A stimulus may be given to the interpretation of Plato's Philebus by no longer ignoring the impact of Plato's political philosophy. A first hint is the occurrence of astasiastotatēn, a notion exclusively functioning within Plato's politi¬cal philosophy and no less surprising, in the 'non-political' Philebus, than 'Friday's Footprint' was to Crusoe. A second hint is the stasis between epistēmai and hēdonai, only to be avoided by the exclusion of hēdonai unwilling to subordinate themselves to phronēsis/nous. A new reading of Philebus (...) in light of these 'footprints' leads to the conclusion that not only the 'digressions' on ontology, cosmology and anthropology but also the analyses of hēdonai and epistēmai — in other words: the main body of Philebus — presuppose the substratum of Plato's political philosophy. Consciousness of this substratum contributes to understanding the content and course of the dialogue, and even to recognizing its unity. (shrink)

As public research organisations are increasingly driven by their national and regional governments to engage in knowledge transfer, they have started to support the creation of companies. These research based spin-off companies (RBSOs) often keep contacts with the research institutes they originate from. In this paper we present the results of a study of four research institutes within two universities and two non-university public research organisations (PROs) in the Netherlands. We show that research organisations have distinct motivations to support the (...) creation of spin-off companies. In terms of resources RBSOs contribute, mostly in a modest way, to research activities by providing information, equipment and monetary resources. In particular, RBSOs are helpful for researchers competing for research grants that demand participation of industry. Furthermore, RBSOs may be seen as a proactive response by Dutch public research organisations to demands of economic relevance from their institutional environment. RBSOs enhance the prestige of their parent organisations and create legitimacy for public funds invested in PROs. At the same time, most RBSOs do not have a significant impact on the direction of the research conducted at the PROs. (shrink)

This book provides an interdisciplinary examination of international law by addressing four critical questions: How are international legal rules distinctive? How does an investigator determine the existence of a rule of international law? Does international law really matter in international politics? and What effect could the changing nature of international relations have on international law? Using Constructivist theory, Arend argues that international law can alter the identity of states, and, consequently, have a profound impact on state behavior.

On the basis of the Suppes–Sneed structuralview of scientific theories, we take a freshlook at the concept of refutability,which was famously proposed by K.R. Popper in 1934 as a criterion for the demarcation of scientific theories from non-scientific ones, e.g., pseudo-scientificand metaphysical theories. By way of an introduction we argue that a clash between Popper and his critics on whether scientific theories are, in fact, refutablecan be partly explained by the fact Popper and his criticsascribed different meanings to the term (...) theoryThen we narrow our attention to one particular theory,namely quantum mechanics, in order to elucidate general matters discussed. We prove that quantum mechanics is irrefutable in a rather straightforward sense, but argue that it is refutable in a more sophisticated sense, which incorporates someobservations obtained by looking closely at the practiceof physics. Recent studies on mind‐wandering reveal its potential role in goal exploration and planning future actions. How to understand these explorative functions and their impact on planning remains unclear. Given certain conceptions of intentions and beliefs, the explorative functions of mind‐wandering could lead to regular reconsideration of one's intentions. However, this would be in tension with the stability of intentions central to rational planning agency. We analyze the potential issue of excessive reconsideration caused by mind‐wandering. We report to which extent elementary particles and the nucleons can be described by an Ansatz that is alternative to the established standard model, and can still yield predicted results that reproduce the observed ones, without using the formalism of quantum mechanics. The different Ansatz is motivated by the attempt to explain known properties of elementary particles as a consequence of an inner structure, in contrast to the approach of the standard model, where the properties are ascribed to point-like particles. (...) Based on the assumption of the existence of photons, the possibility of the creation of fermion and anti-fermion in an interaction of two photons of equal energy is shown. The properties of these created elementary material particles are found to agree with the ones observed. Also the possibility of the creation of a neutron by interaction of two photons of equal energy is shown. In this case, the newly formed neutron rests in the center of the collision system as a combined system of the localized two photons. The created neutron is shown to have the known properties of the neutron, and in addition, to have a definite shape of definite size. The proton is described as the particle formed by decay of the neutron, also owning the observed properties, and in addition a definite shape. For all particles described by the Ansatz, their properties are consequences of an inner structure. The merits of the alternative description as compared to the standard model and the application of quantum mechanics are discussed. (shrink)

We propose simple nonlinear mathematical models for the legal concept of balancing of interests. Our aim is to bridge the gap between an abstract formalisation of a balancing decision while assuring consistency and ultimately legal certainty across cases. We focus on the conflict between the rights to privacy and to the protection of personal data in Art. 7 and Art. 8 of the EU Charter of Fundamental Rights (EUCh) against the right of access to information derived from Art. 11 EUCh. These competing rights are denoted by ( \(i_1\) ) _right to privacy _ and ( \(i_2\) ) _access to information_; mathematically, their indices are respectively assigned by \(u_1\in [0,1]\) and \(u_2\in [0,1]\) subject to the constraint \(u_1+u_2=1\). This constraint allows us to use one single index _u_ to resolve the conflict through balancing. The outcome will be concluded by comparing the index _u_ with a prior given threshold \(u_0\). For simplicity, we assume that the balancing depends on only selected legal criteria such as the social status of affected person, and the sphere from which the information originated, which are represented as inputs of the models, called legal parameters. Additionally, we take “time” into consideration as a legal criterion, building on the European Court of Justice’s ruling on the right to be forgotten: by considering time as a legal parameter, we model how the outcome of the balancing changes over the passage of time. To catch the dependence of the outcome _u_ by these criteria as legal parameters, data were created by a fully-qualified lawyer. By comparison to other approaches based on machine learning, especially neural networks, this approach requires significantly less data. This might come at the price of higher abstraction and simplification, but also provides for higher transparency and explainability. Two mathematical models for _u_, a time-independent model and a time-dependent model, are proposed, that are fitted by using the data. (shrink)

This paper discusses the uniqueness thesis, a core thesis in the epistemology of disagreement. After presenting uniqueness and clarifying relevant terms, a novel counterexample to the thesis will be introduced. This counterexample involves logical disagreement. Several objections to the counterexample are then considered, and it is argued that the best responses to the counterexample all undermine the initial motivation for uniqueness.

Several theoretical publications on the Dirac equation published during the last decades have shown that, an interpretation is possible, which ascribes the origin of electron spin and magnetic moment to an autonomous circular motion of the point-like charged particle around a fixed centre. In more recent publications an extension of the original so called “Zitterbewegung Interpretation” of quantum mechanics was suggested, in which the spin results from an average of instantaneous spin vectors over a Zitterbewegung period. We argue that, the (...) corresponding autonomous motion of the electron should, if it is real, determine non-relativistic spin measurements. Such a direct connection with the established formal quantum mechanical description of spin measurements, into which spin is introduced as a “non-classical” quantity has, to our knowledge, not been reported. In the present work we show that, under certain “model assumptions” concerning the proposed autonomous motion, results of spin measurements, including measurements of angular correlations in singlet systems, can indeed be correctly described using classical probabilities. The success of the model is evidence for the “reality” of the assumed autonomous motion. The resulting model violates the Bell—inequalities to the same extent as quantum mechanics. (shrink)

We study a logic for deontic necessity and sufficiency, as originally proposed in van Benthem :36–41, 1979). Building on earlier work in modal logic, we provide a sound and complete axiomatization for it, consider some standard extensions, and study other important properties. After that, we compare this logic to the logic of “obligation as weakest permission” from Anglberger et al. :807–827, 2015).

It is argued that Hertz's "pictures" bears close similarities to Kantian "schemata", that is, they are rules linking concepts to intuitions and provide them with their meaning. Kant's distinction between symbols and schemata is discussed and related to Hertz's three pictures of mechanics. It is argued that Hertz considered his own picture of mechanics as symbolic in a different (...) way than the force and energy pictures. In the final part of the article it is described how Harald Høffding soon after the publication of Hertz's Principles of Mechanics developed a general theory of analogical reasoning, relying on the ideas of Hertz and Kant. SUMMARYThe history of the law of nations is generally seen as a synonym for the history of the laws of war. Yet, a strictly bilateral perspective can distort our interpretation of early modern diplomacy. The Peace of Utrecht inaugurated an era of relative stability in the European state system, based on balance-of-power politics and anti-hegemonic legal argumentation. Incidental conflicts ought to be interpreted against this background. Declarations of war issued in 1718, 1719 and 1733 during the War of the Quadruple (...) Alliance and the Polish Succession should not be read as doctrinal surrogates for trials between two parties, but as manifestos in a European arena. (shrink)

Organized immaturity refers to the capacity of widely institutionalized sociotechnical systems to challenge qualities of human enlightenment, autonomy, and self-determination. In the context of surveillance capitalism, where these qualities are continuously put at risk, data transparency is increasingly proposed as a means of restoring human maturity by allowing individuals insight and choice vis-à-vis corporate data processing. In this article, however, I draw on research on General Data Protection Regulation–mandated data transparency practices to argue that transparency—while potentially fostering maturity—itself risks producing (...) new forms of organized immaturity by facilitating user ignorance, manipulation, and loss of control of personal data. Considering data transparency’s relative “successes” and “failures” regarding the cultivation of maturity, I outline a set of possible remedies while arguing for a general need to develop more sophisticated ethical appreciations of transparency’s complex and potentially problematic implications for organized (im)maturity in the digital age. Artifacts are probably our most obvious everyday encounter with technology. Therefore, a good understanding of the nature of technical artifacts is a relevant part of technological literacy. In this article we draw from the philosophy of technology to develop a conceptualization of technical artifacts that can be used for educational purposes. Furthermore we report a small exploratory empirical study to see to what extent teachers’ intuitive ideas about artifacts match with the way philosophers write about the nature of artifacts. The purpose of this paper is the clarification of some methodological problems concerning Rawls’ theory of justice. The first part seeks to make more precise Tugendhat’s distinction between 1st-person-theory and 3rd-person-theory. Rawls’ theory fulfills all criteria for 1st-person-theories. In the second part Rawl’s coherence model for the justification of norms („reflective equilibrium“) is critically analyzed and opposed to the hypothetical decision which individuals are to make in the original position (contract model). It is shown that the conception of reflective equilibrium (...) is in various aspects mistaken. In conclusion a problem is indicated which Rawls has not satisfactorily resolved: The veil of ignorance is supposed to guarantee that the decision for the basic principles of social justice is unanimous. Nevertheless it would appear that the individuals in the original position either have too little empirical knowledge in order to make a rational decision, or they have too much knowledge in order to come to an unanimous decision. We present a logic, $$\mathbf {ELI^r}$$ ELI r, for the discovery of deterministic causal regularities starting from empirical data. Our approach is inspired by Mackie’s theory of causes as INUS-conditions, and implements a more recent adjustment to Mackie’s theory according to which the left-hand side of causal regularities is required to be a minimal disjunction of minimal conjunctions. To derive such regularities from a given set of data, we make use of the adaptive logics framework. Our knowledge of deterministic causal (...) regularities is, as Mackie noted, most often gappy or elliptical. The adaptive logics framework is well-suited to explicate both the internal and the external dynamics of the discovery of such gappy regularities. After presenting $$\mathbf {ELI^r}$$ ELI r, we first discuss these forms of dynamics in more detail. Next, we consider some criticisms of the INUS-account and show how our approach avoids them, and we compare $$\mathbf {ELI^r}$$ ELI r with the CNA algorithm that was recently proposed by Michael Baumgartner. Precisamos repensar a nossa abordagem quanto à proteção da privacidade na internet. Atualmente, os formuladores de políticas vêm se aprofundando na ideia de consentimento informado como um meio para proteger a privacidade. Por exemplo, em diversos países, as empresas são obrigadas por lei a obter o consentimento de um indivíduo antes de fazer uso dos seus dados; com base nessas requisitos de consentimento informado, a lei tem por objetivo empoderar as pessoas a fazerem escolhas de privacidade tendo em vista os (...) seus melhores interesses. No entanto, estudos comportamentais colocam em cheque a eficácia desta abordagem de empoderamento como um meio para proteger a privacidade. Este artigo defende uma abordagem conjunta de proteção e empoderamento dos indivíduos para aprimorar a proteção da privacidade. Este artigo aborda problemas práticos do consentimento informado como um meio para proteger a privacidade, e ilustra problemas com os atuais regulamentos de proteção à privacidade dos dados, concernentes à segmentação comportamental. Primeiramente, discutem-se os problemas de privacidade relativos à segmentação comportamental, e o papel central do consentimento informado ao abrigo da lei de proteção à privacidade. Em seguida, enfatizam-se os problemas práticos referentes ao consentimento informado. Por fim, o artigo argumenta que os formuladores de políticas devem dar mais atenção aos regulamentos que protegem as pessoas, e menos aos que as empoderam. INFORMED CONSENT: WE CAN DO BETTER TO DEFEND PRIVACYAbstractWe need to rethink our approach to defend privacy on the internet. Currently, policymakers focus heavily on the idea of informed consent as a means to defend privacy. For instance, in many countries the law requires firms to obtain an individual’s consent before they use data about her. With such informed consent requirements, the law aims to empower people to make privacy choices in their best interests. But behavioural studies cast doubt on this approach’s effectiveness, as people tend to click OK to almost any request they see on their screens. We characterise the intermediate logics which admit a cut-free hypersequent calculus of the form \, where \ is the hypersequent counterpart of the sequent calculus \ for propositional intuitionistic logic, and \ is a set of so-called structural hypersequent rules, i.e., rules not involving any logical connectives. The characterisation of this class of intermediate logics is presented both in terms of the algebraic and the relational semantics for intermediate logics. We discuss various—positive as well as negative—consequences of this characterisation.

BackgroundThe preferable position of Deep Brain Stimulation electrodes is proposed to be located in the dorsolateral subthalamic nucleus to improve general motor performance. The optimal DBS electrode localization for the post-operative improvement of balance and gait is unknown.MethodsIn this single-center, retrospective analyses, 66 Parkinson’s disease patients were assessed pre- and post-operatively by using MDS-UPDRS, freezing of gait score, Giladi’s gait and falls questionnaire and Berg balance scale. The clinical outcome was related to the DBS electrode coordinates in x, y, z (...) plane as revealed by image-based reconstruction. Binomial generalized linear mixed models with fixed-effect variables electrode asymmetry, parkinsonian subtype, medication, age class and clinical DBS induced changes were analyzed.ResultsSubthalamic nucleus-deep brain stimulation improved all motor, balance and FoG scores in MED OFF condition, however there were heterogeneous results in MED ON condition. DBS electrode reconstructed coordinates impacted the responsiveness of axial symptoms. FoG and balance responders showed slightly more medially located STN electrode coordinates and less medio-lateral asymmetry of the electrode reconstructed coordinates across hemispheres compared to non-responders.ConclusionDeep brain stimulation electrode reconstructed coordinates, particularly electrode asymmetry on the medio-lateral axis affected the post-operative responsiveness of balance and FoG symptoms in PD patients. In this paper the thesis is argued that there is no need for a special legal logic to deal with the defeasibility of legal arguments. An important argument for this thesis is that legal judgements ask for a complete justification and that such a complete justification requires a deductively valid argument.

In this contribution I argue that Brouwer’s legal positivism suffers from an internal tension that is not easily solved. This tension stems from the combination of two strands in Brouwer’s thought. The first is that Brouwer wants to stick to the legal positivist view that the law is fixed by convention. The second is that there can be exceptions to the application of legal rules, based on legal principles. The combination of these two strands is, I argue, problematic, because the (...) conventional basis for legal principles will usually be lacking in hard cases. One may then argue, as Brouwer does, that where conventions are lacking there is no law and the judge is not bound by the law. But then exceptions to rules are also allowed where there are no conventional principles to justify these exceptions. This contradicts Brouwer’s starting point that exceptions to the application of rules are possible on the basis of legal principles. (shrink)

This article is a comment on Carel Smith’s paper. Smith rightly argues that the study of law has a hermeneutic character. But his interpretation of legal hermeneutics includes the thesis that in hard cases there is no right or true legal decision. This seems to have negative implications for the scholarly character of the study of law: in hard cases any solution goes. This paper argues, against Smith, that the study of law defends right answers for hard cases. It is (...) also normative in another sense: legal answers, in easy cases as well as in hard cases, always presuppose a normative interpretation of the legal sources. This contributes to the differences of opinion under lawyers. But it is no obstacle to the scholarly character of the study of law, as long as a rational debate about these legal answers and the underlying values and principles is possible. Smith’s rejection of the right answer thesis, however, prevents the possibility of such a rational debate. (shrink)
