In this paper, I explore the ways in which human bodies, payback, and comestibility become inescapably entangled in cultures in which honor is the prevailing virtue. Shakespeare was deeply sensitive to the social and psychological processes through which these concepts become entwined when honor is at stake—to the ways in which, as a means of corrective response, men who transgress a code of honor can be rightly reduced to their bodies, similar to how those who are not allowed to be (...) full participants in an honor culture (most particularly women) always already are. I begin by examining Shakespeare’s earliest depictions of honor cultures in Titus Andronicus and The Rape of Lucrece, and then briefly discusses how the ideas they trade in are further developed and complicated later in his career, focusing specifically on Othello. -/- . One of the most intriguing and painful anomalies of the modern world—so diffused that it has almost become a universal culture— is the incredible number of individuals and groups who kill, torture, burn, kidnap, imprison or merely outrage other people with a clear conscience when a political motive may be alleged. Added to them is the much larger number of people and institutions that tolerate, approve, encourage, praise and even bless that type of behavior when it occurs within (...) a political context. Included in this generic political violence is „the kind of behavior that is much more serious and that we may call terrorist, the behavior of those who seek to impose their will through the commission of atrocities that sow a generalized terror or a panic fear, and then to manipulate the reactions these atrocities provoke. Here “private” terrorists, as well as “semi-state” and “state” terrorists commit acts that would not be tolerated in normal, non-political life, and the public that approves this conduct would never accept it if it occurred in everyday life. Listening for the sounds of silence: a nursing consideration of caring for the politically tortured In 1997 Amnesty International reported that 115 out of 251 countries surveyed practised torture on their citizens. Many of these victims have been forced to flee their country of origin and become refugees in the West, in countries such as Australia, Canada, the UK and the United States. However, torture itself remains an unspoken and covert problem. In addition to the obvious traumatic effects, (...) it may induce shame and dread on the part of the victim. It may be too terrifying and too painful to talk about, and yet may affect every aspect of a person’s life (Forrest 1996). All too commonly a victim of torture may pass unnoticed or unrecognised because health care providers do not know how, or may be unwilling to engage with the issue. This paper will examine the implications for nurses of caring for the tortured. It will explore the nature of torture itself, who might be the perpetrators and who might be the victims (always acknowledging that nurses and other health care staff are often both), how victims of torture may present for health care, and the possible subjective perceptions of a torture victim when faced with a Western health care process and understanding. Finally, it will argue for an increase in awareness and sensitivity on the part of all nurses in all health care settings to the needs and sensibilities of victims of torture, and suggest that caring for them is the distillation of everything good nursing practice should be. A perceived national emergency creates the temptation to abandon principled constraints to official action in order to pursue whatever is thought necessary to confront the crisis. Principled constraints are thought good precisely when they are least needed - during normal times - and thought obstructionist when they are most needed to guide and constrain official action - during times of perceived exceptional circumstances. We are accustomed to thinking of constitutional rights not as absolutes, but as subject to balancing against compelling (...) governmental need. When compelling government interest is expressed in terms of necessity, otherwise prohibited actions, such as torture, may be justified in specific circumstances. In this Article, I argue that we should reject the temptation to rely on necessity to justify extralegal responses to emergencies. Moreover, we should also reject the claim that the Constitution contains a core principle of necessity that frees executive officials to act unfettered by other constitutional constraints under some circumstances. One problem with necessity is that it displaces constitutional commitments to constrained action because necessity, not constitutional principle, becomes the ultimate authority for official action. A second problem with necessity is that when it is used to justify the practice of torture, it undermines the liberal conception of the person that grounds the political legitimacy of the State. Finally, when we prioritize necessity, we change how we look at the world in ways that have pervasive legal and cultural consequences for how we employ other constitutional rights. When we rely on necessity to override principled commitments, such as the prohibition against torture, we change our practices and principles, creating the conditions for changing fundamental aspects of our constitutional culture. I argue that although it is always subject to change, our constitutional culture does not support a worldview that legitimates treating persons as objects of torture, and that arguments to change our culture in light of the needs of necessity are insufficient. Some of our most fundamental moral rules are violated by the practices of torture and war. If one examines the concrete forms these practices take, can the exceptions to the rules necessary to either torture or war be justified? Fighting Hurt brings together key essays by Henry Shue on the issue of torture, and relatedly, the moral challenges surrounding the initiation and conduct of war, and features a new introduction outlining the argument of the essays, putting them (...) into context, and describing how and in what ways his position has modified over time. The first six chapters marshal arguments that have been refined over 35 years for the conclusion that torture can never be justified in any actual circumstances whatsoever. The practice of torture has nothing significant in common with the ticking bomb scenario often used in its defence, and weak U.S. statutes have loop-holes for psychological torture of the kind now favoured by CIA in the 'war against terrorism'. The other sixteen chapters maintain that for as long as wars are in fact fought, it is morally urgent to limit specific destructive practices that cannot be prohibited. Two possible exceptions to the UN Charter's prohibition on all but defensive wars, humanitarian military intervention and preventive war to eliminate WMD, are evaluated; and one possible exception to the principle of discrimination, Michael Walzer's 'supreme emergency', is sharply criticized. Two other fundamental issues about the rules for the conduct of war receive extensive controversial treatment. The first is the rules to limit the bombing of dual-use infrastructure, with a focus on alternative interpretations of the principle of proportionality that limits 'collateral damage'. The second is the moral status of the laws of war as embodied in International Humanitarian Law. It is argued that the current philosophical critique of IHL by Jeff McMahan focused on individual moral liability to attack is an intellectual dead-end and that the morally best rules are international laws that are the same for all fighters.Examining real cases, including U.S. bombing of Iraq in 1991, the Clinton Administration decision not to intervene in the 1994 Rwandan genocide, NATO bombing of Serbia in 1999, and CIA torture after 9/11 and its alternatives, this book is highly accessible to general readers who are interested in the ethical status of American political life, especially foreign policy. This article argues that we sometimes overemphasize the significance of particular acts — i.e., x either is or is not torture — as against the importance of the phenomenology of torture, which involves creating a structure of complete domination and, therefore, complete vulnerability. This is similar to the phoenomenology of slavery. Indeed, in this 150th year since the Supreme Court's decision in the Dred Scott case, it is important to contemplate the full meaning of Chief Justice Taney's declaration that blacks had "no rights" that whites were "bound to respect." Can a liberal political order ever carve out a set of persons — such as suspected terrorists — who indeed have "no rights" that the state is obligated to respect? If the answer is no, then what are the implications for the process by which the United States, presumably a liberal political order, conducts interrogations even of those suspected of being "the worst of the worst"? ¡PRESENTE! investigates the many answers to a seemingly simple question: What does it mean to be present? Performance studies scholar Diana Taylor answers that question by offering an expansive explication of presence as both ethical command and performative knowledge production. Taking the histories of state violence, colonialism, and imperialism as her starting point, Taylor situates being ¡Presente! as an embodied and performed practice of standing alongside those harmed by historical and ongoing violence. Noting that Present/e is simultaneously single and plural (...) in English and Spanish, and drawing on Jean Luc Nancy's formulation of being singular plural, Taylor asks how presence is imbricated in questions of subject formation and collectivity. She begins with reframing the racialization of Latin Americans as a coming into presence through colonial conquest-a presence not as subjects but as subjugated objects-and asks what was made absent through this racialized process. For Taylor, the epistemicide of Indigenous, Native, and African ways of knowing stands at the center of this process of presence and absence. To counter this ongoing epistemicide, Taylor situates ¡Presente! as a performative and decolonial mode of knowledge production that decenters European Enlightenment traditions and seriously takes up Native, Indigenous, and African ways of knowledge and temporality. Grounded in performance studies, this book links knowledge to action as a doing practice, or what Taylor calls a "peripatetic strategy" that emphasis movement in learning. This book offers an expansive theory of ¡Presente! in various locations and situations: the original colonial conquest of Columbus and the Spanish; the May 1968 student protests; a study in Zapatistan autonomy; the 43 disappeared students of Ayotzinapa; queer histories of Mexico; and the former torture centers of the Pinochet dictatorship. Throughout these varied locations, Taylor weaves a methodology, theory, and practice of ¡Presente!. This book will be of interest to students and scholars of performance studies, Latin American studies, American studies, critical ethnic studies, colonial, decolonial, and postcolonial studies, and queer theory. In my recent book Liberalism with Excellence, I have expounded at length a conception of warranted self-respect. That conception, which draws heavily though far from uncritically on the scattered passages about self-respect in the writings of John Rawls, is central to my defense of a variety of liberalism that combines and transfigures certain aspects of Rawlsianism and perfectionism. However, it is also central to the positions taken in some earlier books of mine on capital punishment and torture. Although my (...) understanding of warranted self-respect was presented far more briefly or obliquely in each of those earlier books than in Liberalism with Excellence, it in fact underlies both my limited defense of the death penalty and my absolutist insistence that the use of interrogational torture is never morally permissible. The present paper will recount the gist of my conception of warranted self-respect and will then explain how that conception figures pivotally in my ruminations on the diverse matters of political morality that have been mentioned here. The article discusses the rights of minorities in the system of the International Covenant on Civil and Political Rights. It establishes a conceptual distinction between universal rights, specific rights of minorities in general and specific rights of particular minorities. Universal rights correspond to all individuals (e,g,, “no one shall be subjected to torture”) or all groups of a certain class (e.g., “all families are entitled to protection”). Minority groups and their members are entitled to these rights in the (...) same way as any other individual or group. Specific rights of minorities in general are granted to minority groups (e.g., “minority groups have the right to speak their own language”) or their members (e.g., “persons belonging to a minority group have the right to speak the language of the group”). Finally, specific rights of particular minorities are granted to specific groups identified by their characteristics (e.g., “the linguistic minority X has the right to speak the X language”) or their members (e.g., “any member of the linguistic minority X has the right to speak the X language”). Treaties and international declarations often refer to universal rights and specific rights of minorities in general. However, these rights are usually recognised in broad terms, and their implementation may lead to the recognition of specific rights in favour of particular minorities or their members. Protection of minorities (in the broad sense of the expression) is based on two pillars: on the one hand, the protection against discrimination; on the other hand, the protection of minorities in the strict sense. The first pillar is an aspect of the general principle of nondiscrimination and requires respect for both formal and substantive equalities. The protection of minorities in the strict sense involves the preservation of their particular identity. The purpose of the equality in a formal sense is achieved through universal rights, to the extent that these are granted to minority groups and their members. On the contrary, to achieve equality in a substantive sense, it could be necessary to implement positive measures. The implementation of these measures will usually lead to the recognition of specific rights of minority groups or their members. Finally, the protection of the distinctive characteristics of the minorities will also be done through specific rights. Thus, on the one hand, there are rights, which are intended to protect the minority forms of life (i.e. to protect differences), and, on the other hand, those that are intended to allow minorities equal access to different uniform social goods (i.e. to protect equality). Whereas the former ones seek to protect and promote the particularities of the minority culture (e.g., the right to receive education in their own language), the latter ones are recognised to overcome the disadvantages that minority groups and their members face and are not intended to promote peculiarities, but rather to permit equal access to resources and social opportunities. Article 27 of the International Covenant on Civil and Political Rights enshrines specific rights of minorities intended to protect and promote their own forms of life. Although economic rights are not mentioned (the article refers to the rights “to enjoy their own culture, to profess and practise their own religion, [and] to use their own language”), they may stem from the explicitly recognised rights. The rights recognised by the Covenant are not collective, but individual rights (“in those States in which ethnic, religious or linguistic minorities exist, persons belonging to such minorities shall not be denied the right [...]”). The rights recognised in the Declaration of the United Nations General Assembly on the Rights of Persons Belonging to National or Ethnic, Religious and Linguistic Minorities are of the same nature. The principle of equality and non-discrimination is contained in Articles 2.1 and 26 of the Covenant. This principle forbids direct and indirect discrimination, be it de iure or de facto. As this is a universal right, minorities can also benefit from it. According to the Human Rights Committee, Article 27 imposes on States the adoption of positive measures that exceed an attitude of mere abstention. In the same way, positive measures may be necessary to make the principle of equality and non-discrimination effective. Although neither Article 27 nor Articles 2.1 and 26 refer to individuals belonging to a specific minority, the concrete implementation of these articles through positive measures may produce specific rights for persons belonging to particular minority groups. Frantz Fanon, Psychiatry and Politics affords a much-needed and long-awaited addition to the literature on Frantz Fanon, an exhaustive study of the least-known aspect of his short but remarkable life, his psychiatric practice and publications. The monograph is co-authored by Nigel C. Gibson and Roberto Beneduce, with a foreword by Alice Cherki and translations by Lisa Damon. Gibson is a leading Fanon scholar, jointly responsible for the appropriation of Fanon’s oeuvre by postcolonial studies in the nineteen nineties, and Beneduce is (...) the founding director of Il Frantz Fanon Centro, a counselling and psychotherapy centre for immigrants, refugees, and victims of torture in Turin. Cherki is one of Fanon’s few surviving colleagues and the publication reunites the team that worked on Decolonizing Madness: The Psychiatric Writings of Frantz Fanon, the first translation of Fanon’s collected psychiatric publications into English. Decolonizing Madness was scheduled for release by Palgrave Macmillan in 2014, but is now due in 2019 and Gibson and Beneduce make a somewhat cryptic allusion to production problems in their introduction, stating: ‘We were naïve, as Fanon would have put it, to think that there would be no other interests at play’ (p.22). While the value of early detection of dementia is largely agreed upon, population-based screening as a means of early detection is controversial. This controversial status means that such screening is not recommended in most national dementia plans. Some current practices, however, resemble screening but are labelled “case-finding” or “detection of cognitive impairment”. Labelled as such, they may avoid the ethical scrutiny that population-based screening may be subject to. This article examines conceptualizations of screening and case-finding. It shows how the definitions (...) and delimitations of the concepts (the _what_ of screening) are drawn into the ethical, political, and practical dimensions that screening assessment criteria or principles are intended to clarify and control (the _how_ of screening, how it is and how it should be performed). As a result, different conceptualizations of screening provide the opportunity to rethink what ethical assessments should take place: the conceptualizations have different ethico-political implications. The article argues that population-based systematic screening, population-based opportunistic screening, and case-finding should be clearly distinguished. (shrink)

This article examines a population-based opportunistic screening practice for cognitive impairment that takes place at a hospital in Sweden. At the hospital, there is a routine in place that stipulates that all patients over the age of 65 who are admitted to the ward will be offered testing for cognitive impairment, unless they have been tested within the last six months or have been diagnosed with any form of cognitive impairment. However, our analysis shows that this routine is not universally (...) and mechanically applied. Rather, the health care professionals have developed and use an ethico-political judgment, concerning, for example,whomto test,whento offer the tests, andhowto explain and perform them. This article explores the role and practice of this form of judgment, emphasising its political and ethical nature. The analysis is based on qualitative interviews with professionals and patients, and draws on the theories of Aristotle and Hannah Arendt. (shrink)

The author describes Heller’s concept of ethics as a “quasi-sphere” intersecting with various fields relating to human relationships. Special attention is paid to the axiological aspects of her concept of ethics and the relationship between virtues and responsibility. The author also seeks to show how Heller integrated a traditional philosophical question—the relationship between “is” and “ought to be”—into her concept of “radical philosophy” at an earlier stage in the development of her philosophy. She initially considered the relationship between “is” and (...) “ought to be” to be contrasting. Later, when she had come to accept the political model of liberal capitalist society, the ideal of all-compassing equality became the ideal of “equality of opportunities”. The author interprets this shift as one in which the relationship becomes continual. He is also critical of Heller’s underestimation of the effect the “social a priori” has on the possibilities of human life. (shrink)

The political passages in Polanyi’s Personal Knowledge are an integral part of his arguments against ‘objectivism’ and/or a post-critical, personalist, fiduciary and fallibilist philosophy. This paper elaboratesthe social and political implications of Polanyi’s emphasis upon acceptance of one’s situation and the exercise in it of a sense of responsibility to transcendent ideals, as against attempts to start with a clean slate, to overcome all imperfections and to find some simple rule for political policy. Prescriptive duties and rights, (...) and mutual trust and solidarity, are the bases of politics, anti responsible action must start with them. Sustainable Development Goal (SDG) 2 relates to ending hunger, achieving food security and improving nutrition, and promoting sustainable agriculture. The SDGs mention only a few political indicators and SDG2 in particular is largely devoid of political considerations to end hunger and achieve food security. Nobel Laureate Amartya Sen famously observed the absence of famine in democracies, suggesting that a democratic system provides checks and balances that prevent famine. His observation has elicited further debate and triggered empirical studies in (...) recent years. Going beyond Sen’s hypothesis, this essay examines other political factors that would explain vulnerability to famine and that need to be addressed more explicitly in SDG 2 and similar initiatives. By taking the case of pastoralists in the Afar region of Ethiopia, this research explores selected political determinants of vulnerability to famine. The Eritrea-Ethiopia war and the ensuing border closure have had a detrimental effect on the livelihood of pastoralists in Afar – many pastoralists were deprived of a market and a reliable source of income. In addition, Afar pastoralists were sidelined from the informal salt sector on which they used to rely. The state facilitated this expropriation, leaving pastoralists even more vulnerable to famine. I argue that political considerations are crucial in successfully ending hunger and achieving food security. The essay uses a qualitative case study design and is based on a PhD dissertation. Evidence affirms that aesthetic engagement patterns our movements, often with us barely aware. This invites an examination of pre-reflective engagement within cities and also aesthetic experience as a form of the pre-reflective. The invitation is amplified because design has political implications. For instance, it can draw people in or exclude them by establishing implicitly recognized public-private boundaries. The Value Sensitive Design school, which holds that artifacts embody ethical and political values, stresses some of this. But while emphasizing that (...) design embodies implicit values, research in this field lacks sustained attention to largely unconscious background biases or values, rooted in cultural attitudes and personal interests, that lead theorists and planners—often too narrowly—to promote design organized around specific values such as defensibility. In examining these points, I draw on J. J. Gibson, a central figure for some writing on aesthetics and cities, and whom pragmatists and phenomenologists in turn influenced. Taking a cue from pragmatists in particular, I argue Gibson’s perceptual theory of affordances entails a theory of values, meaning our perception and therewith movements are inherently value-based. I advocate design that accounts for relatively constantly held values such as safety, while also handling the vast pluralism that exists and not crushing the aesthetic vibrancy of city life. A stereoscopic view on a particular historical event, in which contemporary assessments are combined with mental stereotypes of a medieval man, allows a slightly different assessment of the chronicle plot about the posthumous “baptism of bones” of Oleg and Yaropolk, Princes of Kyivan Rus, in 1044. While from theological positions it is perceived as an absurdity and a direct violation of the rules of the church, in the Middle Ages this act did not contradict the mass religious beliefs. From an (...) ethical point of view, the action of Yaroslav the Wise was regarded as concern for the souls of the ancestors who died pagans and therefore did not claim for the salvation. The soteriological optimism that prevailed in the eleventh century in countries of the late Christianization, including Kyivan Rus, gave hope that living people were able to influence the fate of the souls of the dead. From a political point of view, the baptism of the ashes of the ancestors and their reburial in the family tomb of the Princes of Kyiv in the Church of the Tithes was aimed at expanding the circle of heavenly patrons and protectors of the princely dynasty, expanding the period of the Christian history of Kyivan Rus, and, as a result, legitimizing the power of Yaroslav the Wise. The human history has evidenced a great number of systems of hierarchy and power, various manifestations of power and hierarchy relations in different spheres of social life from politics to information networks, from culture to sexual life. A careful study of each particular case of such relations is very im-portant, especially within the context of contemporary multipolar and multicultural world. In the meantime it is very important to see both the general features, typical for all or most of the hierarchy (...) and power forms, and their variation. This set of issues has been treated by a series of international conferences titled ‘Hierarchy and Power in the History of Civilizations’ held in 2000–2006. Most articles of this volume were originally presented at the 4th conference of this series (Moscow, 2006). Needless to mention that all those presentations have been substantially re-worked for the publication in this volume. Notwithstanding the fact that the relations of hierarchy and power are rele-vant for all the spheres as they penetrate the whole of social life, establishing a sort of framework for the human agency, they are naturally most visible in the political sphere. They existed long before the formation of the earliest states – ethologists maintain that complex systems of hierarchy and power can be found among many highly organized animals. Yet, this was with the formation of the state and civilization when the power and hierarchy relations acquired their mature forms. Although ancient and medieval systems of government and domination always attract special attention, contemporary systems are much closer for every scholar. At the same time relations of power and hierarchy in the modern political world system demonstrate a great number of variants, levels and dimensions. In the present edited volume we only focus on three aspects of this important subject. These are revolutionary transformations (in the broad sense of this notion), violence, and globalization. Modernity is marked by the advent of technologies capable of storing data almost indefi­nitely. On the other hand, the data collection takes place without the conscious permission of the users. The storage and collection of personal data is a potential problem, since the digital footprint of a person on the Internet has an impact on the social and political rep­resentation of the individual, its perception by other actors. Compromising the content of a digital footprint can expose information that is (...) not intended for others. There is cur­rently an increasing trend of misuse of stored data, both by criminals and by companies that use the data for sale or surveillance. The need to control how data is collected, stored and used leads to the emergence in the academic literature and the legal field of the “right to be forgotten”, which allows a person to actively moderate the process of collecting and storing data, to participate in determining the circle of those to whom they can be accessed, and delete personal data. The adoption of such a right not only allows the state to influence the collection and storage of data, regulating interactions through law-making activities, but also to realize the potential of an autonomous individual. The prospect of legislating the right to be forgotten has sparked debate in the academic and professional community about the destruction of the free marketplace of ideas and the imposition of political censor­ship on the Internet. The article deals with the philosophical, ethical and political founda­tions of the right to be forgotten. The article substantiates the conclusion that the right to be forgotten has a positive heuristic potential, but at the same time it has conceptual flaws, and is also not able to completely correct the current situation of data processing. However, the implementation of the right to be forgotten in the future can have a beneficial effect on the current situation in the field of collection and storage of personal data. (shrink)

The present essay focuses on political torture during the twentieth century. It takes a multidisciplinary approach, because it entails insights from history, politics, ideology, anthropology, psychology and literature. The aim of the present essay is to discuss the relation between "Classical" torture (in the past centuries) and "Modern" torture (in the twentieth century), analyzing the phenomena in a comparative perspective and paying attention to the hidden and unconscious motives behind historical facts. What I am interested in (...) is the mechanism by which, in the twentieth century, torture has been reintroduced particularly for political prisoners - that means torture for ideas and conscience, torture as a technique of power and not merely as a technique of punishment. What torture destroys first is the dignity and privacy of the victim; only then does it destroy the victim's freedom and integrity. For this reason, every torture is an act of rape, even a symbolic one. I mean this in psychological terms, not as a demonstration of feminist vocabulary. Every touching of the victim's body is rape, emphasizing the "virility" of the torturer. First of all, the torturer wants to become a master of his victim's body, and only later, a master of the tortured person's mind. I include imagination in the concept of torture, imagination being one of the tools of the act of torturing. In torture, imagination becomes, in my demonstration, a never-ending weapon. (shrink)

In “On the character of social communities; the state and the public domain” [Philosophia Reformata 69:125-39, 2004] Dick Stafleu has suggested that the social aspect as currently constituted under Dooyeweerd, covers two distinct things: • companionship • authority and discipline, and that the latter should become a new aspect, the political, placed after the economic and before the juridical. I would like to briefly suggest some issues that need to be discussed and resolved before his suggestion is adopted. I (...) have long felt the tension between the two parts of Dooyeweerd’s version of the social aspect that Stafleu refers to — companionship and authority — and I think Stafleu is right to open up discussion about it. But I am not happy that his proposal either is necessary or solves the problem. Moreover, I can also understand something of Dooyeweerd’s own thinking as he kept the two together. (shrink)

In chapter one I firstly critique some contemporary family-resemblance approaches to the category woman, and claim that they do not take sufficient account of dis-semblance, that is, resemblances that people have in common with members of the contrast category man. Second, I analyze how the concept of woman is semantically contestable: resemblance/dissemblance structures give rise to vagueness and to borderline cases. Borderline cases can either be included in the category or excluded from it. The factors which incline parties in a (...) dispute about membership to include or exclude depend on metaphysical, ethical, or political background assumptions. In chapter two, I begin by considering the harms suffered by transgender persons through “misgendering”, the deployment of gender terms which inflict psychological harms upon transgender persons, place them in situations of injustice, or diminish their self-respect. Such deployments are morally contestable: they can be challenged on ethical grounds. Several characterisations of the term ‘woman’ proposed in the feminist literature are critiqued from this perspective. In chapter three, I elaborate a broadly liberal approach to gender pluralism. The approach involves: i) the public toleration of gender practices and beliefs which contest prevalent gender norms; and ii) state-gender neutrality. Public toleration allows gender non-conforming practices and beliefs within public space. State gender-neutrality consists mainly in the removal from law and government policy of provisions which assume compliance with prevalent conceptions of gender. (shrink)

The example of a political leader who has to decide whether he would allow the torture of a suspect in order to get information about a ticking bomb has become notorious in ethical discussions concerning the tension between moral principles and political necessity. The relation between these notions must be made as clear as possible before a sincere moral evaluation of ticking bomb situations can be given. The first section of this article considers whether the concept of (...) political obligation is different from moral and legal obligations or whether it is a special kind of moral obligation. In the second section, the idea that the dirty hands problem confronts us with the ambiguities of moral life is rejected because it would imply an untenable moral paradox. The thesis that is developed is, namely, if there is such a thing as political necessity, it must be some form of moral obligation. The third section analyses the concept of political necessity and concludes that it cannot overrule basic moral principles and that the international legal prohibition of torture must be considered to be a categorical imperative. In the last section, these ideas concerning political and moral necessity are brought in against the defence of torture, which should be tolerated in the ‘War on Terror’. There it will be argued that the use of the ticking bomb argument not only supports a highly hypocrite political practice but is also deceptive as a moral and political argument. (shrink)
