This paper addresses the selective mechanisms by which criminal proceedings produce strong arguments. It does so by focusing on the failing of argument themes (topoi) in the course of criminal proceedings, rather than on their career. In a further step, the notion of failing is bound to learning: different forms of failing point at different ways and places of learning. The study is comparative, relating cases from four different legal regimes (England, USA, Italy and Germany) that are taken from four (...) extensive ethnographic studies in defense lawyer’s firms. We will track down the failures of topoi at three different stages (pre-trial, trial, and deliberation) in our different legal regimes. Failing occurs in all proceedings in various modes and at different stages. We argue that those modes as well as the different stages at which they occur point at the spots in the respective procedures that allow for learning about the inherent conceptions of “good reasons.”. Drawing on the similarity-attraction perspective and social identity theory, we argue that male versus female interlocking directors are likely to have different experiences when they work alongside female board directors of other firms. The theorized source of such experiences for male interlocking directors is in-group favoritism and/or a social identity threat-related discomfort. Interlocking female directors are theorized to be ambivalent between desiring social support versus experiencing identity threat-based career concerns. These experiences are predicted to motivate male versus female interlocking directors (...) in different ways to reduce or, conversely, to potentially facilitate female representation on focal boards. We additionally predict that economic crisis reduces the biases of male directors against appointing female directors to boards. We test our hypotheses based on a novel data set that includes 25,460 directors in Chinese A-share public companies with a sample of 27,058 firm-quarter observations for 1635 firms between 2006 and 2010 and find most of our hypotheses supported. Hobbes’s interpreters have struggled to find a plausible semantics for evaluative language in his writings. I argue that this search is misguided. Hobbes offers neither an account of the reference of evaluative terms nor a theory of the truth-conditions for evaluative statements. Rather, he sees evaluative language simply as having the non-representational function of prescribing actions and practical attitudes, its superficially representational appearance notwithstanding. I marshal the evidence for this prescriptivist reading of Hobbes on evaluative language and show how it (...) sidesteps various textual and philosophical problems that bedevil the traditional interpretations. The latest academic discussion has focused on the potential and risks associated with technological systems. In this perspective, defining a set of legal rules could be the priority but this action appears extremely difficult at the European level and, therefore, in the last years, a set of ethical principles contained in many different documents has been published. The need to develop trustworthy and human-centric AI technologies is accomplished by creating these two types of rule sets: legal and ethical. The paper (...) aims to critically analyse and compare these rule sets in order to understand their possible relationships in the regulation of legal problems, not only theoretically but also, where present, in some practical applications of AI, such as self-driving cars, smart toys, smart contracts and legal design. Indeed, the purpose is to identify how legal rules and ethical principles can interact for adequate regulation of AI, with particular regard to the fields of application that will be analysed. Drawing on the status characteristic theory, we investigate the effect of gender on board directors’ status ranking and find that all else being equal, female directors’ status ranking is 81.48% of one position lower than that of male directors, a discrepancy that is attributable to gender. We theorize on the mechanism that determines the ways in which the status value of gender on a board affects board interactions, and we predict how this mechanism influences firm outcomes, including excessive managerial spending, (...) social responsibility performance, and firm risk. We test our hypotheses in Chinese firms using an unbalanced panel that includes 5396 firm-year observations for a period of 6 years and find them supported. (shrink)

Modernity has imposed on many of us, and perhaps especially on academics, a habit of silence with regard to what John Rawls called deeply held ‘comprehensive’ moral beliefs. According to Rawls and his many disciples, the survival of liberalism depends upon the bracketing of comprehensive beliefs whenever we step into the public sphere. And in the field of higher education, that would have to include the classroom, the lab, the library carrel, the hotel conference suites where we confer and exchange (...) ideas, as well as the vast academic publishing apparatus. I would like to call attention to the way that the supposed requirement of the Rawlsian silence is being challenged, not just by conservative critics but even by such a staunch defender of conventional liberalism as Jürgen Habermas. Second, if Habermas and the other critics are right, then a fortiori, the public university—perhaps the most representative and exemplary of all the institutions of civil society—ought to welcome the infusion of relevant but closely held beliefs, including religious ones, in carrying out its research and teaching responsibilities. I argue for the role of trust and cooperation as part of the foundation of digital commerce by expanding the reach of the Integrative Social Contract Theory of Donaldson and Dunfee. I propose that a digital business community can be a community in the morally relevant ways that Donaldson and Dunfee describe, and that the basic framework of ISCT can apply to the digital business world similarly to its application in the offline business world. I then analyze the roles of (...) trust and cooperation in e-commerce, showing how they are important to the digital business community and explaining their moral relevance under a digital form of ISCT. I use the ISCT framework to show that trust and cooperation are an instantiation of the hypernorm of necessary social efficiency, and that authentic microsocial norms developed for the ends of trust and cooperation carry moral responsibility. Neste artigo, investigamos práticas de citação de literatura científica na escrita reflexiva do gênero relatório de estágio supervisionado, produzido por professores em formação, em disciplinas de estágio obrigatório em Ensino de Língua Inglesa numa Licenciatura em Letras. Analisaremos, especificamente, como esses professores se representam a partir de citações de literatura científica, e caracterizaremos algumas funções exercidas pelas citações na escrita reflexiva emergente na esfera acadêmica. Utilizamos a abordagem dialógica da linguagem dos estudos bakhtinianos como referencial teórico de base, além de (...) aportes teórico-metodológicos acerca de tipos de sequência e de discurso propostos por Adam e Bronckart. Os resultados da pesquisa mostram que a prática de citação da literatura científica é uma invocação de autoridade com função de erudição, amplificação e ornamentação do discurso produzido, podendo orientar a ação pedagógica desenvolvida pelo professor em formação no estágio supervisionado.In this paper we investigate citation practices of scientific literature in reflexive writing from the genre of supervised pre-service training report produced by pre-service teachers enrolled in the mandatory pre-service training subject of English Language Teaching, at an undergraduate language teaching course. The aim of this research is to analyze how these pre-services teacher represent themselves based on citation practices of scientific literature, and characterize some of the functions deployed by the citations in the reflexive writing emerging in the academic sphere. We use the dialogic approach to language from Bakhtinian studies as a theoretical base, as well as theoretical and methodological contributions regarding types of sequences and of discourse proposed by Adam and Bronckart. The results of this research show that the practice of citation of scientific literature is an invocation of authority as a form of erudition, amplification and ornamentation of the discourse produced. This practice can also guide pedagogical action developed by pre-service teachers in their supervised training. (shrink)

This paper presents some reflections about an approach in work psychology: the Activity Clinic. After a brief introduction to the conceptual background of the “Activity Clinic”, it covers three deeply interconnected themes. The first concerns the meaning attributed to the development of the affects present in the work situation under analysis; the second discusses the reasons for the conflicts that are ultimately due to these affects; the third considers how a method of co-analysis of the activity can lead towards transformation (...) of those conflicts. Our reflections refer to the process engendered by this methodological approach as one of “transferential activity”. The paper explains this process by empirically describing the “transport” of affects involved in the conflicts. The personal interpretation of the cause of problems gives way to the understanding that they are due to organizational dysfunction rather than to individual personalities. Measures can then be taken to break the deadlocks experienced both at the personal and collective level. (shrink)

Is there a compensation gap between female CEOs and male CEOs? If so, are there mechanisms to mitigate the compensation gap? Extending role congruity theory, we argue that the perception mismatch between the female gender role and the leadership role may lead to lower compensation to female CEOs, resulting in a gender compensation gap. Nevertheless, the compensation gap may be narrowed if female CEOs display agentic traits through risk-taking, or alternatively, work in female-dominated industries where communal traits are valued. Additionally, (...) we expect that female CEOs’ risk-taking is less effective in reducing the gender compensation gap in female-dominated industries due to the conflicting emphases on agentic and communal traits. Leveraging a sample of Chinese publicly listed firms, we find support for our hypotheses. Overall, this study contributes to the ethics literature on income inequality issues, by highlighting the effectiveness of potential mechanisms to close the gender compensation gap between female and male CEOs. Ethical considerations arise when individuals who were contracted and paid to conduct a research study and write it up for publication, are denied authorship on a scholarly publication on the grounds that their work was contracted and paid for. Each of the various stakeholders should be considered. Researchers need to make sure that the contract recognizes their intellectual contribution and their right to be named as authors if and when the contracted study is published. If authorship disputes of published works (...) arise, journal editors should have mechanisms in place for addressing such disputes. They should be able to see the contract and have all disputing parties agree to any changes in authorship. If the dispute cannot be resolved, the manuscript should be retracted. Contractors should develop a publication plan and include in the contract stipulations ensuring transparent and unambiguous authorship on any publication ensuing from contracted work. The International Committee of Medical Journal Editors and the Committee for Publication Ethics should update their guidance for authors to include advice regarding researchers involved in contracted work and how to resolve an authorship disputes around it. Did Chinese mysticism vanish after its first appearance in ancient Taoist philosophy, to surface only after a thousand years had passed, when the Chinese had adapted Buddhism to their own culture? This first integrated survey of the mystical dimension of Taoism disputes the commonly accepted idea of such a hiatus. Covering the period from the Daode jing to the end of the Tang, Livia Kohn reveals an often misunderstood Chinese mystical tradition that continued through the ages. Influenced by but (...) ultimately independent of Buddhism, it took forms more various than the quietistic withdrawal of Laozi or the sudden enlightenment of the Chan Buddhists. On the basis of a new theoretical evaluation of mysticism, this study analyzes the relationship between philosophical and religious Taoism and between Buddhism and the native Chinese tradition. Kohn shows how the quietistic and socially oriented Daode jing was combined with the ecstatic and individualistic mysticism of the Zhuangzi, with immortality beliefs and practices, and with Buddhist insight meditation, mind analysis, and doctrines of karma and retribution. She goes on to demonstrate that Chinese mysticism, a complex synthesis by the late Six Dynasties, reached its zenith in the Tang, laying the foundations for later developments in the Song traditions of Inner Alchemy, Chan Buddhism, and Neo-Confucianism. Este artigo tem como objetivo discutir a experimentação política da amizade a partir da teoria dos afetos de Baruch Espinosa: o corpo é essencialmente relacional e é na relação com seus outros, na maneira como afeta e é afetado por elesque se dá a condição de possibilidade da resistência à tristeza e afirmação da alegria – compreendida como aumento da potência de pensar e agir. Neles, atenta-se ao modo como a literatura está intimamente relacionada à problemática da voz e do ordenamento das enunciações e dos corpos no pensamento político do autor, configurando assim uma política / polícia da literatura, conforme a distinção feita por Jacques Rancière.

For the speaker, the discourse structure provides a set of possible contexts for continuation while information structure assignment is independent of discourse structure. In this reproduction of his original publication of 1649, Rene Descartes discusses how seekers of knowledge can best attain true insight of the world around them. Often referred to as simply the Discourse on the Method, this work is frequently cited as one of the most important to appear during the Enlightenment era. It discusses the ideal means through which those in search of knowledge can approach the world, and the practice of science, as a means of attaining true and (...) definitive insight. The Discourse on Method is influential chiefly for its role in establishing the scientific method; a technique which scientists have used to make valid discoveries over the centuries. Descartes instructs the reader to doubt everything, and to use this universal doubt as a starting point from which to approach a problem. In addition to matters of science, Descartes reflects upon his own personal, religious beliefs. In addition to his Method, Descartes also explains certain social and personal notions such as obeying the laws and statutes of his country and prioritizing self-advancement over the achievement of material wealth or fortune. Famous for including the much-quoted phrase "Je pense, donc je suis" - "I think, therefore I am" - the Discourse on Method today stands as a crucial cornerstone of countless educational courses on philosophy. Contrary to a popular reading of his modal epistemology, Berkeley does not hold that inconceivability entails impossibility, and he cannot therefore argue the impossibility of mind-independent matter by appealing to facts about what we cannot conceive. Berkeley is explicit about this constraint on his metaphysical argumentation, and, I argue, does respect it in practice. Popular mythology about the ‘master argument’ notwithstanding, the only passages in which he might plausibly seem to employ the principle that inconceivability entails impossibility are those that (...) argue for the inseparability of primary from secondary qualities. However, an alternative reading of these texts is available that is both consistent with Berkeley's express modal epistemology and credible in its own right. (shrink)

In a series of presentations at Sainte-Anne Hospital, published in English under the title _Talking to Brick Walls_, Lacan offers one of the few explicit references to Bataille in his _œuvre_. He interposes a stark disagreement between himself and Bataille on the status of possible knowledge regarding ontological questions. Lacan reads Bataille as a mystic who proposes that the pursuit of knowledge is a futile task and that knowledge of being is _only _possible _per viam negativam_. In order to advance (...) this reading, Lacan emphasises Bataille’s fixation with “nonknowledge.” At first glance, one can understand why Lacan identifies him as a mystic, and many commentators on Bataille’s writings offer similar reading; however, this ignores subtle nuances of Bataille’s arguments regarding what he calls “inner experience.” More crucially, it ignores his explicit rejection of mysticism on the very basis of the knowledge that results from nonknowledge. This comparison frames a problem for fundamental ontology, of which I hope to elaborate only one aspect: The incompleteness of thought implies a non-relation between thought and being, and we can have a knowledge about this non-relation through an analysis of the limit as phantasmatic and structural rather than as real. Attention-deficit/hyperactivity disorder is a neurodevelopmental disorder with a childhood prevalence of 5%. In about two-thirds of the cases, ADHD symptoms persist into adulthood and often cause significant functional impairment. Based on the results of family and twin studies, the estimated heritability of ADHD approximates 80%, suggests a significant genetic component in the etiological background of the disorder; however, the potential genetic effects on disease risk, symptom severity, and persistence are unclear. This article provides a brief review of the genome-wide and (...) candidate gene association studies with a focus on the clinical aspects, summarizing findings of ADHD disease risk, ADHD core symptoms as dimensional traits, and other traits frequently associated with ADHD, which may contribute to the susceptibility to other comorbid psychiatric disorders. Furthermore, neuropsychological impairment and measures from neuroimaging and electrophysiological paradigms, emerging as potential biomarkers, also provide a prominent target for molecular genetic studies, since they lie in the pathway from genes to behavior; therefore, they can contribute to the understanding of the underlying neurobiological mechanisms and the interindividual heterogeneity of clinical symptoms. Beyond the aforementioned aspects, throughout the review, we also give a brief summary of the genetic results, including polygenic risk scores that can potentially predict individual response to different treatment options and may offer a possibility for personalized treatment for the therapy of ADHD in the future. Thomas Holden presents a fascinating study of theories of matter in the seventeenth and eighteenth centuries. These theories were plagued by a complex of interrelated problems concerning matter's divisibility, composition, and internal architecture. Is any material body infinitely divisible? Must we posit atoms or elemental minima from which bodies are ultimately composed? Are the parts of material bodies themselves material concreta? Or are they merely potentialities or possible existents? Questions such as these -- and the press of subtler questions (...) hidden in their amibiguities -- deeply unsettled philosophers of the early modern period. They seemed to expose serious paradoxes in the new world view pioneered by Galileo, Descartes, and Newton. The new science's account of a fundamentally geometrical Creation, mathematicizable and intelligible to the human inquirer, seemed to be under threat. This was a great scandal, and the philosophers of the period accordingly made various attempts to disarm the paradoxes. All the great figures address the issue: most famously Leibniz and Kant, but also Galileo, Hobbes, Newton, Hume, and Reid, in addition to a crowd of lesser figures. Thomas Holden offers a brilliant synthesis of these discussions and presents his own overarching interpretation of the controversy, locating the underlying problem in the tension between the early moderns' account of material parts on the one hand and the program of the geometrization of nature on the other.
