three steps. First, it considers the boundaries of critical realism in relation to climate crisis research. In this context it identifies climate science as a field that in important respects resonates implicitly with critical realism. Conversely, a book by human ecologist Andreas Malm is introduced as an example of a work that, while sympathetic to critical (...) realism, in key respects contradicts core features of it. Second, to illustrate what an analysis of the crisis informed by critical realism can look like, the paper brings into focus the main causes of the climate crisis – including the capitalist growth imperative, neoliberalism, and consumer culture. Finally, the status quo project, the green growth project and the degrowth project are identified as fundamentally different ways of approaching the climate crisis. (shrink)

In their paper "How Fundamental Physics represents Causality", Andreas Bartels and Daniel Wohlfarth maintain that there is place for causality in General Relativity. Their argument contains two steps: First they show that there are time-asymmetric models in General Relativity, then they claim to derive that two events are causally connected if and only if there is a time-asymmetric energy flow from one event to the other. In our comment we first give a short summary of their paper followed by a (...) section introducing and pondering different conceptions of causation since Bartels and Wohlfarth don’t explicitly declare which notion of causation they build on in the paper. In order to analyze their argument in detail we formalize their crucial step in logical terms. This helps to pose the question whether their proposed derivation is not just a definition in a more precise way. (shrink)

After a year at Brandeis I was hired by MIT, and then I realized for the first time that there was a struggle and that I was on the losing end of it. The people there, particularly Judith Thomson, who is still at MIT, called Continental philosophy “stone-age philosophy,” and wouldn’t let me teach in the graduate program at all, because they thought that it would just corrupt the students and waste their time. I did feel a little unhappy because (...) I wasn’t allowed to teach graduate students, but not very, because I had never taught graduate students, so I didn’t think I had to, and I was still feeling grateful that I could teach philosophy anywhere at all. For fifty years Hubert Dreyfus has done pioneering work which brings phenomenology and existentialism to bear on the philosophical and scientific study of the mind. This is a selection of his most influential essays, developing his critique of the representational model of the mind in analytical philosophy of mind and mainstream cognitive science.

The article discusses the connection between theory formation and historical research in the study of religion. It presupposes that the study of religion is conceived of as an empirical discipline. The empirical basis of theories is provided primarily by historical research, including research in the very recent past, that is, the present time. Research in the history of religions, therefore, is an indispensable part of the study of religion. However, in recent discussions on the methods, aims, and theoretical presuppositions of (...) the discipline, research in the history of religions largely is ignored. To shed some light on this blind spot, the article builds on the philosophy of science of Critical Realism. While the first part deals with the role of historical research in theoretical discourses of the discipline, the second part explains fundamental ontological and epistemological positions of Critical Realism and their implications for empirical research. On this basis, some methodological problems of theory formation in the study of religion are discussed in the third part. In particular, it is argued that it is impossible to validate empirically theories of religion that aim to explain what religion is. The concluding part sketches ways of theory formation in the study of religion that does not take religion as the explanandum but as the theoretical perspective that guides research. (shrink)

Human intuition and perception are basic and essential phenomena of consciousness. As such, they will never be replicated by computers. This is the challenging notion of Hubert Dreyfus, Ph. D., archcritic of the artificial intelligence establishment. It's important to emphasize that he doesn't believe that AI is fundamentally impossible, only that the current research program is fatally flawed. Instead, he argues that to get a device (or devices) with human-like intelligence would require them to have a human-like being in (...) the world, which would require them to have bodies more or less like ours, and social acculturation (i.e. a society) more or less like ours. This helps to explain the practical problems in implementing artificial intelligence algorithms. (shrink)

This book is the first to provide a sustained, coherent analysis of Foucault's work as a whole. To demonstrate the sense in which Foucault's work is beyond structuralism and hermeneutics, the authors unfold a careful, analytical exposition of his oeuvre. They argue that during the of Foucault's work became a sustained and largely successful effort to develop a new method - "interpretative analytics" - capable of explaining both the logic of structuralism's claim to be an objective science and the apparent (...) validity of the hermeneutical counterclaim that the human sciences can proceed only by understanding the deepest meaning of the subject and his tradition. Zusammenfassung Aktuell entstehen zunehmend Studien, die sich dezidiert mit den Lebenswelten ‚muslimischer Jugendlicher‘ auseinandersetzen. Nur wenige dieser Studien folgen einem vergleichenden Forschungsdesign, welches ihre Ergebnisse in einem weiteren Kontext verortet. Der Artikel trägt zur Schließung dieser Forschungslücke bei. Auf der Basis qualitativer Fallanalysen beschäftigt er sich mit den Religionskonstruktionen sunnitischer Jugendlicher, die ihren Lebensmittelpunkt in ländlichen Regionen Österreichs haben und in Moscheegemeinden aktiv sind. Diese Religionskonstruktionen werden mit denen von Jugendlichen verglichen, deren Interviews in protestantischen und römisch-katholischen Kontexten geführt wurden. (...) So können zwei dominante Typen von Religionskonstruktionen unterschieden werden: „Religion im Rahmen von Freizeitaktivitäten“ und „Religion im Rahmen der lokalen Kultur“. Diese Typen finden sich in unterschiedlicher Ausformung in allen Interviews. Die Religionskonstruktionen sind dabei ähnlich, aber unterschiedlich.
