How do we frame decisions to use-or not use-military force? Who should do the killing? Do we need new paradigms to guide the use of force? And what does "victory" mean in contemporary conflict? In many ways, these are timeless questions. But they should be asked again in light of changing circumstances in the twenty-first century. The post-Cold War, post-9/11 world is one of contested and fragmented sovereignty. Contested because the norm of territorial integrity has shed some of its absolute (...) nature. Fragmented because some states do not control all of their territory and cannot defeat violent groups operating within their borders. Humanitarian intervention, preventive war, and just war are all framing mechanisms aimed at convincing domestic and international audiences to go to war (or not), as well as to decide who is justified in legally and ethically killing. The international group of scholars assembled for this book critically examine these frameworks to ask if they are flawed, and if so, how they can be improved. This paper reviews briefly the main approaches in the literature on ethics of war and suggests the need to move beyond an _ethic of justice_ towards an _ethic of care_. The analysis problematizes dominant understandings of “just war” and “just peace” in the literature and highlights that incorporating elements of an ethic of care, our understanding of ethics of war and peace can be redefined, sharpened, and redeployed through an enlarged ethical lens. The, classical realist writings of E.H. Carr and constructivist publications of Alexander Wendt are extraordinarily influential. While they have provoked a great number of reactions within the discipline of International Relations, the ethical dimensions of their works have rarely been studied at length. This article seeks to remedy this lack of examination by engaging in an in-depth scrutiny of the moral concerns of these two mainstream International Relations scholars. On investigation, it is revealed that Carr demonstrates a strong commitment to (...) the ethical principle of fairness and Wendt a moral concern for the prevention of the use of organized violence. These concerns are shared by Rawlsians and cosmopolitans in International Relations, and these findings may thereby encourage closer engagement between these diverse communities that rarely speak to one another and strengthen disciplinary research on morals. In this paper I aim to clarify Hegel's objection to the use of ideals in ethical thinking by examining his opposition to Kant's ideal of perpetual peace. I explain why Hegel believes that the ideal of peace amounts to nothing more than a moral condemnation that ignores the significance for international relations of appreciating the modern nation-state as an ethical achievement. I argue, however, that Kant's proposed federation can be grounded in the concrete ethical realities Hegel accepts as (...) compelling and uses this basis to sketch a defensible understanding of the obligating force of ethical ideals against Hegel's objections. In addition, he turns to the early church fathers to contend that, prior to Constantine, “without exception, the church strongly condemned the taking of human life in any form whatsoever”—thus rejecting abortion and infanticide, the blood sport of the Roman games, suicide, and killing in war (120). This was because the New Testament witness to Jesus and his death on the cross required early Christians to view “the means as just as important, if not more important, than the ends” (xiii).Arner supplements this deontological argument for Christian pacifism, which he learned from John Howard Yoder, with a brief consideration of the virtue of patience cultivated in the early churches, reflecting the influence of Stanley Hauerwas on his thought. This “cardinal virtue” connoting “longsuffering, forbearance, patient endurance”—as found in Jesus’s teaching in the Sermon on the Mount (Mt 5:38–48)—enabled early Christians to practice non-violent resistance “deferring personal revenge in favor of God’s vindicating justice” (98). If Christians were to adopt this same consistently pro-life ethic today, argues Arner, it would “lead to greater healing and peace in our blood-soaked world” (121). The book closes with three appendices—one of which is a chart of terminology that dehumanizes vulnerable victims, including unborn human beings. Almost all of the contributors to this volume—including biblical scholars, theologians, ethicists, pastors, activists, and others—criticize the ideology of Christian Zionism and its support of a theology of dispensationalism that, in their view, distorts the scriptures and fosters violence rather than reconciliation between the Israelis and the Palestinians. In his own presentation titled “What Can Pentecostals and Charismatics Do for Peace with Justice in Israel and Palestine?,” Alexander—who describes himself as a former “one-sided” Christian Zionist who later discovered the writings of Yoder and Hauerwas—appeals to Jesus’s teaching in the Sermon on the Mount and urges Pentecostals to create church communities “that cultivate persons of character and conviction, who through habits, practices, and action live out the core of our faith” (69). TWO FACETS OF HEGEL’S ETHICAL PHILOSOPHY become clear on close inspection. On the one hand, Hegel attempts to take advantage of the Kantian focus on autonomy as the ground for ethical obligation and build an account of Right in terms of free self-determining agency. On the other hand, once the account is in, it looks and feels quite different from Kant’s, emphasizing social institutions and history in ways that are distinctive to Hegel. How far do these Hegelian emphases pull us (...) from Kant? Are they simply an essential corrective of the Kantian project, as some Hegelians would like to claim? Or does Hegel end up with a view that is significantly antithetical to a Kantian position? In this paper I do not intend to address such questions comprehensively. In the wake of political evil on a large scale, what does justice consist of? Daniel Philpott takes up this question in Just and Unjust Peace. While scholars have written about many aspects of dealing with past injustice, no general ethic has emerged. Philpott seeks to provide a holistic model that delivers concrete ethical guidelines for societies striving to build peace.

Dominant normative theories of armed conflict orientate themselves around the ultimate goal of peace. Yet the deployment of these theories in the international sphere appears to have failed in advancing toward this goal. In this paper, we argue that one major reason for this failure is these theories’ use of essentially contested concepts—that is, concepts whose internally complex character results in no principled way of adjudicating between rival interpretations of them. This renders the theories susceptible to manipulation by international (...) actors who are able to pursue bellicose policies under the cover of nominally pacific frameworks, and we show how this happened historically in a case study of the Korean War of 1950–1953. In order to better serve the goals of peace, we suggest, the rules of war should be reframed to simpler, but more restrictive, normative principles. (shrink)

In the wake of political evil on a large scale, what does justice consist of? Daniel Philpott takes up this question in Just and Unjust Peace.

Peace plays a central role in the ethics of war and peace, but this proves to be an enormous challenge. In a recent article, Elisabeth Forster and Isaac Taylor grapple with this important topic. They argue that certain concepts in just war theory—aggression, legitimacy, and peace—are essentially contested and susceptible to manipulation. Because the rules are interpreted and applied by the very states that wage war, it is as if the fox is asked to guard the (...) chicken coop—a recipe for disaster. To avoid manipulation of the theory and make the goal of peace attainable, they defend “minimalism” in the ethics of war and peace. This paper responds to and builds on their article. After nuancing the analysis, I will argue that their minimalism does not solve the problem since the proposed alternative concept is equally prone to misuse, and that their minimalism is mistargeted. What I propose is to specify and ground the rules of war without raising the standard too high, to disentangle jus ad bellum and jus post bellum and see peace as guiding principle for jus post bellum, and to interpret that in a minimalist way. This essay explores Kant's writings on war and peace, and concentrates on the thesis that Kant has a just war theory. It strives to explain what the substance of that theory is, and finds that it differs in several respects from that offered by the just war tradition. Many scholars suspect that Kant has no just war theory. Effort is made to overturn this conventional understanding: first by showing, negatively, that Kant does not subscribe to the two main rival (...) doctrines on the issue, namely, realism and pacifism; and second by demonstrating, positively, how the core propositions of just war theory are consistent with Kant's basic moral and political principles. Interpretive reconstruction then reveals the full substance of Kant's just war theory, which is divided into accounts of jus ad bellum, jus in bello and jus post bellum. Kant's jus post bellum reflections remain his most deep, original and relevant in this regard. (shrink)

Consequentialists claim that their theory is simply that the right action is whichever one will lead to the best state of affairs - and that this formulation provides a powerful intuitive ground for accepting consequentialism. Recent arguments in value theory threaten to show that this formulation lacks either coherent meaning, because states of affairs cannot be good simpliciter, or philosophical power, because their goodness provides no reason to bring them about. I respond to two such arguments - from Judith Jarvis (...) Thomson and Richard Kraut - contending that none can be made to work in a way which undercuts consequentialism's simple formulation. In 1983 the US bishops issued a deeply influential pastoral letter, The Challenge of Peace: God's Promise and Our Response, which addressed moral questions of warfare, particularly in the context of the Cold War. Four decades later, it is clear that the challenge to build just and peaceful societies is still with us in the US and throughout the world. This article supports the development of new documents—whether episcopal or papal—to center nonviolence in Catholic teaching, to demonstrate the value (...) and efficacy of active nonviolence in working toward a just peace, and to clarify the relationship between nonviolence and the just war tradition. Who is to be included in a political community and on what terms? William A. Barbieri Jr. seeks answers to these questions in this exploration of the controversial concept of citizenship rights—a concept directly related to the nature of democracy, equality, and cultural identity. Through an examination of the case of Germany’s settled “guestworkers” and their families, _Ethics of Citizenship_ investigates the pressing problem of political membership in a world marked by increased migration, rising nationalist sentiment, and the ongoing reorganization (...) of states through both peaceful and violent means. Although some of Germany’s foreign workers have gradually attained a degree of social and economic legitimacy, Barbieri explains how they remain effectively excluded from true German citizenship. Describing how this exclusion has occurred and assessing current attitudes toward political membership in Germany, he argues for a just and democratic policy toward the tax-paying, migrant worker minority, one that would combine the extension of the individual rights of citizenship with the establishment of certain group rights. Through a dissection of ongoing public “membership debates” over issues such as suffrage, dual citizenship, and immigration and refugee policy, Barbieri identifies a range of competing responses to the question of who “belongs” in Germany. After critiquing these views, he proposes an alternative ethic of membership rooted in an account of domination and human rights that seeks to balance individual and group rights within the context of a commitment to democracy and equal citizenship. The breath or wind is the core point of humans. As you know, you will read in John 3.8 that the humans are born from the wind. The breath and wind have something to do with the ethics of being human, because humans live with breath and breathing. Ethics is essentially a way of life through breathing. Tadashi Ogawa is Professor of Philosophy Emeritus at Kyoto University Breath and breathing are central themes of Asian philosophies since ancient times. This was also the case in ancient Europe. But we forgot about this dimension in our academic discourse. The book of Lenart Škof brings into sight that well known Western philosophers of the 20th century picked this topic up again. The book is the most notable and far-reaching attempt to rediscover the fundamental dimension of breath and breathing for the contemporary discourse of philosophy. The wounds of political injustice include the following: violation of (...) the victim’s human rights, harms to the victim’s person, the victim’s ignorance of the source and circumstances of political injustices, the lack of acknowledgment of the suffering, the standing victory of the wrongdoer’s political injustice, and harm to the person of the wrongdoer. In such situations, Philpott argues, “what the government and community withhold is... an acknowledgment not only that a victim has rights but also that his rights were violated and that he suffered because of this violation” (37).The definition of justice in this context of wounds is reconciliation. It “encompasses peace settlements, human rights, democracy, and other key goals of negative and positive peace [as well as]... a broad restoration of right relationship involving a multiplicity of practices that each redress wounds of injustice in a particular way” (48–49).Daniel Philpott affirms peace as human rights, equality, and the rule of law, plus actors and institutions like the United Nations that spread this justice. He presents a fair summary of contending positions on human rights and works to develop overlapping agreement. “What is most essential to right relationship in the political order is human rights, their popular legitimacy, and their corresponding virtues” (55). But also, “It is in redressing wrong conduct—the other dimension of justice—that political reconciliation becomes far more distinctive” (55). This requires a deeper understanding of just peacemaking with restorative justice based in Judaism, Christianity, and Islam, and in insightful assessment of the burgeoning practices of truth commissions and restorative justice in the transitions from dictatorship to democracy.Philpott’s “rooted reason” invites different religions to speak from their depths but also encourages them to speak with reasons that can convince in public discourse (18, 20). Envisioning the incorporation of reconciliation into the modern state “is the life’s work of Rabbi Marc Gopin. In today’s Middle East, [End Page 211] Gopin argues, Jews as well as Christians and Muslims cannot afford to ignore the peacebuilding potential of traditional religious concepts” (132). Can Muslims, on the basis of their religious convictions, join in an overlapping consensus on such an ethic?” His answer is a clear yes (153).He identifies and assesses six practices of a politics of reconciliation. The first involves building socially just institutions and relations between states: “Since 1974, some ninety societies... have sought to replace dictatorships with democracies.... The concept of jus post bellum deals with moral considerations in the aftermath of conflict and is concerned with how a just peace should look like. This paper analyses the concept of jus post bellum as developed by contemporary Just War theorists. Its aim is to provide a critical perspective on the proposed substantial scope of this concept. In other words, it will consider the question: in restoring peace after war, is it justified for just combatants to change (...) the political structure of a defeated aggressor? The piece will be divided into two main parts. First, through a review of the literature, I define the current state of the art on jus post bellum thinking in relation to a number of key aspects of this concept. What does241 it entail? Which principles is it made of? What sort of activities do just war theorists speak about when they speak of creating a just peace? Second, I focus on the principle of ?political rehabilitation? of the defeated state: is it permissible? Under what circumstances? While considering these questions and authors' views on this matter, the paper will provide a critical reappraisal of the current debate on the justifiability of political reconstruction in post-conflict states.
