When making substituted judgments for incapacitated patients, surrogates often struggle to guess what the patient would want if they had capacity. Surrogates may also agonize over having the (sole) responsibility of making such a determination. To address such concerns, a Patient Preference Predictor (PPP) has been proposed that would use an algorithm to infer the treatment preferences of individual patients from population-level data about the known preferences of people with similar demographic characteristics. However, critics have suggested that even if such (...) a PPP were more accurate, on average, than human surrogates in identifying patient preferences, the proposed algorithm would nevertheless fail to respect the patient’s (former) autonomy since it draws on the ‘wrong’ kind of data: namely, data that are not specific to the individual patient and which therefore may not reflect their actual values, or their reasons for having the preferences they do. Taking such criticisms on board, we here propose a new approach: the Personalized Patient Preference Predictor (P4). The P4 is based on recent advances in machine learning, which allow technologies including large language models to be more cheaply and efficiently ‘fine-tuned’ on person-specific data. The P4, unlike the PPP, would be able to infer an individual patient’s preferences from material (e.g., prior treatment decisions) that is in fact specific to them. Thus, we argue, in addition to being potentially more accurate at the individual level than the previously proposed PPP, the predictions of a P4 would also more directly reflect each patient’s own reasons and values. In this article, we review recent discoveries in artificial intelligence research that suggest a P4 is technically feasible, and argue that, if it is developed and appropriately deployed, it should assuage some of the main autonomy-based concerns of critics of the original PPP. Names and natural kind terms have long been a major focus of debates about meaning and reference. This article discusses some of the theories and arguments that have appeared in those debates. It is remarkably difficult to say what names are without making controversial theoretical assumptions. This article does not attempt to do so here. It instead relies on paradigm examples that nearly all theorists would agree are proper names, for instance, ‘Aristotle’, ‘Mark Twain’, ‘London’, ‘Venus’, and ‘Pegasus’. All of (...) the proper names that are discussed in the article are singular nouns that have no syntactic structure. Most of them refer to objects, but some, such as ‘Pegasus’, apparently do not. This article introduces and defends the “pathological complexity thesis” as a hypothesis about the evolutionary origins of minimal consciousness, or sentience, that connects the study of animal consciousness closely with work in behavioral ecology and evolutionary biology. I argue that consciousness is an adaptive solution to a design problem that led to the extinction of complex multicellular animal life following the Avalon explosion and that was subsequently solved during the Cambrian explosion. This is the economic trade-off problem of having to (...) deal with a complex body with high degrees of freedom, what I call “pathological complexity.” By modeling the explosion of this computational complexity using the resources of state-based behavioral and life history theory we will be able to provide an evolutionary bottom-up framework to make sense of subjective experience and its function in nature by paying close attention to the ecological lifestyles of different animals. Être vu, nu, par un chat ; essayer de savoir quel effet cela fait d’être une chauve-souris ; penser les modes de cohabitation et de compagnonnage que nous formons avec les animaux, en dépit de toutes les violences que nous leur faisons subir, constituent autant d’expériences de pensée limites qui ont ponctué le discours philosophique sur l’animalité au xxe siècle. Il n’est pas étonnant que Cora Diamond fasse un cas de toutes ces expériences : ce qu’elle nomme « une difficulté (...) de la réalité », c’est-à-dire un point d’achoppement entre la pensée et ce qu’elle essaye de saisir, le réel, qui est susceptible de nous faire perdre nos concepts. Je me propose dans ce texte d’explorer les voies de cette difficulté, qui sont souvent des voies contournées ou des déviations. L’idée est aussi de réfléchir aux moyens dont la philosophie dispose pour affronter cette difficulté, sans dénégation et sans déviation. (shrink)

L’interactivité est communément perçue comme la marque caractéristique des technologies digitales et, par extension, de différentes formes de fictions, de médias ou d’œuvres numériques – de la littérature hypertextuelle et des jeux vidéo au net art. On peut toutefois s’interroger sur le sens précis qu’il convient de donner à cette notion, ainsi que sur les promesses auxquelles elle est souvent associée. À défaut de pouvoir cerner un concept unique et maxi-englobant d’interactivité, nous suggérons qu’il est plus profitable de tenter d’identifier (...) des types et des degrés d’interactivité. Nous tentons de montrer pourquoi cette théorie pluraliste et gradualiste est plus attrayante que d’autres approches développées dans la littérature récente. Nous mettons enfin cette conception à l’épreuve du jeu vidéo, en montrant qu’elle permet de réévaluer le rôle que joue l’interactivité dans ce médium, mais qu’elle met aussi au jour les limitations inhérentes des fictions interactives que l’on y trouve. There has been much criticism of the idea that Friston's free-energy principle can unite the life and mind sciences. Here, we argue that perhaps the greatest problem for the totalizing ambitions of its proponents is a failure to recognize the importance of evolutionary dynamics and to provide a convincing adaptive story relating free-energy minimization to organismal fitness.

This paper constitutes a radical departure from the existing philosophical literature on models, modeling-practices, and model-based science. I argue that the various entities and practices called 'models' and 'modeling-practices' are too diverse, too context-sensitive, and serve too many scientific purposes and roles, as to allow for a general philosophical analysis. From this recognition an alternative view emerges that I shall dub model anarchism.

Ce débat, comme cela a déjà été noté dans un certain nombre de publications récentes, est en fait hanté par une question sceptique, qui fut posée à la photographie dès son invention : si l’image photographique s’excepte du régime traditionnel de la représentation et si elle est bien le résultat d’une prise de vue automatique, en quel sens pouvons-nous encore dire qu’elle (...) est artistique? Il me semble que le concept goodmanien d’exemplification permet de répondre au défi lancé par le sceptique. J’essaie de montrer pourquoi. Die Studie untersucht die Entstehung der modernen Philosophiegeschichte, wie sie sich im Übergang vom Barock zur Aufklärung als philosophische Disziplin innerhalb des gelehrten Diskurses der historia literaria konstituierte. Die Auffassung, daß Philosophie ein Produkt menschlicher Verstandestätigkeit sei und mit dem Denken der Griechen beginne, erweist sich dabei als Resultat eines Traditionsbruchs, mit dem die entstehende Aufklärung sich vom christlichen Aristotelismus der Schulphilosophie sowie von den platonisch-hermetischen Spekulationen der Schwärmer und Pansophen absetzte. In der Umbruchphase zwischen Barock und Aufklärung entsteht so (...) der moderne philosophiegeschichtliche Kanon, der sich fundamental von der zuvor gültigen historischen Logik der Wissenschaftsgeschichte unterscheidet. Die Geschichte der Philosophie wird nun nicht länger als Sammelbecken unterschiedlich perfekter Ausformulierungen einer archetypischen Weisheit verstanden, sondern im Kontext der 'Entdeckung der geschichtlichen Welt' als ein kontingenter temporaler Prozeß menschlicher Wissenschaftsentwicklung begriffen. Wie es zu dieser Entdeckung der Philosophiegeschichte kam und worin ihre wissenschaftsgeschichtlichen Implikationen bestehen, ist Gegenstand der Darstellung, die gegenüber der bisherigen Forschung verstärkt die Interdependenzen zwischen theologischem, philosophischem, rechts- und literärgeschichtlichem Diskurs berücksichtigt. New data-driven technologies yield benefits and potentials, but also confront different agents and stakeholders with challenges in retaining control over their data. Our goal in this study is to arrive at a clear picture of what is meant by data sovereignty in such problem settings. To this end, we review 341 publications and analyze the frequency of different notions such as data sovereignty, digital sovereignty, and cyber sovereignty. We go on to map agents they concern, in which context they appear, (...) and which values they allude to. While our sample reveals a considerable degree of divergence and an occasional lack of clarity about intended meanings of data sovereignty, we propose a conceptual grid to systematize different dimensions and connotations. Each of them relates in some way to meaningful control, ownership, and other claims to data articulated by a variety of agents ranging from individuals to countries. Data sovereignty alludes to a nuanced mixture of normative concepts such as inclusive deliberation and recognition of the fundamental rights of data subjects. (shrink)

Genome editing techniques are seen to be at the frontier of current research in the field of emerging biotechnologies. However, such biotechnological research is tensioned at the interface of science, technology and society. On the one hand, this means that it offers a tremendous potential to provide new concepts, methods and – in the long run – novel applications for urgent challenges and needs within society.

This paper presents the outlines of a phenomenological theory of foundational or non-inferential knowledge according to which the facts or states of affairs towards which our beliefs are intentionally directed can sometimes serve as reasons or evidence for what we believe. This occurs in acts of fulfillment, in which an object or state of affairs is given as it is thought to be. Hopp further argues that the sorts of empirical facts that can serve as reasons for noninferentially justified beliefs (...) are not confined to facts about one’s own occurrent mental states, but include facts about the physical world as well. In the course of defending the view against objections, Hopp argues that we should be internalists about the reasons in virtue of which what we believe is justified but externalists about the factors in virtue of which our states of believing have the status of being justified. He also argues against the claim that mental states, such as perceptual experiences, constitute our evidence for empirical beliefs. (shrink)

Je m’emploie à montrer qu’une intelligence du monde social (des rapports de classe, de genre, de race et d’autres formes de domination) s’exerce à l’étage des vécus singuliers. Ce n’est pas seulement que les gens sont différents les unes des autres – encore que j’insiste sur la vérité et la force d’une affirmation à première vue si banale –, mais aussi qu’un sens renouvelé de l’objectivité (...) s’obtient lorsque la production d’un savoir est réfléchie depuis la position particulière de celui qui l’énonce. Dans la littérature contemporaine, plusieurs philosophes se sont demandé s’ils entraient dans la catégorie traditionnelle de l’art. Une autre façon de considérer la chose, qui ne présuppose aucune définition de l’art, consiste à appréhender la forme artistique particulière à laquelle appartiennent les œuvres vidéoludiques. The process of applying the law tends to oscillate between two modes: the subsumption under “clear” rules on the one hand and the interpretative concretisation of vague and abstract blanket clauses on the other. Legal arguments therefore refer both to the semantic content of rules and to legal self-evidence. Consequently the application of law can effectively be influenced not only through new legislation, but also through the introduction of new inter-preters bringing with them a different set of preconceptions, and thus (...) differing interpretations of the law. The traditional balance between these two models of control is endangered in mul-ticultural societies since these societies are characterised by conflicting concepts of justice. An automated application of law, aspired to by many legal scholars, could dispense legal practice from such conflicting prejudices. The price for that gain, however, would likely be a loss of the rule of law in the general understanding. (shrink)
