APLICAÇÃO DA ANÁLISE ECONÔMICA DO DIREITO AO NOVO MARCO REGULATÓRIO DO PRÉ-SAL.

La inteligencia artificial (IA) no es sólo una moda, sino un conjunto de sistemastecnológicos que han adquirido en los últimos años un enorme desarrollo con aplicaciones a múltiples aspectos de la vida cotidiana de los ciudadanos, tanto por parte de particulares (empresas) como de los propios Estados.La Unión Europea ha apostado siempre por compatibilizar los avances tecnológicos con el respeto de los principios y valores de la democracia, el Estado de Derecho y los derechos y libertades fundamentales. Desde tales premisas, (...) actualmente se enfrenta a la búsqueda de un modelo regulatorio de la IA ante las carencias del Reglamento General de Protección de Datos (RGPD) en este ámbito.A través de la Propuesta de Reglamento (UE) sobre IA, se pretende adoptar una regulación marco del uso de la IA que suponga una “tercera vía” inspirada en los principios y valores de la Unión y se contraponga a las actuales fórmulas regulatorias “abstencionistas” (EE.UU) e “hiperreguladoras” (China), proporcionando un modelo que consiga el efecto imitador o “efecto Bruselas” de una IA “confiable” para los ciudadanos y las empresas a nivel mundial. La centralidad que tiene la dimensión erótica en nuestras sociedades occidentales se refleja, entre otros múltiples fenómenos, en amplios y diversos nichos de mercado tendientes a generar ganancias por medio de la oferta de cuerpos, bienes y servicios que promueven la maximización de las experiencias sensorio-sexuales y la optimización del cuerpo en términos estéticos y eróticos. La producción de subjetividades se juega en el marco de un mercado que ofrece experiencias que combinan diversión, esfuerzo y autopromoción bajo las lógicas (...) de los insoslayables marcadores sociales de la diferencia.Al calor de estos fenómenos contemporáneos, tejidos por las tramas del erotismo, el género y el mercado, el presente artículo se propone realizar un análisis performático y performativo de una experiencia de participación observante en un taller de seducción femenina realizado en la ciudad de Córdoba. Se abordarán las técnicas corporales que fueron enseñadas, aprendidas y ensayadas en el taller y, en un segundo momento, el tipo específico de ideal regulatorio de la feminidad que estaba siendo propuesto tanto por medio de las particulares citaciones erótico-corporales que fuimos instadas a reiterar como por el discurso experto del profesor del taller. Con ello, se busca construir una descripción densa de esta instancia apostando a que amplíe los modos de abordar y conocer cómo estos paradójicos espacios reúnen experiencias y discursos de normalización y reactivación de viejos mandatos femeninos, a la par que transforman convenciones ligadas al género y la sexualidad. O intuito do presente trabalho é discutir o uso do termo desinformação pelo campo da Ciência da Informação (CI). A palavra, desinformação, passou a ser utilizada nos últimos anos – mais notadamente após a eleição de Donald Trump a presidência dos Estados Unidos da América, cargo que ocupou entre os anos de 2016 a 2020 - para caracterizar um comportamento pautado no compartilhamento de notícias falsas via redes sociais digitais, majoritariamente, e, por meio de técnicas de comunicação que almejam fazer (...) usuários de determinada ferramenta de comunicação, acreditar em uma notícia falsa. No entanto, julgamos que o emprego do termo não consegue explicar de forma clara como ocorre ou, se é possível, determinarmos via estudos do campo da CI (informação como dimensão física, informação como dimensão cognitiva, informação como dimensão intersubjetiva social) que exista um fenômeno ou um processo que desinforme sujeitos expostos a determinada informação. Julgamos haver uma contradição no termo, que pode contribuir para uma tábula rasa explicativa sobre como se processa a validação de determinados conteúdos informativos, ou seja, sob quais fundamentos éticos, marcos regulatório e práticas consuetudinárias os sujeitos nesta arena digital produzem, se apropriam e disseminam informação. Este manuscrito objetiva analisar, no âmbito do direito transnacional, do direito nacional e das convenções estabelecidas no mercado, características atinentes à certificação de orgânicos, tema extremamente relevante para a segurança alimentar. Desde 1970, o movimento orgânico se apresenta como um modelo alternativo em contestação aos impactos ambientais gerados pela agricultura industrial e pelos ditames da Revolução Verde. É nesta conjuntura que a Federação Internacional de Agricultura Orgânica (IFOAM) instaura um marco regulatório (certificação por auditoria) de abrangência global para este (...) setor, que, apesar de apresentar natureza privada, logra de legitimidade em inúmeros países. É oportuno destacar que a regulação não é exclusivamente oriunda do setor público, ela pode ser desenvolvida concomitantemente aos modelos estatais, assim, podemos ter modelos estatais nacionais, globais, inclusive oriundos do setor privado. Por seu turno, a legislação nacional também recepcionou estas diretrizes transnacionais, contudo alcançou identidade própria ao reconhecer os sistemas participativos de garantia da qualidade orgânica (SPG/OPAC) no intuito de contemplar a agricultura familiar de base agroecológica, o que, posteriormente, consubstanciará em uma inovação normativa em sede de soft law em nível internacional. Sem olvidar, inequivocamente, da exceção legal disposta para regularização da produção orgânica e agroecológica com vistas à venda direta da produção orgânica e agroecológica através das Organizações de Controle Social (OCS). Quanto à metodologia será utilizado o método dialético, abordagem qualitativa e objetivo analítico-descritivo, de sorte que a revisão bibliográfica será fundamental para analisar os materiais disponíveis sobre esta temática. Neste texto, refletimos acerca da educação escolar no meio rural brasileiro estabelecendo interface com os direitos humanos. Para alcançar este objetivo, fazemos uma retrospectiva histórica da educação oferecida pelo Estado à população rural, demonstrando que sistematicamente tem sido direito negado do ponto de vista do acesso, da continuidade e da qualidade social do ensino. Contudo, com o processo de democratização da sociedade na década de 1980 e da emergência de movimentos sociais, é reivindicado o direito universal à educação consignado na (...) Constituição Federal de 1988 como “direito de todos e dever do Estado”. A partir de meados de 1990, uma política educacional contra-hegemônica é construída por um conjunto de atores coletivos, constituindo o Movimento Nacional de Educação do Campo, denominada de Educação do Campo. Se a grande conquista reside no marco regulatório no qual se pode visualizar uma educação que considera a identidade, especificidade e diversidade dos sujeitos do campo, isso não significa a garantia desses direitos. Do ponto de vista metodológico, a abordagem analítica desta reflexão se orienta pela perspectiva epistemológica do materialismo histórico, tendo por base de pesquisa elementos da legislação educacional brasileira e o diálogo com autores que apontam para novos horizontes da educação como direito social. Como resultado desta investigação, apontamos desafios a serem enfrentados, entre eles o consórcio dos entes federados nem sempre afinado no cumprimento do marco regulatório da Educação do Campo; poucas iniciativas de formação inicial e continuada específica para professores da Educação do Campo; estrutura material precária das escolas; o material didático-pedagógico contempla conteúdos descontextualizados e inadequados às peculiaridades locais, às vivências e necessidades dos usuários da escola; ausência de Projeto Político Pedagógico, Currículo e calendário escolar capazes de, ao mesmo tempo, dar conta de oferecer o conhecimento socialmente produzido pela humanidade e atender a diversidade, especificidade dos sujeitos com direito ao acesso à escola onde vivem e uma educação omnilateral, que não dissocia a formação humana e profissional. Concluímos identificando uma profunda brecha entre o marco regulatório da Educação do Campo conquistado e a garantia real de uma educação cidadã e profissional de qualidade a ser ofertada à população do campo. Desinformação enquanto um fenômeno social criou uma nova desordem global, onde as novas condições de produção, circulação e consumo de informação fizeram das notícias falsas um importante instrumento geoestratégico que, associado às técnicas híbridas, coloca as ações das mídias comunicacionais em sintonia na geração de notícias falsas. Analisamos a maneira como os meios de comunicação disseminam informações tomando como base cinco filtros indicados por Chomsky e Herman (2003): Filtro 1: Importância, propriedade e orientação dos benefícios dos meios de comunicação; Filtro (...) 2: A publicidade como principal fonte de renda; Filtro 3: O fornecimento de notícias para a mídia; Filtro 4: As medidas corretivas como método para disciplinar a mídia; Filtro 5: Anticomunismo como mecanismo de controle. A análise realizada demonstra que, além de notícias falsas, as notícias reais são manipuladas e orientadas para polarizar ideologicamente, requerendo uma adaptação da sociedade na construção de marcos regulatórios, ao passo que as empresas (desenvolvedoras das redes sociais, por exemplo) e seus logaritmos não conseguem contrariar as redes globais da desinformação que atravessam países, continentes e línguas. This paper examines the subversive role of statistics paleontology at the end of the 19th and the beginning of the 20th centuries. In particular, I will focus on German paleontology and its relationship with statistics. I argue that in paleontology, the quantitative method was questioned and strongly limited by the first decade of the 20th century because, as its opponents noted, when the fossil record is treated statistically, it was found to generate results openly in conflict with the Darwinian theory (...) of evolution. Essentially, statistics questions the gradual mode of evolution and the role of natural selection. The main objections to statistics were addressed during the meetings at the Kaiserlich-Königliche Geologische Reichsanstalt in Vienna in the 1880s. After having introduced the statistical treatment of the fossil record, I will use the works of Charles Léo Lesquereux, Joachim Barrande, and Henry Shaler Williams to compare the objections raised in Vienna with how the statistical treatment of the data worked in practice. Furthermore, I will discuss the criticisms of Melchior Neumayr, one of the leading German opponents of statistical paleontology, to show why, and to what extent, statistics were questioned in Vienna. The final part of this paper considers what paleontologists can derive from a statistical notion of data: the necessity of opening a discussion about the completeness and nature of the paleontological data. The Vienna discussion about which method paleontologists should follow offers an interesting case study in order to understand the epistemic tensions within paleontology surrounding Darwin’s theory as well as the variety of non-Darwinian alternatives that emerged from the statistical treatment of the fossil record at the end of the 19th century. In the theoretical literature on moral responsibility, one sometimes comes across cases of manipulated agents. In cases of this type, the agent is a victim of wholesale manipulation, involving the implantation of various pro-attitudes (desires, values, etc.) along with the deletion of competing pro-attitudes. As a result of this manipulation, the agent ends up performing some action unlike any that she would have performed were it not for the manipulation. These sorts of cases are sometimes thought to motivate historical views (...) of responsibility, on which the agent’s past is relevant to whether she is responsible for a specific action. In a recent paper, Daniel Sharp and David Wasserman bring these theoretical discussions on moral responsibility to bear on practical issues regarding neurological modifications of individuals. After proposing and arguing for a historical view, Sharp and Wasserman offer some insight into how such a view may help us in determining the responsibility of subjects who have undergone Deep Brain Stimulation. This paper aims to join this discussion, by arguing that the correct historical view to be applied will also appeal to the agent’s control over her mental life and the fact that this was bypassed. I conclude with some brief comments on the practical implications of such a historical view. (shrink)

Abstract. This paper argues that the “Argument from Moral Peer Disagreement” fails to make a case for widespread moral skepticism. The main reason for this is that the argument rests on a too strong assumption about the normative significance of peer disagreement (and higher-order evidence more generally). In order to demonstrate this, I distinguish two competing ways in which one might explain higher-order defeat. According to what I call the “Objective Defeat Explanation” it is the mere possession of higher-order evidence (...) that explains defeat. I argue that this type of explanation is problematic and that it at best collapses into another explanation I call the “Subjective Defeat Explanation”. According to this explanation, it is coming to believe that one’s belief fails to be rational that explains defeat. Then I go on to argue that the Subjective Defeat Explanation is able to provide a straightforward explanation of higher-order defeat but that it entails that peer disagreement (and higher-order evidence more generally) only contingently gives rise to defeat, and importantly, that the condition it is contingent upon is very often not satisfied when it comes to moral peer disagreement specifically. As a result, it appears that moral knowledge is seldom threatened by moral peer disagreement. (shrink)

In this paper, I investigate the variety and richness of the taxonomical practices between the end of the nineteenth and the early twentieth centuries. During these decades, zoologists and paleontologists came up with different quantitative practices in order to classify their data in line with the new biological principles introduced by Charles Darwin. Specifically, I will investigate Florentino Ameghino’s mathematization of mammalian dentition and the quantitative practices and visualizations of several German-speaking paleontologists at the beginning of the twentieth century. In (...) so doing, this paper will call attention to the visual and quantitative language of early twentieth-century systematics. My analysis will therefore contribute to a prehistory of the statistical frame of mind in biology, a study which has yet to be written in full. Second, my work highlights the productive intertwinement between biological practices and philosophical frameworks at the turn of the nineteenth century. Deeply rooted in Kantian bio-philosophy, several biologists sought to find rules in order to apply ordering principles to chaotic taxonomic information. This implies the necessity to investigate the neglected role of Kantian and Romantic bio-philosophy in the unfolding of twentieth-century biology. (shrink)

Although mouse‐tracking has been taken as a real‐time window on different aspects of human decision‐making processes, whether purely semantic information affects response conflict at the level of motor output as measured through mouse movements is still unknown. Here, across two experiments, we investigated the effects of semantic knowledge by predicting participants’ performance in a standard keyboard task and in a mouse‐tracking task through distributional semantics, a usage‐based modeling approach to meaning. In Experiment 1, participants were shown word pairs and were (...) required to perform a two‐alternative forced choice task selecting either the more abstract or the more concrete word, using standard keyboard presses. In Experiment 2, participants performed the same task, yet this time response selection was achieved by moving the computer mouse. Results showed that the involvement of semantic components in the task at hand is observable using both standard reaction times (Experiment 1) as well as using indexes extracted from mouse trajectories (Experiment 2). In particular, mouse trajectories reflected the response conflict and its temporal evolution, with a larger deviation for increasing word semantic relatedness. These findings support the validity of mouse‐tracking as a method to detect deep and implicit decision‐making features. Additionally, by demonstrating that a usage‐based model of meaning can account for the different degrees of cognitive conflict associated with task achievement, these findings testify the impact of the human semantic memory on decision‐making processes. Between 1909 and 1913, Berlin’s Museum für Naturkunde unearthed more than 225 tons of fossils in former German East Africa and transported them to Berlin. Among them were the bones of Brachiosaurus brancai, which would eventually become the biggest mounted dinosaur in the world. By analyzing the social and communicative strategies that made this expedition possible, this paper aims to reveal several aspects of natural history knowledge production at the end of the long nineteenth century. Using rhetoric, the director of (...) the Geological–Paleontological Museum in Berlin, Wilhelm von Branca, conducted a highly successful campaign to market the dinosaurs in Prussia and to convince public opinion and the Prussian central state of the value of paleontology. He fired the Prussian imagination and took advantage of the competitive urge to emulate American paleontology and industry. This work examines how his public relations strategies shaped the German biological “landscape” of the first decades of the twentieth century. It asks: when and under what conditions did paleontology successfully appeal to the public? How does communication dictate, shape, and constrain the development of a specific epistemic agenda? And what kind of power do the public and money have? (shrink)

This paper offers an introduction to Hermann Cohen’s Das Princip der Infinitesimal-Methode, and recounts the history of its controversial reception by Cohen’s early sympathizers, who would become the so-called ‘Marburg school’ of Neo-Kantianism, as well as the reactions it provoked outside this group. By dissecting the ambiguous attitudes of the best-known representatives of the school, as well as those of several minor figures, this paper shows that Das Princip der Infinitesimal-Methode is a unicum in the history of philosophy: it represents (...) a strange case of an unsuccessful book’s enduring influence. The “puzzle of Cohen’s Infinitesimalmethode,” as we will call it, can be solved by looking beyond the scholarly results of the book, and instead focusing on the style of philosophy it exemplified. Moreover, the paper shows that Cohen never supported, but instead explicitly opposed, the doctrine of the centrality of the ‘concept of function’, with which Marburg Neo-Kantianism is usually associated. This article surveys various topics that link questions about housing with considerations of economic justice. Housing has received increasing attention from philosophers within the last decade. In political philosophy, some aspects of a topic attract more attention than others. Presently, philosophical reflection focuses on the value of a home; homelessness; gentrification; segregation; and spatial justice, with a substantial body of literature developing on these interconnected themes. We highlight some of the recent contributions to the field of housing justice while also (...) identifying areas that have received less attention. Specifically, we emphasize the importance of further philosophical exploration into how macroeconomic factors, like fiscal and monetary policy, impact housing justice. Additionally, we advocate for normative approaches that underscore justice issues not readily addressed by frameworks prioritizing human flourishing or relational equality. (shrink)

By inserting the dialogue between Einstein, Schlick and Reichenbach into a wider network of debates about the epistemology of geometry, this paper shows that not only did Einstein and Logical Empiricists come to disagree about the role, principled or provisional, played by rods and clocks in General Relativity, but also that in their lifelong interchange, they never clearly identified the problem they were discussing. Einstein’s reflections on geometry can be understood only in the context of his ”measuring rod objection” against (...) Weyl. On the contrary, Logical Empiricists, though carefully analyzing the Einstein–Weyl debate, tried to interpret Einstein’s epistemology of geometry as a continuation of the Helmholtz–Poincaré debate by other means. The origin of the misunderstanding, it is argued, should be found in the failed appreciation of the difference between a “Helmholtzian” and a “Riemannian” tradition. The epistemological problems raised by General Relativity are extraneous to the first tradition and can only be understood in the context of the latter, the philosophical significance of which, however, still needs to be fully explored. I discuss three arguments that have been advanced in support of the epistemic mentalist view, i.e., the view that infants' social cognitive abilities manifest a capacity to attribute beliefs. The argument from implicitness holds that SCAs already reflect the possession of an “implicit” and “rudimentary” capacity to attribute representational states. Against it, I note that SCAs are significantly limited, and have likely evolved to respond to contextual information in situated interaction with others. I challenge the argument from parsimony by claiming (...) that parsimony per se favors neither a mentalist nor a behavior-reading account. Finally, I argue that early SCAs do not develop continuously into four-year-olds' belief attribution abilities. Accordingly, the argument from developmental continuity is empirically inadequate. Careful analysis of both the empirical data and the theoretical assumptions leading to the epistemic mentalist view is needed in order to improve our understanding of SCAs in earl.. (shrink)

Are concepts stable entities, unchanged from context to context? Or rather are they context-dependent structures, created on the fly? We argue that this does not constitute a genuine dilemma. Our main thesis is that the more a pattern of features is general and shared, the more it qualifies as a concept. Contextualists have not shown that conceptual structures lack a stable, general core, acting as an attractor on idiosyncratic information. What they have done instead is to give a contribution to (...) the comprehension of how conceptual structure organized around such a stable core can produce contextually appropriate representations on demand. Resumen Este artículo tiene como propósito central presentar los resultados de una investigación sobre el funcionamiento de las coletillas interrogativas en un corpus oral del español de Chile desde una perspectiva sistémico funcional del lenguaje. Las categorías de análisis interpersonal se derivan de los estratos semántico-discursivo y léxico-gramatical. En el estrato de los significados se han considerado la función de habla y la mercancía semiótica, mientras que en el estrato de la codificación los modos de cláusula y la ubicación de (...) coletilla en la cláusula. Se concluye que la coletilla es un recurso productivo para la expresión de significados interpersonales en todas las funciones de habla. Se integra mayormente en movimientos que cumplen el rol de “dar”, en tanto que la principal materia de negociación es “información”. Dentro del sistema de MODO, se integran en posición final de cláusulas declarativas y en menor medida en cláusulas imperativas e interrogativas. Abstract The main purpose of this paper is to present the results of an investigation about functioning of tag questions in oral corpus of Chilean Spanish from a systemic-functional language perspective. The categories of interpersonal analysis are derived from the semantic-discursive and lexical-grammatical strata. In the meaning stratum, the speech function and the semiotic commodity have been considered, while in the coding stratum, the clause modes and the location of the tag question in the clause have been considered. It is concluded that the tag question is a productive resource for the expression of interpersonal meanings in all speech functions. It is mostly integrated in moves that fulfill the role of ‘give’, while the main subject of negotiation is ‘information’. Within the mood system, they are mostly integrated in final position of declarative clauses and to a lesser extent in imperative and interrogative clauses. (shrink)

Gerald Holton has famously described Einstein’s career as a philosophical “pilgrimage”. Starting on “the historic ground” of Machian positivism and phenomenalism, following the completion of general relativity in late 1915, Einstein’s philosophy endured (a) a speculative turn: physical theorizing appears as ultimately a “pure mathematical construction” guided by faith in the simplicity of nature and (b) a realistic turn: science is “nothing more than a refinement ”of the everyday belief in the existence of mind-independent physical reality. Nevertheless, Einstein’s mathematical constructivism (...) that supports his unified field theory program appears to be, at first sight, hardly compatible with the common sense realism with which he countered quantum theory. Thus, literature on Einstein’s philosophy of science has often struggled in finding the thread between ostensibly conflicting philosophical pronouncements. This paper supports the claim that Einstein’s dialog with Émile Meyerson from the mid 1920s till the early 1930s might be a neglected source to solve this riddle. According to Einstein, Meyerson shared (a) his belief in the independent existence of an external world and (b) his conviction that the latter can be grasped only by speculative means. Einstein could present his search for a unified field theory as a metaphysical-realistic program opposed to the positivistic-operationalist spirit of quantum mechanics. (shrink)

Recent discussions on Fregean and neo-Fregean foundations for arithmetic and real analysis pay much attention to what is called either ‘Application Constraint’ ($AC$) or ‘Frege Constraint’ ($FC$), the requirement that a mathematical theory be so outlined that it immediately allows explaining for its applicability. We distinguish between two constraints, which we, respectively, denote by the latter of these two names, by showing how$AC$generalizes Frege’s views while$FC$comes closer to his original conceptions. Different authors diverge on the interpretation of$FC$and on whether it (...) applies to definitions of both natural and real numbers. Our aim is to trace the origins of$FC$and to explore how different understandings of it can be faithful to Frege’s views about such definitions and to his foundational program. After rehearsing the essential elements of the relevant debate (§1), we appropriately distinguish$AC$from$FC$(§2). We discuss six rationales which may motivate the adoption of different instances of$AC$and$FC$(§3). We turn to the possible interpretations of$FC$(§4), and advance a Semantic$FC$(§4.1), arguing that while it suits Frege’s definition of natural numbers (4.1.1), it cannot reasonably be imposed on definitions of real numbers (§4.1.2), for reasons only partly similar to those offered by Crispin Wright (§4.1.3). We then rehearse a recent exchange between Bob Hale and Vadim Batitzky to shed light on Frege’s conception of real numbers and magnitudes (§4.2). We argue that an Architectonic version of$FC$is indeed faithful to Frege’s definition of real numbers, and compatible with his views on natural ones. Finally, we consider how attributing different instances of$FC$to Frege and appreciating the role of the Architectonic$FC$can provide a more perspicuous understanding of his foundational program, by questioning common pictures of his logicism (§5). This paper examines Karl Alfred von Zittel’s practice in order to uncover the roots of so-called idiographic paleontology. The great American paleontologist Stephen Jay Gould (1941–2002) defined the discipline of idiographic paleontology as illustration and description of the morphological features of extinct species. However, this approach does not investigate macroevolutionary patterns and processes. On the contrary, the paleobiological revolution of the 1970s implemented an epistemic methodology that illustrates macrovelutionary patterns and laws by combining idiographic data with a nomothetic form of (...) explanation. This article elucidates the features of the idiographic data as well as the acquired knowledge coupled with this approach. First of all, Heinrich G. Bronn’s (1800–1862) statistical method is analyzed. Zittel’s practice arose as a reaction against the approximate conclusions reached by Bronn’s quantitative approach. Second, the details of Zittel’s methodology are described in order to bring out its peculiarities. The microscope played a pivotal role in creating and forming Zittel’s morphological data. This analysis sheds new light on the reasons behind the so-called ideographic paleontology, thus revising Gould’s historical reconstruction, as well as on the notion of paleontological data. However, even though Zittel aimed at reaching precise and stable conclusions, his data cannot be used for elucidating evolutionary mechanisms: they are scientific in a purely descriptive sense, but completely useless for biological investigations. Finally, this paper examines how Zittel’s methodology affects the contemporary paleobiological enterprise and thereby reflects upon the notion of natural history. (shrink)

In 1912, Ernst Cassirer contributed to the special issue of the Kant-Studien that honored Hermann Cohen's retirement—his mentor and teacher, and the recognized founding father of the so-called 'Marburg school' of Neo-Kantianism. Examines how Leo Strauss sought to recover "nature," which he saw as inseparable from genuine philosphy since its inception in ancient Greece.

We consider algebras on binary relations with two main operators: relational composition and dynamic negation. Relational composition has its standard interpretation, while dynamic negation is an operator familiar to students of Dynamic Predicate Logic (DPL) (Groenendijk and Stokhof, 1991): given a relation R its dynamic negation R is a test that contains precisely those pairs (s,s) for which s is not in the domain of R. These two operators comprise precisely the propositional part of DPL.This paper contains a finite equational (...) axiomatization for these dynamic relation algebras. The completenessresult uses techniques from modal logic. We also lookat the variety generated by the class of dynamic relation algebras and note that there exist nonrepresentable algebras in this variety, ones which cannot be construedas spaces of relations. Background The global pandemic raised ethical issues for nurses about caring for all patients, not just those with COVID-19. Italy was the first European country to be seriously affected by the first wave, while Estonia’s infection and death rates were among the lowest in Europe. Did this raise different ethical issues for nurses in these two countries as well? Aim The aim was to describe and compare ethical issues between nurses working during the first wave of the COVID-19 pandemic in (...) Estonia and Italy. Research design A cross-sectional survey study with a self-administered questionnaire. The impact of COVID- 19 emergency on nursing care questionnaire was used. Participants and research context Convenience sampling was used to recruit 1098 nurses working during the first wave of the pandemic in 2020: 162 from Estonia and 936 from Italy. Ethical considerations Research ethics approvals were obtained, and the nurses provided informed consent. Results The most frequent ethical issues for Estonian nurses were professional communication and ensuring access to care for patients without COVID-19, and for Italian nurses, the end-of-life care and the risk of them getting the virus and transmitting it to their loved ones. There were no statistically significant differences in the frequency of ethical issues between Estonian nurses working with patients with and without COVID-19. Italian nurses caring for COVID-19 patients faced statistically significantly more (both p <.001) issues around prioritising patients and end-of-life. Nurses working with patients without COVID-19 in Italy faced more issues about access to care ( p <.001). Conclusions Estonian and Italian nurses, working in different clinical contexts during the first wave of the pandemic, faced different ethical issues. Local contextual aspects need to be considered to support nurses’ ethical decision-making in providing care during future crises and to ensure ethical care for patients. (shrink)

In considering what it means to lead organizations effectively and ethically, the literature comprising spirituality at work and spiritual leadership theory has become highly influential, especially in the USA. It has also attracted significant criticism. While in this paper, we endorse this critique, we argue that the strand of literature which purportedly takes a Christian standpoint within the wider SAW school of thought, largely misconstrues and misapplies the teaching of its founder, Jesus. As a result, in dismissing the claims and (...) application of SAW and SLT, there is a real risk that we lose the vital contribution of Christian thought, not least some of the timeless counter-cultural wisdom of Jesus which, we contend, offers a vital foundation to the practice of ethical leadership and business ethics in organizations. In proposing a way forward, two thorny issues which face all leaders are addressed: dealing with ego and closing the gap between what we say and what we do. The more we understand about the dynamics of human nature, the more we learn about the profundity of Jesus’ teachings. We then propose a number of ways in which Jesus-centred ethical leadership can be practised. Each is radical and each implies risk: both the personal risk of inner renewal arising from repentance as a doorway to personal integrity, as well as the risk of opposing unethical practices and promoting the excellence of core practices in the workplace. It is well known that the validity of Choice Principles is problematic in non-standard Set Theories which do not abide by the Limitation of Size Principle. In this paper we discuss the consistency of various Choice Principles with respect to the Generalized Positive Comprehension Principle . The Principle GPC allows to take as sets those classes which can be specified by Generalized Positive Formulae, e.g. the universe. In particular we give a complete characterization of which choice principles hold in Hyperuniverses. (...) Hyperuniverses are structures which arose independently in Non-well-founded Set Theory and in Mathematical Semantics of Concurrent Programming Languages and are hitherto the only existing models of GPC. Hyperuniverses are naturally endowed with a κ-compact uniform κ-topology and are uniformly isomorphic to their exponential space, i.e. the space of their closed subsets endowed with the Exponential Uniformity. Some philosophers have defended the idea that in cases of all-things-considered misleading higher-order evidence it is rational to take divergent doxastic attitudes to p and E supports p. In a recent paper, Sophie Horowitz has argued that such “Level-Splitting views” are implausible since they violate a rational requirement she calls the Non-Akrasia Constraint. In this paper, I argue that Horowitz’s objection is misguided since it conflates two distinct notions of epistemic rationality.

This paper attempts to show how the logical empiricists’ interpretation of the relation between geometry and reality emerges from a “collision” of mathematical traditions. Considering Riemann’s work as the initiator of a 19th century geometrical tradition, whose main protagonists were Helmholtz and Poincaré, the logical empiricists neglected the fact that Riemann’s revolutionary insight flourished instead in a non-geometrical tradition dominated by the works of Christoffel and Ricci-Curbastro roughly in the same years. I will argue that, in the attempt to interpret (...) general relativity as the last link of the chain Riemann–Helmholtz–Poincaré–Einstein, logical empiricists were led to argue that Einstein’s theory of gravitation mainly raised a problem of mathematical under-determination, i.e. the discovery that there are physical differences that cannot be expressed in the relevant mathematical structure of the theory. However, a historical reconstruction of the alternative Riemann–Christoffel–Ricci–Einstein line of evolution shows on the contrary that the main philosophical issue raised by Einstein’s theory was instead that of mathematical over-determination, i.e. the recognition of the presence of redundant mathematical differences that do not have any correspondence in physical reality.
