Using ideas from evolution and postformal stages of hierarchical complexity, a hypothetical scenario, premised on genetic engineering advances, portrays the development of a new humanoid species, Superions. How would Superions impact and treat current humans? If the Superion scenario came to pass, it would be the ultimate genocidal terrorism of eliminating an entire species, Homo Sapiens. We speculate about defenses Homo Sapiens might mount. The tasks to relate two species (systems) constitutes a postformal, Metasystematic task. In the 1970s and 1980s, Simon Blackburn published a number of much-discussed works in which he argued that the supervenience of the moral on the natural generates a serious problem for moral realism, a problem which his own brand of moral projectivism can avoid. As we will see below, Blackburn construed moral supervenience in terms of what is known as weak supervenience. Partly in response to Blackburn, a number of philosophers have argued that weak supervenience is too weak to capture (...) the intuitive sense in which the moral supervenes on the natural. Instead, it is argued, we should opt for strong supervenience, and, further, that strong supervenience completely disables Blackburn's argument against moral realism. This idea – that strong supervenience undermines Blackburn's argument – is very common in recent metaethics, and the purpose of the present paper is to develop a challenge to this near-orthodoxy. Widowhood is common in old age, can be accompanied by serious health consequences and is often linked to substantial changes in social network. Little is known about the impact of social isolation on the development of depressive symptoms over time taking widowhood into account. We provide results from the follow-up 5 to follow-up 9 from the longitudinal study AgeCoDe and its follow-up study AgeQualiDe. Depression was measured with GDS-15 and social isolation was assessed using the Lubben Social Network Scale (LSNS-6). (...) The group was aligned of married and widowed people in old age and education through entropy balancing. Linear mixed models were used to examine the frequency of occurrence of depressive symptoms for widowed and married elderly people depending on the risk of social isolation. Our study shows that widowhood alone does not lead to an increased occurrence of depressive symptoms. However, "widowed oldest old", who are also at risk of social isolation, have significantly more depressive symptoms than those without risk. In the group of "married oldest old", women have significantly more depressive symptoms than men, but isolated and non-isolated do not differ. Especially for people who have lost a spouse, the social network changes significantly and increases the risk for social isolation. This represents a risk factor for the occurrence of depressive symptoms. (shrink)

Pursuant to the aims and scope of the Special Issue it is part of, this invited contribution seeks to shed new light on the nature and working logic of legal reasoning. It does so by engaging with two of the most authoritative views on the subject which have recently been put forward in the Common law world—namely, Lord Hoffmann’s, and Larry Alexander and Emily Sherwin’s. A key-concern of the Anglophone debate on legal reasoning is whether it is a specialistic (...) type of reasoning requiring ad hoc education and training, or ordinary reasoning subject to ordinary rules of language (i.e. sentence construction, interpretation, etc.). The article argues that compelling though they are, these sorts of enquiries do not help to understand what legal reasoning really is and how it operates. In particular, it argues that if we are to understand what legal reasoning is and how it works, we ought to examine the propositions it aims to craft and support. In so arguing, the article further shows that exploring law’s nature and operations as an intellectual means for social ordering also helps to understand how law works as a regulatory phenomenon more generally. In chapter 8 of Miller 2003, I argued against the idea that Jackson and Pettit's notion of program explanation might help Sturgeon's non-reductive naturalist version of moral realism respond to the explanatory challenge posed by Harman. In a recent paper in the AJP[Nelson 2006, Mark Nelson has attempted to defend the idea that program explanation might prove useful to Sturgeon in replying to Harman. In this note, I suggest that Nelson's argument fails.

In chapter 3 of Wittgenstein on Rules and Private Language, Kripke’s Wittgenstein offers a “sceptical solution" to the sceptical paradox about meaning developed in chapter 2 (according to which there are no facts in virtue of which ascriptions of meaning such as “Jones means addition by ‘+’” can be true). Although many commentators have taken the sceptical solution to be broadly analogous to non-factualist theories in other domains, such as non-cognitivism or expressivism in metaethics, the nature of the sceptical solution (...) has not been well-understood. The main aim of this paper is to advance our understanding of the nature of the non-factualism about meaning proposed in the sceptical solution. It attempts to outline some desiderata that should be respected by interpretations of the sceptical solution and considers two objections raised against it in Barry Stroud’s paper “Wittgenstein on Meaning, Understanding and Community". It attempts to correct misconstruals of the sceptical solution that have been promulgated by Davidson and some of his followers and suggests that the sceptical solution developed by Kripke’s Wittgenstein is best viewed as a form of quasi-realism about meaning. It ends by outlining what it takes to be the most pressing challenges facing the sceptical solution. (shrink)

An overview of the concept of Strong Emergence, and a summary of the papers within the special issue.

Training of resident physicians is essential for the care of future patients. While surgical trainee involvement is necessary, its disclosure to patients can often be omitted or underplayed by surgeons. The informed consent process and the underlying ethical principles make evident that patients should be informed of trainee involvement. In this review we explore the importance of disclosure, current themes in practice, and the optimal discussion for which we should strive.

I consider the well known “manifestation challenge” to semantic realism propounded by Michael Dummett, and further developed by Crispin Wright and Bob Hale. I distinguish between strong and weak versions of the challenge, and show that anti–realists effectively concede that realism can meet the strong version. I then argue that the weak version is unmotivated. Building on work by John McDowell and Peter Strawson, and responding to criticisms from Wright, I argue further that the semantic realist can meet even the (...) weak version. It emerges, inter alia, that there are some serious ambiguities in the standard anti–realist characterisations of semantic realism. (shrink)

In his book Wittgenstein on Rules and Private Language, Saul Kripke develops a famous argument that purports to show that there are no facts about what we mean by the expressions of our language: ascriptions of meaning, such as “Jones means addition by ‘+’” or “ Smith means green by ‘green’”, are according to Kripke’s Wittgenstein neither true nor false. Kripke’s Wittgenstein thus argues for a form of non- factualism about ascriptions of meaning: ascriptions of meaning do not purport to (...) state facts.1 Define semantic realism to be the view that ascriptions of meaning are apt to be assessed in terms of truth and falsity, and are, at least in some instances, true. Semantic realism, thus defined, is a form of cognitivism about semantic judgement, according to which judgements ascribing meaning express beliefs, states apt for assessment in terms of truth and falsity. Kripke’s Wittgenstein thus argues against semantic realism, and in favour of a form of semantic non-cognitivism. However, another form of opposition to semantic realism accepts that semantic judgements express beliefs but asserts that those beliefs are systematically and uniformly false.2 This cognitivist form of opposition to semantic realism is similar to the error-theoretic form of opposition to moral realism mooted by J.L. Mackie in the first chapter of his Ethics: Inventing Right and Wrong. In this paper I will investigate whether there is a plausible analogue of Mackie’s “argument from queerness” that can be used to make a case for an error-theory of semantic judgement. In §2 I set out what I take to be Mackie’s argument from queerness against moral realism. In §3 I argue that there is no straightforward and plausible analogue of that argument that would justify an error theory about ascriptions of meaning. In §4 and §5 I defend the argument of §3 against an objection developed in a recent paper by Daniel Whiting. (shrink)

This paper explores the prospects for using the notion of a primitive normative attitude in responding to the sceptical argument about meaning developed in chapter 2 of Saul Kripke’s Wittgenstein on Rules and Private Language. It takes as its stalking-horse the response to Kripke’s Wittgenstein developed in a recent series of important works by Hannah Ginsborg. The paper concludes that Ginsborg’s attempted solution fails for a number of reasons: it depends on an inadequate response to Kripke’s Wittgenstein’s ‘finitude’ objection to (...) reductive dispositionalism; it erroneously rejects the idea that a speaker’s understanding of an expression guides her use; it threatens to collapse into either full-blown non-reductionism or reductive dispositionalism; and there is no motive for accepting it over forms of non-reductionism such as those developed by Barry Stroud and John McDowell. This leads to important excursions into (...) related areas of metaphysics, philosophy of mind, and cognitive science that present the more recent attempts to save the notions of sense and meaning by philosophers such as Paul Grice, John Searle, Jerry Fodor, Colin McGinn, and Crispin Wright. Frederic Stoutland (1982a, 1982b) has argued that a Davidsonian theory of meaning is incompatible with a realist view of truth, on which the truth-conditions of sentences consist of mind-independent states of affairs or concatenations of extra-linguistic objects. In this paper we show that Stoutland’s argument is a failure.

We dare to question the denial of each one of them as a possible inauguration of the other two. The pause in movement as a gesture that reveals the body and space. The absence of the body as an agent that gives rise to movement and space. The potential (...) charge of a space that has not yet been determined, allowing the movement of bodies to be performed with creative freedom. The formal theory of the Model of Hierarchical Complexity is presented. Complexity theories generally exclude the concept of hierarchical complexity; Developmental Psychology has included it for over 20 years. It also applies to social systems and non-human systems. Formal axioms for the Model are outlined. The model assigns an order of hierarchical complexity to every task, using natural numbers, establishing a quantal notion of stage and stages of performance. This formalizes properties of stage theories in psychology. The formal theory of (...) the model enables extending the concept of hierarchical complexity to any field where tasks and their performances exist. (shrink)

In chapter VI of Language, Truth, and Logic, A.J. Ayer argues that ethical statements are not literally significant. Unlike metaphysical statements, however, ethical statements are not nonsensical: even though they are not literally significant, Ayer thinks that they possess some other sort of significance. This raises the question: by what principle or criterion can we distinguish, among the class of statements that are not literally significant, between those which are genuinely meaningless and those which possess some other, non-literal form of (...) significance. I suggest that Ayer needs a generalised version of the verification principle in order to answer this question. However, when we formulate the generalised version, it turns out that ethical statements do not satisfy it, so that the emotivist is committed to viewing ethics, like metaphysics, as meaningless verbiage. Emergency departments are challenging research settings, where truly informed consent can be difficult to obtain. A deeper understanding of emergency medical patients’ opinions about research is needed. We conducted a systematic review and meta-summary of quantitative and qualitative studies on which values, attitudes, or beliefs of emergent medical research participants influence research participation. We included studies of adults that investigated opinions toward emergency medicine research participation. We excluded studies focused on the association between demographics or consent document features and participation (...) and those focused on non-emergency research. In August 2011, we searched the following databases: MEDLINE, EMBASE, Google Scholar, Scirus, PsycINFO, AgeLine and Global Health. Titles, abstracts and then full manuscripts were independently evaluated by two reviewers. Disagreements were resolved by consensus and adjudicated by a third author. Studies were evaluated for bias using standardised scores. We report themes associated with participation or refusal. Our initial search produced over 1800 articles. A total of 44 articles were extracted for full-manuscript analysis, and 14 were retained based on our eligibility criteria. Among factors favouring participation, altruism and personal health benefit had the highest frequency. Mistrust of researchers, feeling like a ‘guinea pig’ and risk were leading factors favouring refusal. Many studies noted limitations of informed consent processes in emergent conditions. We conclude that highlighting the benefits to the participant and society, mitigating risk and increasing public trust may increase research participation in emergency medical research. New methods for conducting informed consent in such studies are needed. (shrink)

BackgroundThe U.S. Food and Drug Administration traditionally has kept confidential significant amounts of information relevant to the approval or non-approval of specific drugs, devices, and biologics and about the regulatory status of such medical products in FDA’s pipeline.ObjectiveTo develop practical recommendations for FDA to improve its transparency to the public that FDA could implement by rulemaking or other regulatory processes without further congressional authorization. These recommendations would build on the work of FDA’s Transparency Task Force in 2010.MethodsIn 2016-2017, we convened (...) a team of academic faculty from Harvard Medical School, Brigham and Women’s Hospital, Yale Medical School, Yale Law School, and Johns Hopkins Bloomberg School of Public Health to develop recommendations through an iterative process of reviewing FDA’s practices, considering the legal and policy constraints on FDA in expanding transparency, and obtaining insights from independent observers of FDA.ResultsThe team developed 18 specific recommendations for improving FDA’s transparency to the public. FDA could adopt all these recommendations without further congressional action.FundingThe development of the Blueprint for Transparency at the U.S. Food and Drug Administration was funded by the Laura and John Arnold Foundation.
