Ivancovsky et al. explore the relationship between curiosity and creativity, by suggesting they align through novelty-seeking mechanisms. We argue that a general mechanism linking both capacities together is question-asking: Curiosity drives question-asking that leads to creative problem solving. Yet, current findings from our lab suggest that question complexity relates to creativity, but not necessarily to curiosity, warranting further investigation.

Introducing the sixth and final installment of the Common Knowledge symposium “Apology for Quietism,” Allen looks at the symposium retrospectively and concludes that it has mainly concerned “sage knowledge,” defined as foresight into the development of situations. The sagacious knower sees the disposition of things in an early, incipient form and knows how to intervene with nearly effortless and undetectable (quiet) effectiveness. Whatever the circumstance, the sage handles it with finesse, never doing too much but also never leaving anything undone (...) that must be accomplished. Quiet, when it is knowingly and effectively quiet (not pusillanimous or poor in spirit), is about what not to do, how not to approach a problem, what not to decide, what is not known, what will not work. Allen explains these principles in terms of traditional Chinese thought, Daoist and Confucian: wei we wei, or “doing-not-doing,” means effective inaction. What makes such wisdom possible is not mystical insight, he argues, but discipline in a certain kind of art. The sage has no need of reasons (let alone doctrines), only effectiveness; and he does not need truth or justice, only subtlety. The detachment of a quietist has little, if anything, to do with transcending perspectives. Detachment is good as a means to flexibility, and instead of transcending perspectives, a sage is skilled in the quiet art of never getting stuck in one. To be effectively quiet is not so much to be silent as to be inaudible, invisible; the sage “vanishes into things.”. (shrink)

Turkish-Islamic literature contains numerous religious literar writings. In the existing literature, it can be seen that many kinds such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, and al-asmā al-ḥusnā were written. Al-Asmā al-ḥusnā, written in the form of poetry and prose, were mostly sharḥ or their khawaṣṣ were explained. Çihil-nām al-Manẓūm, which is mentioned in the study, was written as khawaṣṣ al-asmā al-ḥusnā. The work is a poet entitled as Fażāyī. Manuscript was written in the (...) last quarter of the fifteenth century, and thus, it is presumed that the poet lived in the same century. This work has been identified in a manuscript. In addition, the poet’s Hadiyyat al-aḥbāb, der-Bayān al-maqāmāt al-darwīshān, Kitāb al-sharʿiyyat al-arbāb, and Ghazaliyyāt al-Darwīsh Fażāyī four other works have been identified. In the writings of the asmā al-ḥusnās, the names of ninety-nine were emphasized. In this study, the forty names of God are expressed. The text presented is a continuation of the tradition of writing some prose works written in Arabic and Persian. Çihil-nām al-Manẓūm, written in Arabic prose and known as Asmā al-Idrīsiyya it can be seen as a free stsyle translation of the prophet Idrīs. Forty names in the content of the work, their proper-ties, when, how much and how to read is explained. In this study, firstly the information about the subject of Qurʾān, hadith, Arabic, Persian and Turkish literature in the beautiful names of God is provided. Then, the information about the poet Fażāyī was given. Çihil-nām al-Manẓūm was introduced and the transcriptional form of the text was given.SummaryOne of the reasons that deeply affect a nation is the change of religion. This change did not only affect the individual but also influenced the society in which he was born and grew. One of the nations with strong influence is the Turks. Turks, after Islamization, have estab-lished a new civilization. One of the areas where this Islamic civilization reflects is the literary aspect of society. In this literature, which has begun to be formed, religious genres such as tawhīd, munājāt, nʿat, mawlid, hilya, hijrah-nāma, shafāʿat-nāma, miʿrāj, qisas al-anbiya, ramaḍāniyya, have been revealed. One of them is about God. Religious literary writings about God were written in the form of tawhīd and munājāts, which consist of one or more prophets found at the head of the dīwāns, or as the annotations of asmā al-ḥusnā or as khawaṣṣ asmā al-ḥusnā.In time, the need for some Turkish literary and scientific works to be translated into a different language were born. It can be seen that with some changes such as subtraction and addition, texts are rewritten or poetic works are translated into prose. The original of our research subject Çihil-nām al- Manẓūm’s is written in Arabic and prose. Çihil-nām al-Manẓūm, it is a munājāt of the work known as Asmā al-Idrīsiyya, which describes the call of prophet Idrīs.Asmā al-ḥusnā is a religious term used mostly to describe the attributes and names of God. In the Qurʾān, there is no information about the number of asmā al-ḥusnā mentioned as a concept. However, the number of the names of God in the Qurʾān is 155. This number is differ-ent in ḥadīths. It is widely accepted that the number of asmā al-ḥusnā is 99. Some Islamic schol-ars have argued against such restricting statements, arguing that ninety-nine names, such as the hiding of the Night of Qadr, were hidden in all Divine names during the month of ramaḍān, while others suggested that the number of ninety-nine was large number of asmās (names).The first examples of asmā al-ḥusnā were written in Arabic literature. Some of them are not detached: Abū Manṣūr al-Māturidī (d. 333/944) Kitāb al-Tawḥīd, Abū ʿAbdullāh al-Ḥalīmī (d. 403/1012) al-Minhāj fī shuʿabiʾl īmān, Taḳī al-Dīn Ibn Taymiyya (d. 728/1328) al-Īmān. Again, he wrote a book about the char-acteristics of letters. Aristotle later wrote a commentary using the majority of the information found in this book. Some of the works are written to narrate the Prophet Idrīs’s praising God with forty names:Muḥammad al-Tunisian, al-Ravḍatu al-Sundusiyya fī asmā al-ḥusnā al-Idrīsiyya al-Suhrawardiyya; Shāb al-Dīn Yaḥya b. Ḥabash al-Suhrawardī, Çihil-nām. Among these, the most famous is the work called Asmā al-Idrīsiyyā, written by Suhrawardī. Many mawlids (mawlid al-nabī) have been written as a reflection of the love for the prophet Muhammad. Süleymān Çelebi’s (d. 825/1422) Wasila al-nacāt, has been seen as the founding work in Turkish literature in this category. The effect of Wasila al-nacāt has continued for centuries, and inspired many other mawlids. One of them is Enverī Erzincānī’s work named Mawlūd al-sharīf (Sumbul al-gulzār al-kalām al-kadīm). In literature tradition, mawlids are written in masnawī in ​​verse form, Mawlūd al-sharīf was written in style. (...) ode. In this respect, the work can be seen as an exception between the other ones. Another remarkable aspect of the work is the similarity between the two stories in Nasibī al-mawlid which is estimated to be written in XV. or XVI. century. Until now, no academic work has been done about Mawlūd al-sharīf. The sources that provide information about Mawlūd al-sharīf report about, two copies, one in Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi) and the other in Kastamonu Manuscript Library (Kastamonu Yazma Eserler Kütüphanesi). Research showed that the copy in Kastamonu was in fact another copy of Wasila al-nacāt another copy of Mawlūd al-sharīf was also found in the Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi). The number of couplets of Mawlūd al-sharīf has increased to 202 with the finding of the second copy. About the author of the work that is approximatly written in the XVII. or XVIII. century no information could be found. This study, introduces the Mawlūd al-sharīf and its authors, compares it with Wasila al-nacāt and presents an critical analysis of the text.Summary: The term mawlid means birth, birth time and place of birth. It was used to describe works such as the birth of the Prophet, miracles and the death of the Prophet. Next to these there also many mawlids about the lifes of Fatīma the daughter of the Prophet and her husband Alī, and few about the lifes of a spiritual guide. The first examples of this type seen in Arabic literature are Ibn Dihya al-Kalbī (d. 633/1235), Muhammad al-Azafī (d. 633/1236) and Cafar b. Hasan al-Barzancī (d. 1177/1764); Muhammad b. Masūd el-Kāzarūnī (d. 758/1356) and Sūzanī (d. 569/1173). The celebrations related to mawlid have turned into ceremonial form in the era of the Fatimies. The Fatimies held, Mawlid-al-Alī, Mawlid al-Hasan, Mawlid al-Husayin and Mawlid al-Fatīma ceremonies next to the Prophet’s. The first mawlid ceremony in the form of today was seen in the time of Muzaffar al-Dīn Gokboru (d. 630/1233).Different ideas have been put forward about the first mawlid text in Turkish literature, but Süleymān Çelebi’s Wasila al-nacat has been accepted as a pioneer work in the recognition and love of this kind. Many mawlids were written with the influence of Wasila al-nacat. The likeness of the content and the motifs of the majority of mawlids to Wasila al-nacat is interpreted as a strong sign indicating its importance in this genre. The translation of Wasila al-nacat into Arabic, Circassian, Greek, Kurdish, Tatar, Sawamish, English, German, Albanian, Bosnian... languages ​​should be considered as a factor that exposes its breadth.It is estimated that around 200 Turkish mawlids have been written, but this number is increasing with new studies. One of these mawlids is the work of Enverî Erzincānī called Mawlūd al-sharīf Ethem Erkoç and Mehmet Fatih Köksal are the researchers who have been aware of the existence of this work for the first time. Both researchers mention that the work has 142 couplets and the only copy is that in the Çorum Hasanpasha Writing Works Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi). In his work called Mawlid-nāma Köksal states that there is a second copy of the work, but the copy of Kastamonu, which is known as the second copy, is actually a copy of Wasila al-nacat. In the present study, another more bulky version of Mawlūd al-sharīf was recorded in Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi). In the catalogs of the National Library (Milli Kütüphane) and Çorum Hasanpasha Manuscript Library (Çorum Hasanpaşa Yazma Eserler Kütüphanesi), the mawlid is indicated as Persian; the reason fort his mistake might be, the fact that the first twelve of the text is Persian.Although there were many poets who used the pseudonym Enverī there is no poet in Turkish literature, who was from Erzincan and wrote a mawlid with the same pseudonym. It was understood that the poet was a sayyid.In five places the author’s name or pseudonym is mentioned. His work shows that he is from Erzincān and that he has a mawlid. As a mawlid poet Enverī, adopted a quite ambitious style. He praises himself for writing in Persian, being the best Persian speaker in this area, and boasted his pure character and wise poetry.In the headlines of the copies the work is called Mawlūd al-sharīf / Sunbul al-gulzār al-kalām al-kadīm. Therefore, it would be more appropriate to consider the work as a double name sage. The copies do not include a record of the copyright date of the work. According to the second copy, which is shorter and which has the impression that it is incomplete, the work was copied in 1249/1833. It can be said that the Mawlid was written in the XVII. or XVIII. century because of its language and style.In the mawlid tradition of writing mawlid, generally masnawī form was preferred. Rarely some mawlids were conposed in verse styles. One of these works, which are two for now, is the one in which Çizmeci-zāde Vehbī wrote the couplets of Wasila al-nacat in sixth verse form. The other one is the Mawlūd al-sharīf of Enverī Erzincān. Mawlūd al-sharīf was written entirely in the form of an ode, except of two stories with 48 couplets must have been added later. The work with 202 couplet was separated from Wasila al-nacat and other mawlids in terms of starting with a Persian tawhid and using the style of an ode. Because of the small number of citations, the subjects described in Wasila al-nacat have not been contacted or have been summarized. Mawlūd al-sharīf is one of the shortest ones. Because of the small number of couplets of Mawlūd al-sharīf, the subjects described in detail in Wasila al-nacat are either not mentioned or only summarized. The work, consists of two major sections: The birth of the Prophet and the miracle of miraj. The remarkable feature of Mawlūd al-sharīf is that the two stories told are identical to the stories in Nasībī Mawlid (XV. or XVI. century). The first story tells how, a Jewish couple living in Baghdad became Muslims because of their respect for the mawlid ceremony. The second story tells about, a young named Alī who organized a mawlid ceremony with little money left from his mother and therefore died with faith. Surprisingly, this similarity is seen in the content and narrative forms of the stories in both texts. The fact that the comparative stories are almost the same makes on think of the possibilities of imitating, quoting or saving rather than an impression of the author by the previous text. Taking into account the chronological time, it seems more likely to accept the quotations in the Mavlūd al-sharīf as duplicating. Writing the stories in Mawlūd al-sharīf after the main chapters and the line differences in the rulers reinforce the impression that the stories are added later. (shrink)

We consider small-weight Cutting Planes (CP * ) proofs; that is, Cutting Planes (CP) proofs with coefficients up to $\operatorname{Poly}(n)$ . We use the well known lower bounds for monotone complexity to prove an exponential lower bound for the length of CP * proofs, for a family of tautologies based on the clique function. Because Resolution is a special case of small-weight CP, our method also gives a new and simpler exponential lower bound for Resolution. We also prove the following (...) two theorems: (1) Tree-like CP * proofs cannot polynomially simulate non-tree-like CP * proofs. (2) Tree-like (CP * proofs and Bounded-depth-Frege proofs cannot polynomially simulate each other. Our proofs also work for some generalizations of the CP * proof system. In particular, they work for CP * with a deduction rule, and also for any proof system that allows any formula with small communication complexity, and any set of sound rules of inference. (shrink)

Comparative study of the theory of knowledge (Islam) with special reference to the philosophy of Ghazzālī, 1058-1111 and Aḥmad Raz̤ā K̲h̲ān̲, 1856-1921.

Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

I argue for a new conception of practical authority based on an analysis of the relationship between authority and subject. Commands entail a demand for practical deference, which establishes a relationship of hierarchy and vulnerability that involves a variety of signals and commitments. In order for these signals and commitments to be justified, the subject must be under a preexisting duty, the authority’s commands must take precedence over the subject’s judgment regarding fulfillment of that duty, the authority must accept the (...) position and responsibilities of command, and the authority must be sufficiently trustworthy relative to how vulnerable the subject makes herself by deferring. This results in an instrumentalist conception of practical authority that can be favorably compared to Joseph Raz’s famous service conception. The relational conception’s main advantage is that it focuses on the authority as much as the subject, requiring that the authority accept responsibility for the relationship and be sufficiently trustworthy. The article considers the nature of legalistic, or formal, conceptions of the rule of law, focusing particularly on the work of Joseph Raz and Albert Venn Dicey. It asks how such apparently narrow conceptions are generated, and how far they can resist including broader social claims. It concludes that the rationale behind legalistic conceptions compels them to address issues of poverty and the literacy of the law's subjects. However, legalistic conceptions of the rule of law can still avoid sliding into (...) the wider non‐legalistic models advanced by writers such as T. R. S. Allan. (shrink)

This paper examines the following three questions: (1) In The Rose Garden of Mystery (Golshan-e Rāz), how does the prominent 7-8th-century Iranian Sufi, Maḥmūd Shabistarī, distinguish the mystical “contemplation” and “rational reflection” in pursuing divine knowledge? (2) Was Shabistarī an anti-rationalist (strict fideist)? (3) How does Shabistarī’s position fit into the ancient Greek, Neoplatonist, and medieval Islamic and Christian metaphysics? This paper examines Golshan-e Rāz in the context of Shabistarī’s other works, commentaries, secondary sources, and Islamic thought—Sufism and philosophy. Existing (...) literature on Golshan-e Rāz primarily focuses on its literary aspects, neglecting its philosophical and mystical concepts. However, a thorough understanding requires examining these concepts in a broad context, which will inspire further research. The rationale behind this research is rooted in the religious obligation for believers to know God, with “thinking” as the means to acquire such knowledge. This is why the first question Herawī poses to Shabistarī pertains to the nature of thought—justifying this paper’s focus. Contemporary opposition to religion often stems from its perceived incongruity with the rational frameworks offered by positivism, materialism, or scientific inquiry. By differentiating between mystical and rational modes of thought that Shabistarī presents, this study shows the contemporary person that intellectual inquiry extends beyond rationalism and encompasses mysticism. Consequently, rational and mystical perspectives should be pursued in the quest for the divine. Furthermore, this study contends that Shabistarī should not be regarded as a strict fideist; instead, his criticism is directed toward the constraints inherent in rational thinking. (shrink)

We study the complexity of proving the Pigeon Hole Principle in a monotone variant of the Gentzen Calculus, also known as Geometric Logic. We prove a size-depth trade-off upper bound for monotone proofs of the standard encoding of the PHP as a monotone sequent. At one extreme of the trade-off we get quasipolynomia -size monotone proofs, and at the other extreme we get subexponential-size bounded-depth monotone proofs. This result is a consequence of deriving the basic properties of certain monotone formulas (...) computing the Boolean threshold functions. We also consider the monotone sequent expressing the Clique-Coclique Principle defined by Bonet, Pitassi and Raz [9]. We show that monotone proofs for this sequent can be easily reduced to monotone proofs of the one-to-one and onto PHP, and so CLIQUE also has quasipolynomia -size monotone proofs. As a consequence of our results, Resolution, Cutting Planes with polynomially bounded coefficients, and Bounded-Depth Frege are exponentially separated from the monotone Gentzen Calculus. Finally, a simple simulation argument implies that these results extend to the Intuitionistic Gentzen Calculus. Our results partially answer some questions left open by P. Pudlák. (shrink)

The ‘liberal-communitarian’ debate arose within anglophone political philosophy during the 1980s. This essay opens with an account of the main outlines of the debate, showing how liberals and communitarians tended to confront each other with opposing interpretations of John Rawls’ Theory of Justice (1999; originally published in 1971) and Political Liberalism (2005; originally published in 1993). The essay then proceeds to discuss four forms of ‘liberalism after communitarianism’: Michael Freeden’s account of liberalism as an ideology; Joseph Raz and Will Kymlicka’s (...) perfectionist liberalisms; the liberalism of value pluralists such as Isaiah Berlin and Bernard Williams; and Judith N. Shklar’s liberalism of fear. Fakhr al-Dın al-Razı’s final theological treatise, al-Matalib al-‘Aliya min al-‘Ilm al-Ilahiyya, is sufficient justification for the assertion of his towering significance as interpreter of Ibn Sına and in the development of new theological paradigms. Yet such is its richness and subtlety that al-Razı’s views in the Matalib on key doctrinal issues such as the creation of the world require much further study. Previously, scholars have maintained that al-Razı refrains from affirming any one doctrine of creation. I argue to the contrary, (...) that despite al-Razı’s epistemological caution on matters pertaining to the action of God, he ultimately deems creation ex nihilo most probable on the balance of evidence, and therefore the doctrine that is to be believed. Noise in behavior is often viewed as a nuisance: while the mind aims to take the best possible action, it is let down by unreliability in the sensory and response systems. How researchers study cognition reflects this viewpoint – averaging over trials and participants to discover the deterministic relationships between experimental manipulations and their behavioral consequences, with noise represented as additive, often Gaussian, and independent. Yet a careful look at behavioral noise reveals rich structure that defies easy explanation. First, both (...) perceptual and preferential judgments show that sensory and response noise may potentially only play minor roles, with most noise arising in the cognitive computations. Second, the functional form of the noise is both non-Gaussian and non-independent, with the distribution of noise being better characterized as heavy-tailed and as having substantial long-range autocorrelations. It is possible that this structure results from brains that are, for some reason, bedeviled by a fundamental design flaw, albeit one with intriguingly distinctive characteristics. Alternatively, noise might not be a bug but a feature: indeed, we suggest that noise is fundamental to how cognition works. Specifically, we propose that the brain approximates probabilistic inference with a local sampling algorithm, one that uses randomness to drive its exploration of alternative hypotheses. Reframing cognition in this way explains the rich structure of noise and leads to a surprising conclusion: that noise is not a symptom of cognitive malfunction but plays a central role in underpinning human intelligence. The definitions of disease proffered by philosophers and medical actors typically require that a state of ill health be linked to some known bodily dysfunction before it is classified as a disease. I argue that such definitions of disease are not fully implementable in current medical discourse and practice. Adhering to the definitions would require that medical actors keep close track of the current state of knowledge on the causes and mechanisms of particular illnesses. Yet, unaddressed problems in medical terminology (...) can make this difficult to do. I show that unrecognized misuse of “heterogeneous,” “biomarker,” and other important health terms—which I call index terms—can misrepresent the current empirical evidence on illness pathophysiology, such that unvalidated illness constructs become mistaken for diseases. Thus, implementing common definitions of disease would require closing this “loophole” in medical discourse. I offer a simple rule that, if followed, could help do just that. (shrink)

Studie má za cíl představit strukturu Hayekova evolucionismu. Argumentace postupuje v několika krocích: Východiskem je historicko- systematická expozice způsobu, jakým evoluční teorie ovlivnila Hayekovu filosofii, především s ohledem na periodizaci vývoje jeho myšlení a systematické odlišení explanans a explanandum v rámci jeho teorie vědy. Dále je rozebírán způsob, jakým Hayek rozvíjí svoji metodologii vědy. V této souvislosti je argumentováno ve prospěch teze, že Hayekovo pojetí metodologického dualismu je důsledkem ovlivnění evoluční teorií. Zároveň je evoluční teorie představena jako nástroj vysvětlení, konkrétně (...) pak tzv. vysvětlení vzorce. Následně je představeno Hayekovo pojetí společnosti v kontextu kulturní evoluce. Společnost je interpretována jako řád jednání a je kladen důraz na Hayekovo vnímání společnosti jako řádu vyvíjejícího se společně s lidskou myslí. Na základě těchto předpokladů je v poslední části rozvinuto Hayekovo pojetí mysli. Toto pojetí vychází z konekcionistické pozice. Dále argumentuji proti tradičnímu pohledu na Hayekovu filosofii jako rozvíjení Kantovy filosofie. Závěr rekapituluje základní body Hayekova evolucionismu. (shrink)

Alexy si prefigge di individuare quale argomentazione sia razionale (rationaler), ma soprattutto di quali argomentazioni siano inaccettabili poiché del tutto irrazionali: l'autore intende così fornire un criterio di individuazione che possa soddisfare le esigenze del ragionamento giuridico (principalmente quello giudiziario). La ricerca di Alexy non si propone di affermare un giudizio di valore su cosa possa essere considerato effettivamente morale o giuridico e cosa non possa esserlo, vale a dire una particolare decisione, come esito finale del ragionamento, mentre tutto il (...) suo impegno filosofico è diretto verso la definizione delle condizioni metodologiche per la correttezza del ragionamento stesso, allo scopo di scongiurare o, comunque, individuare eventuali irrazionalità. La teoria dell'argomentazione giuridica di Alexy si presenta come un insieme di regole che possono essere considerate una summa ricavata in parte dalla logica formale: accanto a queste rigorose formulazioni, però, si possono osservare anche i contributi della logica induttiva e gli strumenti della retorica, relativi alla verifica delle premesse, come il principio dell'onere dell'argomentazione o del precedente. Le regole individuate da Alexy si dividono essenzialmente in due principali categorie: la prima concernente il discorso pratico generale, la seconda riguarda invece il discorso giuridico, inteso come caso particolare del primo. Nei capitoli seguenti si procede dunque all'analisi di alcuni aspetti della teoria dell'argomentazione, tenendo conto anche delle osservazioni formulate dallo stesso Alexy in risposta alle critiche ricevute, tentando di distinguere i validi contributi della teoria stessa da quegli aspetti che possono apparire eccessivi e inadeguati rispetto alla metodologia adottata. La posizione metodologica debole di Alexy, che mira solo all'esclusione dell'estrema irrazionalità, non risulta poi davvero così “debole” e provoca le critiche di O. Weinberger, J. Habermas, N. MacCormick e J. Raz. L'obiettivo che la teoria di Alexy sembra prefiggersi e mancare, o quanto meno non essere in grado di giustificare adeguatamente il metodo elaborato per conseguirlo, è soprattutto l'elaborazione di una procedura di giustificazione esterna. I severi limiti che lo stesso Alexy pone preliminarmente al proprio progetto vengono infranti, seppure in senso debole, estendendosi al di fuori dell'orizzonte limitato della razionalità relativa al diritto vigente, qualunque esso sia: Alexy non è del tutto fedele alle proposte avanzate con la sua prospettiva debole, in particolare alla netta separazione tra argomentazione e decisione. La neutralità del criterio di controllo di razionalità contrasta, infatti, con qualsiasi pretesa di giustizia, se, come sostenuto da Alexy, deve essere intesa come relativa ad un ordinamento giuridico positivo. Un contributo importante dell'opera di Alexy è la definizione estensiva del concetto stesso di argomentazione elaborata dall'autore che riafferma la complessità e l'apertura del discorso giuridico ben oltre i limiti posti dalle metodologie che ne costringono l'orizzonte entro un rigido logicismo giuridico. Il metodo adottato da Alexy rappresenta un valido contributo anche per lo statuto epistemologico della scienza giuridica, distinguendo l'elaborazione scientifica delle procedure per garantire il controllo di razionalità dalla certezza dei risultati conseguibili. Una volta accettata la sua funzione solo nei suoi limiti storici e politici di strumento di notevole riduzione dell'ambito dell'irrazionalità del discorso giuridico e dei suoi esiti, si può valutare correttamente tutta la portata della teoria, “non definitiva”, elaborata da Alexy e la sua struttura aperta nei confronti di ogni specie di ragionamento giuridico, come prescritto dall'ultima regola di transizione del discorso pratico generale, che espone tutta la teoria dell'argomentazione ad un perenne confronto dialettico con ogni possibile e diversa tesi. RÉSUMÉDes travaux récents par Joseph Raz, Niko Kolodny et Sergio Tenenbaum suggèrent qu'il n'existe aucune contrainte normative propre aux intentions. De telles contraintes seraient un mythe. Selon eux, il est possible d'articuler la rationalité des intentions sans postuler que l'intention est un état mental. Je soutiens que nous pouvons aussi comprendre la nature descriptive des intentions sans postuler que l'intention est un état mental. Tout comme l'idée selon laquelle il y aurait des contraintes normatives propres aux intentions, ce postulat est (...) aussi un mythe. L'intention est plutôt une action accompagnée de certaines sous-actions caractéristiques et jouant un rôle de coordination. (shrink)

Haydar el-Herevî Horasan’dan Osmanlı topraklarına gelen önemli âlimlerdendir. Teftâzânî’nin şeçkin bir talebesi olan bu âlim I. Mehmed’ten büyük saygı görerek onun tarafından himaye edilmiştir. Herevî, Zemahşerî’nin el-Keşşâf’ı üzerine yazdığı şerhi büyük övgü ifadeleriyle I. Mehmed’e ithaf etmiş, ithafın yer aldığı mukaddimede hayat hikayesiyle ilgili önemli ayrıntılar vermiştir. Osmanlı topraklarında geçirdiği uzun yıllar sonra Timur’un oğlu Şahruh ile irtibat kuran Herevî, el-Keşşâf şerhi mukaddimesini tekrardan kaleme alarak aynı eseri bu sefer Şahruh’a ithaf etmiştir. Herevî’nin bu yeni patronaj ilişkisi mukaddimenin ikinci versiyonundan (...) öğrenilmektedir. İkinci versiyonda sadece ithaf kısmı değiştirilmemiş, yeni haminin kimliğiyle irtibatlı olarak muhteva da yeni- den kurgulanmıştır. İlk versiyonda bulunmayan önemli biyografik ayrıntılar ikinci versiyonda yer almaktadır. Mukaddimenin iki versiyonu Herevî biyografisinin neredeyse yegâne kaynağıdır. Bu makalede mukaddimenin ikinci versiyonu ilk defa gün yüzüne çıkarılmış ve her iki versiyonda verilen bilgiler bir araya getirilerek Herevî’nin biyografisi inşa edilmiştir. İki versiyonda herhangi bir tarih verilmemiş, sadece bazı şehirlerdeki ikamet süreleri belirtilmiştir. Biyografi inşa edilirken anlatıda oluşan boşluklar tarihi olaylardan hareketle doldurulmuş ve tarihlendirme yapılmıştır. Bahsedilen olaylar, yapılan nitelemeler ve verilen ikamet süreleri itibara alınarak Herevî’nin hayatının yaklaşık kırk yıllık bölümü tam olarak tarihlendirilmiş, Serahs’tan başlayarak sırasıyla Şîraz, Tebriz, Şirvan, Bursa, Edirne ve tekrar Horasan’a uzanan yıllara dair bütünlüklü bir tablo ortaya konulmuştur. Bu hayat hikayesi ulema-sultan ilişkileri, siyasî gelişmelerin ilim hayatına yansımaları ve hayatını ilim yolculuklarında geçiren bir âlimin zihin dünyası hakkında eşsiz bilgiler sunmaktadır. The use of sound to systematically communicate data has been with us for a long time, and has received considerable research, albeit in a broad range of distinct fields of inquiry. Sonification is uniquely capable of conveying series and patterns, trends and outliers…and effortlessly carries affect and emotion related to those data. And sound-either by itself or in conjunction with visual, tactile, or even olfactory representations-can make data exploration more compelling and more accessible to a broader range of individuals. Nevertheless, (...) sonification and auditory displays still occupy only a sliver of popular mindshare: most people have never thought about using non-speech sound in this manner, even though they are certainly very familiar with other intentional uses of sound to convey status, notifications, and warnings. This article provides a brief history of sonification, introduces terms, quickly surveys a range of examples, and discusses the past, present, and as-yet unrealized future promise of using sound to expand the way we can communicate about data, broaden the use of auditory displays in society, and make science more engaging and more accessible. Este artigo tem por objetivo relatar a experiência com o Projeto de educação filosófica denominado Ética e Educação para o Pensar a partir da Literatura Infantil, abordando a história da sua criação, algumas referências teóricas e metodológicas, a estrutura do projeto e o desenvolvimento através de parceria entre o Instituto Sadia, Fundação Sidónio Muralha, Instituto de Filosofia e Educação para o Pensar e seis secretarias de educação. O foco do projeto é a educação ética através da comunidade de investigação, enfatizando (...) a abordagem dialógica dos valores, procurando trabalhar na direção da autonomia moral e cognitiva das crianças. O projeto foi desenvolvido com professores e alunos da Educação Infantil e Ensino Fundamental I. No final do artigo são apresentadas algumas produções dos alunos desenvolvidas como parte do projeto e depoimentos dos professores sobre o mesmo. (shrink)

Congress must not excessively restrict PBMs’ ability to negotiate with manufacturers; alternatively, reforms could be paired with other policies that address the high prices of brand-name drugs.

Chronic pain is a common disorder with enormous sociomedical importance. A major part of primary and secondary costs of illness is caused by the various pain syndromes. Nociception – the sensory perception of a painful stimulus – is a complex process relying on an intricate system of anatomical, neurophysiological and biochemical networks. This applies even more so to pain – the state of experiencing a nociceptive event, of interpreting it in terms of meaning for the affected individual and of suffering (...) a range of emotions it elicits. This intricacy renders it obvious, that the empirical medical sciences alone cannot explain all aspects of pain. Hence, it has also become a focus of phenomenological research. One aspect of these investigations is the interaction of pain and the perception of the lived body’s spatiality. The focus of this article will build on these concepts to develop a construct of the alteration of temporality caused by chronic pain and the effects this spells out for the affected subject. To this end, I will primarily draw on Merleau-Ponty’s ideas of the lived body as well as on theories of enactivism and embodiment. I will also point out parallels to neuroscientific data, thereby demonstrating the proximity of phenomenology and neuroscience. A possible partial solution to the pain dilemma may be derived from psychology: techniques relying on cognitive behavioural intervention, awareness training, and existential analysis may provide alleviation to patients suffering from chronic pain. First Professor of Logic and Metaphysics at Main Pedagogical Institute and then also St. Petersburg University, Carpatho-Rusyn P. D. Lodij spent a quarter of a century teaching philosophy and law in the Russian Empire in the first third of the 19th century. His knowledge of Kant’s philosophy and his attitude to Kant’s criticism are estimated diametrically opposed in the research literature. An analysis of his main philosophical work, “Logical Precepts which Lead to Cognition and the Distinction of the True from (...) the False” (1815), convincingly proves that Lodij was an excellent scholar of Kant’s philosophy. In Russia, he was the first thinker who spoke about the differences between the first and second editions of the “Critique of Pure Reason”. Lodij also was the first who noted both the revolutionary role of Kant’s Copernican turn, and the importance of Humeʼs causality problem for the formation of critical philosophy. In Russia, Lodij was the first who proposed a detailed description of Kant’s transcendental idealism. At the same time, Lodij’s general attitude to Kant was rather skeptical. In his own logic, he does not follow Kant’s division of logic into pure and applied, but he returns to pre-Kant’s split into theoretical and practical logics. Lodij disputes with the basic conclusions about the space derived from the transcendental aesthetic, denies synthetic judgments a priori and the rooting of the cognizing reason in illusions. Despite his unequivocal claims regarding Kant’s philosophy, “Logical Precepts” and its author were persecuted during the so-called “professorsʼ affair” of the 1820s. As a result, Lodij was suspended from teaching philosophy, and his logic textbook was withdrawn from teaching for both “disgrace” and imaginary Kantianism. (shrink)

Pal. 7.435 and other epigrams from Anth. Pal. 7. Virgil's bilingual reader would participate in the Hellenistic Ergänzungsspiel and supplement further meaning to this otherwise generic scene.

Bunu müteakiben, bir taraftan Aristoteles'in bazı eserlerini ve diğer taraftan İbn Rüşd'ün bunlardan iktibâsen yazdığı Telhîsât'ı, Kütübhâne-i Hidivî'den istinsâh ettirerek mütalaa ettim. Sonra da Şehristânî'nin Kitâbü'l-Milel ve'n-Nihal'i, Zevzenî'nin Muhtasar Târîh-i Hukemâ'sı, Fârâbî ile İbn Sînâ'nın bazı eserleri, Ebû Abdullâh el-Kâtib'in Mefâtîhu'l-Ulûm'u, İbnu'n-Nedîm Bağdâdî'nin Kitâbü'l-Fihrist'i gibi Avrupa'da basılmış birtakım nadir kitapları ve diğer birçok mantık kitaplarını gözden geçirerek, bunlardan her ne buldumsa aldım. Bu şekilde cem ettiğim kelimeler ve tabirler büyücek bir mecmua teşkil etmiş ise de bunlar mantık ve eski felsefeye ait olduğundan yeni terimlerin de karşılıklarını bulmak lazım geldi. Bu noksanı da âcizâne kütüphanemde mevcut lûgat kitaplarından Fransız ve İngiliz ve Arap ve Fars dillerine ait olan kamuslara müracaat ederek ve bunlarla maksadın temini mümkün olamadığı halde kelimelerin etimolojik anlamlarına nazaran birer tabir bulmak suretiyle mümkün mertebe ikmal etmek üzere bu Lûgatçe'nin tertip ve tanzimine başladım. Ve Bulletin de la Société Française de Philosophie başlığıyla yayınlanmakta olan süreli yayının bazı numaralarında, 1904 senesinden beri yer almış ve bu kere son bulmuş ise de henüz ayrıca kitap şeklinde toplanmamış olan Yeni Felsefe Lûgatçesi'ni başlıca kaynak kabul ederek, buna dâhil edilmiş olan yeni terimlerin hemen hepsini aldım. E. Goblot'nun Felsefe Lûgatçesi'yle diğer lûgatçelerde mananın açıklık kazanmasına hizmet ediyor gördüğüm özet bilgileri de ait oldukları kelimelere ilave ettim. Kısacası bu naçiz eser, diğer lûgatlerin hiçbirine henüz geçmemiş olan yeni felsefe terimlerinden başka felsefeyle ilgili olan tıp bilimine ve sosyal ve ekonomik bilimlere ait bir hayli kelimeleri de içermektedir. Bununla beraber âcizâne eserimin pek noksan olduğunu ve ancak ilim ve irfan erbabının tashih kalemleri için hazırlanmış bir müsveddecik teşkil edebileceğini itiraf ederim. Yegâne emelim mütalaa erbabına naçizâne bir hizmette bulunarak hayır ile yâd olunmaya hak kazanmaktan ibaret olduğundan görülecek hataların iyi niyetime bağışlanacağı ümidindeyim". This article represents the author’s reflections on the book by Karl Sigmund “Exact Thinking in Demented Times. The Vienna Circle and the Epic Quest for the Foundations of Science” and the fate of the Vienna Circle. Sigmund paints a vivid portrait of the Vienna Circle against the background of the difficult historical period in which its members lived and worked. The Vienna Circle established the tradition of liberating consciousness and science from metaphysics. But the participants of the Vienna Circle and (...) their entourage did not manage to get rid of the humanistic issues, despite the declaration of strict scientific character. The author of the article draws attention to the internal contradiction between strict scientific topics and the existential-humanistic perception of this topic by the Vienna Circle’s authors and their likeminded people, and by Sigmund himself. The author concludes that it was thanks to this contradiction the Vienna Circle became not only a stage in the development of philosophical science, but also had a broad cultural influence on art, politics, architecture, museums, etc. The historical and philosophical tradition connects the activities of the Vienna Circle with the beginning of the divergence between the philosophical scientific and humanistic traditions in the understanding of philosophy, and the controversy between R. Carnap and M. Heidegger is an important point in this process. But Sigmund’s book gives the impression that this is not the divergence strictly scientific and humanistic traditions, but the difference between two humanistic traditions, one of them tends to express its thoughts strictly analytically. Background Scientific and technological advancements in mapping and understanding the interrelated pathways through which biological and environmental exposures affect disease development create new possibilities for detecting disease risk factors. Early detection of such risk factors may help prevent disease onset or moderate the disease course, thereby decreasing associated disease burden, morbidity, and mortality. However, the ethical implications of screening for disease risk factors are unclear and the current literature provides a fragmented and case-by-case picture. Methods To identify key ethical considerations (...) arising from the early detection of disease risk factors, we performed a systematic scoping review. The Scopus, Embase, and Philosopher’s Index databases were searched for peer-reviewed, academic records, which were included if they were written in English or Dutch and concerned the ethics of (1) early detection of (2) disease risk factors for (3) disease caused by environmental factors or gene-environment interactions. All records were reviewed independently by at least two researchers. Results After screening 2034 titles and abstracts, and 112 full papers, 55 articles were included in the thematic synthesis of the results. We identified eight common ethical themes: (1) Reliability and uncertainty in early detection, (2) autonomy, (3) privacy, (4) beneficence and non-maleficence, (5) downstream burdens on others, (6) responsibility, (7) justice, and (8) medicalization and conceptual disruption. We identified several gaps in the literature, including a relative scarcity of research on ethical considerations associated with environmental preventive health interventions, a dearth of practical suggestions on how to address expressed concerns about overestimating health capacities, and a lack of insights into preventing undue attribution of health responsibility to individuals. Conclusions The ethical concerns arising with the early detection of risk factors are often interrelated and complex. Comprehensive ethical analyses are needed that are better embedded in normative frameworks and also assess and weigh the expected benefits of early risk factor detection. Such research is necessary for developing and implementing responsible and fair preventive health policies. (shrink)
