One of the epistemological results emerging from this initial study, is that the different forms of co-relational inference, known in the Islamic jurisprudence as qiyās represent an innovative and sophisticated form of reasoning that not only provide new epistemological insights of legal reasoning in general but they also furnish a fine-grained pattern for parallel reasoning that can be deployed in a wide range of problem-solving contexts and that does not seem to reduce to the standard forms of analogical argumentation studied (...) in contemporary philosophy of science. More specifically the main claim is that a dialectical framework provides the right instrument to stress two of the most salient features of this form of inference: (1) it's heuristic nature and (2) the dynamics underlying the meaning-explanation of the terms involved. Both display what we take to be the main epistemological idea behind the qiyās, namely: the open texture of the meaning of normative statements. To put it more generally, the notion of co-relational inference suggests that every form of parallel reasoning based on meaning presupposes that the concept of meaning involved is open to contextual changes. Hugh MacColl and, more recently, Storrs McCall searched for a formal system in which the validity ofthese formulae could be expressed. Unfortunately neither of the resulting systems is very satisfactory. In this paper we introduce dialogical games with the help of a new connexive If-Then (), the structural rules of which allow the Proponent to develop winning strategies not only for the above-mentioned connexive theses but also for ¬ and ¬. Further on, we developthe corresponding tableau systems and conclude with some remarks on possibleperspectives and consequences of the dialogical approach to connexivity including the loss of uniform substitution leading to a new concept of logical form. This monograph proposes a new way of studying the different forms of correlational inference, known in the Islamic jurisprudence as qiyās. According to the authors’ view, qiyās represents an innovative and sophisticated form of dialectical reasoning that not only provides new epistemological insights into legal argumentation in general but also furnishes a fine-grained pattern for parallel reasoning which can be deployed in a wide range of problem-solving contexts and does not seem to reduce to the standard forms of analogical reasoning (...) studied in contemporary philosophy of science and argumentation theory. After an overview of the emergence of qiyās and of the work of al-Shīrāzī penned by Soufi Youcef, the authors discuss al-Shīrāzī’s classification of correlational inferences of the occasioning factor. The second part of the volume deliberates on the system of correlational inferences by indication and resemblance. The third part develops the main theoretical background of the authors’ work, namely, the dialogical approach to Martin-Löf's Constructive Type Theory. The authors present this in a general form and independently of adaptations deployed in parts I and II. Part III also includes an appendix on the relevant notions of Constructive Type Theory, which has been extracted from an overview written by Ansten Klev. The book concludes with some brief remarks on contemporary approaches to analogy in Common and Civil Law and also to parallel reasoning in general. (shrink)

Professor Guillaume's translation of the Sira of Ibn Ishaq is now reissued. The translator used Ibn Hisham's abridgement and also included many additions and variants found in the writings of early authors. The book thus presents in English practically all that is known of the life of the Prophet.In the introduction, the translator discusses the character of the Sira in the light of the opinion of early Arabian scholars, noting especially the difficulties of the poetry. In its origins Dialogical logic constituted the logical foundations of an overall new movement called the Erlangen School or Erlangen Constructivism that should provide a new start to a general theory of language and of science. In relation to the theory of language, according to the Erlangen-School, language is not just a fact that we discover, but a human cultural accomplishment whose construction reason can and should control. The constructive development of a scientific language was called the Orthosprache-project. Unfortunately, the (...) Orthosprache-project was not further developed and somehow seemed to fade away. Perhaps, one could say that one of the reasons is that the semantic links between dialogical logic, that was restricted to logical constants, and the more general linguistic aspirations of the Orthosprache were not sufficiently developed and then the new theory of meaning of dialogical logic seemed to be cut off from the project of setting the basis for a general theory of meaning.In the present paper we would like to contribute to precise one possible way in which a general dialogical theory of meaning could be linked to dialogical logic. Protecting women and children is one of the core values of the Islamic legal tradition. In Muslim countries religious, constitutional, and legal frameworks obligate the state to take special measures to provide protection to women and children within families and in society. However, despite such provisions, post-divorce maintenance rights are not granted to women in Pakistan and Iran. Family law enacted in Pakistan and Iran still differs in form and substance from what has been mentioned in the primary sources of (...) Islamic law and from the previous articulations of early Islamic law scholars. Moreover, patriarchal notions of male authority are still sustained through law and judicial interpretations when it comes to the question of giving post-divorce maintenance to women. As a result in the absence of a welfare system divorced women are left in a vulnerable situation. Although in Iran, some financial compensation under the concept of Ujrat ul Misl is given to divorced women, but it remains unclear whether the right to Mata’at-ul-Talaq has been recognised under the family law. In Pakistan the law does not include any provision for giving women Ujrat ul Misl and Mata’at- ul -Talaq. Moreover in the absence of a welfare system, divorced Muslim women in both countries are left in a vulnerable situation. This article engages with plural normative sources and contemporary notions of human rights to make the case for family law reform and for awarding post-divorce maintenance rights to Muslim women in Pakistan and Iran. Despite the fact that it has been more than 40 years since Henry Corbin and Hossein Ziai pointed out that the work of Shihāb al-Dīn Suhrawardī (549/1155, 587/1191) has not yet been systematically studied, a thorough investigation of his work is still in its infancy. The present brief study, which aims to contribute to filling such a gap by further developing some of the points contained in Rahman & Seck's (2022) paper, articulates some remarks on the relevance of Suhrawardī's epistemology (...) of presence for contemporary studies on temporal logic. More specifically, we will focus our brief presentation on the fruitfulness of his postulate of the priority of experience of immediate knowledge discussed in the Ḥikmat al-Ishrāq and how this postulate is related to the concept of self-consciousness (وعي الذاتي).Thus the particularity of this study is that Suhrawardī's epistemology of presence, unlike contemporary temporal logic developed for example by Prior, emphasizes the temporalization of the instantiation of an event or the performance of an act rather than of the propositions that express that event or act. Moreover, in Suhrawardī's modal syllogistic, there is an analysis of contingency that differs from most contemporary authors and that also involves several dimensions of time. More generally, Suhrawardī's notion of direct knowledge offers new insights into the logical and ontological status of the now. (shrink)

Physically and intellectually, man is not the same as a million years ago. This “improvement” in humans has occurred over a period of time and not as a result of any outside biotechnical intervention. So, the question is what is the need now? The fine line between what can be done technically and what should be done morally is the reason for biomedical ethics. What is the nature of man, and what is his relationship with his creator and his environment? (...) Whose interest are we as scientists and physicians to guard? What are the rights of the unborn, and who protects those rights? While seeking medical treatment for infertility and reconstructive surgery for a malformation or genetic manipulation for a genetic disease might perhaps be appropriate and recommended, is it also appropriate to create a super healthy, super human with genetic manipulation? If so, then are we embarking on the path of ethnic cleansing of humans of lesser ability, and is it appropriate to discriminate? In this paper, such questions and concerns are discussed from an Islamic perspective. (shrink)

Despite periods of resurgence over the last decades, it is safe to say that transcendental arguments no longer enjoy a prominent presence in the philosophical landscape. One reason for their declining prominence is the sustained suspicion that despite their self‐proclaimed metaphysical neutrality, transcendental arguments are, in fact, metaphysically committed. This paper aims to revive the discussion of transcendental considerations by offering a metaphysically neutral account of transcendental arguments. I argue that a metaphysically neutral conception of transcendental arguments requires a revision (...) of two concepts constitutive of transcendental claims, namely, transcendental necessity and the a priori. I propose a transcendental reading of Wittgenstein's On Certainty, which, I maintain, provides us with an alternative, metaphysically neutral understanding of these concepts. Thus revised, transcendental claims are suitable for what Mark Sacks once described as the “post‐metaphysical” orientation of contemporary philosophy. (shrink)

Recent literature on dialogical logic discusses the case of tonk and the notion harmony in the context of a rule-based theory of meaning. Now, since the publications of those papers, a dialogical version of constructive type theory (CTT) has been developed. The aim of the present paper is to show that, from the dialogical point of view, the harmony of the CTT- rules is the consequence of a more fundamental level of meaning characterized by the independence of players. In her book Fiction and Metaphysics (1999) Amie Thomasson, influenced by the work of Roman Ingarden, develops a phenomenological approach to fictional entities in order to explain how non-fictional entities can be referred to intrafictionally and transfictionally, for example in the context of literary interpretation. As our starting point we take Thomasson’s realist theory of literary fictional objects, according to which such objects actually exist, albeit as abstract and artifactual entities. Thomasson’s approach relies heavily on the notion of ontological dependence, (...) but its precise semantics has not yet been developed. Moreover, the modal approach to the notion of ontological dependence underlying the Artifactual Theory has recently been contested by several scholars. The main aims of this paper are (i) to develop a semantic approach to the notion of ontological dependence in the context of the Artifactual Theory of fiction, and in so doing bridge a number of philosophical and logical gaps; (ii) to generalize Thomasson’s categorial theory of ontological dependence by reconstructing ontological categories of entities purely in terms of different structures of ontological dependence, rather than in terms of the basic kinds of entities the categorical entities depend on. Intellectual Capital is a driving force behind the financial performance of non-financial firms. Investing in intellectual and physical capital allows companies to optimize their financial performance by maximizing resource utilization. This study aims to determine whether IC efficiency impacts the financial performance of listed Pakistani and Indian companies between 2010 and 2020. Return on Assets and Return on Equity are used to calculate financial performance, and IC is calculated using the modified Value-Added Intellectual Coefficient model. Regression analysis is performed using (...) the STATA software developed by the South Texas Art Therapy Association. Human Capital, Structural Capital, and Capital Employed have a significant impact on Pakistani and Indian firms’ financial performance. Resource-based theory supports these findings. The findings should provide management with a prompt to improve financial performance and emphasize the importance of IC. A rare study has addressed the impact of IC on firm financial performance using the MVAIC model, rather than the VAIC model, in Pakistan and India. (shrink)

The Joint Battle Management Language (JBML) is an XML-based language designed to allow Command and Control (C2) systems to interface easily with Modeling and Simulation (M&S) systems. While some of the XML-tags defined in this language correspond to types of entities that exist in reality, others are mere syntactic artifacts used to structure the messages themselves. Because these two kinds of tags are not formally distinguishable, JBML messages in effect confuse data with what the data represent. In this paper we (...) show how a realism-based ontology combined with a rule language can be used to make these distinctions explicit. The approach allows storage of the contents of JBML messages in a Referent Tracking System in a format that mimics the structure of reality thereby providing an aid to message validation. (shrink)

Despite the significant amount of debate that Merleau-Ponty’s work has seen over the years, it remains an unresolved issue whether his phenomenology offers what he announces as a ‘new definition of the a priori’. In this paper, I make a case in favor of his claim by clarifying his commitments to the a priori against two dominant lines of interpretation, naturalist and Kantian. I argue that Merleau-Ponty’s view that the sciences themselves rely on the a priori method of Wesensschau establishes (...) his basic commitment to apriority. At the same time, Merleau-Ponty’s treatment of the a priori differs in important respects from the Kantian a priori and its transcendental idealist ramifications because, on his view, the subject is not the unique ground of constitution. Having tackled these obstacles to understanding Merleau-Ponty’s commitments to the a priori, I argue in light of his conception of ‘radical reflection’ that rather than being a static element of experience, the a priori stands in a dynamic relation with the a posteriori as a distinctive way of articulating structures of lived experience. the demise of the logical positivism programme. The answers given to these qu- tions have deepened the already existing gap between philosophy and the history and practice of science. While the positivists argued for a spontaneous, steady and continuous growth of scientific knowledge the post-positivists make a strong case for a fundamental discontinuity in the development of science which can only be explained by extrascientific factors. The political, social and cultural environment, the argument goes on, determine both the questions and (...) the terms in which they should be answered. Accordingly, the sociological and historical interpretation - volves in fact two kinds of discontinuity which are closely related: the discontinuity of science as such and the discontinuity of the more inclusive political and social context of its development. More precisely it explains the discontinuity of the former by the discontinuity of the latter subordinating in effect the history of science to the wider political and social history. The underlying idea is that each historical and - cial context generates scientific and philosophical questions of its own. From this point of view the question surrounding the nature of knowledge and its development are entirely new topics typical of the twentieth-century social context reflecting both the level and the scale of the development of science. RésuméAristote n'a pas développé une théorie de la quantification du prédicat, mais une étude récente de Hasnawi a montré qu'Ibn Sīnā a consacré à celle-ci une étude rigoureuse. Assumant la structure aristotélicienne sujet-prédicat, Ibn Sīnā qualifie les propositions qui comportent un prédicat quantifié, de propositions déviantes. Une conséquence de cette approche avicennienne est que la seconde quantification est absorbée par le prédicat. La distinction claire ainsi opérée entre un sujet quantifié, qui pose le domaine de la quantification, et une partie (...) prédicative, qui construit une proposition sur ce domaine, correspond structurellement à la distinction, faite dans la théorie constructive des types, entre le type des ensembles et le type des propositions.Aristote n'a pas non plus combiné son analyse logique de la quantification avec sa théorie ontologique des relations ou de l’égalité. Ibn Sīnā, en revanche, a utilisé les syllogismes qui nécessitent une logique de l’égalité et il a examiné des cas où la quantification se combine, via l’égalité, avec des termes singuliers. En outre, ces réflexions sont essentielles pour sa théorie des nombres qui est fondée sur l'interaction entre l’un et le multiple. Lorsqu'on combine la théorie métaphysique de l’égalité telle qu'on la trouve chez Ibn Sīnā avec son travail sur la quantification du prédicat, il en résulte tout naturellement une logique de l’égalité. En effet, l'interaction entre la quantification du prédicat et l’égalité peut être appliquée aux exemples de syllogismes mentionnés par Ibn Sīnā dans lesquels ces notions interviennent. En utilisant les instruments formels fournis par la théorie constructive des types de Martin-Löf, cet article établit des liens entre la métaphysique d'Ibn Sīnā et son travail logique, liens qui ont été discutés en relation avec d'autres sujets par Thom et Street. The main aim of the present paper is to show that, if we follow the dialogical insight that reasoning and meaning are constituted during interaction, and we develop this insight in a dialogical framework for Martin-Löf's Constructive Type Theory, a conception of knowledge emerges that has important links with Robert Brandom's (1994, 2000) inferential pragmatism. However, there are also some significant differences that are at center of the dialogical approach to meaning. The present paper does not discuss explicitly phenomenology, however, (...) one might see our proposal as setting the basis for a further study linking phenomenology and the dialogical conception of meaning – the development of such a link is part of several ongoing researches. The ‘dignity and worth of the human person’ emphasised in international human rights instruments resonate strongly in relation to the world’s ageing population, which is projected to be the fastest growing population group in the world and often among the most vulnerable. While elderly persons as a group are heterogeneous and their socio-economic life situation varies significantly between individuals, the need for universal support mechanisms such as non-contributory old-age benefits have been recognised by many states, and currently, over 100 countries (...) around the world provide some form of social pension targeted towards the elderly populations. This article appraises a sample of these old-age pension schemes from the perspective of the right to social security, with particular emphasis on the dignity and worth of the human person as espoused within the international human rights regime. Ils sont la source d'un des problèmes majeurs de l'histoire omeyyade comme de celle de l'Orient proto-byzantin.
