If, as many suppose, pornography changes people, a question arises as to how.1 One answer to this question offers a grand and noble vision. Inspired by the idea that pornography is speech, and inspired by a certain liberal ideal about the point of speech in political life, some theorists say that pornography contributes to that liberal ideal: pornography, even at its most violent and misogynistic, and even at its most harmful, is political speech that aims to express certain views about (...) the good life, 2aims to persuade its consumers of a certain political point of view—and to some extent succeeds in persuading them. Ronald Dworkin suggests that the pornographer contributes to the ‘moral environment, by expressing his political or social convictions or tastes or prejudices informally’, that pornography ‘seeks to deliver’ a ‘message’ , that it reflects the ‘opinion’ that ‘women are submissive, or enjoy being dominated, or should be treated as if they did’, that it is comparable to speech ‘advocating that women occupy inferior roles’.3 Pornography on this view is political speech that aims to persuade its listeners of the truth of certain ideas about women, and of course ‘the government must leave to the people the evaluation of ideas’.4 Another answer offers a vision that is not grand and noble, but thoroughly reductive. Pornography is not politically persuasive speech, but speech that works by a process of psychological conditioning. This view seems common enough in the social science literature. This condition involves not merely the orthodox freedom (in some sense) of speakers to distribute words, but also two less frequently acknowledged dimensions of free speech: audience understanding and consideration. ABSTRACT In ‘Just Words: On Speech and Hidden Harm: An Overview and an Application’, Mary Kate McGowan argues that some racist speech in public places should be made unlawful in the United States for the same reason that sexist behaviour in the workplace is already legally actionable—namely, to protect individuals from a hostile discriminatory environment. While McGowan may be correct that some public racist speech may constitute an act of discrimination in some morally significant sense, I present several reasons for (...) doubting that such speech constitutes a hostile discriminatory environment in the relevant legal sense. Should our commitment to freedom of speech extend to freedom of hate speech: speech that promotes hatred toward an individual or group on the basis of a characteristic such as race, gender, sexuality, nationality, or religion—often, although perhaps not exclusively, using slurs and epithets? Drawing on philosophy of language and empirical research, this essay outlines five theoretical models of how hate speech may function, and explores their implications for this issue. I argue that (some) hate speech can be regulated without (...) compromising freedom of expression; and furthermore that, under certain circumstances, considerations of free speech may favour regulating hate speech. This question lies at the heart of a debate that raises fundamental issues about just when, and on what grounds, the state is justified in using its coercive powers to limit the freedom of individuals.

In this paper we introduce a distinct metaethical position, fictionalism about morality. We clarify and defend the position, showing that it is a way to save the 'moral phenomena' while agreeing that there is no genuine objective prescriptivity to be described by moral terms. In particular, we distinguish moral fictionalism from moral quasi-realism, and we show that fictionalism possesses the virtues of quasi-realism about morality, but avoids its vices.

It is a commonplace in liberal circles that individual persons have a right to individual autonomy or self-determination. Each mentally competent adult has a right to be at liberty to live and shape their own life in accordance with their own view about what makes for a good life, free from undue coercion or interference by others, so long as they do not harm others. In the words of John Stuart Mill, mentally-competent persons should have the liberty of “framing the (...) plan of our life to suit our own character, of doing as we like, subject to such consequences as may follow, without impediment from our fellow creatures, so long as what we do does not harm them, even though they may think our conduct foolish, perverse or wrong”. Every human life has equal intrinsic value. This commitment is what stands between us, and the barbarism that has characterised so much of human history—or so runs the consensus in modern liberal societies. So strong is our conviction about this line between civilisation and barbarity that rarely is it subject to critical scrutiny.

Many philosophers are sympathetic to a perdurantist view of persistence. One challenge facing this view lies in its ability to ground prudential rationality. If, as many have thought, numerical identity over time is required to ground there being sui generis (i.e. non-instrumental) prudential reasons, then perdurantists can appeal only to instrumental reasons. The problem is that it is hard to see how, by appealing only to instrumental reasons, the perdurantist can vindicate the axiom of prudence: the axiom that any person-stage (...) has reason to promote the wellbeing of any other person-stage that is part of the same person as that stage. The claim that perdurantists cannot vindicate the axiom, and hence that the view should be rejected, is what we call the normative argument against perdurantism. In this paper we argue that purely instrumental rationality can ground the truth of this axiom, and hence that the normative argument against perdurantism fails. (shrink)

Some theories of personal identity allow some variation in what it takes for a person to survive from context to context; and sometimes this is determined by the desires of person-stages or the practices of communities.This leads to problems for decision making in contexts where what is chosen will affect personal identity.‘Temporal Phase Pluralism’ solves such problems by allowing that there can be a plurality of persons constituted by a sequence of person stages. Liberals agree that free speech should be protected, where speech is understood broadly to include all forms of intentional communication, including actions and pictures, not merely the spoken or written word. A surprising view about free speech in some liberal and legal circles is that communications should be protected on free-speech grounds only if the communications are mentally mediated. By “mentally mediated communication” we mean speech which communicates its message in such a way that the message can be rationally evaluated (...) by hearers, and causes the hearers to believe it, when it does, through the mechanism of those hearers employing their rational capacity to judge that it is correct. The mental-mediation or persuasion principle, as it is sometimes called, has some important legal and public policy implications. It has been applied to argue that certain forms of expression, despite being forms of speech or expression, lack even a prima facie claim to protection on free speech grounds. -/- Our central aim is to show why the mental mediation principle is mistaken. Liberals should think that some speech which is not mentally mediated deserves protection for the very same reasons that speech which is mentally mediated is often thought to deserve protection. Many philosophers have become sceptical of the use of thought experiments in theorising about personal identity. In large part this is due to work in experimental philosophy that appears to confirm long held philosophical suspicions that thought experiments elicit inconsistent judgements about personal identity, and hence judgements that are thought to be the product of cognitive biases. If so, these judgements appear to be useless at informing our theories of personal identity. Using the methods of experimental philosophy, we investigate whether (...) people exhibit inconsistent judgements and, if they do, whether these judgements are likely to be the source of cognitive bias or, instead, sensitivity to some relevant factor. We do not find that people’s judgements are sensitive to any of the factors we investigate (relevant or irrelevant), nor that people have inconsistent judgements across cases. Rather, people’s judgements are best explained by them having a very minimal account of what it takes for a person to survive. Since this pattern of judgements is no reason to think that we are subject to cognitive bias, we see no reason, as things stand, to be sceptical of our judgements. (shrink)

This study explores the connections between time, travel, and creative acts such as painting and poetry, highlighting the similarities that unite these themes. It also focuses on the relationships between the East and the West in regards to these subjects, and posits that travel can be understood as an active form of meditation. The study argues that the meaning of wanderings can be found by learning to make them conscious, and that there has been a deep reflection on time, (...) consciousness, and mobility since ancient times. In this paper we suggest that there is a need to examine what is meant by “context” in Social Psychology and present an example of how to place identity in its social and institutional context. Taking the case of British naturalisation, the process whereby migrants become citizens, we show that the identity of naturalised citizens is defined by common-sense ideas about Britishness and by immigration policies. An analysis of policy documents on “earned citizenship” and interviews with naturalised citizens shows that (...) the distinction between “elite” and “non-elite” migrants is evident in both the “reified” sphere of policy and the “common sense” sphere of everyday identity construction. While social representations embedded in lay experience construct ethno-cultural similarity and difference, immigration policies engage in an institutionalised positioning process by determining migrants' rights of mobility. These spheres of knowledge and practice are not disconnected as these two levels of “managing otherness” overlap—it is the poorer, less skilled migrants, originating outside the West who epitomise difference (within a consensual sphere) and have less freedom of mobility (within a reified sphere). We show that the context of identity should be understood as simultaneously psychological and political. (shrink)

Recent neuroscientific research has caused a paradigm shift in our understanding of the meaning and scope of compassion. Derived from the Latin root compassiō, compassion used to be a religious emotion that implied suffering with the perceived sufferer, whereas now it is examined as a psychological, neuroscientific, neurobiological, and thus natural, phenomenon. The newly arisen research interest in compassion led to the development of secular compassion training programs that follow closely in the footsteps of the “mindfulness revolution.” Whereas the latter (...) has been criticized for its reductionist appropriation of Buddhist thought by the capitalist west, in this paper, I demonstrate that the secularization of compassion is the result of innovative activities by representatives of the Buddhist traditions. I argue that some of the causes for the recent secularization and sciencization can be traced back into the fourteenth century Tibet, namely to the innovative exegetical activities of the scholars of the Tibetan Lojong tradition. I argue that from the perspective of the tradition, the sciencization of compassion resembles a deliberate purposeful “translation” effort that fits into the “two-track approach” of Buddhist propagation. Engineers encounter difficult ethical problems in their practice and in research. In many ways, these problems are like design problems: they are complex, often ill-defined; resolving them involves an iterative process of analysis and synthesis; and there can be more than one acceptable solution. This book offers a real-world, problem-centered approach to engineering ethics, using a rich collection of open-ended scenarios and case studies to develop skill in recognizing and addressing ethical issues.

It is often assumed that concepts from the formal sciences, such as mathematics and logic, have to be treated differently from concepts from non-formal sciences. This is especially relevant in cases of concept defectiveness, as in the empirical sciences defectiveness is an essential component of lager disruptive or transformative processes such as concept change or concept fragmentation. However, it is still unclear what role defectiveness plays for concepts in the formal sciences. On the one hand, a common view sees formal (...) concepts to be protected against defects because of their precise and stable nature. On the other, studies going back as far as Lakatos (1963) showcase the changeability of such concepts. -/- In this paper, I will investigate if and how defectiveness based on the occurrence of inconsistencies can appear with formal concepts. To make the case as strong as possible, I employ a strict notion of formal concept that assumes the concept to have a fixed and definite extension. I will show that there are indeed certain types of defectiveness that cannot occur with such concepts; but that there are other types of defectiveness that do occur. This means that while formal concepts have to be treated differently than non-formal concepts, questions about defectiveness---as raised in the conceptual engineering debate and philosophy of science---can still be applied to them. I will highlight this point by showing how formal sciences have special strategies available to them that allow them to resolve defectiveness of their concepts in a flexible and informative manner. Climate change and decarbonization raise complex justice questions that researchers and policymakers must address. The distributions of greenhouse gas emissions rights and mitigation efforts have dominated justice discourses within scenario research, an integrative element of the IPCC. However, the space of justice considerations is much larger. At present, there is no consistent approach to comprehensively incorporate and examine justice considerations. Here we propose a conceptual framework grounded in philosophical theory for this purpose. We apply this framework to climate mitigation scenarios (...) literature as proof of concept, enabling a more holistic and multidimensional investigation of justice. This essay offers a Deleuzian reading of Drift, a multilingual project by the cross-disciplinary artist Caroline Bergvall. It argues that the text- and performance-project promotes forms of deterritorialization that give radical witness to the contemporary humanitarian crisis in the Mediterranean where thousands of people drown each year as they try to reach Europe. In breaking down barriers between languages, the artistic work employs non-representational modes of address to reflect on what it means to lack citizenship and recognition in the (...) context of the crisis. Close readings challenge postcolonial accusations that the writings of Deleuze and Guattari are at best utopian and at worst politically naive and without purchase on the real-life catastrophes of Fortress Europe. Instead, Deleuzian strategies are shown to enable Bergvall to actualize a multilingual politics of speech and performance that points towards the historical and contemporary imbrications of the West in mass-drownings of recent... Up Against Foucault offers both a feminist critique of Foucauldian theories as well as an attempt to reconcile these seemingly irreconcilable perspectives. Feminists are often "up against Foucault" because he questions key conclusions in feminism regarding the nature of gender relations, and men's possession of power. This book, however, fills the gap in literature about Foucault by showing how his theories of sexuality and power relations are often applicable to the everyday realities of women's lives. Drawing upon their diverse backgrounds (...) in social theory and philosophy, the contributors discuss the ways in which Foucault provokes feminists into questioning their grasp of power relations, and examines the implications of his decision to overlook categories of gender in his discussion of sexuality and power relations. The author discusses important philosophical issues raised by religious experience, such as the role of models and metaphors in their description, and the way experiences in general are used as evidence for claims about the world. Using contemporary and classic sources from the world's religions, the author gives an account of different types of religious experience. The National Library of France owns an uncommon illuminated manuscript of the Book of Job : the Parisinus graecus 135. Written in Greek in 1361/62, it is illustrated with a very large iconographic cycle , which combines Byzantine and gothic styles. The examination of the historical background allows us to bring forth the general meaning of the manuscript and to locate its origin with some probability in the Papal entourage and the Byzantine latinophile circles. The analysis of the iconographic cycle (...) of the manuscript shows that it is likely inspired by the theology developed in the literal commentary of Thomas of Aquinas on the Book of Job. Remarkably, this author is intensively translated in Greek in the middle of the fourteenth century in Byzantium under the aegis of the Emperor John VI Cantacuzenus. (shrink)

Previous research indicates that the depletion of self-regulatory resources can promote unethical behavior that benefits the self. Extending this literature, we focus on norm-transgressing behavior that is intended to primarily benefit others. In particular, we predicted a differing effect of self-regulatory resource depletion on dishonesty that benefits one’s group, depending on the degree of identification with the group. Following a dual process approach, we argue that if identification with the group is strong, then people may have an automatic inclination to (...) benefit their group even perhaps by lying. In contrast, if identification with the group is weak, then the default, uncontrolled impulse may be to tell the truth. Accordingly, identification with the social group should interact with self-regulatory resource depletion in predicting group-benefiting dishonesty. Focusing on pro-organizational dishonesty, we tested our hypotheses in one field study with 1269 employees and in one experimental study with 71 university students. As predicted, the results revealed a highly significant interaction of organizational identification and self-control strength: Depletion of self-regulatory resources increased the level of pro-organizational dishonesty among those who identify highly with the organization, but decreased the level of such behavior among those who identify less. A central area of current philosophical debate in the foundations of mathematics concerns whether or not there is a single, maximal, universe of set theory. Universists maintain that there is such a universe, while Multiversists argue that there are many universes, no one of which is ontologically privileged. Often model-theoretic constructions that add sets to models are cited as evidence in favour of the latter. This paper informs this debate by developing a way for a Universist to interpret talk that (...) seems to necessitate the addition of sets to V. We argue that, despite the prima facie incoherence of such talk for the Universist, she nonetheless has reason to try and provide interpretation of this discourse. We present a method of interpreting extension-talk (V-logic), and show how it captures satisfaction in `ideal' outer models and relates to impredicative class theories. We provide some reasons to regard the technique as philosophically virtuous, and argue that it opens new doors to philosophical and mathematical discussions for the Universist. (shrink)
