Trial and Error – Failing and Learning in Criminal Proceedings.Kati Hannken-Illjes, Livia Holden, Alexander Kozin & Thomas Scheffer - 2006 - International Journal for the Semiotics of Law - Revue Internationale de Sémiotique Juridique 20 (2):159-190.
This paper addresses the selective mechanisms by which criminal proceedings produce strong arguments. It does so by focusing on the failing of argument themes (topoi) in the course of criminal proceedings, rather than on their career. In a further step, the notion of failing is bound to learning: different forms of failing point at different ways and places of learning. The study is comparative, relating cases from four different legal regimes (England, USA, Italy and Germany) that are taken from four (...)

Few Women on Boards: What’s Identity Got to Do With It?Lívia Markoczy, Sunny Li Sun & Jigao Zhu - 2020 - Journal of Business Ethics 165 (2):311-327.
Drawing on the similarity-attraction perspective and social identity theory, we argue that male versus female interlocking directors are likely to have different experiences when they work alongside female board directors of other firms. The theorized source of such experiences for male interlocking directors is in-group favoritism and/or a social identity threat-related discomfort. Interlocking female directors are theorized to be ambivalent between desiring social support versus experiencing identity threat-based career concerns. These experiences are predicted to motivate male versus female interlocking directors (...)

Hobbes on the function of evaluative speech.Thomas Holden - 2016 - Canadian Journal of Philosophy 46 (1):123-144.
Hobbes’s interpreters have struggled to find a plausible semantics for evaluative language in his writings. I argue that this search is misguided. Hobbes offers neither an account of the reference of evaluative terms nor a theory of the truth-conditions for evaluative statements. Rather, he sees evaluative language simply as having the non-representational function of prescribing actions and practical attitudes, its superficially representational appearance notwithstanding. I marshal the evidence for this prescriptivist reading of Hobbes on evaluative language and show how it (...)

The Possible Relationship Between Law and Ethics in the Context of Artificial Intelligence Regulation.Livia Aulino, Maria Cristina Gaeta & Emiliano Troisi - 2023 - Humana Mente 16 (44).
The latest academic discussion has focused on the potential and risks associated with technological systems. In this perspective, defining a set of legal rules could be the priority but this action appears extremely difficult at the European level and, therefore, in the last years, a set of ethical principles contained in many different documents has been published. The need to develop trustworthy and human-centric AI technologies is accomplished by creating these two types of rule sets: legal and ethical. The paper (...)

New Visions of the Zhuangzi.Livia Kohn (ed.) - 2015 - Three Pines Press.
New Visions of the Zhuangzi is a collection of thirteen essays on the ancient Daoist philosophical work, presenting new angles and approaches. It overcomes the traditional division of schools in favor of topics, sheds new light on key philosophical notions, examines Zhuangzi's use of language, and explores issues of his use of language. In addition, it also applies modern neuroscience to its instructions, explores its vision of the ideal mind, and connects Zhuangzi's teachings to issues of education and community relevant (...)

The Glass Pyramid: Informal Gender Status Hierarchy on Boards.Lívia Markóczy, Sunny Li Sun & Jigao Zhu - 2019 - Journal of Business Ethics 168 (4):827-845.
Drawing on the status characteristic theory, we investigate the effect of gender on board directors’ status ranking and find that all else being equal, female directors’ status ranking is 81.48% of one position lower than that of male directors, a discrepancy that is attributable to gender. We theorize on the mechanism that determines the ways in which the status value of gender on a board affects board interactions, and we predict how this mechanism influences firm outcomes, including excessive managerial spending, (...)

Modernity has imposed on many of us, and perhaps especially on academics, a habit of silence with regard to what John Rawls called deeply held ‘comprehensive’ moral beliefs. According to Rawls and his many disciples, the survival of liberalism depends upon the bracketing of comprehensive beliefs whenever we step into the public sphere. And in the field of higher education, that would have to include the classroom, the lab, the library carrel, the hotel conference suites where we confer and exchange (...)

Digital Trust and Cooperation with an Integrative Digital Social Contract.Livia Levine - 2019 - Journal of Business Ethics 160 (2):393-407.
I argue for the role of trust and cooperation as part of the foundation of digital commerce by expanding the reach of the Integrative Social Contract Theory of Donaldson and Dunfee. I propose that a digital business community can be a community in the morally relevant ways that Donaldson and Dunfee describe, and that the basic framework of ISCT can apply to the digital business world similarly to its application in the offline business world. I then analyze the roles of (...)

This paper presents some reflections about an approach in work psychology: the Activity Clinic. After a brief introduction to the conceptual background of the “Activity Clinic”, it covers three deeply interconnected themes. The first concerns the meaning attributed to the development of the affects present in the work situation under analysis; the second discusses the reasons for the conflicts that are ultimately due to these affects; the third considers how a method of co-analysis of the activity can lead towards transformation (...)

    She’-E-O Compensation Gap: A Role Congruity View.Joyce C. Wang, Lívia Markóczy, Sunny Li Sun & Mike W. Peng - 2019 - Journal of Business Ethics 159 (3):745-760.
Is there a compensation gap between female CEOs and male CEOs? If so, are there mechanisms to mitigate the compensation gap? Extending role congruity theory, we argue that the perception mismatch between the female gender role and the leadership role may lead to lower compensation to female CEOs, resulting in a gender compensation gap. Nevertheless, the compensation gap may be narrowed if female CEOs display agentic traits through risk-taking, or alternatively, work in female-dominated industries where communal traits are valued. Additionally, (...)

Can Authorship be Denied for Contract Work?Livia Puljak & Dario Sambunjak - 2020 - Science and Engineering Ethics 26 (2):1031-1037.
Ethical considerations arise when individuals who were contracted and paid to conduct a research study and write it up for publication, are denied authorship on a scholarly publication on the grounds that their work was contracted and paid for. Each of the various stakeholders should be considered. Researchers need to make sure that the contract recognizes their intellectual contribution and their right to be named as authors if and when the contracted study is published. If authorship disputes of published works (...)

Early Chinese Mysticism: Philosophy and Soteriology in the Taoist Tradition.Livia Kohn & PhD Associate Professor of Religion Livia Kohn - 1992 - Princeton University Press.
Did Chinese mysticism vanish after its first appearance in ancient Taoist philosophy, to surface only after a thousand years had passed, when the Chinese had adapted Buddhism to their own culture? This first integrated survey of the mystical dimension of Taoism disputes the commonly accepted idea of such a hiatus. Covering the period from the Daode jing to the end of the Tang, Livia Kohn reveals an often misunderstood Chinese mystical tradition that continued through the ages. Influenced by but (...)

In this article we argue that discourse structure constrains the set ofpossible constituents in a discourse that can provide the relevantcontext for structuring information in a target sentence, whileinformation structure critically constrains discourse structureambiguity. For the speaker, the discourse structure provides a set of possible contexts for continuation while information structure assignment is independent of discourse structure. For the hearer, the information structure of a sentence together with discourse structure instructs dynamic semantics how rhematic information should be used to update (...)

In this reproduction of his original publication of 1649, Rene Descartes discusses how seekers of knowledge can best attain true insight of the world around them. Often referred to as simply the Discourse on the Method, this work is frequently cited as one of the most important to appear during the Enlightenment era. It discusses the ideal means through which those in search of knowledge can approach the world, and the practice of science, as a means of attaining true and (...)

Contrary to a popular reading of his modal epistemology, Berkeley does not hold that inconceivability entails impossibility, and he cannot therefore argue the impossibility of mind-independent matter by appealing to facts about what we cannot conceive. Berkeley is explicit about this constraint on his metaphysical argumentation, and, I argue, does respect it in practice. Popular mythology about the ‘master argument’ notwithstanding, the only passages in which he might plausibly seem to employ the principle that inconceivability entails impossibility are those that (...)

Based on the results of family and twin studies, the estimated heritability of ADHD approximates 80%, suggests a significant genetic component in the etiological background of the disorder; however, the potential genetic effects on disease risk, symptom severity, and persistence are unclear. Thomas Holden presents a fascinating study of theories of matter in the seventeenth and eighteenth centuries. These theories were plagued by a complex of interrelated problems concerning matter's divisibility, composition, and internal architecture. Is any material body infinitely divisible? Must we posit atoms or elemental minima from which bodies are ultimately composed? Are the parts of material bodies themselves material concreta? Or are they merely potentialities or possible existents? Questions such as these -- and the press of subtler questions (...)
