The concept of judicial justice in the information age has a natural affinity with artificial intelligence. As artificial intelligence continues to make breakthroughs in judicial data sorting and deep learning knowledge, judicial artificial intelligence has gradually become a reality. Artificial intelligence can conduct legal argumentation, interpret calculation results, human–computer collaboration, and judicial judgment. At the (...) same time, the development of artificial intelligence technology also has potential risks, such as algorithm black boxes, algorithm discrimination, etc., to help judges achieve judicial justice, the value of judicial justice should be pursued to the limit of its judicial application. This essay argues that individual-oriented informed consent is inadequate to protect human research subjects in mainland China. The practice of family-oriented decision-making is better suited to guide moral research conduct. The family’s role in medical decision-making originates from the mutual benevolence that exists among family members, and is in accordance with family harmony, which is the aim of Confucian society. I argue that the practice of informed consent for medical research on human subjects ought to remain family-oriented in mainland China. (...) This essay explores the main features of this model of informed consent and demonstrates the proper authority of the family. The family’s participation in decision-making as a whole does not negate or deny the importance of the individual who is the subject of the choice, but rather acts more fully to protect research subjects. Life has a central position in Hegel’s philosophy, and its development has gone through the stages from primitive unity to finite life. In this process it appears in two forms: the first is the form of conceptual definitions about life, which mainly involves Hegel’s preexisting thoughts, and these definitions are born out of his thinking about how to overcome the subject-object split; the second is the form of the principle of life, which mainly appears in the process of constructing Hegel’s (...) philosophical system, and the dialectical kernel of which is reflected in his combining of life with negativity. The study of the principle of life in Hegel’s philosophy enables a complete understanding of Hegel’s thought. This study deals with three aspects to reveal the principle of life in Hegel’s philosophy in terms of vitalization of the self, changes in pre and post thought. The vitalization of the self in Hegel’s philosophy is discussed, and the principle of life in Hegel’s philosophy is elaborated in two stages: the first and the second. (shrink)

In order to establish his "school of principle" system of thought, which was founded on objective idealism, Zhu Xi proposed a theory of "investigating things and exhausting principles" [gewu qiongli]. This became the epistemological foundation for his system of thought. This epistemology formed an organic whole with his world view. On the one hand, his "theory-of-investigating-things" epistemology opened up pathways for his system of objective idealism; on the other hand, his "school-of-principle" system formed the theoretical foundation for his epistemology of (...) Present-bias is the preference, all else being equal, for positive events to be located in the present rather than the non-present, and for negative events to be located in the non-present rather than the present. Very little attention has been given to present-bias in the contemporary literature on time biases. This may be because it is often assumed that present-bias is not a distinctive psychological kind; that what explains people’s being present-biased is just what explains them displaying various other time-biases. (...) According to this view, there is no need to investigate present-bias independently of investigating these other biases, since present-bias is really just a manifestation of these other biases. We call this the manifestation thesis. We take up the question of whether the manifestation thesis is true, and argue that it is not. Thus, by failing to investigate present-bias in its own right we are failing fully to understand the spectrum of ways in which people display time biases. In turn, we suggest, this may have implications for the ways we evaluate whether present-bias is rationally permissible. (shrink)

With a previous paper (Niu & Wang, 1995), a general, hypothetical outline of the mechanism of carcinogenesis was proposed. With reference to the fact of starvation-induced hypermutation in micro-organisms, we propose that the hypoxia commonly seen in the cells at the centre of solid tumours might also result in hypermutation, and then p53-dependent programmed cell death. Like the apparently adaptive mutations in micro-organisms, only those genes (e.g. p53) that enable the cells to escape from apoptosis may be selected.

To cope with the water deficit resulting from saline environment, plant cells accumulate three kinds of osmotica: salts, small organic solutes and hydrophillic, glycine-rich proteins. Salts such as NaCl are cheap and available but has ion toxicity in high concentrations. Small organic solutes are assistant osmotica, their main function is to protect cytoplasmic enzymes from ionic toxicity and maintain the integrity of cellular membranes. Hydrophillic, glycine-rich proteins are the most effective osmotica, they have some characteristics to avoid crystallization even in (...) high concentration, but because they are expensive they are not as commonly used as salts or organic solutes. In addition there is the question of whether the genetic information for growth in saline environment is present in all kinds of plants, both halophytes and nonhalophytes. (shrink)

From the viewpoint of an evolutionary biologist, carcinogenesis should be looked upon as a protective mechanism against destruction of DNA. Because genes expressed in embryonic cells are covered and protected by heterochromatinization, they are the most appropriate ‘alternate genes’ compared to genes that are expressed already in somatic cells. When DNA-damage occurs, the embryonic genes can be activated. Some somatic cells exhibit some features of embryonic cells.

This is an invited commentary on "Physical Time within Human Time" (Gruber, Block, & Montemayor, 2022) and "Bridging the Neuroscience and Physics of Time" (Buonomano & Rovelli, 2021). I’m very sympathetic to aspects of each proposal. In this article, I offer some comments, starting with (Buonomano & Rovelli, 2021).

Division of labour is a marked feature of multicellular organisms. Margulis proposed that the ancestors of metazoans had only one microtubule organizing center (MTOC), so they could not move and divide simultaneously. Selection for simultaneous movement and cell division had driven the division of labour between cells. However, no evidence or explanation for this assumption was provided. Why could the unicellular ancetors not have multiple MTOCs? The gain and loss of three possible strategies are discussed. It was found that the (...) advantage of one or two MTOC per cell is environment-dependent. Unicellular organisms with only one MTOC per cell are favored only in resource-limited environments without strong predatory pressure. If division of labour occurring in a bicellular organism just makes simultaneous movement and cell division possible, the possibility of its fixation by natural selection is very low because a somatic cell performing the function of an MTOC is obviously wasting resources. Evolutionary biologists should search for other selective forces for division of labour in cells. (shrink)

In order to explore the mechanism of consumer responses to corporate social responsibility, this paper constructs a research framework including CSR, consumer–company identification, consumer responses, and fit, and tests the framework using a scene-questionnaire survey. Empirical results demonstrate that CSR not only has positive influence on consumer purchase intention, recommend intention, and loyalty directly, but also has indirect positive influence on consumer purchase intention and recommend intention through CCI. The influencing process of CSR on CCI is moderated by fit and (...) the moderating direction is different owing to product types. For the products whose association preference is positive, fit can positively moderate the relationship between CSR and CCI, while for products whose association preference is negative, the moderating role will be negative. Comrade Hu Qili, on behalf of the Central Secretariat, has delivered a speech of congratulations at the Fourth Congress of the National Writers' Association. This speech is very important. In it, Comrade Hu Qili stated: "As regards the freedom of [artistic] creation, the Party and state should provide the necessary conditions [for it] and create the necessary environment and atmosphere. At the same time, the writers' own thoughts and feelings and their creative activities as a whole should be in step (...) with the environment of freedom provided by the Party and state." Demands are made on both sides. On the one hand, the Party and state should create the requisite conditions, environment, and atmosphere for literary creation. The civil liberties stipulated in the Constitution include the freedom of creation. For writers who are Party members, the rights of Party members, stipulated by the Party constitution and by the Party's criteria for political life, also include the right of freedom of creation. Many problems still exist in this respect; situations still exist wherein no active measures are being taken to create the conditions, environment, and atmosphere for writers to fully enjoy the freedom of creation due to them. [The authorities] in some localities even obstruct or willfully interfere with the realization of this freedom, or they suppress democracy, resort to persecution and retaliation, or employ crude and simplistic means to deal with writers and with artistic creation—a meticulous form of mental labor that has its own special regularities. The thorough solution of problems of this sort still requires great efforts on our part. On the other hand, Comrade Hu Qili also said in his congratulatory speech that the writers' own thoughts and feelings and their creative activities as a whole should be in step with the environment of freedom provided the Party and state. That is to say, they must remain in step with the Constitution, and where Party-member writers are concerned, they should remain in step with the Party constitution, and they should ensure the implementation of relevant stipulations in the Constitution and Party constitution. Many efforts must be made, whether by Party committees and governments at various levels or by the writers, to promote the healthy development and continued flourishing of socialist literature and art. Hence, the two sentences in Comrade Qili's congratulatory speech address the matter very comprehensively. (shrink)

Writing, or calligraphy, in China is strongly influenced by ancient techniques of making art. Chinese characters have evolved from the patterns of bronze drawings, and China’s earliest hieroglyphs usually retain the traces of their origin in paintings. These paintings usually recorded daily life, and the related Chinese characters have evolved from these with general, simplified and abstract features. The composition that makes Chinese characters is a manifestation of ancient Chinese philosophy, of which Confucianism, Taoism and Buddhism are the three key (...) strands. They have affected Chinese culture and aesthetics in all dynasties. Chinese philosophy emphasizes the integration of individuals in their surrounding environment. The art of ancient China consequently combines skills that relate to the artificial, or constructed, and to natural patterns. Chinese characters make a perfect example of this. The article/presentation will outline the research that I have so far undertaken on the relation between Chinese calligraphy and architectural space, between writing and constructing environments. It will also present some experimental design research that aims at developing from the above-mentioned basic research new architectural typologies that are contemporary, resonant and sensitive to the Chinese context. Die vorliegende Studie hat „Angst und Entängstigung“ in Kierkegaards Schrift „Begriff Angst“ zum Thema und versucht, durch detaillierte Textarbeit das hier beschriebene Phänomen der Angst als einen wesentlichen Teil des menschlichen Gefühlslebens in seiner vollen Begrifflichkeit zu entfalten. Die Arbeit ist in drei Teile gegliedert: der erste Teil beschäftigt sich mit den theologischen und metaphysisch-existentialistischen Grundlagen von Kierkegaards Schrift, der zweite Teil behandelt die Begriffe Angst und Entängstigung, der dritte Teil stellt die Angstthematik in den philosophischen Horizont der idealistischen und (...) nachidealistischen Philosophie. Der Übergang zum dritten Kapitel ist eine detaillierte tabellarische Darstellung der Angst in ihren wesentlichen Momenten, die die komplexe Entfaltung der Angstthematik übersichtlich macht und vor allem die These von der anthropologischen Grundlegung in ihren verschiedenen Stadien nachzeichnet. Mit der sich am Text durchgängig bestätigenden These, dass Kierkegaards Ansatz eine hamartologisch begründete Anthropologie zugrunde liegt, will die Studie eine der schwierigsten und dunkelsten Abhandlungen Kierkegaards in ihrer ganzen Komplexität erhellen. BackgroundIndividuals with mind-wandering experience their attention decoupling from their main task at hand while others with flow experience fully engage in their task with the optimum experience. There seems to be a negative relationship between mind-wandering and flow. However, it remains unclear to what extent mind-wandering exerts an impact on flow. And it is also elusive whether physical activity and mindfulness, which are as important factors that affected individuals’ attentional control and psychological health, are beneficial in explaining the association between (...) mind-wandering and flow. The current study investigated the relationship between mind-wandering and flow, and the potential mediation effects of physical activity and mindfulness in this association.MethodsA cross-sectional exploratory study design, including multiple scales such as the Mind-Wandering Questionnaire, the International Physical Activity Questionnaire Short Form, Mindfulness Attention and Awareness Scale, and the Short Dispositional Flow Scale was applied. Descriptive statistics and bivariate correlation coefficients were applied in the analysis of these data. A multiple mediation model was used to examine the relationships between mind-wandering, flow, physical activity, and mindfulness.ResultsMind-wandering was inversely associated with physical activity, mindfulness and flow, respectively; and flow was positively related to physical activity and mindfulness, respectively. Moreover, multiple mediation results demonstrated that physical activity and mindfulness, respectively, mediated the relationship between mind-wandering and flow.ConclusionThese findings are helpful to understand how our minds attend to the present moment, and the crucial roles of physical activity and mindfulness in the association between mind-wandering and flow. An implication of these is the possibility that the effective strategies aimed at enhancing both the levels of physical activity and mindfulness are needed to reduce the negative impact of mind-wandering on flow. Human resource management risks are due to the failure of employer organization to use relevant human resources reasonably and can result in tangible or intangible waste of human resources and even risks; therefore, constructing a practical early warning model of human resource management risk is extremely important for early risk prediction. The back propagation neural network is an information analysis and processing system formed by using the error back propagation algorithm to simulate the neural function and structure of the human (...) brain, which can handle complex and changeable things that do not have an obvious linear relationship between output results and input factors, so as to find the objective connection between the two. Based on the summary and analysis of previous research works, this article expounded the research status and significance of early warning for human resource management risks, elaborated the development background, current status, and future challenges of the BP neural network, introduced the method and principle of the BP neural network’s connection weight calculation and learning training, performed the risk inducement analysis, index system establishment, and network node selection of human resource management, constructed an early warning model of human resource management risk based on the BP neural network, conducted the risk warning model training and detection based on the BP neural network, and finally carried out a simulation and its result analysis. The study results show that the early warning model of human resource management risk based on the BP network is effective, and this trained and tested BP network risk warning model can be used to conduct early warning empirical research on human resource risks to prevent human resource risks, ensure enterprise’s benign operation, and at the same time play a role in supervision and promotion of market order rectification. I examine the relation between naturalistically motivated and other critiques of grounding and similar critiques of the contrast between A- and B-theoretic views of time. I argue that even the combined dialectical upshot of nonunity objections in the latter case is not what it is in the former. I sympathetically discuss the objection that the notion of grounding is not intelligible and part of ‘esoteric’ metaphysics; this objection turns out to be just as serious in the case of the A/B (...) contrast. I then consider whether grounding is needed to draw the A/B contrast in the first place and answer this question in the negative. Finally, I comment on the costs of esotericism in both cases. Während der moderne Neukonfuzianismus auf der „kreativen Transformation“ der Tradition des Konfuzianismus basiert, beruht meine Wiedergeburt der traditionellen chinesischen Kultur auf der Kritik am Konfuzianismus und der Umgestaltung der daoistischen Philosophie. Vor zwanzig Jahren jedoch befand sich dieses Projekt noch im Stadium einer Skizze und ich hatte keine Zeit, sie zu entwickeln, also nannte ich sie einen „vorläufigen Entwurf“.
