Public and professional debates have come to rely heavily on a special type of reasoning: the argument-from-ignorance, in which conclusions depend on the _lack_ of compelling information. "I win my argument," says the skillful advocate, "unless you can prove that I am wrong." This extraordinary gambit has been largely ignored in modern rhetorical and philosophical studies. Yet its broad force can be demonstrated by analogy with the modern legal system, where courts have long manipulated burdens of proof with skill and (...) subtlety. This legal, philosophical, and rhetorical study by Richard H. Gaskins provides the first systematic treatment of arguments-from-ignorance across a wide range of modern discourse—from constitutional law, scientific inquiry, and moral philosophy to organizational behavior, computer operation, and personal interaction. Gaskins reviews the historic shifts in constitutional proof burdens that have shaped public debate on fundamental rights and, by analogy, on the fundamental status of intellectual and cultural authority. He shows how similar shifts have dominated polemical battles between scientific and ethical modes of authority, affecting both academic and popular discussion. Finally, he discovers the philosophical roots of default reasoning strategies in the arguments of Kant and nineteenth-century Kantian schools. Concluding that shifting proof burdens are inescapable in a world of scientific and moral uncertainty, Gaskins emphasizes the common strategic ground shared by dogmatic and skeptical reasoning. According to a common judgement, a social planner should often use a lottery to decide which of two people should receive a good. This judgement undermines one of the best-known arguments for utilitarianism, due to John C. Harsanyi, and more generally undermines axiomatic arguments for utilitarianism and similar views. In this paper we ask which combinations of views about (a) the social planner’s attitude to risk and inequality, and (b) the subjects’ attitudes to risk are consistent with the aforementioned judgement. (...) We find that the class of combinations of views that can plausibly accommodate this judgement is quite limited. But one theory does better than others: the theory of chance-sensitive utility. The purpose of this article is to expose a basic flaw at the root of perennialism as a method for studying mysticism—its distinction between ‘exoteric’ and ‘esoteric’ components of mysticism and religion. Rather than being distinct, the specific ‘exoteric’ doctrines of a given mystic’s tradition penetrate the mystics’ knowledge-claims. Thus, the ‘esoteric’ dimension in a mystical tradition is permeated by that mystical tradition’s ‘exoteric’ doctrines, not by the transcultural and ahistorical perennial spine that perennialists postulate. Contrary to what the perennialists (...) suggest, there is no one underlying esoteric set of beliefs embedded in all traditional religions that all mystics share. Rather, in the different religious traditions of the world, there are genuinely different mysticisms with different beliefs, practices, values, and goals. Thus, the perennialist approach distorts the history of mysticism. It is better seen as a theology of religions than as an alleged discernment of timeless truths presented throughout the history of mysticism. (shrink)

Mystics claim to experience reality in a way not available in normal life, a claim which makes this phenomenon interesting from a philosophical perspective. Richard H. An examination of analytic philosophers' approaches to and critiques of the intelligibility of experiences of 'pure consciousness', non-intentionality, and selflessness in light of mystical experiences. Whether neuroscience can determine whether experiences of 'pure consciousness' are possible is also examined.

Burke suggests that we should view society as a partnership between the past, the present, and the future. I defend this idea by outlining how we can understand the interests of the past and future people and the obligations that they have towards each other. I argue that we have forward-looking obligations to leave the world a decent place, and backward-looking obligations to respect the legacy of the past. The latter obligation requires an understanding of the role that traditions and (...) meta-traditions should (and should not) play in tying together societies—especially national societies—over time. Neuroscientific scanning of meditators is taken as providing data on mystical experiences. However, problems concerning how the brain and consciousness are related cast doubts on whether any understanding of the content of meditative experiences is gained through the study of the brain. Whether neuroscience can study the subjective aspects of meditative experiences in general is also discussed. So too, whether current neuroscience can establish that there are “pure consciousness events” in mysticism is open to question. Bodunrin, in his 1981 essay, asks: ‘Is there an African Philosophy, and if there is, what is it?’ This question has occupied centre stage among younger African intellectuals for about a decade now. The most articulate among these intellectuals, who are themselves philosophers, are Bodunrin , Kwasi Wiredu , H. Odera Oruka , Marcien Towa and Eboussi Boulaga , and Paulin Hountondji . ‘The work of the philosopher consists in assembling reminders for particular purposes.’ Among the many purposes for which Wittgenstein assembled reminders, the deeper understanding of the religious life would have to qualify as one. Though on first reading this would hardly seem obvious, I hope to make this abundantly clear through an examination of his later literature. There are two ways in which he sheds light on religious issues: first , by the personal passion of his own life and the (...) forthright display of intellectual integrity expected of any professional thinker toward any discipline , and, second , by making his philosophical investigations descriptive. Any analysis of religious issues or the understanding of the religious life should involve the high degree of personal integrity and the rigorously descriptive method which Wittgenstein makes apparent throughout his writing. An exposition of human dignity as the foundation of moral order. From this starting point, the author derives the most important precepts of natural law from human dignity in a systematic way. Using the principle of human dignity, the author then develops natural law precepts to guide human behavior in various areas of life corresponding to the natural inclinations: life issues, sexual issues, political issues, and the contemplative life.

I make three points. First, the i-frame and s-frame are not helpful frameworks for thinking about behavioral public policy. Second, the authors ignore the role of politics: Policies (and the s-frame) require laws and regulations. Third, the research on retirement savings, which is all about the system, undercuts their claims.

Using the analytic framework of normative logic presented in Fisher, Lovell, and Valero-Silva, provided here are five original business ethics mini-cases that may be used to teach and practice case analysis. We have taken the six questions that are used in the analytic framework of normative logic to solve ethical problems and have adapted them to seven steps that can be applied to conflict resolution of mini-cases in class. Then the adapted normative logic model has seven steps: Describe the “fundamental (...) needs of humankind” as they relate to the case, e.g. caring, supporting, reciprocity, fairness, trust; Explain the established norms, values, and laws that can be seen to apply in this case; State in brief the facts of the situation; Examine the network of circumstances that preceded the situation ; Generate at least three alternative positions and actions open to the actor in the case; Speculate on the hypothesized consequences of the different positions or actions the actor in the case may take; and Choose among the alternative positions the actor in the case might take and give your informed and judged reason for making that choice. A suggested answer is provided for one case, which could be reproduced as a class handout for students to examine after having done their own analysis and having discussed the case as a class. In the period since the 2008 Wall Street crash, little consensus has emerged on its causes or actions to prevent a recurrence. Our capability for rational decision making was overwhelmed. Viewing the entire financial system as a huge, richly interconnected organization suggests that its structure and associated management practices are suited for a far simpler environment. An organization that is large relative to its environment and sufficiently complex to require the coordination of specialized expertise cannot function by enabling decision makers (...) to respond only to local demands. The resulting inability to recognize critical interdependencies and the nature of their risk makes periodic catastrophic failure likely. Specifically, compartmentalization of information, influence, and reward creates a myopic decision environment in which individual decision makers are unlikely to make effective or ethical decisions. Useful criteria for evaluating solutions can be suggested by considering the interaction of two factors: limited human information processing capability and the effect of motivation on information processing. Taken together, they suggest that human information processing is both limited and opportunistic. We cannot process all information available and the information selected for processing narrows to that needed to achieve salient rewards. Because of this, the organization's reward practices and their effect on motivation are a critical variable. Large financial rewards contingent upon short term, local, simplistic measures inevitably narrow the focus of decision maker's attention to a small part of the system. In contrast, dominant intrinsic motivation is rooted in awareness of, and responsibility for, broader outcomes. Each type of motivation differs in its requirements for sharing of information, influence, and reward. These, in turn, determine the adaptability of the organization to complexity and change. While this has significant ethical implications, its logic rests on the limitations of human information processing and motivation. Aligning human motivation and information flow to the demands of a complex, turbulent financial environment is the challenge we must meet to prevent further cataclysms. (shrink)

Professor Margaret Canovan wrote two studies of the work of German-Jewish émigré political theorist, Hannah Arendt. The first, The Political Thought of Hannah Arendt, appeared in 1974, while Hannah Arendt: A Reinterpretation of Her Political Thought was published in 1992. Both were intended for the Anglophone world, especially the US and Great Britain, although Arendt’s reception was more favorable in America where she settled in 1941 than in the UK. An historian of political thought at Keele University, UK, Canovan was (...) ideal to bring Arendt to a general academic audience not to aim at a highly specialized readership deeply grounded in German thought. Though Canovan emphasized the conservative dimensions of Arendt’s thought, her conclusion was, finally, that Arendt’s political thought was a form of modern “republicanism” not an argument for inherited political traditions or a plea for New Left radicalism. It has become popular to portray the Buddhist Nāgārjuna as an ontological nihilist, i.e., that he denies the reality of entities and does not postulate any further reality. A reading of his works does show that he rejects the self-existent reality of entities, but it also shows that he accepts a "that-ness" to phenomenal reality that survives the denial of any distinct, self-contained entities. Thus, he is not a nihilist concerning what is real in the final analysis of things. How (...) Nāgārjuna’s positions impact contemporary discussions of ontological nihilism and deflationism in Western philosophy is also discussed. (shrink)

Wittgenstein, in his characteristic way of indirectly bringing us to see an important feature in human life, said: ‘… art shows us the miracles of nature… We say: “Just look at it opening out!” This essay discusses how works of art ‘blossom’ and thus elicit an imaginative human response. Its various parts focus on the connected theme that some sensible component is essential to the production and comprehension of art. Each part, however, investigates a different aspect of the theme and (...) could stand on its own. What will be argued about this aesthetic factor in art will also be shown to cast light on our understanding of certain narrative texts and ceremonial acts of religion. (shrink)

The riddle Frazer confronts us with in The Golden Bough is posed in the form of a question. ‘Why is this happening?’ - this life and death of the King of the Wood at Nemi? In the related context of his accounts of the fire-festivals in Europe, Frazer refines the question in a more dramatic form: ‘What is the meaning of such sacrifices? Why were men and animals burnt to death at these festivals?’ Frazer recognizes something serious in all this. (...) The practice of human sacrifice is puzzling; it does leave us disquieted! But Frazer's search for what he calls ‘a fairly probable explanation’ of the motives which gave rise to the priesthood of Nemi and its embodiment of the practice of human sacrifice, Wittgenstein in his ‘Remarks on Frazer's Golden Bough’ feels, does not help us to understand a practice like the burning of a man! With all the additional data, numerous theories, and the historical tracing of origins we are no closer to resolving the perplexities of the riddle than the riddle itself presents to us daily. Scientific interest in drug-induced mystical experiences reemerged in the 1990s. This warrants reexamining the philosophical issues surrounding such studies: Do psychedelic drugs cause mystical experiences? Are drug-induced experiences the same in nature as other mystical experiences? Does the fact that mystical experiences can be induced by drugs invalidate or validate mystical cognitive claims? Those questions will be examined here.
